PRESENT: Mayor Tom Wilharber Council Member Ben Fehrenbacher Council Member Steve King \J Council Member D. CALL TO ORDER Mayor Wilharber called the meeting to order at 6:34 p.m. II. PUBLIC INPUT on 2014 Budget & Tax Levies Finance Director Paulseth briefly reviewed a presentation regarding the 2014 proposed budget and tax levy stating that the presentation is derived from the Council's preliminary 2014 Budget and Tax Levy approved in September. Finance Director Paulseth and Administrator Larson stated that the 2014 tax levy and budget are similar to levels back to 2007, Centerville's ranking is comparative to other cities of similar size for revenue and expenditures. Finance Director Paulseth stated that the City would be in receipt of Local Government Aid in 2014 of $54,000 and have the opportunity to take advantage of the new government sales tax exemptions. Administrator Larson reminded Council that in 2012 the City began budgeting for street maintenance and the bids received for the 2014 Mill & Overlay Street Project would determine whether special assessments would be needed. Larson also stated that the Local Government Aid and sales tax exemption made it possible to avoid an otherwise likely tax increase. The General levy has remained at essentially the same dollar amount since about 2007. There being no one present who wished to comment on the budget, Mayor Wilharber closed the Public Input at 6:51 p.m. III. APPROVAL OF AGENDA 1 City of Centerville Council Meeting Minutes December 11, 2013 Mayor Wilharber noted the addition of Centerville Claims (Check #28426 - 28432) and Res. #13 -OXX — Ordering Preparation of Plans & Specifications and Ordering Advertisement for Bids on Improvement — 2014 Mill & Overlay Projects, and Settlement Agreement Related to LaMotte Park Damages, for consideration this evening. Motion by Council Member Fehrenbacher, seconded by Council Member Love to approve the Set Agenda as presented with the above stated amendment All in favor. Motion passed unanimously. IV. APPROVAL OF MINUTES 1. November 13, 2013 City Council Meeting Minutes The Mayor provided Council Members with an opportunity to amend the draft minutes. Council Member King stated that he desired for the minutes to note that he did not vote in favor of the Royal Meadows Improvement Project. Motion by Council Member Love, seconded by Council Member Paar to approve the minutes of the November 13, 2013 City Council Meeting Minutes with the above stated amendment. All in favor. Motion passed. 2. November 11, 2013 City Council Work Session Meeting Minutes The Mayor provided Council Members with an opportunity to amend the presented minutes. Motion by Council Member Fehrenbacher, seconded by Council Member King to approve the minutes of the November 11, 2013 City Council Work Session Meeting Minutes as presented. All in favor. All in favor. Motion passed VI. AWARDS/PRESENTATIONS /APPEARANCES Page 2of8 2 City of Centerville Council Meeting Minutes December 11, 2013 1. Settlement Agreement — LaMotte Park Damages (Flag Football Tournament) Legal Counsel Glaser stated that the two individuals responsible for organizing the flag football tournament earlier in the year that damaged the turf have agreed to a Settlement, have signed the agreement along with a guardian (brother) of the minor individual. Legal Counsel Glaser stated that the individuals have agreed to pay the City $6,500 by the end of 2014. Motion by Council Member Love, seconded by Council Member King to Accept the Settlement Agreement as presented. All in favor. Motion passed. VII. OLD BUSINESS 1. P & R Recommendation to Approve Special Event Permit Application for "Shake Your Shamrock" 5K/8K Runs — Tabled from Previous Meeting Mayor Wilharber stated that the above items was tabled at the previous meeting due to request for additional information regarding cleanup responsibilities, Liability Insurance, police and fire presence and event beneficiaries. Mayor Wilharber stated that Staff provided Council with the additional information requested. Motion by Council Member Paar, seconded by Council Member Love to approve the Parks & Recreation Committee recommendation to Approve the Special Event Permit Application for "Shake Your Shamrock" 5K/8K Runs in 2014 as submitted with the stipulation that the Police Department has full control whether to cancel the event due to weather. All in favor. Motion passed. 