PRESENT: Mayor Tom Wilharber Council Member Jeff Paar Council Member Steve King Not /Council Member Ben Fehrenbacher ABSENT: Council Member D. Love STAFF: City Administrator Dallas Larson City Engineer Mark Statz Legal Counsel Kurt Glaser Mr. Olaf Lee, 1724 Heritage Street, appeared before Council desiring to speak regarding the sunset date to connect his home to municipal water services (December 31, 2017). Mr. Lee stated that the water main that would service his home is located in the rear of his property rather than with most other homes is located in the road right-of-way much closer to the home. Mr. Lee requested that Council consider his and his neighbors lengthy connection as a financial hardship and grant them additional time to connect, such as when a water main is brought down Heritage Street. Mr. Lee addressed the fact that he and his wife encountered this issue in the midst of sale negotiations. Mr. Lee also stated that in the time that he has resided in the home, the City has rezoned the property, placed restrictions on additions, decks, fences, etc. Administrator Larson discussed the downtown redevelopment plan, associated planning for road reconstruction, building requirements/moratorium, etc. and stated that certain restrictions are in place; however most have been removed due to the length of time for development and the economic downturn. Administrator Larson stated that two (2) individuals on the section of roadway that Mr. Lee resides have already connected to the available water main. Administrator Larson requested that Staff be allowed to complete research regarding the issue and provide it at the next meeting. Council consensus was to accept additional Staff research at their August 13, 2014 meeting. I. CALL TO ORDER Mayor Wilharber called the meeting to order at 6:30 p.m. II. PLEDGE OF ALLEGIANCE III. AWARDS/PRESENTATIONS/APPEARANCES-None P1 City of Centerville Council Meeting Minutes July 23,2014 Mayor Wilharber opened the Public Hearing at 6:42 p.m. IV. PUBLIC HEARING 1. Mr. & Mrs. Stan Hasiak, 6994 Centerville Road — Appeal the Designation of Dog as Potentially Dangerous Centennial Lakes Police Chief James Coan appeared before Council and stated that on June 17, 2014 Community Service Officer Fredrickson was called to receive a dog bit complaint from a gentleman that had been chased by two (2) German Shepard dogs belonging to the Hasiak's and bit by one (1) and his clothing being nipped at by the other. Chief Coan stated that this evening is to determine whether or not to determine if the dog that bit (Szaryk) be deemed Potentially Dangerous. Ms. Stephanie Hasiak appeared before Council to appeal the designation of Szaryk as being Potentially Dangerous. Ms. Hasiak stated that all requirements for a dog of this designation have been met including a newly installed fence. CSO Fredrickson stated that at the time of this incident, the Hasiak's had not been following proper enclosure requirements for the already deemed Potentially Dangerous dog Heidi. CSO Fredrickson stated that snowfencing had been installed in one area rather than the same material that is utilized throughout the remainder of the yard and that has recently been replaced with a more permanent fencing material with a gate. Ms. Hasiak stated that it was not the intent to let the animals out, they just got out during a period that her husband was getting ready to leave. Attorney Glaser reviewed the requirements for a dog that is deemed Potentially Dangerous by stating that the owners must provide proper enclosure, the dog must be muzzled when outside of that enclosure and on a leash not exceeding six (6) feet, be micro chipped and be annually registered with the City. Council had confusion regarding which dog had bit during this incident and the deeming of Potentially Dangerous of the other dog. Administrator Larson stated that there were two recent incidents where dogs had bitten but they were two (2) separate incidents with two (2) separate dogs and owners. Administrator Larson stated that Hasiak's other German Shepard name Heidi had been deemed Potentially Dangerous in 2009 following a bite incident. Lengthy discussion ensued regarding the Hasiak's routine with the dogs, leaving their home and gated area, transferring them from the basement to outdoors, rehoming of Heidi, $300,000 liability insurance requirement, deeming of Dangerous versus Potentially Dangerous. Council Member Paar questioned whether either of these two dogs had been involved with an additional incident several weeks prior. Chief Coan stated that he was unaware of additional incidents but would research the item. Mayor Wilharber closed the Public Hearing at 7:08 p.m. Page 2 of 7 P2 City of Centerville Council Meeting Minutes July 23,2014 