CALL TO ORDER Mayor Wilharber called the meeting to order at 6:30 p.m. II. PUBLIC INPUT 1. 2013 Budget & Tax Levies Finance Director Jeziorski reviewed the timeline, 2012 projected end of year General Fund balance ($1,110,324) which meets the required 40 -50% of the 2013 Budget expenditures (53 %), levy tax rates, tax capacity components, tax rate trends and enterprise funds (sewer, water and storm water rates with slight rate adjustments which include fixed and variable components for both residential and commercial customers) with Council. Director Jeziorski stated that he anticipates a surplus of $68,674 for 2012, of which $18,700 is committed to the construction of a sand volleyball court at Laurie LaMotte Memorial Park. Director Jeziorski stated that nothing within the 2013 Budget has been modified since Council last reviewed it several weeks prior. Director Jeziorski stated that the City's levy amount has remained stable over the last three (3) years. Council Member King stated that his property taxes increased due to slight improvement to his residential property and request that Director Jeziorski explain why when property taxes values decrease property owners don't realize that same decrease in their taxes. I 1 City of Centerville Council Meeting Minutes December 12, 2012 Director Jeziorski stated that each property may not be experiencing the same downward market value movement as others and as a result, properties with a smaller reduction in value may pick up part of the tax share of properties with a larger percentage decrease in value. Taxes are levied in dollars and then redistributed to the various properties based upon the State mandated formula for assigning value to the properties. Mr. Dean Luxenburg, 1697 Peltier Lake Drive, felt that the City was not considering all avenues to decrease the City's budget and felt that additional collaboration with other municipalities and being more creative with staffing levels would allow the City to be more fiscally responsible. Council thanked Mr. Luxenburg for his comments and stated that they have been very cognizant and innovative while considering the City's budget, its impact on property owners' taxes. Significant collaborating with neighboring communities has been happening and more efforts are being considered. III. APPROVAL OF AGENDA Mayor Wilharber added Centerville Claims (Check #27674 - 27681) to the Consent Agenda, noted replacement pages associated with the Conditional Use Permit for Center Mart and added Items #8 and 9 under New Business. Item #8, Consider Recycling Incentive for 2012 and Item #9, Economic Development Project. Motion was made by Council Member King, seconded by Council Member Love to approve the Agenda as aforementioned. All in favor. Motion passed unanimously. IV. APPROVAL OF MINUTES 1. November 28, 2012 City Council Meeting Minutes Motion by Council Member Fehrenbacher, seconded by Council Member Paar to approve the November 28, 2012 City Council Meeting Minutes as presented. All in favor. Motion passed unanimously. VI. AWARDS /PRESENTATIONS /APPEARANCES 1. Centennial Lakes Police Department — Quarterly Report (Sgt. Pat Aldrich) Sergeant Pat Aldrich addressed Council and gave a brief review of the items /projects that the Centennial Police Department have been focusing on since his last report three (3) months prior. Sergeant Aldrich stated that Officers are currently focusing on relationships with residents within the community versus criminal elements at this time due to Centerville's lower crime rate; attending snowmobile club meetings allowing partnerships with members; tracking and policing of vacant/foreclosed properties; school partnerships providing additional visibility and safety; dual training between the Centennial Fire District (First Responder) and Centennial Lakes Police (Use of Force); addition of several new members to the department; universal Glock handgun program; current use of license plate reader; funeral participations for fallen officers; new vehicles and graphics; CERT Program; participation in "Toward Zero Death" (anti -DWI and traffic safety) program and recent commercial burglaries that included stolen firearms. Mayor Wilharber thanks Sergeant Aldrich for the quarterly report. VII. OLD BUSINESS 1. None VIII. NEW BUSINESS 1. Planning & Zoning Commission Report & Recommendation to issue a Conditional Use Permit to CenterMart, 1801 Main Street Mayor Wilharber noted that there were replacement pages placed before Council for consideration and requested that Legal Counsel provide clarification of the modifications that had been made to the Conditional Use Permit. Legal Counsel Glaser stated that Item #4 was modified to allow for the following language: "Each day a violation exists constitutes a separate offense. Criminal penalties are in addition to any other remedy available in law or equity." Legal Counsel Glaser stated that this language allowed greater protection for the City and allowed an opportunity to work with the applicant to