February 11, 2015 City Council Meeting Minutes City of Centerville Council Meeting Minutes February 25,2015 Mayor Wilharber provided Council Members with an opportunity to amend the presented minutes. Motion by Council Member Paar, seconded by Council Member King, to approve the minutes of the February 11, 2015 City Council Meeting as presented All in favor. Motion passed. VII. CONSENT AGENDA 1. Motion by Council Member Paar, seconded by Council Member King to approve the Consent Agenda as presented. All in favor. Motion passed. VIII. AWARDS/PRESENTATIONS/APPEARANCES 1. Ms. Nancy Johnson, 7260 Unity Avenue, Centerville Lions Representative — Recap 1St Annual Lynn Johnson Memorial Ice Fishing Contest Ms. Johnson thanked staff, Council, sponsors, volunteers, Lion members, Anoka County Parks, Centennial Police & Fire, Waste Management, and Benson Airport's American Young Eagles Club. Ms. Johnson stated that without all of the individuals and businesses the contest would not have been able to take place. Ms. Johnson also stated that 1,100 holes were drilled prior to the contest starting, 974 tickets for holes and 908 raffle tickets were sold, prizes were awarded for the first through thirty fish caught along with the largest one through ten caught. Ms. Johnson stated that the Lions sold out of chili but also sold bouya, chips, hot dogs, coffee, hot cocoa, beer, adult beverages on the ice. Ms. Johnson also stated that people came for all over Minnesota to enjoy the fishing contest but to also patronize local establishments. Mayor Wilharber thanks those that both participated either through attendance, assistance or sponsorships and stated that it was a well-attended event. IX. OLD BUSINESS 1. Review of Bids—2015 Street Improvement Project Page 2 of 9 City of Centerville Council Meeting Minutes February 25,2015 Engineer Statz reminded Council that the City received bids just prior to the last Council meeting, lowest bid was $503,900.50 and the bid included all of the work being completed by the contractor which is different from last year's project where materials and labor were bid separately and Public Works completed some of the smaller work. Finance Director Paulseth noted that the City had $465,000 in special assessments, $90,000 in surplus from 2014 and $200,000 budgeted for streets in 2015. Ms. Paulseth felt that the funding was available even with the obligations outstanding for the CSAH2 1/Centerville Road project. Ms. Paulseth stated that funds would be utilized from the general fund along with the water and sewer funds associated with that project. Discussion ensued regarding the CSAH21/Centerville Road project and its cost of $700,000, funding coming from $300,000 general fund, $200,000 water fund and $200,000 from the sewer fund, concerns for overruns on the project, concerns for the downtown colored concrete intersection, street maintenance fund balance remaining at $100,000 and $200,000 being budgeted for the upcoming year which could delay further street upgrades and assessment amounts for last year's project ($500) versus this year's amount of$525 and $15,000 remaining to be paid from the assessments of last years' project. Discussion ensured regarding the process for determining the assessment amount, the timeframe for accepting the bids, parade route, completion dates, no need for road closures or detours associated with the project and project differences from the previous year and this year not experiencing manhole versus roadway level problems. Motion by Council Member Fehrenbacher, seconded by Council Member Paar to direct Staff to schedule a special assessment public hearing assessing each benefiting proyerty $525 for the 2015 Mill & Overlay Proiect. Discussion ensued regarding raising the levy versus large special assessments to complete projects similar in the future, intent of obtaining all roadways in good condition within its projected period of time, Council Member Love's desire to levy for the projects versus estimating assessments or projecting amounts that may prove to be incorrect or not allow repairs in the future. Council Member Love opposed. Motion passed. 2. Res. #15-OXX—Relating to the Proffered Settlement Agreement by the White Bear Lake Restoration Association Relating to Regionalization of Municipal Drinking Water Supplies & Northeast Water Summit/Minnesota Department of Natural Resources Groundwater Management Area Project. Administrator Ericson stated that at Council's previous meeting, staff was directed to draft a resolution in opposition to the settlement agreement and reflect Centerville's position with the inclusion of the potential for impact on Centerville, Centerville Lake levels, and etc. Page 3 of 9 City of Centerville Council Meeting Minutes February 25,2015 City Attorney Glaser stated that he added the very last bullet point "The unique impact on the City of Centerville from this settlement includes the potential use of the Saint Paul Regional Water Service facilities located in Centerville to pump water out of Centerville Lake to serve the region's needs. The drawdown of Centerville Lake could have negative environmental impacts." Council Member King requested that language be added that the Metropolitan Council designed the regional water supply project and Council concurred. Administrator Ericson stated that if Council desired Staff would forward the resolution to legislators, Metropolitan Council, Minnesota Department of Natural Resources and local representatives from neighboring communities. Motion by Council Member Kinn, seconded by Council Member Love to Approve Res #15-008 and its forwarding to appropriate entities. All in favor. Motion passed. 