HomeMy WebLinkAbout2014-07-23 CC Minutes - Approved CITY OF CENTERVILLE CITY COUNCIL MEETING July 23, 2014 6:30 p.m. Pursuant to due call and notice thereof, the City of Centerville held their regularly scheduled meeting of July 23, 2014 at City Hall, 1880 Main Street. PRESENT: Mayor Tom Wilharber Council Member Jeff Paar Council Member Steve King Council Member Ben Fehrenbacher ABSENT: Council Member D. Love STAFF: City Administrator Dallas Larson City Engineer Mark Statz Legal Counsel Kurt Glaser Mr. Olaf Lee, 1724 Heritage Street, appeared before Council desiring to speak regarding the sunset date to connect his home to municipal water services (December 31, 2017). Mr. Lee stated that the water main that would service his home is located in the rear of his property rather than with most other homes is located in the road right-of-way much closer to the home. Mr. Lee requested that Council consider his and his neighbors lengthy connection as a financial hardship and grant them additional time to connect, such as when a water main is brought down Heritage Street. Mr. Lee addressed the fact that he and his wife encountered this issue in the midst of sale negotiations. Mr. Lee also stated that in the time that he has resided in the home, the City has rezoned the property, placed restrictions on additions, decks, fences, etc. Administrator Larson discussed the downtown redevelopment plan, associated planning for road reconstruction, building requirements/moratorium, etc. and stated that certain restrictions are in place; however most have been removed due to the length of time for development and the economic downturn. Administrator Larson stated that two (2) individuals on the section of roadway that Mr. Lee resides have already connected to the available water main. Administrator Larson requested that Staff be allowed to complete research regarding the issue and provide it at the next meeting. Council consensus was to accept additional Staff research at their August 13, 2014 meeting. I. CALL TO ORDER Mayor Wilharber called the meeting to order at 6:30 p.m. II. PLEDGE OF ALLEGIANCE III. AWARDS/PRESENTATIONS/APPEARANCES-None City of Centerville Council Meeting Minutes July 23, 2014 Mayor Wilharber opened the Public Hearing at 6:42 p.m. IV. PUBLIC HEARING 1. Mr. & Mrs. Stan Hasiak, 6994 Centerville Road – Appeal the Designation of Dog as Potentially Dangerous Centennial Lakes Police Chief James Coan appeared before Council and stated that on June 17, 2014 Community Service Officer Fredrickson was called to receive a dog bite complaint from a gentleman that had been chased by two (2) German Shepard dogs belonging to the Hasiak’s and bit by one (1) and his clothing being nipped at by the other. Chief Coan stated that this evening is to determine whether or not to determine if the dog that bit (Szaryk) be deemed Potentially Dangerous. Ms. Stephanie Hasiak appeared before Council to appeal the designation of Szaryk as being Potentially Dangerous. Ms. Hasiak stated that all requirements for a dog of this designation have been met including a newly installed fence. CSO Fredrickson stated that at the time of this incident, the Hasiak’s had not been following proper enclosure requirements for the already deemed Potentially Dangerous dog Heidi. CSO Fredrickson stated that snowfencing had been installed in one area rather than the same material that is utilized throughout the remainder of the yard and that has recently been replaced with a more permanent fencing material with a gate. Ms. Hasiak stated that it was not the intent to let the animals out, they just got out during a period that her husband was getting ready to leave. Attorney Glaser reviewed the requirements for a dog that is deemed Potentially Dangerous by stating that the owners must provide proper enclosure, the dog must be muzzled when outside of that enclosure and on a leash not exceeding six (6) feet, be micro chipped and be annually registered with the City. Council had confusion regarding which dog had bit during this incident and the deeming of Potentially Dangerous of the other dog. Administrator Larson stated that there were two recent incidents where dogs had bitten but they were two (2) separate incidents with two (2) separate dogs and owners. Administrator Larson stated that Hasiak’s other German Shepard name Heidi had been deemed Potentially Dangerous in 2009 following a bite incident. Lengthy discussion ensued regarding the Hasiak’s routine with the dogs, leaving their home and gated area, transferring them from the basement to outdoors, rehoming of Heidi, $300,000 liability insurance requirement, deeming of Dangerous versus Potentially Dangerous. Council Member Paar questioned whether either of these two dogs had been involved with an additional incident several weeks prior. Chief Coan stated that he was unaware of additional incidents but would research the item. APPROVAL OF AGENDA Mayor Wilharber added Centerville Claims (Check #28827-28851). Motion by Council Member Fehrenbacher, seconded by Paar to approve the Agenda as presented with the addition of Centerville Claims (Check #28827-28851) as presented. All in favor. Motion passed. VI. APPROVAL OF MINUTES 1. July 9, 2014 City Council Meeting Minutes The Mayor provided Council Members with an opportunity to amend the presented minutes. Motion by