V. City Attorney Glaser stated that Szaryk was unprovoked, chased and bit an individual on public property. Council Member Fehrenbacher reiterated that all requirements of a Potentially Dangerous dog "Szaryk" have been complied with and the owner is appealing the designation. Attorney Glaser stated that if Council desire to affirm Chief Coan's designation Council should adoption the presented resolution. Page 3 of 7 P3 City of Centerville Council Meeting Minutes July 23,2014 IX. NEW BUSINESS 1. Review Proposal by Mr. Richard Fursman, Brimeyer/Fursman—Assist with Recruitment of New City Administrator Mr. Fursman introduced himself to Council and provided a budget along with a calendar showing specified dates/timeline for filling Administrator Larson position following retirement. Mr. Fursman stated that he had just returned from being outside of the Country and thanked Council for their patience. Mr. Fursman stated that it is an aggressive timetable and that he would like to have a pool of 15 candidates for Council to consider and will report to the Administrator the outcome of those candidates. Mr. Fursman felt that he would provide a progress report to Council slightly following August 25, 2014 and Council and Staff could meeting with the top 4-5 candidates. Mr. Fursman stated that he proposed holding interviews with these candidates September 12 and 13, 2014 and have a new Administrator on board by October 1, 2014 (Mr. Larson's retirement date). Council Member Fehrenbacher felt that it was important for Staff to meet with candidates. Mr. Fursman felt that a scaled back search proposal was fitting due to the immediate position vacancy, financial concerns, most undesirable candidates would not make the finalist phase and rather large pool of executives to draw from so he was proposing $10,000 for the search fee and an additional $2,750 for expenses such as copies, supplies, mileage and advertising. Mr. Fursman stated that on the reverse side of the proposal, if Council desired, there were additional services that could be secured. Motion by Council Member Fehrenbacher, seconded by Council Member Paar to secure Fursman/Brimever as the City's executive search firm in an amount of$10,000 but not to exceed$12,750 with expenses, as presented. All in favor. Motion passed. 2. & 3. Approve Special Assessment Agreement for Flood Study — Lake Area Utilities & Approve Special Assessment Agreement for Flood Study—Muellner Blacktop Administrator Larson stated that the next two (2) items relate to same issue and are a part of the already approved agreement with Mr. Gerald Rehbein, R &R Leasing, to complete a flood study in conjunction with FEMA recent adjustments. Administrator Larson explained that both Lake Area Utilities and Muellner Blacktop would benefit from the boundary modifications and have each agreed to participate up to one-third of the cost, with a maximum limit$10,000 and $10,000 respectively. Administrator Larson stated that the two (2) entities have signed agreements which repay their share as a special assessment over five years. Council Member King questioned who would assume financial responsibility if the study exceeded the maximum of the agreements? Administrator Larson stated that Mr. Rehbein would cover any amounts over the maximums in the other two agreements. Page 4 of 7 P4 City of Centerville Council Meeting Minutes July 23,2014 Motion by Council Member Paar, seconded by Council Member King to both Special Assessment Agreements for Flood Study, Lake Area Utilities & Muellner Blacktop as presented. All in favor. Motion passed. 4. Res. #14-025 —Establishing Parking Restrictions on CSAH21/Centerville Road Administrator Larson stated that this is standard protocol with county road reconstruction projects and the restriction would one block downtown, north of Sorel. There was concern for future downtown redevelopment and potential for needed parking. Administrator Larson stated that this would be discussion at that time but is not needed currently. Motion by Council Member Fehrenbacher, seconded by Council Member Paar to adopt Res. #14-025 — Establishing Parking Restrictions on CSAH21/Centerville Road as presented. All in favor. Motion passed. 5. 2014 Goals Statement Administrator Larson stated that he had added #4. Hire New City Administrator and that the goals center around attracting commercial development, sale of City owned property and collaborating with neighboring communities. Council Member King suggested that Fire District/Department be added. Motion by Council Member Fehrenbach, seconded by Council Member King to approve the 2014 Goals Statement as presented. Discussion ensued regarding the helpfulness of council goals to a potential candidate for the City Administrator position. All in favor. Motion passed. 