rectify a violation if one occurred. Page 3 of 7 3 City of Centerville Council Meeting Minutes December 12, 2012 Motion was made by Council Member Love, seconded by Council Member Paar to approve the fmdings and recommendation of Planning and Zoning and to approve A Conditional Use Permit to CenterMart, 1801 Main Street to Operate a Vehicle & Equipment Rental Business at the same location. Discussion ensued regarding the use of the unpaved neighboring lot (1825 Main Street), minimum requirements for the use of that lot, abutting property owner concerns and required permits needed for improvements to either 1801 or 1825 Main Street. Administrator Larson stated that currently the property owner is parking trailers on a grassy area and they either need to pave that surface or move the trailers to an area that is dust free and impervious. Administrator Larson stated that due to the fact that the building resides on one (1) parcel and the same owner owns the abutting parcel, the owner(s) could pave a parking lot with proper permitting, request the proper City permits to operate on that location: however, the recommended permit only covers 1801 Main Street and they would have to seek additional permitting if they desire to operate this business at 1825 Main Street. All in favor. Motion passed unanimously. 2. Planning & Zoning Commission Findings for Rezoning from P -1 to B -1, 7087 — 20 Avenue South (Old Public Works Site) Administrator Larson stated that the City's 2010 -2030 Comprehensive Plan included this modification and alignment of the zoning map is required. Motion was made by Council Member Fehrenbacher, seconded by Council Member King to aDvrove the Planning & Zoning Commission's Findings for Rezoning 7087 — 20 Avenue South to B -1 from P -1. All in favor. Motion passed unanimously. Administrator Larson stated that Staff will provide Council with an ordinance allowing for this amendment at their next meeting. 3. Res. #12 -029 — Adopting Budget & Tax Levies for 2013 Discussion was held previously. Motion was made by Council Member Love, seconded by Council Member Paar to adopt Res. #12 -029 — Adopting Budget & Tax Levies for 2013 as presented All in favor. All in favor. Motion passed unanimously. 5. Consider Canceling the Regularly Scheduled Council Meeting of December 26, 2012 Due to HolidayNacations Administrator Larson stated that Council may wish to consider canceling the meeting of December 26. No agenda items have been identified yet and bills were processed in order to allow skipping the meeting. Discussion was had regarding availability of members, expenditures and procedure for calling a meeting if one was needed. Motion was made by Council Member Fehrenbacher, seconded by Council Member Love to cancel the resularly scheduled meetins of December 26,2012; however, if it was determined a meetins was needed one would be called followins proper protocol. All in favor. Motion passed unanimously. 6. City Hall Office Hours — December 24, 2012 (7:30 a.m. —12:00 (noon))? Administrator Larson stated that City Hall routinely closed at noon on Christmas Eve; however, Staff needed to utilize their PTO (personal time off) for the four (4) hour period. Discussion was had that many businesses would be closed the day prior to Christmas. Motion was made by Council Member Paar, seconded by Council Member Love to close City Hall on Monday, December 24, 2012 for the entire day with Staff utilizins Page 5 of 7 5 City of Centerville Council Meeting Minutes December 12, 2012 their PTO hours for the missed work hours. All in favor. Motion passed unanimously. 7. Placement of Recycling Collection Container Per Request of City of Lino Lakes Administrator Larson stated that previously it was discussed that the City of Lino Lakes desired to place a recycling collection trailer in the fire hall parking lot in an attempt to achieve funding for their planned construction of a park near the corner of Centerville Road and Birch Street. Both cities felt that the park would be utilized by their respective residents. Administrator Larson stated that initially the request was discussed through the Centennial Fire District Steering Committee. Discussion was had regarding a written agreement responsibility for disposal of inappropriate material(s), length of time of placement, Centerville's desire to offer the same type of recycling opportunity, reciprocating offerings, recycling reporting and signage. Motion was made by Council Member Fehrenbacher, seconded by Council Member Paar to approve the placement of a recycling collection trailer in the fire hall parking lot for a period of one year with the City of Lino Lakes being responsible for disposal of inappropriate materials discarded at the same location and the City of Centerville receiving tonnage credit for items recycled. Council Member King opposed. Motion passed. 