Council Member King, seconded by Council Member Fehrenbacher to approve the minutes of the July 9, 2014 City Council Meeting as presented. All in favor. Motion passed. VII. CONSENT AGENDA 1. City of Centerville July 10, 2014 through July 23, 2014 Claims (Check #28801-28826) & (Check #28827-28851) 2. Centennial Police Department Claims through July 15, 2014 (Check #9985-10008) 3. Centennial Fire District Claims through July 8, 2014 (Check #6471-6486) Motion by Council Member Fehrenbacher, seconded by Council Member King to approve the Consent Agenda as presented. All in favor. Motion passed. VIII. OLD BUSINESS 1. Res. #14-024 – Affirming Designation as Potentially Dangerous Animal The Mayor provided Council with an additional opportunity to question Chief Coan or CSO Fredrickson regarding the matter. City Attorney Glaser stated that Szaryk was unprovoked, chased and bit an individual on public property. Council Member Fehrenbacher reiterated that all requirements of a Potentially Dangerous dog “Szaryk” have been complied with and the owner is appealing the designation. Attorney Glaser stated that if Council desire to affirm Chief Coan’s designation Council should adoption the presented resolution. Motion by Council Member Fehrenbacher, seconded by Council Member King to adopt Res. #14-024 – Affirming Designation of Potentially Dangerous Animal as presented. All in favor. Motion carried. Review Proposal by Mr. Richard Fursman, Brimeyer/Fursman ~ Assist with Recruitment of New City Administrator Mr. Fursman introduced himself to Council and provided a budget along with a calendar showing specified dates/timeline for filling Administrator Larson position following retirement. Mr. Fursman stated that he had just returned from being outside of the Country and thanked Council for their patience. Mr. Fursman stated that it is an aggressive timetable and that he would like to have a pool of 15 candidates for Council to consider and will report to the Administrator the outcome of those candidates. Mr. Fursman felt that he would provide a progress report to Council slightly following August 25, 2014 and Council and Staff could meeting with the top 4-5 candidates. Mr. Fursman stated that he proposed holding interviews with these candidates September 12 and 13, 2014 and have a new Administrator on board by October 1, 2014 (Mr. Larson’s retirement date). Council Member Fehrenbacher felt that it was important for Staff to meet with candidates. Mr. Fursman felt that a scaled back search proposal was fitting due to the immediate position vacancy, financial concerns, most undesirable candidates would not make the finalist phase and rather large pool of executives to draw from so he was proposing $10,000 for the search fee and an additional $2,750 for expenses such as copies, supplies, mileage and advertising. Mr. Fursman stated that on the reverse side of the proposal, if Council desired, there were additional services that could be secured. Motion by Council Member Fehrenbacher, seconded by Council Member Paar to secure Fursman/Brimeyer as the City’s executive search firm in an amount of $10,000 but not to exceed $12,750 with expenses, as presented. All in favor. Motion passed. 2. & 3. Approve Special Assessment Agreement for Flood Study ~ Lake Area Utilities & Approve Special Assessment Agreement for Flood Study ~ Muellner Blacktop Administrator Larson stated that the next two (2) items relate to same issue and are a part of the already approved agreement with Mr. Gerald Rehbein, R & R Leasing, to complete a flood study in conjunction with FEMA recent adjustments. Administrator Larson explained that both Lake Area Utilities and Muellner Blacktop would benefit from the boundary modifications and have each agreed to participate up to one-third of the cost, with a maximum limit $10,000 and $10,000 respectively. Administrator Larson stated that the two (2) entities have signed agreements which repay their share as a special assessment over five years. Council Member King questioned who would assume financial responsibility if the study exceeded the maximum of the agreements? Administrator Larson stated that Mr. Rehbein would cover any amounts over the maximums in the other two agreements. All in favor. Motion passed. 4. Res. #14-025 – Establishing Parking Restrictions on CSAH21/Centerville Road Administrator Larson stated that this is standard protocol with county road reconstruction projects and the restriction would one block downtown, north of Sorel. There was concern for future downtown redevelopment and potential for needed parking. Administrator Larson stated that this would be discussion at that time but is not needed currently. Motion by Council Member Fehrenbacher, seconded by Council Member Paar to adopt Res. #14-025 – Establishing Parking Restrictions on CSAH21/Centerville Road as presented. All in favor. Motion passed. 5. 2014 Goals Statement Administrator Larson stated that he had added #4. Hire New City Administrator and that the goals centered around attracting commercial development, sale of City owned property and collaborating with neighboring communities. Council Member King suggested that Fire District/Department be added. Motion by Council Member Fehrenbach, seconded by Council Member King to approve the 2014 Goals Statement as presented. Discussion ensued regarding the helpfulness of council goals to a potential candidate for the City Administrator position. All in favor. Motion passed. 