The attachments include a Bird's Eye view, a Street Level view, and a material list. Starting with the Bird's Eye view, it is our intent to install an asphalt area for our employee parking. We plan to install a 6 feet high wood fence (see material list slide 1). The wood fence will continue along the south side property line until it connects to the city's chain link fence. A roiling privacy chain link gate (see slide 2) will be installed from the South East corner of the maintenance building to the area behind the wood fence. The wood fence constructed on the North side of the property will be the same style (slide 1) and 8 feet tall. The fence will continue along the west property line connecting to the chain link fence of the city's water tower parcel. The area behind the fence and the maintenance building our plan is to install a dustless clear rock product. This is a 4 to 11/2" angular rock (slide 3). The Bird's Eye view also depicts our plan for equipment parking and storage bins for landscape materials. These bins will be installed on top of concrete or asphalt pads. The Street Level view depicts our concept for landscaping and building color. This portrays our beautiful landscaping talents showing our high quality work and high end materials. These enhancements will run along the entire frontage of the property. The maintenance shop will be painted in a Taupe color blending with the office building and other surrounding properties. The employee parking area, our thoughts are to plant trees, shrubs, and grasses to soften the appearance. In front of the office our plan is to landscape installing mulch, shrubs, flowers, and grasses (see the material list of suggested items). This letter is a brief overview of our intentions of improvements at 7087 20th Avenue South. The items will be discussed further at the Planning Commission meeting on November 3, 2014. Findings and Decision The Planning & Zoning Commission met on December 2, 2014, to hold a public hearing to consider a request of Alex's Lawn & Turf, LLC for a conditional use permit for property located at 7087 20th Avenue. FINDINGS: 1) The Planning and Zoning Commission heard and considered all testimony of interested persons submitted in writing prior to and in person during the public hearing. 2) The proposed use may be operated in the B-1 zoning district subject to a Conditional Use Permit with reasonable conditions. 3) The proposed use is consistent with the Comprehensive Plan. 4) The applicant is willing to conform to conditions in the draft Conditional Use Permit attached hereto. RECOMMENDATION: The Planning Commission finds that the standards for granting a Conditional Use Permit have been met and recommends that the City Council approve the Conditional Use Permit, subject to the conditions contained in the draft CUP attached hereto. CITY COUNCIL DECISION: Findings and recommendation are adopted by the Council this 10th day of December, 2014. Subject to the terms and conditions set forth herein, the City of Centerville hereby grants approval of a conditional use permit for: Alex's Lawn and Turf, LLC to operate a landscaping business and subject the conditions of this permit. 2. Property. The permit is for the following described property: 7055 21st Avenue 3. Conditions. This permit is issued subject to the following conditions: a) This permit anticipates owner will use the site in conformance with the site plan attached hereto and identified as Exhibit A. b) Applicant will pave with asphalt the front 60 feet of the lot for employee and visitor parking. c) Applicant will pave the balance of the site with clear, 3/ -1 %2 inch angular lime rock (not crushed) to provide a dust free,but permeable surface. d) Applicant will fence the portion of the property back of the front line of the building with wood privacy fence, except that the easterly portion shall be six foot chain-link with privacy slats. e) Applicant shall provide a movable gate to allow access for the city, its employees and agents to access the water tower and related facilities. f) Applicant shall be permitted to have up to ten bins, installed on asphalt or concrete surface, with open storage of landscape materials in conformance with the site plan, Exhibit A. g) Fertilizers, salt and similar chemicals shall be stored only within the building, or on an asphalt or concrete paved surface and shall be covered with a roof or tarp, in compliance with City Code,when not in active use. Any spilled materials shall be promptly cleaned up and properly disposed of. h) Vehicles with damaged or missing body parts and inoperable vehicles, shall be stored only inside a building. i) No parking of vehicles shall be permitted on the street at any time. DRAFT 7087 20`x'Avenue 233122140004 j) Bulk gasoline or other fuels shall not be stored on site and there shall be no exterior storage of containers of lubricants or other chemicals. k) Vehicles with leaking oils or other fluids shall be promptly repaired and any spilled oils and fluids shall be immediately cleaned up and properly disposed of. Any spills of fuels,lubricants of more than one gallon, and spills of any toxic chemical shall be promptly cleaned up and properly disposed of and shall be reported within twenty-four hours to the City. 1) The site shall be landscapted and buildings shall be painted in accordance with the application letter dated October 30, 