6. City Agent Administrator Larson stated that most of the Council was aware that the Centennial Fire District was formed by a Joint Powers Agreement and within that agreement was a provision for a member City to withdraw, and the City of Lino Lakes has exercised their right and intends to form their own fire department. Administrator Larson stated that with the impending withdrawal distribution of assets must take place. Administrator Larson explained that the Fire District has inventoried all equipment and had it appraised, Mr. Keinath has been appointed by his City's Council to select equipment needed for the Circle Pines station and Dallas would like for Council to appoint him as the City of Centerville's agent to select equipment needed for the Centerville station. Administrator Larson stated that both he and Mr. Keinath had met with respective station chiefs and expect to have their equipment needs prioritized before the distribution date. Page 5 of 7 P5 City of Centerville Council Meeting Minutes July 23,2014 Motion by Council Member King, seconded by Council Member Park to approve City Administrator Larson as the City of Centerville City Agent for the distribution of the Centennial Fire District's assets. All in favor. Motion passed. X. ANNOUNCEMENTS/UPDATES 1. Administrator Larson — Mailboxes within cul de sacs. Administrator Larson stated that several cul de sacs still have mailboxes placed on individual lots and the City has had issues regarding snow removal in these same areas. Administrator Larson explained that with the numerous mailboxes the Public Works Department has experienced difficulty with finding areas to place the snow from the roadways and has suggested gang box type mailing stands on the street entering the cul-de-sac. Administrator Larson suggested that Staff inventory troublesome areas and forward letters to residents regarding the necessity of relocation and gang box style mailboxes. Mayor Wilharber questioned the necessity of several newspaper boxes per mailbox and their respective move also. Administrator Larson stated that he would forward a draft of the letter to Council Members for their review prior to forwarding to residents. 2. Engineer Statz stated that he would be taking paternity leave for a period of two (2) months and all inquiries could be addressed by Mr. Lee Mann from his office. 3. Mayor Wilharber questioned the final wear course on the Center Street Project and how it could be affected by the existing cracks. Council Member Fehrenbacher stated that a 6% increase would be experienced by Centerville. Lengthy discussion by the Governing Board had taken place to determine immediate needs versus technology and some items that had been in the original budget were removed. 5. Council Member Paar stated that the meeting that had been recently held at the City of Circle Pines with Centennial Fire District members went very well with discussions regarding level of services that would be provided after withdrawal by Lino Lakes, staffing levels, fire fighter retirement, etc. 6. Mayor Wilharber reviewed a letter received by the City from Mr. Michaels Recycles Bicycles regarding the City's efforts to recycle bicycles at their annual Recycling/Clean Up day. Mr. Michaels Recycles Bicycles had collected 355 bicycles since 2007 in Centerville with 236 of them being refurbished and placed back into circulation for disadvantaged adults and youths. 7. Council Member King requested that Mediation Services availability be placed on utility bills. Discussion ensued regarding other entities use of franchise fees and research into the City's potential use in the future. Administrator Larson would provide information in the future. Thanks for taking care of that. Yes, we would be utilizing the parking lot as we would be starting the race at LaMotte. My plan was to place the 3 extra port-o-potties near the start of the race. I had planned to call waste management to get extra trash receptacles. Pat Branch had given me this tip. The routes we will be using are attached. hftp://www.mappedometer.com/ . Sorry, I can't figure out how to attach each route, but if you load Route#269302 for the 10k and 269306 for the 5K. If you need me to, i can print them out and drop them by. Can you please let me know about the deposit that needs to be worked out and anything else you can think of that I need to take care of. (we do plan to contact the police depts. to see what we need there) I will let the CHS Baseball Boosters know at the meeting on May 6th. Thanks for all your help!!! The City Administrator states that we should provide the trash receptacles and port-a-potties with the funds from the Deposit to ensure that everything is cleaned up in our