3. Reaffirming Final Plat, 6995 — 201h Avenue South with Promissory Note for Park Dedication Fees Lot 1 ($3,806, Center Villa, Second Addition) Attorney Glaser stated that the Lessard's had been given 60 days to file the approved plat, they did not do so due to the existing tenant's financing falling through. Attorney Glaser stated that another buyer is in place, the plat needs to reaffirmed and a requirement of the reaffirmation was that park dedication fees be paid in the amount of$3,860. Attorney Glaser also stated that the Lessard's have requested that they be allowed to enter into the submitted Promissory Note rather than paying the fees up front. Attorney Glaser stated that if the Lessards' fail to comply with the Promissory Note, a lien will be placed against the proceeds of the sale and if a sale does not occur,the $3,860 will be assessed to their property taxes commencing 2016. Administrator Ericson stated that Mechanical Air Systems, Inc., an HVAC company, has shown interest in the property and has submitted for a Conditional Use Permit. Administrator Ericson also stated that the Planning & Zoning Commission would be considering scheduling a public hearing at their next meeting. Administrator Ericson stated that Mechanical Air Systems, Inc. is a reputable company with fourteen (14) employees, Miller Mobile Marine will unfortunately be vacating the property at the end of April and staff has met with the potential buyers regarding their use of the building, outside storage and fire suppression requirements which are not needed. Motion was made by Council Member Fehrenbacher, seconded by Council Member Love to reaffirm Council's previous approval for Final Plat of 6995 — 20'h Avenue South as submitted and Promissory Note for Park Dedication Fees ($3,860 for Lot 1, Center Villa, Second Addition as presented. All in favor. Motion carried. 4. CSAH21/Centerville Street Reconstruction — St. Paul Regional Water Agreement (6th Rider) Allowing for 48" Culvert Installation& Maintenance Administrator Ericson stated that it is critical that this agreement is completed allowing the City's replacement of the culvert that is in disrepair on their property. Engineer Statz stated that Legal Counsel and himself had been working with Mr. Bill Tschida, Unit Supervisor, St. Paul Regional Water Services to obtain an agreement to allow for the replacement. Attorney Glaser Page 4 of 9 City of Centerville Council Meeting Minutes February 25,2015 stated that the City and St. Paul Regional Water Services entered into an agreement in 1966 and that to move forward with the culverts replacement an amendment would need to be obtained from them. Both entities understand that the work needs to be completed, however, financial responsibility for each entity's infrastructure is of major concern. Engineer Statz also stated that this situation is very unique due to the placement of piping above the structure that needs to be replaced and ownership and financial responsibility due to the construction and going forward. Engineer Statz stated that it has been agreed that the Regional Water Service will temporarily suspend their pipe allowing for the replacement of the culvert. Attorney Glaser stated that the original 1966 agreement places all blame and liability for any problems with St. Paul Regional Water Systems' infrastructure on the City but this agreement will make St. Paul Regional Water Systems liable during this construction phase. Mayor Wilharber questioned the use of the City's trailway connecting to the Rice Creek Chain of Lakes Regional Parks trailway during this construction. Engineer Statz stated that the County would be placing detour/trailway closure signage and that it was anticipated to be closed for up to two (2) months. Motion by Council Member Paar, seconded by Council Member Fehrenbacher to approve the submitted 6 1h Rider to Agreement (St. Paul Regional Water Systems/City of Centerville) as presented. All in favor. Motion carried. X. NEW BUSINESS 1. Request of Ms. Anna Marple, Tenant, 1965 South Robin Lane, for Deaf Child Signage Administrator Ericson stated that Ms. Marple has provided the City with a formal request for signage within the Royal Meadows Development and that Staff is looking for direction regarding this item. Administrator Ericson stated that it was anticipated that two (2) signs and posts would cost approximately $125/sign. Administrator Ericson suggested that City Engineer Statz and the Public Works Staff work together regarding placement of the signage. Discussion ensued regarding false sense of security with the signage, 30 mile per hour speed limit posting, street's narrowness and inability to exceed 30 miles per hour and Ms. Marple's notification of moving from the City or change in household dynamics when it occurs. Motion by Council Member Love, seconded by Council Member Paar to install two (2) "Deaf Child" signs and posts ($125/sign) with securing an agreement with Ms Marple for notification of moving or change in household dynamics. All in favor. Motion carried 2. Res. #15-009— Supporting the Transfer of Firefighter Service Credits and Pension Assets from the Centennial Fire Relief Association to the City of Lino Lakes Administrator Ericson stated that this item is being brought forth on behalf of the fire fighters due to Lino Lake's decision to leave the Centennial Fire District and allowing those fire fighters that desire to be hired by Lino Lakes the portability of their service credits and pension assets Page 5 of 9 City of Centerville Council Meeting Minutes February 25,2015 that current reside with the Centennial Fire District to be brought to the City of Lino Lakes as of January 30, 2015 Motion by Council Member Paar, seconded by Council Member Love to Approve Res. #15- 009 — Supporting the Transfer of Firefighter Service Credit and Pension Assets from the Centennial Fire Relief Association to the City of Lino Lakes as presented. All in favor. Motion carried. Attorney Glaser stated that language is being crafted so that this item can be taken to the legislature for action. 