2. Anoka County Response to Centerville's Request Regarding Turn Lanes & The CSAH21 /Centerville Road Reconstruction Project (M. Statz Update) Engineer Statz stated that following the last Council meeting where several residents requested modification in the proposed project, he forwarded their requests for project re- design to Mr. Doug Fischer, County Engineer and enclosed in Council's packet was the County's response. Engineer Statz reviewed the responses by stating that the County believes that if they make investment in the reconstruction project it at minimum should include turn lanes otherwise they will only provide a mill and overlay. Council Member Love stated that he had received several telephone calls from residents stating that they were in favor of the turn lanes for safety reasons. Engineer Statz explained that the next procedure would be to work with the County regarding a Joint Powers Agreement (JPA) for the reconstruction. Consensus of the Council was to include Staff in working with the Engineer on the JPA. Motion by Council Member Fehrenbacher, seconded by Council Member Love to direct Staff and Engineer Statz to work with Anoka County regarding a draft Joint Powers Agreement for the Reconstruction of CSAH21 /Centerville Road Proiect based upon the current plan. Res. #13 -028 — Adopting Budget & Tax Levies for 2014 Finance Director Paulseth and Administrator Larson previously addressed this item during the public hearing. Motion by Council Member Fehrenbacher, seconded by Council Member King to approve Res. #13 -028 — Adopting Budget & Tax Levies for 2014 as presented All in favor. Motion passed. 2. Res. #13 -029 — Approving of Anoka County's Classification & Sale of Forfeited Lands — PIN #R23- 31 -22 -34 -0026 Per Anoka County Res. #2013 -130 Mayor Wilharber stated that the small parcel is on the east side of Dupre Road. Administrator Larson stated that Council has expressed an interest in purchasing this land for public purpose in the past and that no other individuals that he is aware of have expressed interest. Administrator Larson stated that this is the beginning process of the County taking over the parcel for forfeiture and that if Council desired he would make them aware that the City is still interested in purchasing the parcel. Motion by Council Member King, seconded by Council Member Paar, to approve Res. #13 -029 — Approving of Anoka County's Classification & Sale of Forfeited Lands — PIN #R23- 31 -22 -34 -0026 Per Anoka County Res. #2013 -130 as presented All in favor. Motion passed. Council consensus was to continue to acquire the parcel. 3. Res. #13 -030 — Ordering Preparation of Plans & Specifications and Ordering Advertisement for Bids on Improvement — 2014 Mill & Overlay Projects Administrator Larson stated that this resolution would affirm Council's desire to move forward with the 2014 Mill & Overlay Projects containing 13 segments of roadway. Administrator Larson explained that the project would be bid in two parts to take advantage of the sales tax exemption offered to governmental entities. Engineer Statz stated that bids would be received in January for materials and February for equipment and labor. Administrator Larson stated that with favorable bids, assessments may not be needed. Discussion ensued regarding the ability to remove items from the bids if areas were determined to not be needed or the assessment process would be needed and items to be completed prior to the Mill & Overlay Projects (i.e. catch basins, heaving of existing storm sewer lines, etc.). Motion by Council Member Fehrenbacher, seconded by Council Member Paar, to approve Res. #13 -030 — Ordering Preparation of Plans & Specifications and Page 4of8 4 City of Centerville Council Meeting Minutes December 11, 2013 Ordering Advertisement for Bids on Improvement — 2014 Mill & Overlay Proiects as presented. All in favor. Motion passed. 4. Res. #13 -031 — Assigning Duties as They Relate to Handling Banking Transactions for the City Administrator Larson stated that this is an annual resolution but with hiring Ms. Paulseth it is imperative to complete this early. Motion by Council Member Paar, seconded by Council Member Love, to approve Res. #13 -031 — Assigning Duties as They Relate to Handling Banking Transactions for the City as presented. All in favor. Motion passed 5. Consider Recycling Incentive - Authorize Rebate to Residents, Subject to Anoka County Approval Administrator Larson stated that as in the past, excess funds subsequent to expenditures have been released to residents through the City's recycling incentive program. Administrator Larson stated that staff is proposing a refund of $6,554.34 or $5.00 per household for their efforts in meeting /exceeding the County's goal placed on the City of 350 tons of recyclable materials being recycled for the year. Administrator Larson stated that the City has received authorization from the County to expend these funds with reimbursement following in January. Motion by Council Member Fehrenbacher, seconded by Council Member King, to Authorize Staff to Refund $6,554.34 ($5/household) to Residents Through a Credit on Their 1 St Ouarter Utilitv Bill as Part of the City's Recycling Incentive Program and Continued Recycling Efforts. All in favor. Motion passed 6. Consider Location for Future Street Connection to 20 