RESOLUTION NO.
RESOLUTION APPROVING JOINT POWERS AGREEMENT
WITH CITY OF LINO LAKES
(21 AVENUE IMPROVEMENTS)
WHEREAS, Minnesota Statutes, Section 471.59, authorizes political subdivisions to enter into
Joint Powers Agreements, and
WHEREAS, the City of Centerville and the City of Lino Lakes agree that it is in the best interest
of the traveling public to construct the extension of 21" Avenue north of CSAH 14 (Main Street),
and
WHEREAS, said parties mutually agree that the City of Centerville shall cause the construction
of 21" Avenue extension and backage road, and
WHEREAS, the parties agree that it is in their best interest that the cost of said project be shared.
NOW, THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
CENTERVILLE, MINNESOTA, that the City Council hereby approves the Joint Powers
Agreement with the City of Lino Lakes for the construction of 21" Avenue South, said
agreement attached hereto as Exhibit A.
BE IT FURTHER RESOLVED, that the Joint Powers Agreement shall be effective and may be
executed upon receipt of signed special assessment agreements from property owners covering
100% of the cost of the project.
Adopted by the Centerville City Council this 28 day of August, 2013.

A RESOLUTION ORDERING PREPARATION OF REPORT ON STREET
IMPROVEMEENTS
WHEREAS, it has been proposed to improve North Robin Lane from 20 Avenue to
West Robin Lane, and West Robin Lane from North Robin Lane to South Robin Lane,
and South Robin Lane from 20 Avenue to West Robin Lane and Cardinal Drive from
West Robin Lane to 20 Avenue by construction of watermain, street paving, concrete
curb and related drainage improvements and to assess the benefiting property for all or a
portion of the cost of the improvement pursuant to Minnesota Statutes Chapter 429.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
CENTERVILLE, MINNESOTA, that the proposed improvement be referred to Mark
Statz of Stantec, who shall report to the Council with all convenient speed advising the
Council in a preliminary way as to whether the proposed improvement is necessary, cost
effective and feasible and as to whether it should be best made as proposed or in
conjunction with some other improvement, and the estimated cost of the improvement as
recommended.

The Grantors, in consideration of the sum of One Dollar ($1.00) and other good and
valuable consideration to them in hand paid by the City, the receipt and sufficiency of which is
hereby acknowledged, do hereby grant and convey to the CITY OF CENTERVILLE, its
successors and assigns, forever, a perpetual easement for a drainage system and public utility
purposes over, across, on, under, and through land situated within the County of Anoka, State of
Minnesota, legally described on the attached Exhibit A ( "Permanent Easement Premises ").
INCLUDING the rights of the City, its contractors, agents, servants, and assigns, to enter
upon the Permanent Easement Premises at all reasonable times to construct, install, reconstruct,
inspect, repair, and maintain the drainage system and public utilities over, across, on, under, and
through the Permanent Easement Premises, together with the right to grade, level, fill, drain and
excavate the Permanent Easement Premises, and the further right to remove trees, bushes,
undergrowth, and other obstructions interfering with the construction, installation, maintenance,
inspection and repair of the drainage system and public utilities.

with the City, its successors and assigns, that they are well seized in fee title of the above -
described Permanent Easement Premises; that they have the sole right to grant and convey the

any breach of the foregoing covenants.