3. Review& Comment—Metropolitan Council's Draft Water Resources Policy Plan Administrator Ericson stated that the Metropolitan Council has requested written comments from the City regarding their plan. Administrator Ericson stated that if Council Members desired they could review the document and submit their concerns to staff but staff would also be reviewing it. Administrator Ericson also stated that the comments were due the middle of March and if he heard of other communities having concerns or adverse requirements involving northern cities he would incorporate them in Centerville's comments. Motion by Council Member Love, seconded by Council Member King to table this item to Council's next regularly scheduled meeting of March 11, 2015. All in favor. Motion carried. XI. COUNCIL & ADMINISTRATION ANNOUNCEMENTS 1. Administrator Report a. City of Lion Lakes Email Correspondence — Administrator Ericson stated that at Council's last meeting Staff was instructed to forward to the City of Lion Lakes its opinion regarding their request to leave the Fire District on January 1 rather than follow the January 30, 2016 date in the amended Joint Powers Agreement for the District. Administrator Ericson also stated that due to Circle Pine's response and the City of Centerville's response to their request, no meeting was needed for February 26, 2015 where they anticipated that they would be voting on the matter. 2. Council & Staff Reports a. Council Member King stated that as he reported previously that Century Link will be competing for cable service customers against Comcast shortly. Mayor Wilharber stated that the City's annual audit has commenced and desired to compliment Ms. Sweeney for her additional work and Ms. Paulseth for her work. Members of both the Parks & Recreation Committee and the Planning & Zoning Commission offered items to be included in Council's Goals and Council incorporated them. Staff was directed to modify the previously submitted goals accordingly. Mayor Wilharber closed the Joint Work Session at 8:33 p.m. and re-opened the Regularly Scheduled Council Meeting to again Close the Meeting for the Closed Executive Session. XII. Findings and Decision The Planning & Zoning Commission met on March 3, 2015, to consider taking action to authorize the residential use of Lots 2, 9, 10, 11, Block 3, Centerville. (The "subject property".) OTHER WELLS MANAGEMENT The presence of other wells within the City's DWSMAs presents the potential for contamination sources, at or near land surface,to be rapidly introduced into the aquifer used by the City's wells. Eventually, all wells become unused or unusable. State law requires unused wells to be properly sealed. However, the location and status of wells has not been adequately monitored. A. Seal Abandoned Wells Objective: Enhance the protection of the City's wells by Cooperating with the MDH Well Management Program to seal all abandoned wells within the DWSMAs. Actions: (1) The Wellhead Protection Plan Manager will investigate potential sources of financial assistance and the establishment of a program to assist property owners in sealing their abandoned wells. The investigation will include Federal and State grant programs and a City low-interest loan program. (2) The Wellhead Protection Plan Manager will notify property owners with the probability of a well located on their property. The notification will include contact numbers for property owners to obtain consultative services regarding methods to locate and seal abandoned wells and an announcement of a public informational meeting. (4) The Wellhead Protection Plan Manager will request that the MDH provide a copy of well sealing reports. The location of the sealed wells will be verified and placed in the building officials parcel files. (5) The Building Official will incorporate the list of probable wells into the City's Building 2007-12-12 Page 18 Centerville Wellhead Protection Plan (Part 2) records. When application is made to demolish a building the records will be reviewed to determine if a well search is required. Cooperator(s): Minnesota Department of Health and Anoka County Environmental Services. Time Frame: 5 years from the approval of the plan. Estimated Cost: ($0.20 per parcel within DWSMA) Goal Achieved: (1) Completion of the investigation and actions initiated. (2) Completion of notification to property owners. (3) Completion of public meeting. (4) Incorporation of probable well sites into City parcel files. B. Monitor Well Construction Objective: Cooperate with the MDH Well Management Program to monitor and maintain accurate records of the construction of wells within the City. This project will improve the location accuracy of constructed wells by having a local official verify the location information submitted by the licensed well contractor. Actions: (1) The City Wellhead Protection Plan Manager will request the MDH to provide a copy of reports for new well construction in the City. The City will place the copy into the building official's file for the parcel. If information regarding the location of the well is insufficient to determine the parcel location - the City will notify the MDH and request that they follow up with the licensed well contractor to obtain sufficient information. (2) The City Building Official will place the copy of the well record in the parcel file which is reviewed when application is made for building permits or lot development. (3) The City Utilities Department will require owners of buildings that switch from a private well to City water submit a copy of the well sealing report within 6 months. If the well remains in use the property owner must submit a statement of the intended use of the well. The well sealing report or statement of intended use will be forwarded to the building official to be place in the parcel file. Cooperator(s): Minnesota Department of Health.
