HomeMy WebLinkAbout2014-02-12 Handouts at Meeting Assessment resolution — 2014 Mill & Overlay RESOLUTION NUMBER 14 -OXX A RESOLUTION DECLARING COST TO BE ASSESSED AND ORDERING PREPARATION OF PROPOSED ASSESSMENT AND CALLING FOR A PUBLIC HEARING ON 2014 STREET MILL AND OVERLAY IMPROVEMENTS WHEREAS, bids have been received, and costs have been determined for the improvement of the following streets by construction of a mill and pavement overlay: 1. 73 Street from Mill Road easterly to a point approximately 150 feet east of Quebec Street. 2. Quebec Street from 73 to Old Mill Road 3. Old Mill Road from 73 Street to a point approximately 250 feet north of Revoir Street 4. All of Revoir Street 5. Deer Pass Drive from 20 Avenue west and then north to its terminus in the cul -de -sac 6. Lakeland Circle east from Centerville Road to Main Street 7. Meadow Lane from Centerville Road to Dupre Road 8. Dupre Road from a point approximately 150 feet easterly of Meadow Lane easterly then southerly to a point approximately 150 feet north of Center Street 9. Pioneer Lane from Dupre Road to Eagle Trail 10. Brian Court from Brian Drive easterly to its terminus in the cul -de -sac. 11. All of Steven Lane 12. Lakeland Circle West from Centerville Road to Main Street 13. Centerville Road from Lakeland Circle north a distance of approximately 150 feet. WHEREAS, the bid price for the improvement is $348,100 and the expenses to be incurred in the making of such improvement amount to $68,000 so that the total cost of the improvement will be $414,100. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF CENTERVILLE, MINNESOTA: 1. The portion of the cost of such improvement to be paid by the city is hereby declared to be $320,100 and the portion to be assessed against benefiting property is declared to be $94,000. 2. The City Administrator, with the assistance of the consulting engineer shall forthwith calculate the proper amount to be specially assessed for such improvement against every assessable lot, piece or parcel of land within the district affected, without regard to cash valuation, as provided by law and not to exceed $500 per residential lot, and he shall file a copy of such proposed assessment in his office for public inspection. 3. A hearing shall be held on the 12 day of March, 2014, at City Hall, at 6:45 p.m. or shortly thereafter, to pass upon the proposed assessment and at such time and place all persons owning property affected by such improvement will be given an opportunity to be heard with reference to such assessment. 4. The City Administrator is hereby directed to cause a notice of the hearing on the proposed assessment to be published once in the official newspaper at least two weeks prior to the hearing Assessment resolution — 2014 Mill & Overlay and he shall state in the notice the total cost of the improvement. He shall also cause mailed notice to be given to the owner of each parcel described in the assessment roll not less than two weeks prior to the hearing. WHEREAS, pursuant to action of the city council, a report has been prepared by Mark Statz of Bonestroo, with reference to the 2014 Street Mill and Overlay project, more fully described as construction of a mill and pavement overlay of the following streets: 1. 73 Street from Mill Road easterly to a point approximately 150 feet east of Quebec Street. 2. Quebec Street from 73 to Old Mill Road 3. Old Mill Road from 73 Street to a point approximately 250 feet north of Revoir Street 4. All of Revoir Street 5. Deer Pass Drive from 20 Avenue west and then north to its terminus in the cul -de -sac 6. Lakeland Circle east from Centerville Road to Main Street 7. Meadow Lane from Centerville Road to Dupre Road 8. Dupre Road from a point approximately 150 feet easterly of Meadow Lane easterly then southerly to a point approximately 150 feet north of Center Street 9. WHEREAS, such report indicates that the proposed improvement is feasible. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF CANNON FALLS, MINNESOTA: 1. The Council will consider the improvement in accordance with the report and the assessment of the benefiting property for all or a portion of the cost of the improvement pursuant to Minnesota Statutes Chapter 429 at an estimated cost of $348,100. 2. The Council finds that the proposed improvement has no relationship to the Comprehensive Plan since the project is primarily rehabilitation of existing streets, and therefore will not require review by the Planning and Zoning Commission. A public hearing shall be held on such proposed improvement on the 12' day of March, 2014, in City Hall at 6:30 p.m. and the administrator shall give such mailed and published notice of such hearing and improvement as required by law.
