CALL TO ORDER Vice - Chairperson Jon Grahek called the February 6, 2013 Parks & Recreation Committee Meeting to order at 6:34 p.m. at Centerville City Hall administrative offices. ROLL CALL — SEE ABOVE II. SET AGENDA Motion was made by Committee Member Peterson, seconded by Committee Member Waeghe to add number 5 "2013 Upgrades to Park" under Committee Business All in favor. Motion carried unanimously. III. APPEARANCES — Tom Lee, Music in the Park Budget and calendar discussion regarding the Music in the Park program for 2013. Set 2013 dates: 6/4, 6/11, 6/18, 6/25, 7/2, 7/9, 7/16, and 7/23. Three actions were added to the list: (1) Verify the $2,200 is allocated for the 2013 Music in the Park. (Pat/Mike) (Action Item 13 -005) (2) Quote a process for 2 x 100 ft chords ' / a" to ' / a" connections. (Tom Lee) (Part of Action Item 12- 060) (3) Get permission to use the City PA System. (Action Item 13 -006) IV. CONSIDERATION OF MINUTES 1. Consideration of the January 2, 2013 Parks and Recreation Committee meeting minutes. Motion was made by Committee Member Haiden, seconded by Committee Member Bettinger to approve the January 2, 2013 meeting minutes with the following changes under Committee Business: #2 first line: Replace "Council Blessing" with "Council Support ", #5 1 St paragraph line 5 — Replace "Committee Member Haiden" with "Committee Member Amundsen" All in favor. Motion carried unanimously. City of Centerville Parks & Recreation Committee February 6, 2013 V. COMMITTEE BUSINESS 1. Centennial Soccer Club — Request to Use Field(s) @ LaMotte Park (1, 2, & 11) & Acorn Creek Park (Field 1) April 1— July 26, 2013 5:30 p.m. to Sunset & August 1— October 30, 2013 5:00 p.m. to Sunset The Committee discussed. Motion was made by Committee Member Peterson to approve Summer Schedule as written (April to July), and alter the fall schedule (August to October) to Acorn Creek Park and LaMotte Park Location 11 only — All in favor. Motion carried unanimously. Committee Member Jon Grahek abstained due to neighbor relationship with requester. 2. Volunteer Flyer Discussion took place. Feedback to Committee Member Seeley was to add "Other" for flexibility for new ideas that are not on the list. 3. Special Event Permit Application — 8K Walk/Run/In -Line & Kids Free % Mile Fun Run Motion was made by Committee Member Grahek and seconded by Committee Member Amundsen to approve the request. All in favor. Motion carried unanimously. 4. Special Event Permit Application — 5K and 8K Walk/Run "Shake Your Shamrock ", March 16, 2013 — Kelly's Korner Discussion took place by the Committee. Motion by Committee Member Seeley and seconded by Committee Member Amundsen to recommend approval contingent on not using the Cornerstone Park as the start or finish area. Recommend using empty lot bordered by Centerville /Sorel/Heritage Roads. Park and Rec and City of Centerville not responsible for conditions of trail or cleaning before and after the event. They will need to contact Anoka Parks for use of trail in Park system. 5. 2013 Upgrades to Park Discussion took place by Committee to brainstorm a list of ideas. a. Water Ski Bench b. Tennis Court Bench c. Kitchen Make Over @ LaMotte Park d. Hidden Spring Park Irrigation e. Within the grant application it states "in order to receive a grant you must have an Invasive Aquatic Plant Management Permit for the control project. • If you already have a permit; list the permit number here , and include a copy of the signed permit. • If you do not have a permit, please complete and send in a permit application, and include a copy of your permit application with this grant application. If you visit the Minnesota Department of Natural Resources Website: http: / /www.dnr. state. mn. us /shorelandmgmt/apq /permits.htmI there are fees associated with this application. Maybe the ski club is willing to pay those fees or is prepared to hire someone to take care of the weeds, but I believe this is what the grant is for is reimbursement. Does the ski club have a permit already? Didn't they have the lake treated last year? We will complete further research on the Invasive Aquatic Plant Management Permit Application and its corresponding fees and get back to you. He is asking about city cooperation in treating Centerville lake for milfoil. I would think that it is in the City's best interest to keep the lake as clean as possible, but this is well out side of my lane. What is or what should the city do? Should we ( or 1) forward this to Anoka County Parks? They also have an interest in Centerville Lake. We have seen first hand, the progression of the invasion of Eurasian Milfoil slowly take over the majority of the lake, unfortunately rendering the lake almost unusable. While we feel the entire lake needs to be treated but, we would like to treat the north east bay on the lake, this will allow not only our club but also a large number of outdoors enthusiasts to use this area of the lake. We have not treated the lake in the past