6. City Agent Administrator Larson stated that most of the Council was aware that the Centennial Fire District was formed by a Joint Powers Agreement and within that agreement was a provision for a member City to withdraw, and the City of Lino Lakes has exercised their right and intends to form their own fire department. Administrator Larson stated that with the impending withdrawal distribution of assets must take place. Administrator Larson explained that the Fire District has inventoried all equipment and had it appraised, Mr. Keinath has been appointed by his City’s Council to select equipment needed for the Circle Pines station and Dallas would like for Council to appoint him as the City of Centerville’s agent to select equipment needed for the Centerville station. Administrator Larson stated that both he and Mr. Keinath had met with respective station chiefs and expect to have their equipment needs prioritized before the distribution date. Page 5 of 7 City of Centerville Council Meeting Minutes July 23, 2014 Motion by Council Member King, seconded by Council Member Paar to approve City Administrator Larson as the City of Centerville City Agent for the distribution of the Centennial Fire District’s assets. All in favor. Motion passed. X. ANNOUNCEMENTS/UPDATES 1.Administrator Larson – Mailboxes within cul de sacs. Administrator Larson stated that several cul de sacs still have mailboxes placed on individual lots and the City has had issues regarding snow removal in these same areas. Administrator Larson explained that with the numerous mailboxes the Public Works Department has experienced difficulty with finding areas to place the snow from the roadways and has suggested gang box type mailing stands on the street entering the cul-de-sac. Administrator Larson suggested that Staff inventory troublesome areas and forward letters to residents regarding the necessity of relocation and gang box style mailboxes. Mayor Wilharber questioned the necessity of several newspaper boxes per mailbox and their respective move also. Administrator Larson stated that he would forward a draft of the letter to Council Members for their review prior to forwarding to residents. 2.Engineer Statz stated that he would be taking paternity leave for a period of two (2) months and all inquiries could be addressed by Mr. Lee Mann from his office. 3.Mayor Wilharber questioned the final wear course on the Center Street Project and how it could be affected by the existing cracks. Engineer Statz stated that certain cracks would be routed and filled prior to the asphalt wear coat. Administrator Larson stated that there would be an upcoming pre-construction meeting for the 2014 Mill & Overlay Project shortly but that he did not have a start date as of this time. 4.Council Member Fehrenbacher stated that there was a recent Police Governing Board meeting and they approved the 2015 Budget. Council Member Fehrenbacher stated that a 6% increase would be experienced by Centerville. Lengthy discussion by the Governing Board had taken place to determine immediate needs versus technology and some items that had been in the original budget were removed. 5.Council Member Paar stated that the meeting that had been recently held at the City of Circle Pines with Centennial Fire District members went very well with discussions regarding level of services that would be provided after withdrawal by Lino Lakes, staffing levels, fire fighter retirement, etc. 6.Mayor Wilharber reviewed a letter received by the City from Mr. Michaels Recycles Bicycles regarding the City’s efforts to recycle bicycles at their annual Recycling/Clean Up day. Mr. Michaels Recycles Bicycles had collected 355 bicycles since 2007 in Centerville with 236 of them being refurbished and placed back into circulation for disadvantaged adults and youths. Mayor Wilharber also stated that the letter commented that Ms. Bender had been accommodating and Council acknowledged Ms. Bender’s work being the Recycling Coordinator. 7.Mayor Wilharber stated that at the end of June the Centennial Lakes Police Department conducted one (1) of their annual tobacco compliance checks and all licensed establishments passed. Mayor Wilharber commended the establishments for their efforts. Page 6 of 7 City of Centerville Council Meeting Minutes July 23, 2014 8.Mayor Wilharber stated that Mediation Services had forwarded a letter requesting that the City again participate in their services for the residents of Centerville. Mayor Wilharber and other Council Members felt that the services offered to residents were very important. City Attorney Glaser stated that he recommends Mediation Services to half a dozen individuals that he sees per year. Council Member King requested that Mediation Services availability be placed on utility bills. Discussion ensued regarding other entities use of franchise fees and research into the City’s potential use in the future. Administrator Larson would provide information in the future. Council Member Paar reminded residents of the events that would be taking place during the Fete des Lac celebration this weekend and stated that a listing of event could also be found on the City’s web site and at local businesses.