Avenue /CSAH21 Administrator Larson stated that at some point in the future, the property owner of the vacant property abutting the Willow Glen Development and Central Bank will be proposing the construction of a street through the property and it would be advantageous of the City to consider the connections from 21" Avenue to Main Street /CSAH14 and 20 Avenue North/CSAH54 prior to meeting with the County and the developer's submission. Lengthy discussion was had regarding City and Developer desires along with County requirements and inability of current owner to sell /develop parcel /parcels. Motion by Council Member Paar, seconded by Council Member Fehrenbacher to enter discussions with Anoka County regarding a roadway and alternate roadway allowing access to 20 Avenue (CSAH 54). All in favor. Motion passed 7. Consider Amendment of Centennial Fire District Joint Powers Agreement — Section 2.6 Voting Page 5 of 8 5 City of Centerville Council Meeting Minutes December 11, 2013 Administrator Larson reported that the City of Lino Lakes initiated a request to amend the existing Joint Powers Agreement requiring that the Committee may not take action unless a motion receives at least one affirmative vote from each member city. Administrator Larson stated that Mayor Reinhart and Lino Lakes Council Members intend to withdraw from the Centennial Fire District if the amendment is not made. Mayor Reinhart was on hand to advocate his modification to the JPA and stated that the Circle Pines City Council voted against the amendment language. Circle Pines Council Member Richard Runbeck advocated for approval, indicating that Lino's withdrawal from the Centennial Fire District would increase costs for the two remaining cities. Lengthy discussion was had regarding the process of amending the Joint Powers Agreement; withdrawal period; Lino Lakes' dissatisfaction with costs, future avenues of revenue, distrust, veto power and potential for stalemates or inability to accomplish needed goals. Mayor Dave Bartholomay, City of Circle Pines was also present and advocated not to amend the Joint Powers per Mayor Reinhardt's wishes and instead amend language to allow withdrawal six months later than the current language of by December 31 of an odd year similar to what his Council approved at their meeting the evening prior. The extension would allow additional time to try resolve the matter. The Mayor Bartholomay stated that his Council also felt that stalemates and inability to accomplish goals would happen with the proposed amendment by Lino Lakes Mayor Reinhardt. Council's concerns were of veto power and stalemates, distrust and unwillingness to rectify potential dissatisfaction, lack of analysis or reporting of cost benefit to their Council prior to Mayor Reinhart taking this issue to the Fire Steering Committee and appearing to make decisions on his own rather than as a Council. Motion by Council Member Fehrenbacher, seconded by Council Member Paar to reiect the City of Lino Lakes' Requested Language Amendment to the Centennial Fire District Joint Powers Agreement — Section 2.6 Voting as presented. Discussion ensued whether the City of Lino Lakes would consider any other amendment to the Joint Powers Agreement other than the one that failed this evening and the City of Circle Pines regarding the language. Mayor Reinhart stated that nothing else is on the table to consider. Upon vote being taken, Council Member Love opposed. Motion passed. Motion by Council Member Love, seconded by Council Member Fehrenbacher to approve the amendment suggested by the City of Circle Pines Allowing Withdrawal Notice being Given Between January 1, 2014 and June 30, 2014 or During the Month of December in Odd - Numbered Years, Beginning with December of 2015. Parks & Recreation Committee Recommendation to Reserve Unspent Budget Items in 2013 for use in 2014 Administrator Larson suggested that Council consider this item at a later date following the submission of all 2013 expenses associated with the Parks & Recreation Program Budget. Administrator Larson stated that Council has allowed this practice in the past. Motion by Council Member Fehrenbacher, seconded by Council Member King to Table This Item Until All 2013 Expenditures Are Accounted For. All in favor. Motion passed. 9. Consider Purchasing a Replacement Phone System & Agreement with Roseville I -Net Administrator Larson stated that the City's current telephone system has been in place for more than ten years and could use replacement along and recommended the City of Roseville's capability of providing telephone and internet services rather than Comcast and Century Link at a lower cost. Administrator Larson also stated that the new phone system would allow for connectivity between Administrative Offices and Public Works, funds would be expended from Capital Equipment funds which the purchase is budgeted for, and that the City of Roseville provides similar services to the Cities of Circle Pines, Lino Lakes, Forest Lake and the Centennial Fire District. Motion by Council Member Love, seconded by Council Member Paar, to Purchase a Replacement Telephone System, Enter Into An Agreement with the City of Roseville for I -Net Services and Expend up to $4,600 from Capital Equipment funds as presented. All in favor. Motion passed. 