but, our club is very concerned with the health of the lake, and would like to help in anyway possible to improve it. From what I have found, since I sent the first email to Pat, is that the grant will cover about half of the cost of treatment of the Milfoil, but it is a reimbursement type system. Our club is willing to help with the cost but probably can not afford a huge amount. I think the permit says we can treat up to 15% of the lake if chemical only or 50% for mechanical, I am not sure yet how much that will cover and the cost that goes with it. It sounds like it costs around $250 an acre. This website has more info, I am trying to sift through as much as I can when ever I have a free moment at work. I hope we can work together to save the lake before it becomes unusable. This Permit is subject to the rights, privileges and limitations set forth herein. SECTION ONE PROPERTY Permittee shall have the right of use and access to public property located at 7121 Main Street and its shoreline adjacent to Centerville Lake (hereinafter referred to as "Property"). SECTION TWO TERM The term of this Permit shall begin on May 15, 2012 and shall expire on August 31, 2013 unless revoked or voided for reasons otherwise specified in this document. SECTION THREE PERMIT CONSIDERATION It is understood that Permittee does not charge spectators to view its waterski shows. As long as that condition exists, Permittee shall pay City $1.00 as consideration for the issuance of this Permit. SECTION FOUR PERMITTED USE OF THE PROPERTY Pursuant to Code Section 92.30, Permittee is granted variances from Chapter 92 of the Centerville Code to accomplish the purposes set forth in the Permit: A. Permittee will use the Property for the purpose of conducting waterski shows and accommodating public viewing of these shows. Permittee may install a dock into Centerville Lake, subject to approval of St. Paul Regional Water Services and subject to permits from Minnesota Department of Natural Resources, if any are required. No other- improvements may be attached to the Property. B. The Property is designated as an area where vehicles may be driven by Permittee (in variance of Code Section 92.06); C. Permittee may locate and park a 10 x 12 equipment trailer on the Property at a location to be agreed upon by the parties and that trailer may be present on the Property during times when public grounds are closed (in variance of Code Sections 92.07 & 92.08); D. Permittee may post up to two signs advertising its waterski shows on the Property (in variance to Code Section 92.12), however said signage must otherwise comply applicable law; E. Permittee may swim from the Property (in variance to Code Section 92.18); F. Permittee may launch a boat from the Property (in variance to Code Section 92.20); and G. Permittee may use the protected shoreline areas of the Property extending fifteen feet from the high water mark of the Lake (in variance to Code Section 92.21) but must maintain and protect the shoreline from erosion or damage. SECTION FIVE OTHER APPROVALS Permittee understands that part of the underlying Property is owned by St. Paul Regional Water Service and a condition of this Permit is that approval must be obtained from St. Paul Regional Water Service. SECTION SIX CITY'S INSPECTION City shall have the right at any time to inspect and examine the Property to insure compliance by Permittee with its obligations under this Permit and its obligations under the law. SECTION SEVEN MAINTENANCE OF THE PROPERTY City will mow the grass on the Property in accordance with the City's normal maintenance schedule. If more frequent mowing is required, Permittee agrees it will do so at its sole cost and expense. Permittee will pick up trash that is left on or around the Property immediately after each waterski show or other sponsored event. Permittee may provide portable toilets for its use and for use of spectators and patrons, however they shall be placed in a location to be mutually agreed upon by the parties. SECTION EIGHT ALTERATIONS Permittee shall not make any alterations, additions, or improvements to the Property without City's prior written consent and the consent of St. Paul Regional Water Services. SECTION NINE LOSS AND DAMAGE Permittee assumes and shall bear the entire risk of loss, damage to, theft or destruction of its dock, trailer and any personal property or equipment that is located on the Property. I I SECTION TEN INDEMNITY Permittee hereby ssumes entire responsibility and liability for an and all damage of an Y � tY h' Y g Y kind or nature whatsoever to all persons resulting from, arising out of, or occurring in connection with its use of the Property. If any person shall make a claim for damage or injury here above described, whether such claim may be based upon the City's alleged breach of any duty or obligation on the part of the City, Permittee agrees to indemnify and save harmless City and St. Paul Regional Water Services (SPRWS), its agents, servants