In the fall of 2014, the Public Works Director toured the streets in town to update their condition assessment and place them on the City's schedule of thin bituminous overlays. The road segments which were identified as being in need of an overlay in 2014 were as follows: • Dupre Road (Main St. to Portage Way) • North Robin Lane • Brian Drive (South of Clearwater Creek) • South Robin Lane • Eagle Trail • West Robin Lane • Portage Way • Cardinal Drive The overlay and bituminous patching of these streets should be completed as one project to maximize economies of scale and to secure the best bids possible. Other work related to these streets could be contracted out separately. This may make the overlay/patching bid more attractive since there will not be any ancillary work for the paving contractor to worry about. As was the case last year, streets will receive a 1-inch overlay except that the streets in Robin Lane area would receive a full bituminous removal and replacement due to the condition of the pavement in that area. Last year, we performed an edge mill of the pavement before overlaying them, but based on this years'experience, we are proposing a full width mill to accommodate the overlay. The cost difference will be minimal. Project costs are estimated at $350,000 including both construction and indirect costs. The cost estimate for these improvements is based on a per lineal foot cost of approximately $30, which were typical of last years'project except that the Robin Lane area streets are figured at$60 per lineal foot due to the nature of the repairs need there. Brian Hare,Lee Mann-Stantec Paul Palzer-Public Works Director sm document2 Des gr with cornmunrty in mind PARCELID: 233122410052 VACATION OF PERMANENT PUBLIC EASEMENT THIS VACATION AGREEMENT ("Agreement") is made this day of November 2014 by and between Lake Area Utilities, Inc., a domestic corporation organized under the laws of the State of Minnesota, and doing business as Lake Area Utility Contracting, hereinafter referred to as "Grantee," and the City of Centerville, a municipal corporation organized under the laws of the State of Minnesota, as Grantor, hereinafter referred to as "City." WHEREAS, on March 16, 2010, the City and Grantee entered into an agreement granting the City a permanent public easement for a public trail, over, across on and through land situated within the County of Anoka, State of Minnesota, legally described on the attached, Exhibit A, hereinafter referred to as the "Permanent Easement Premises"; WHEREAS, said grant of a permanent public easement was entered as Document Number 2013961.006 Abstract; and Record ID 2295255, with Anoka County Recorder on March 22, 2010, hereinafter referred to as the "Grant Document"; WHEREAS, thereafter,the City constructed a public trail over the Grantee's land; WHEREAS, a subsequent survey of the Permanent Easement Premises revealed an error in the legal description used to define the Permanent Easement Premises as compared to the physical location of constructed public trail; and WHEREAS,the Parties to this Agreement desire to correct this error by vacating the easement granted on March 16, 2010, and granting a new trail easement, using a correct legal description matching the physical location of the constructed public trail. WITNESSETH: VACATION OF PERMANENT TRAIL AND WALKWAY EASEMENT The City, as Grantor, in consideration of the sum of One Dollar ($1.00), and other good and valuable consideration to it in hand paid by the Grantee, including the Grantee's agreement to enter into a new grant of a permanent public easement in favor of the City to accommodate its existing public trail across the Grantee's lands, does forever vacate, release, abandon and allow to revert back to the Grantee, its successors and assigns, all of its rights to the existing perpetual public easement previously granted for the purpose of constructing and modifying a public trail over, across, on, and through land situated within the County of Anoka, State of Minnesota, legally described on the attached (Exhibit A) ("Permanent Easement Premises"); and thereby does vacate all rights as described in the Grant Document. The vacation of rights described herein does not interfere with any future or separate grant of rights by Grantee to Grantor. IN WITNESS WHEREOF,the City, at Grantor has signed this Vacation of Permanent Public Easement on the day and year first above written.