2014. m) Limits on the noise emitted at the property line shall conform to the noise regulations contained in City Code Section 91.09 and the use is subject to other nuisance regulations contained in Chapter 91. n) Landowner and the business operator shall jointly and individually be responsible for the continuing conformance with the permit and that if the proposed use is not initiated within six months of this date, the permit shall be void. i) Grantee will follow the applicable standards and requirements of the City of Centerville, Rice Creek Watershed District, Anoka County, Army Corp of Engineers, FEMA, Minnesota DNR and any other agency having jurisdiction over the property and shall secure and file with the City, any permits required by outside agencies. j) The City reserves the right to annually review this permit for compliance with the conditions and may impose additional conditions to mitigate unforeseen problems. 4. The Planning&Zoning Commission met on December 2, 2014, to consider a request of Shane Krueger on behalf of Shane's Auto, LLC, for a Conditional Use Permit(CUP)to operate a vehicle repair business at 7139 201h Avenue, City of Centerville. Findings: 1) The Planning and Zoning Commission heard and considered all testimony of interested persons submitted in writing prior to and in person during the public hearing. 2) The proposed use may be operated in the B-1 zoning district subject to a Conditional Use Permit with reasonable conditions. 3) The proposed use is consistent with the Comprehensive Plan. 4) The applicant is willing to conform to conditions in the draft Conditional Use Permit attached hereto. RECOMMENDATION. The Planning Commission finds that the standards for granting a Conditional Use Permit have been met and recommends that the City Council approve the Conditional Use Permit, subject to the conditions contained in the draft CUP attached hereto. Subject to the terms and conditions set forth herein, the City of Centerville hereby grants approval of a conditional use permit for: Shane Krueger and Shane's Auto, LLC, 7139 20th Avenue to operate an auto repair business and subject the conditions of this permit. 2. Property. The permit is for the following described property: 7139 2e Avenue 3. Conditions. This permit is issued subject to the following conditions: a) No more than seven vehicles awaiting repairs shall be stored on the site at any one time and shall be parked only on a paved surface. Inoperable vehicles shall not be stored outside a building for more than three business days. b) Vehicles with damaged or missing body parts shall be stored only inside a building. c) No more than two vehicles offered for sale shall be parked on the front of the property at any time. Vehicles shall be parked only on paved surfaces. d) A minimum of two spaces in front of the building shall be reserved for customer parking and not used for employees or vehicles for sale and shall be sign-posted accordingly. e) No parking of vehicles shall be permitted on the street at any time. f) Bulk gasoline or other fuels shall not be stored on site and there shall be no exterior storage of containers of lubricants or other chemicals. g) Vehicles with leaking oils or other fluids shall be promptly repaired and any spilled oils and fluids shall be immediately cleaned up and properly disposed of. Any spills of more than one gallon shall be reported within twenty-four hours to the City. DRAFT DRAFT DRAFT 11/26/2014 h) Limits on the noise emitted at the property line shall conform to the noise regulations contained in City Code Section 91.09 and other nuisance regulations contained in Chapter 91. i) Testing of gasoline engines and other noise producing equipment shall be limited to the hours of 7:30 a.m. to 7:00 p.m., Monday through Saturday. j) Landowner and the business operator shall jointly and individually be responsible for the continuing conformance with the permit and that if the proposed use is not initiated within six months of this date, the permit shall be void. i) Grantee will follow the applicable standards and requirements of the City of Centerville, Rice Creek Watershed District, Anoka County, Army Corp of Engineers, FEMA, Minnesota DNR and any other agency having jurisdiction over the property and shall secure and file with the City, any permits required by outside agencies. j) The City reserves the right to annually review this permit for compliance with the conditions and may impose additional conditions to mitigate unforeseen problems. 4. Motion carried. 3. Concept Plan-Watermark Subdivision of Lino Lakes. Commissioner Koski gave a report on the Watermark Subdivision, having attended the Lino Lakes Planning and Zoning meeting in October. He indicated that the Lino Lakes Planning Commission is aware of the concerns expressed by this body with regard to the street connection at 73rd Street. He was unsure what if anything, they would do about the comments received from Centerville. V. NEW BUSINESS 1. Request for Conditional Use Permit—7087 20th Avenue, Alex's Landscaping. The Commission received a request for conditional use permit from Alex Shuda,Alex's Landscaping. Mr Shuda was present to explain his plans to buy the City property at 7087 20th Avenue for his landscape business. He explained his plans for paving and fencing. He indicated that he plans to enhance the property with landscaping, as well.