and employees from and against any and all losses, expense, damage or injury that the either might sustain as a result of any such claims and Permittee agrees to assume, on behalf of City and SPRWS, the defense of any action at law or equity, which may be brought against the City or SWRWS upon such claims and pay on behalf of City or SPRWS, upon its demand, the amount of judgment that may be entered into against City or SPRWS in such action. SECTION ELEVEN INSURANCE Permittee, at its sole cost and expense, shall procure and maintain insurance coverage which is acceptable to the City Administrator which accomplishes the following: (a) coverage for the risk of harm or negligence to any person due to operations subject to this Permit or Permittee's use of the Property, (b) coverage for the risk of physical damage to its owned personal property and equipment, and (c) coverage for the risk of public liability and property damage, and as to all aspects of insured loss said insurance coverage shall not be in an amount less than $1,000,000. Permittee shall provide proof of insurance for workers compensation insurance as required by Minnesota Law. Moreover, Permittee shall name the City (and if requested, SPRWS) as additional insured on said insurance policies. Continuation of these insurance requirements are an on -going condition of this Permit. As a further condition of insurance coverage, USA Water Ski, Entertainment & Sports Insurance eXperts (ESIX), or any insurance company issuing coverage under this Permit shall be required to notify the City in the event of any notice or intent to discontinue coverage. This Permit is void at such time as Permittee's insurance coverage is not effective. However, Permittee's legal obligations to assume the entire responsibility and liability for any and all damage of any kind or nature whatsoever to all persons resulting from, arising out of, or occurring in connection with its use of the property, continues in perpetuity regardless of the terms of cancellation or termination of this Permit. SECTION TWELEVE CONDTIONS OF PERMIT Permittee shall, without exception, obtain an executed document entitled, "Participant Waiver and Release of Liability, Assumption of Risk and Indemnity Agreement" (hereinafter referred to as a "Waiver") from each member of its organization who will participate in any activity held at, or staged from, the Property. If such member is a minor, then Permittee shall, without exception, obtain a signed Waiver from a duly authorized parent or guardian. Permittee assumes all risks and waives liability in the event that any such Waiver is not effective or binding. Permittee shall supply a copy of each executed Waiver to the City before any person may participate in activities authorized under this Permit. Only members of Permittee's organization may participate in activities authorized under this Permit. SECTION THRITEEN NON - WAIVER By executing this document Permittee specifically affirms that the City is not waiving or otherwise limiting any of its legal rights or defenses, or otherwise expanding its liability for activities related to the operation of this Permit. SECTION FOURTEEN NOTICES All notices required or permitted under this Permit shall be sufficient if delivered personally or mailed to the party at the address set forth in this Agreement, or at such other address as either party may designate in writing from time to time. Any such notice mailed to such address shall be effective twenty four (24) hours after it has been deposited in the United States mail, properly addressed and with postage fully prepaid. SECTION FIFTEEN APPLICABLE LAW AND ENFORCEMENT The validity, enforcement, and performance of this Permit shall be governed and determined by the laws of the State of Minnesota and the City of Centerville. SECTION SIXTEEN TERMINATION OF PERMIT All of the conditions, standards or other requirements set forth in this document are continuing obligations of this Permit. This Permit is only valid so long as all of the obligations set forth herein are met. You may recall that we have an agreement from SPRWS to allow us to use it for three years 2011 -2013. 1 think it is their intention that the agreement would not be renewed after 2013, but that they will expect the city to buy the parcel, if that use is to continue. An alternative might be to see if they will lease it to the city, but I have not had that conversation with them. No doubt, that would have a cost associated with it. I had suggested to them a token payment of $1000 to buy the property, but that was rejected. They told me that they would sell it for less than their standard lakeshore frontage prices, but that it would need to be based on market value. That is when I ordered the appraisal, so we would have something to base our further discussion on. The city may not need to own the property, except if the Bald Eagle Water Ski Show is to continue. In fact, there were some large trees on the property that SPRWS had to pay to remove last year that the city would have been responsible for if we owned it. Some additional trees remain. This information is to give Park & Rec something to think about. I have not yet shared this with the entire Council." Dallas Larson Assumptions: 1. The value of this land is $8,900 ( appraised value) (see the attachment to Dallas Larson's e-mail. 2. Based on an earlier note from Dallas Larson, Deadbroke is expected to make a $5000 donation this year. That donation will be for the sand volleyball court. 