10. Consider Cancellation/Re- Scheduling of the December 25, 2013 City Council Meeting. The Mayor stated that due to the scheduling of the next meeting which falls on Christmas Day, would Council like to cancel the meeting and if one is needed prior to the end of the year he can call one. The process will be similar to what happened during the month of November. Motion by Council Member Fehrenbacher, seconded by Council Member Paar, to Cancel the Regularly Scheduled Council Meeting of December 25, 2013 due to the Christmas Holiday. All in favor. Motion passed. IX. ANNOUNCEMENTS/UPDATES City Administrator Larson stated that the Department of Natural Resources has placed conditions on the City's ability to issue an Interim Use Permit for the Black Dirt Operation. Due to the proximity to the floodplain, DNR determined the need for a 'No Page 7 of 8 7 City of Centerville Council Meeting Minutes December 11, 2013 Rise Certificate" or to move the pile 200 -250 feet out of the Floodway. Administrator Larson stated that the issue may need to go before the Planning & Zoning Commission again to modify conditions of the permit. Council Member Love reported that the City would be received a dividend check from the League of Minnesota Cities for the period of 2013 and that the Police and Fire Department also would be receiving theirs shortly. Council Member King stated that recently he had attended a Water District Management meeting along with the Met Council. Council Member King had concerns as to home values is the local area is deemed a water conservation district. Mayor Wilharber reported that Mediation Services and the Alexandra House would be forwarding their invoices for services soon, roadways are slick due to the weather with the salt brine solution being washed away from recent rain, that the Parks and Recreation Committee recently had a showing of The Muppets Christmas Carol at Centerville Elementary and 20 to 30 individuals attended and that the Eagle Pass Townhome Associated expressed their gratitude to the Public Works Staff for their assistance in a recent curb stop locate /raising project. CALL TO ORDER Mayor Wilharber called the meeting to order at 6:3 p.m. The purpose of the meeting was to consider a proposed amendment to the Centennial Fire District, Joint Powers Agreement. The amendment would extend the opportunity to give notice to withdraw from the district to January 30, 2014. The exact text of the amendment is as follows: 11.1 Notice: Member municipalities may withdraw from the District only in accordance with this section. Notice to withdraw may only be given between January 1, 2014 and January 30, 2014 or during the month of December in odd - numbered years, beginning December of 2015. Such notice shall provide a minimum of two (2) years notice to the remaining municipalities of the intent to withdraw. Motion by Council member Love, seconded by Council member King that the amendment be approved as presented. All present voted in favor. Motion passed. The Planning & Zoning Commission met on January 7, 2014 to consider a request of Rehbein Properties, DBA Rehbein's Black Dirt, for an Interim Use Permit (IUP) to operate a black dirt processing business at 21 Avenue south of Clearwater Creek in the City of Centerville. Findings: 1) The Planning and Zoning Commission heard and considered all testimony of interested persons submitted in writing prior to and in person during the public hearing on November 5, 2013. 2) The proposed use may be operated in the I -1 zoning district subject to an Interim Use Permit with reasonable conditions. 3) Minnesota DNR offered comments that require a "No Rise Certificate" if the use is located in the Floodway. 4) The proposed use is not inconsistent with the Comprehensive Plan if allowed on a temporary basis until the planned use is feasible. 5) The applicant is willing to conform to conditions in the draft Interim Use Permit attached hereto. RECOMMENDATION. The Planning Commission finds that the standards for granting a Interim Use Permit have been met and recommends that the City Council approve the Interim Use Permit, subject to the conditions contained in the draft IUP attached hereto. January 7. 2014 Planning and Zoning Commission Dallas Larson, Administrator 17 CITY OF CENTERVILLE ANOKA COUNTY, MINNESOTA APPROVAL OF INTERIM USE PERMIT 1. Permit. Subject to the terms and conditions set forth herein, the City of Centerville hereby grants approval of an interim use permit for: Rehbein Properties, DBA Rehbein's Black Dirt, to operate dirt processing at property west of 21" Avenue, south of Clearwater Creek, subject the conditions of this permit. 