8. Recycling Incentive for 2012 Administrator Larson explained that SCORE (Select Committee on Recycling and the Environment) funds are obtained from haulers and the City is allotted an amount to foster recycling through programs and education. In the past, if any amount is unspent, those dollars have been returned to customers through a billing credit by the hauler. The amount is higher than the past, primarily due to savings provided for Cleanup/Recycling day. Staff is requesting that the hauler provide to residents a recycling incentive of approximately $10,000 if approved by Anoka County. Motion was made by Council Member Love, seconded by Council Member Paar to authorize the Recycling Incentive for 2012 in the amount of approximately $10,000 subiect to Anoka County's approval. All in favor. Motion passed unanimously. 9. Economic Development Project Administrator Larson reported that he has been continuing to work with a firm to construct a 20,000 square foot building or larger within the industrial park along Fairview Street, and has offered incentives agreed to by the Council at a closed meeting earlier this Page 6 of 7 6 City of Centerville Council Meeting Minutes December 12, 2012 fall. The offering of Tax Increment Financing to the firm requires a public hearing; however, Anoka County and Centennial School District must meet and consider the offering also. Administrator Larson stated that both entities seem willing to review the Tax Increment Financing Plan very quickly and waive normal notice requirements. Administrator Larson felt that finalizing the Tax Increment Plan would give the City a "leg up" in the process of securing this business versus another community. Administrator Larson requested the Council's permission to engage a consultant (Northland Securities) to draft a Tax Increment Plan with the understanding that if the project did not go forward their fee of $4,800 would be reduced to $2,400. Council Member Fehrenbacher questioned the firms concerns with the City's offerings. Administrator Larson stated that the firm has not made any decision on where to locate its expansion, but has sold their existing building. Thus, when they are able to make a decision, the timeline to complete the project is likely to be short. Administrator Larson stated that the firm has hired an architect. Motion was made by Council Member Fehrenbacher, seconded by Council Member Paar to authorize drafting of the Tax Increment Plan in an amount not to exceed $4,800 and setting a public hearing on the plan for January 2, 2013.. Transcribed by City Staff Member Teresa Bender, City Clerk Page 7 of 7 7 City Council 2012 -12 -12 7:50 p.m. Minutes of Work Session Present were Mayor Tom Wilharber, Council Members D Love, Jeff Paar, Steve King, and Ben Fehrenbacher. Also present were Mark Statz, Stantec and Public Works Director Paul Palzer. The purpose of the work session was to cover a variety of agenda items, the most critical being to meet with representatives of Anoka County regarding improvements to Centerville Road. 1. Centerville Road (CSAH 21). Representatives of Anoka County included Commissioner Rhonda Sivarajah and Doug Fischer County Engineer, along with his Assistant, Curt Kobilarsik Doug Fischer of Anoka County reviewed preliminary plans regarding the possible improvements to CSAH 21. The improvement would be: Main Street to Heritage Street - Mill and Overlay; Heritage Street to Hunters Trail - Full Reconstruction; Hunters Trail to Birch Street - Reclaim Shape and Pave. A section of the road between Heritage Street and Dupre Road would have some curb, but most of the road would be rural section with ditches. Mr. Fischer apologized that his staff had presented plans for a more substantial improvement, but that funding is not currently in place for the higher cost version staff had shared. If the project cost is more than what he described, then the project would need to be part of the county five -Year Capital Improvement Plan and that would delay the project. The project was discussed at length along with the merits of a more substantial improvement to the road. Anoka County would have significantly more right -of -way to acquire, if the design of the road included more urban section. Even so, some right -of -way will need to be purchased. That adds about six months to the project planning phase. The City's share of the project as described by Fischer, would be about $80,000 and would rise to about $300,000 with the trunk storm sewer being constructed from the downtown to LaMotte Park. If trails were added, that would be entirely the City's cost. Anoka County would like direction from the City as to the level of improvement that the City desires and whether any trails or sidewalks should be included. It was noted that Lino Lakes has responsibility for part of the southerly end of the improvement. Lino Lakes has indicated that they would not be likely to request that trails be included, but intend to make trails a developer cost when adjoining property is developed. They also need to know whether the City wishes to construct trunk storm sewer from the downtown south to LaMotte Park. 8 The City Council will include these issues on a work session for some time in January and will provide a response to Anoka County following that. 2. Paid Time Office (PTO) Policy. Administrator Larson pointed out that the agreement with Local 49, negotiated before his employment, includes a change in PTO earnings at three years. All non -union Staff have the first change at five years. Also, the union has a maximum accrual carryover at year- end of 216 hours, whereas other employees have a maximum of 208 hours. The concerns of fairness and for encouraging another union were considered. Consensus was that the non -union staff PTO policy should be changed to conform with those for union employees. 