3. If assumption #2 is correct, we will have the necessary funds to proceed with the sand volleyball court. I am always asked how I come up with these numbers. Here is that answer: a. Money currently on reserve for the volleyball court plus.. b. Money from the 2011 8K run (on reserve but not dedicated to the volleyball court according to earlier discussions with Mike.) plus c. The assumed $5,000 from Deadbroke. ( we do not have this money in hand - yet) 4. The Fete des Lacs events will continue to earn a net profit of about $2500 a year. 5. The construction of a sand volleyball court remains the Committee's #1 priority. Trail signs remains priority #2 Where will the money come from? 1. We ask the City Council to approve the purchase of the Trailside park lake shore, with the understanding that this Committee will raise the funds through Fete des Lacs events (8K Run) and donations over the next three years. 2. We ask Dallas Larson to negotiate the best possible price for that lake shore. 3. We ask Bald Eagle Waterski Show for a donations toward the purchase of the land. Or we ask for a commitment to donate half of the purchase price over the next three years 4. Bald Eagle Waterski Show ask their Thursday night spectators for donations. Maybe those donations could go for this purpose. 5. We commit the 2012, 2013, and if necessary the 2014 8K Run proceeds to this purpose. 6. Paul Palzer may have come up with a way that we can save some money we asked Council to set aside for trail signs. Any saving there could be reprogrammed to pay back a loan from the Council. 7. We could possibly save some money out of the Parks Programs line and ask the Council to reallocate that money toward this project. Bottom line is, IF we want to purchase that land and we could make this happen. Recommendations 1. The Committee and the Council should pursue the opportunity to purchase the shoreline at Trailside Park. Developing new parks fits well with the City's 2030 Comprehensive Plan. We should not be dependent on the good mercy of the St Paul Water Works to continue the current arrangement pass 2013. 2. Re -order the Committee's priorities as follows: a. There are two parcels of lakeshore that the City has the opportunity to buy. If possible, we should buy both. The first parcel is a strip of land on Centerville Lake at what we have been calling Trailside Park. St Paul Water Services owns that land and has granted us permission to use it for the purposes of hold Bald Eagle Water Ski Shows every Thursday evening. They are willing to selling to the City. They want market value. Dallas had an appraisal done on this property. It appraised for $8,900. This issue just came to my attention about a week ago. I would put the Centerville Lakeshore (Trailside Park) as my number 1 priority and the Olson property on Peltier Lake as #2 priority. Bear in mind that I would really like to see the City buy both. I rank the Centerville Lakeshore as #1 because we have an immediate and continuing use for that property (the waterski shows) and it is much more affordable. Last summer was the first year that the waterski shows were at that location. They drew 200 to 250 people per show. I think that is an impressive turn out; obviously the community enjoys the show. The Committee has not yet discussed either property as this has all come up in the last week or so. It is on their agenda for next Wednesday. I believe that we will have raised enough money to go out for bids on the sand volleyball court for LaMotte Park by this summer. I have recommended to the Committee that we continue to pursue that project as our number 1 priority. However, as soon as we have the $10,000 required for the volleyball court secured in a reserve account, I am willing to commit to raising the funds necessary to secure the St Paul Water Service property adjacent to Trailside park. (Those are my views not the Committees commitment - as I said, they have not yet discussed the issue.) We can not make the same commitment for the Peltier Lake property. $29,000 is beyond the reach of our Committee. Dallas and I have discussed the use of the Peltier lake site a couple of times. We have talked about putting a sail boat mooring field there and /or racks for canoes or kayaks. this will take some planning to figure out what could be done. I will not be at the Committee meeting this Wednesday evening. Maybe Steve can fill us in on the views of the Committee.