2. Property. The permit is for the following described property: PID's: 24- 31 -22 -32 -0002 & 24- 31 -22 -32 -0003 3. Conditions. This permit is issued subject to the following conditions: a) All activities shall be conducted entirely within the easterly 680 feet of the property south of Clearwater Creek(approx. 13 acres), and shall not encroach closer to Clearwater creek than 50 feet, and shall not use any other adjacent property, whether owned or not, unless a interim or conditional use permit is applied for and issued, permitting the activity on that site. b) Existing green strip along Clearwater Creek shall not be disturbed. c) Operating hours shall be limited to 6:00 a.m. to 6:00 p.m. Monday through Friday and 7:00 a.m. to 6:00 p.m. Saturday. d) Permittee shall endeavor to limit speed of trucks entering or leaving the site to 25 miles per hour. e) Permittee shall maintain millings at the entrance to the site for a minimum distance of 250 feet south from the intersection of 21" Avenue and Commerce Drive and Permittee keep the drive and adjoining street free of mud and dirt. Upon notice by the city of excessive accumulation of dirt or mud in the street, Permittee shall clean and \or sweep within four hours. 18 f) No fuels or chemicals shall be stored on the site, unless contained in a building. g) Maximum noise emitted at the property line shall conform to the noise regulations contained in City Code Section 91.09 and applicant shall not violate other nuisance regulations contained in Chapter 91. h) The maximum height of all piles shall be limited to 50 feet above the natural grade of the site. Materials allowed to be brought to the site shall only be granular compactable material and black dirt. No broken concrete or asphalt material is permitted. i) Ingress and egress shall be limited to 21" Avenue. Hauling on Commerce Drive and Fairview Avenue in conjunction with this permit, is not allowed. j) Permittee shall supply a monthly accounting of all material hauled in to the site and hauled off the site. This accounting of material hauled from the site shall be in the form of a log of loads hauled out each day and documenting the quantity of material in each load together with copies of truck load tickets and/or bills of sale. k) Recognizing the impact on adjoining streets and in recognition of administrative and other costs of monitoring this permit the following fees shall be paid by the operator: 1. For loads of black dirt material hauled from the site, $0.25 per cubic yard, to be paid monthly. 2. For loads of compactable granular material hauled from the site, $0.10 per cubic yard, to be paid monthly. 1) Landowner and the business operator shall jointly and individually be responsible for the continuing conformance with the permit and that if the proposed use is not initiated within six months of this date, the permit shall be void. m) Grantee will follow the applicable standards and requirements of the City of Centerville, Rice Creek Watershed District, Anoka County, Army Corp of Engineers, FEMA, Minnesota DNR and any other agency having jurisdiction over the property and shall secure and file with the City, copies of any permits required by outside agencies. Requirements shall include the filing a Stormwater Pollution Prevention Plan. n) Grantee will secure necessary permits and follow the applicable rules and regulations of Minnesota Pollution Control Agency and EPA for collection, storage and disposal of solids, liquids and gases. Grantee will file with the City within ten days of receipt, copies of any permits and/or notice of enforcement actions by these agencies. o) Grantee will permit a city inspector to view the premises, including the inside of buildings, during normal business hours. p) Minnesota DNR has commented that, for the use to be located in the Floodway, a "No Rise Certificate would be required. Applicant will provide a "No Rise Certificate" or move dirt stockpiles out of the Floodway not later than July 1, 2014. This permit does not allow placing any new material in the floodway, prior to the city receiving a "No Rise Certificate." j) The City reserves the right to annually review this permit for compliance with the conditions and may impose additional conditions to mitigate unforeseen problems. 19 4. This permit shall be effective February 1, 2014, and shall expire at December 31, 2018. Not later than December 31, 2019, all excess material remaining on the site shall be hauled away and /or leveled and the site graded and seeded to prevent erosion, in conformance with law. 5. The vacant office of Mayor is filled in the manner set forth by Minnesota Statute Section 412.02. 4.