3. Draft Ordinance Amending Chapter 51 relating to Mandatory Connection to Municipal Water. Administrator Larson reviewed a draft ordinance that extends the sunset date to connect to watermain to 2021 for areas where water is first made available after January 1, 2016. It was noted that the sunset date was extended from 2012 to 2017 after the 2009 Improvement Project. After considerable discussion, consensus of the Council was that the ordinance should be presented for adoption as drafted, at the next meeting. The Tournament is scheduled for February 16 2013 from 11:00 a.m. until 2:00 p.m. on Centerville Lake, Centerville, MN. Contestants are discouraged inside contest area prior to 10:00 a.m. 2. The top place prizes are determined by largest weight and time registered. In the event of a tie, the first fish registered takes priority. Any size fish may place. 3. Each person will be allowed to fish one hole per ticket (2 holes max. per MN DNR). You may register as many fish as you want, but only the heaviest fish per contestant will qualify for a competition prize. No contestant will be eligible for more than one competition prize. There is no age requirement on tournament participation. 4. All fish entered must be brought to the judges stand immediately and be alive. Dead or frozen fish are ineligible. Judges shall have the right to verify that fish were legally caught. The decision of the Judges is final. In the event deception is detected, his /her prize will go to back into the prize kitty. Contestants are responsible for verification of weight of fish at time of weigh in. 5. All fish must be caught and the contestants in route to the Judges stand by 2:00 p.m. on the day of the contest. 6. Contestants must fish in the area designated for the contest and will be required to have their ticket at all times. Ticket checks as well as container inspections may be performed by Contest Judges. 7. Contestants will be allowed to move to other unoccupied holes in the contest area. You are allowed to bring as many poles as desired, but cannot use more than one pole per hole at a time. Contestants may use holes provided or drill their own and will not be allowed to leave the contest area between 11:00 a.m. -2:00 p.m. 8. The Contest Ticket is also good for random Door Prize drawings. In addition, a separate same day Raffle will be held. 9. Entry fee for the tournament is $5.00 per ticket /hole. Code Section 51.08 (D) shall be amended to read as follows: (D) All property served by private water systems must connect to public water, if it is available, not later than 12 -31 -2017, except that where water is made available by the City after January 1, 2013, properties served shall be connected no later than 12 -31 -2021. Section 2. Effective Date. This ordinance shall be effective immediately upon its passage and publication according to law. NOW THEREFORE BE RESOLVED by the City Council of Centerville, Minnesota: 1) That the City of Centerville acts as the legal sponsor for project(s) contained in the Anoka County Community Development Block Grant Application, attached hereto, to be submitted on by January 15, 2013, and city staff is authorized to submit the application and any additional supporting information and data necessary. 2) That the City of Centerville has the legal authority to apply for financial assistance and the institutional, managerial, and financial capacity to ensure adequate construction, operation, maintenance and replacement of the proposed project for its design life. 3) That the City of Centerville has not incurred any costs and has not entered into any written agreements to purchase property. 4) That the City of Centerville has not violated any Federal, State, or local laws pertaining to fraud, bribery, graft, kickbacks, collusions, conflict of interest or other unlawful or corrupt practice. 5) That upon approval of its application by the state, City of Centerville may enter into an agreement with the Anoka County for the above - referenced project(s) and that the City of Centerville certifies that it will comply with all applicable laws and regulations as stated in all contract agreements. 53 6) That Mayor and Clerk are hereby authorized to execute such agreements and amendments thereof as are necessary to implement the project(s) on behalf of the applicant.
