NOTICE OF PUBLIC HEARING
NOTICE IS HEREBY GIVEN, that the Planning and Zoning Commission of the City of
Centerville will consider the requested Conditional Use Permit submitted by Mr. Steven
Vermeersch to operate an automobile repair facility in the B -1 District AT (PIN #823-
31 -22 -11 -0009) — 7137 — 20 Avenue North.
The meeting is scheduled for Tuesday, January 8, 2013 commencing at 6:30 p.m.
or shortly thereafter. The purpose of the meeting is to ascertain public input regarding
the above request and the possibility of granting the condition use permit as requested.
The public hearing will be held in Council Chambers located at 1880 Main Street,
Centerville, Minnesota 55038.
The City Hall is ADA accessible. Requests for hearing assisted devices or a sign
language interpreter must be received before 4:00 p.m., January 3, 2013. All persons
interested are invited to attend and to be heard.

Pursuant to due call and notice thereof, the Planning and Zoning Commission held its regular
meeting on December 4, 2012, at 6:30 p.m.

I. CALL TO ORDER. The meeting was called to order by Chairperson Mosher at 6:34
p.m.

1. Center Mart — Request for Conditional Use Permit, 1801 & 1825 Main Street, U -Haul
Rental Business
Mr. Chad Buechler and Mr. Carl Buechler were present to explain the application and the
proposed use of the property. Mr. Chad Buechler requested approval to park trailers on the grass,
indicating that it would not be practical to pave the 1825 Main Street lot, due to the slim margins
on the rental business. At that point the hearing was opened to public comment, the following
persons offered testimony:
Mr. Lynne Johnson - As a resident he has no objection to the use as proposed, but indicated that he
plows snow for Center Mart.
Mr. Lloyd Drilling- Owns property to the east. He feels that the operator should not be able to
park vehicles on the grass, that the City rules are there to provide order and to protect values of
affected properties around the City. He would not object to the proposal if the vehicles were
parked on pavements and if restricted to the 1801 Main Street parcel.
Mr. Chad Buechler- had to leave the meeting, but indicated that Mr. Carl Buechler could speak for
the applicant.

Commissioner Lee questioned whether it would be detrimental to allow parking on the grass or on
a crushed rock surface, given that Kelly's has a crushed rock parking lot. It was pointed out that
Kelly's predated the current zoning ordinance. Consensus was that the Code should be uniformly
applied for all new uses.
The Commission reviewed a draft permit prepared by Staff. Commissioner Larson suggested that
the draft permit be amended to limit the conditional use to the. 1801 Main Street property, noting
that for the business to operate, they may have to add a small amount of pavement to the east side
of the parking lot.
Mr. Carl Buechler responded that the proposed permit conditions seem reasonable.
Motion by Commissioner Larson, seconded by Commissioner Koski to close the hearing on
the proposed Conditional Use All in favor. Motion carried unanimously.
Motion by Commissioner Larson, seconded by Commissioner Wood to adopt the draft
Findings and Decision with the stipulation that the permit only apply to Lot 1, the 1801 Main
Street address and that condition B be amended to limit vehicles for sale to two. All present
voted in favor. Motion carried unanimously.
2. REZONING OF PROPERTY AT 7087 - 20' AVENUE from P -1 to B -1
The proposal by the City of Centerville is to rezone the property to B -1 in order to conform with
the guided use for the property as contained in the 2030 Comprehensive Plan. The hearing was
opened to public comment, no one was present to speak with regard to the proposed rezoning.
Motion by Commissioner Wood, seconded by Commissioner Larson to close the hearing on
the proposed Conditional Use All in favor. Motion carried unanimously.
Motion by Commissioner Larson, seconded by Commissioner Koski to adopt the draft
Findings and Decision to approve the rezoning. All present voted in favor. Motion carried
unanimously.
III. APPEARANCES/ PRESENTATIONS
Mr. Charles Reinhardt, 1723 Meadow Lane, was present to request that the Planning and Zoning
Commission process a change in the City Code to allow chickens to be kept in residential areas of
the City. Mr. Reinhardt presented materials in support of his request, including ordinance
language from Anoka which allows up to four chickens to be kept at residences.
Consensus by the Commission was that Staff should survey area communities to see what others
have done in this regard, and to report back at the next meeting.

Mr. Vermeersch was present to review his request.
Motion by Commissioner Montain, seconded by Commissioner Larson to schedule a public
hearing on the proposed Conditional Use Permit Application for January 8, 2013 at 6.30
p.m. All in favor. Motion carried unanimously.
VI. DISCUSSION ITEMS
Administrator Larson reported on possible industrial development projects that are pending. One
of them has an offer of tax increment financing assistance from the City. If the project gets a green
light from the owner this week, the Commission may be asked for a special meeting around
December 20. Further, the TIF plan will require review by P &Z.
VII. CONSIDERATION OF MINUTES
Motion by Commissioner Koski, seconded by Commissioner Larson to approve minutes
from the November 13, 2012, meeting with an amendment showing that Commissioner
Larson arrived at 6:40 p.m. All in favor. Motion carried unanimously
VIII. ADJOURNMENT
Motion by Commissioner Larson, seconded by Commissioner Koski to adiourn the meeting
at 8:20 p.m. All in favor. Motion carried unanimously.