park and along our trails. I was just working on comparing the options, so that should be in place next week and I don't see a problem naming the City of Centerville as well as Anoka County. Yes -we are having all of the participants sign waivers - hopefully via the registration website. But we plan on having them on hand for same day registration as well. Thank you so much for passing my name onto Pat Branch!!! He has been so helpful with tips in getting this event together. So I really appreciate that! In getting everything ready for the meeting next week, I was searching through my emails to print out the request to the City of Centerville to waive the registration fee for us, but was unable to find it, and am now questioning whether or not I sent it. Background: Watermain Construction. In approximately 2003, a watermain was constructed to serve the Chauncey-Barret Senior Housing project. The watermain connects in the Eagle Pass development to the east, and goes westerly to connect to a watermain in Centerville Road, making a complete loop. The eight-inch line is just south of the rear property line of the homes along the south side if Heritage Street. While this does provide service to Chauncey Barret, given the size of the pipe and the looping, this is clearly a city watermain, not merely a service line. Properties to the north were not specially assessed for any of the cost. The watermain is located on the south property line of the property in question, and two of the neighboring properties on the south side of Heritage have already connected. Deadline to connect. In 2006, the Council placed in City Code, the requirement to connect to city water by 12-31-2012. That sunset date was extended to 2017, as a result of Council action taken in 2009. In 2013, the Council passed another amendment stating that for properties that water is made available after January 1, 2013, the deadline to connect is 12-31-2021. Notification to this owner. The owners of the property at 1724 Heritage were notified beginning May 6, 2009, that water was available to connect. Letters were sent again on May 23, 2013, and May 5, 2014, advising that watermain was available and that the city had contractor bids to connect residences that wished to do so at this time. The cost estimates provided to the owner of 1724 Heritage were as follows: 2009 - $10,467 2013 - $13,094 2014 - $13,500. Each of the estimates used about 60 feet of service line distance, however that is clearly less than the actual here, since the home is located about 85 feet from the rear property line, and the exact termination point in the home where water would be extended, is unknown. The service line required could be more on the order of 130 feet. In each of the estimates above, the extra 80 feet of service line distance would add: 2009 - $1,680, C:\Users\tbender\AppData\Local\Microsoft\Windows\Temporary Internet Files\Content.Outlook\9NJG4319\2014-07- 30 memo to Council r water connect 1724 Heritage.doc P48 2013 - $4,018, and 2014 - $2,400. The difference is purely the contractor's rate per foot for the additional distance over 60 feet. Summary. While the cost to connect the property in question to city water would be less if a watermain were placed in the street out front, water is available on the rear property line, if the property owner wishes to connect. The difference in cost is not double what it would be with a watermain in Heritage, but more on the order of 15-20%, as identified above. The question, it seems to me, is whether a distance of 130 feet is a reasonable distance to expect a property owner to make a water connection. There are cases where water is not yet available for connection. For example the properties on the north side of Heritage Street should not be expected to connect now, since they would need to extend services across the property of other private owners. But here we have a watermain adjoining the property, albeit a greater than usual distance. We have had many property owners connect, where even greater distances were involved. I have attached cost estimates and mailings regarding the issue, since 2009. The bid included pricing for other locations in the City that are not a part of this project. If you wish to take advantage of this, your water service can be run into your basement and connected to your internal plumbing at this time. The water service would be directionally bored from the boulevard to the chosen location in your basement so you would not have any disturbance to your yard other than a small patch in the boulevard. The bid prices are reasonable and all costs can be specially assessed to your property over a period of fifteen years. If you select this option, we will provide you with a document that