A RESOLUTION ADOPTING SPECIAL ASSESSMENT ON IMPROVEMENT
WHEREAS, pursuant to proper notice duly given as required by law, the Council has
met, heard and passed upon all objections to the proposed reassessment for improvement
of 21 Avenue from a point approximately 600 feet south of Main Street to a point
approximately 1,400 feet south of Main Street and continuing on a new unnamed street
(now Commerce Drive) parallel to Main Street westerly to 20 Avenue, by installation of
watermain, sanitary sewer, street pavement, curb, storm sewer and related drainage
improvements,
WHEREAS, by Resolution 09 -015, the Council adopted assessments and an Assessment
Roll, related to the aforementioned improvements on June 10, 2009.
WHEREAS, pursuant to Orders from Courts of the State of Minnesota, the Council has
met and heard this matter pursuant to Minnesota Statutes Section 429.017, Subdivision 2
for the purpose of making a reassessment as to such parcels identified herein.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
CENTERVILLE, MINNESOTA,
1. Such proposed reassessment, a copy of which is attached hereto and made a part
hereof, is hereby adopted and shall constitute a revision of the previous special
assessment against the lands named therein in keeping with directives of
applicable Order of the District Court and Court of Appeals, and each tract of land
therein included is hereby found to be benefited by the improvement in the
amount of the amended assessment levied against it.
2. Such proposed reassessment shall follow all of the terms and conditions as
ordered in Resolution 09 -015, adopted June 10, 2009, except as specifically stated
herein. This reassessment shall amend the amount of assessments set forth in the
Assessment Roll attached to Resolution 09 -015 with the amount of assessments
set forth in the amended Assessment Roll attached to this Resolution. The balance
of these amended assessed amounts plus accrued interest shall be payable in
annual installments extending over the remaining period of annual installments.
The first installment of the adjusted balance shall be payable on or before the first
Monday in January, 2014.
3. The owner of any property so assessed may, at any time prior to certification of
the reassessment to the County Auditor, pay the whole or part of the reassessment
on such property with interest accrued to the date of payment, to the City
Administrator, and he may at any time thereafter, pay to the Administrator the
entire amount of the assessment remaining unpaid, with interest accrued to
December 31 of the year in which such payment is made. Such payment must be
made before November 15 or interest will be charged to December 31 of the next
succeeding year.
4. The Administrator shall file the amended assessment rolls pertaining to this
reassessment in the office of the County Auditor, such that installments of
principal and interest will be collected as due with taxes on each parcel of land
included in the amended assessment roll.

This is to notify you that the final assessment for street improvements that were
determined to benefit your property, was adopted on June 10, 2009, pursuant to Minn.
Statutes Chapt. 429. The amount of the assessment as adopted is listed above. The
assessment roll for the project is on file in the office of the City Clerk.
A property owner may appeal his assessment to the district court p ursuan t to N1hM
Statute Sec. 429.081, by serving notice of appeal on the mayor or administrator of the city
within 30 days after adoption of the assessment and by filing such notice with the district
court within ten days after service upon the mayor or administrator.
Homestead property owners 65 years or older are reminded that applications for deferment
of special assessment must be filed within thirty days of the adoption of special
assessment by the City Council. Also, any property owner may prepay his special
assessment without interest within thirty days of adoption of the special assessment (by
July 10, 2009).
Anyone desiring to prepay their assessments or to apply for a senior citizen deferment
should contact this office as soon as possible but in no event later than November 1, 2009,
to express your intentions. We will then assist you in making sure the proper amounts are

1. TE Grant Trail Project (000616- 08165 -0). Final payment paperwork has been processed with the
County.
2. 2008 Downtown Storm Water Improvements (000616- 08167 -0). A record plan of the project
is being produced.
3. 2013 Street and Utility Improvements (193801520), The project is out for bid. Bids will be
received on Wednesday, February 20"' at 10.00 AM. The results of the bid will be shared with Council
on the 22 At that time, an Assessment Hearing could be scheduled if the Council was satisfied with
the bids.
4. CSAH 21 Reconstruction (193801639), City staff` met with Anoka County staff to review the
current plan for CSAH 21 based on input we gave the county during the City Council Workshop that
County staff attended, County staff had made significant changes to the plan since then, including
adding back in left turn lanes in many locations and extending the limits of the urban section, Some of
these changes are things we were asking for, while others were new ideas County staff will estimate
the project cost with the changes, including an estimate of the City's share and will report that in
March. If there are questions from Council, we can answer them at the next meeting,