will outline the costs and on which you would express your agreement to be specially assessed. Of course, you could prepay the costs at any time. The estimated costs of the work breakdown are as follows: Boring in service, estimated 65 feet(additional Footage at$30/ft.) $1,950.00 Connections within your home (Flat rate)* $1,000.00 Permits& Coordination(Flat rate) $400.00 Connection to Curb Stop $1,400.00 Water Meter $400.00 Water Access Charge(Trunk System Charge) $1,850.00 Water Connection Unassessed Watermain $6,350.00 Estimated cost $13,500.00 Estimate Annual Payment(If Assessed to Property Taxes) (5%interest for 15 years) $1,300.62 DEADLINE: In order to schedule all of these service line installations, it is important that we have as much advance time as possible. Thus, we must ask that you respond no later than May 30, 2014 if you think you would like to participate in this work. Please contact City Hall at (651) 429-3232 to have your name put on the list of those that desire to be included. Or, you may sign and return the enclosed post card. We will need to schedule a visit to your property to find out where the water meter would be located and to get a measurement on the total service line distance. We will then send you the connection agreement with exact costs, allowing you to make your final decision to proceed or not. P50 Thank you, Dallas Larson City Administrator * This cost includes patching the concrete floor, but not repair of any floor coverings. ***As a reminder, City Code requires all properties with City water available to connect by the end of 2017. Your well may be retained for outside yard sprinkling only, but costs to reconnect to a yard sprinkling system are not included in the above estimates. If the well is not going to be used, it should be properly abandoned. Those costs could be included at this time if you desire. If you decline to connect at this time, you can do so later with your own contractor providing the work;however, you will have City fees associated with that at the going rate. The City Council recognizing that the costs to connect could be difficult to manage, has offered a longer repayment term for those that might like a lower annual payment. Thus, you have an additional option to extend the term from 15 years out to 25 years. The interest rate for the longer term is 5.25%compared to 4%for the shorter term. The longer term would reduce the annual payment by about $150 per year. While this may not change your mind, we wanted to tell you about the decision,in case it makes a difference to you. The bid prices are reasonable and all costs can be specially assessed to your property over a period of several years. If you select this option,we will provide you with a document that will outline the costs and on which you would express your agreement to be specially assessed. P53 DRAFT DRAFT DRAFT pct e r m e 1880 3fain Street,Centem4ffe,MN55038 E-4a-Jlish eU 1857 651-429-3232 or Ext 651-429-8629 July 29, 2014 Centerville, MN 55038 Re: Mailbox Location Dear Since about 1999, the City Code has required mailboxes to be grouped together in ranks of six to ten and actually prohibited mailboxes from being located within the circular cul- de-sacs. The main reason they are prohibited in cul-de-sacs is that,in winter it is very difficult to get the snow plowed full width in the circle and due to the limited area to place snow. For example, a lot in a cul-de-sac could taper to as little as 45 feet wide at the curb and could have a driveway twenty-four feet wide, thus leaving less than half of the width on each lot to store the snow from a large circular cul-de-sac. If you place mail boxes in those very limited gaps, snow removal becomes even more problematic. The last two winters have demonstrated to us why the mailbox regulations are important. While mailboxes in most of the cul-de-sacs in Centerville have already been corrected we have a small number that have been overlooked. Your home is located in one of those. It is the City's plan to remove your mailbox from its existing location and move it to a grouping of five or six at the entrance to your cul-de-sac. A diagram of where it will be placed is enclosed. We anticipate this work will be done during the last week of August and the first two weeks of September. Before that,we would like you to verify that your box has your house number legibly imprinted on it. If it isn't,please make sure that is complete by the planned move date. If your mailbox is damaged and you would like to provide us with a new mailbox to install,we will be happy to accommodate that, if you let us know. We understand that moving your mailbox will be a bit more inconvenient, but the move is necessary. Thank you in advance for your cooperation.
