PRESENT: Mayor Tom Wilharber Council Member Jeff Paar Council Member Steve King Council Member D. Love Council Member Ben Fehrenbacher ABSENT: None. ` STAFF: City Administrator Mike Ericson - Legal Counsel Kurt Glaser Engineer Mark Statz Finance Director Ellen Paulseth Public Works Maintenance Technician Tedd Peterson L CALL TO ORDER Mayor Wilharber called the meeting to order at 6:30 p.m. II. PLEDGE OF ALLEGIANCE III. APPOINTMENTS/PRESENTATION I. Commissioner Rhonda Sivarajah a. Legislative Update b. I-35/Trunk Highway 97 & CSAH 32 Ramps Anoka County Commissioner Sivarajah introduced herself to Council and stated that she was here to provide Council with an and update on what has been happening within the County. Commissioner Sivarajah stated that she was aware of the City's opposition to the White Bear Lake Lawsuit Settlement, stated that five (5) suburban counties are participating in discussions for items for Metropolitan Council and issues that they will pursue in the future. Commissioner Sivarajah stated that the County would like the City's support regarding the entire reconstruction of bridge located at the intersection of 1-35/Trunk 97, explaining that the existing bridge is in major disrepair, deficient in size and is a public safety hazard. Commissioner Sivarajah stated that the County/MN Dot is requesting Federal funding in the amount of 25 1 City of Centerville Council Meeting Minutes March 25,2015 million for the project and it is believed that this is a major thoroughfare for traffic to St. Paul and surrounding suburbs. Commissioner Sivarajah desired to draw attention to an upcoming Senior Expo that would be taking place on April 11, 2015, from 9:00 a.m. to noon at Lord of Life Church in Ramsey where they will be a free breakfast and a wealth of information specific to seniors and their families. Council Member King questioned whether the bridge construction would be a cost sharing project or how funding would work. Commission Sivarajah stated that if the County completed the work they would not get the entire funding of 25 million is would be closer to 8-9 million. Commissioner Sivarajah stated that that is why the resolution before Council this evening is so important in gaining surrounding communities support and the County's continuing efforts to work in conjunction with MN Dot, and the Cities of Columbus and Forest Lake. Commissioner Sivarajah stated that she has enjoyed working with Administrator Ericson in the past and looked forward to a successful working relationship with Centerville Staff. 2. Greg Kieselhorst, Centerville Lions Request for Permits Associated with Annual Lions Cadillac Dinner Mayor Wilharber suggested placing repeated annual requests for events to be placed in the Consent Agenda going forward. Council concurred stating that they have not experienced issues with the event in the past. Lion Member Kieselhorst stated that the Lions are requesting a raffle permit and temporary liquor license for their Cadillac Dinner event scheduled for April 18, 2015 commencing at 6:00 P.M. — 10:00 P.M. OPEN FORUM Mr. Charles Reinhardt, 1723 Meadow Lane Mr. Reinhardt stated that he believes that his neighbor at 1743 Meadow Lane constructed a fence approximately six (6) years ago and it is located on his property. Mr. Reinhardt stated that he is removing some additional wiring that allowed a buffer between his dogs and Mr. Rivard's and has concerns for the safety of his dogs. Mr. Reinhardt stated that he generally is a passive person but when he approached the City regarding this matter they suggested participation in Mediation Services for himself and his neighbor in an attempt to repair the neighborly relationship that apparently has broken down. Mr. Reinhardt stated that he has attempted to work with Mr. Rivard regarding the location of the existing fence and cost sharing the placement of a fence along Mr. Rivard's property rather than abutting the fence up against Mr. Reinhardt's which is placed 2' from the property line. Several members of Council felt that the City addresses ordinance violations via complaints and Mr. Reinhardt was filing a complaint. Legal Counsel Glaser stated that in his experience with similar neighborly relationships, participation in mediation has resolved these issues and Page 2 of 9 2 City of Centerville Council Meeting Minutes March 25,2015 encouraged the two individuals to participate. Legal Counsel Glaser stated that both individuals have been provided with information regarding Mediation Services along with their original fence applications and permits. Ms. Robyn Moore, 7353 —201h Avenue North Ms. Moore presented Council with information regarding glyphosate, which is a herbicide developed by Monsanto and sold under the trade name Roundup. Ms. Moore stated that studies have proven it to be a carcinogenic to humans, would like to see its residential usage banned within the City as in other states and cities and on crops that we all eat. Ms. Moore stated that this is a very serious issue being that it not only is transferred to humans through air particles but through the soil as it remains in soil that has been treated for years and placed on crops that are consumed by humans. Ms. Moore stated that not only does the product cause cancer but it is also linked to autism, Parkinson's Disease and other deficiencies in humans/babies. Council Member King desired additional information from Ms. Moore and Mayor Wilharber directed staff to ascertain whether the League of MN Cities, Federal or State agencies were in the process of handling concerns similar in nature to Ms. Moore's. Ms. Moore stated that she would remain in contact with the City regarding the matter. IV. PUBLIC INPUT/HEARING 1. Storm Water Pollution Prevention Program/MS4 Annual Report Motion by Council Member Fehrenbacher, seconded by Council Member Love to open the Public Input Meeting at 7:10 p.m. All in favor. Motion carried. Engineer Statz stated that as a storm sewer system operator and permitted by the State of Minnesota for discharging these waters within the metropolitan area and as requirements we must provide an opportunity to residents to review the City's annual report and provide comment. Engineer Statz also stated that the report addresses public education, conditions of storm ponds, pond dredging, street sweeping, etc. Mayor Wilharber questioned whether anyone in the audience desired to comment on the item and no comments were made. Motion by Council Member Fehrenbacher, seconded by Council Member Love to close the Public Input Meeting at 7:13 p.m. All in favor. Motion carried. 2. Proposed Assessments—2015 Mill & Overlay Street Project Motion by Council Member Fehrenbacher, seconded by Council Member King to open the Public Hearing for Proposed Assessments — 2015 Mill & Overlay Street Proiect at 7.14 p.m. All in favor. Motion carried. Page 3 of 9 3 City of Centerville Council Meeting Minutes March 25,2015 Engineer Statz stated that this is the second of two hearings required as part of the 429 assessment process, received bids several meetings prior and requested that Finance Director Paulseth review funding of the project. Finance Director Paulseth stated that there is $200,000 in a revolving street fund, $200,000 carry over from the previous year and $443,000 in the budget prior to special assessments. Finance Director Paulseth stated that there would be approximately $100,000 remaining in the budget once the project was completed. Discussion ensued regarding replacement of the colored concrete in the downtown area, the priority for funding that project and best timeframe to complete the work (traffic control/closure,etc.), the city's pavement management plan, bids, and condition of roadways within the Royal Meadows Development. Public Works Maintenance Technician Peterson stated that the roadways within the Royal Meadows Development have remained safe and do not present a hazard. The streets are better than anticipated due to several issues receiving attention along with the water project last year. Public Works Maintenance Technician Peterson also stated that he felt that having the same contractor that was completing the work on Centerville Road working on the colored concrete intersections would ensure material quality, price discounting, and fend off traffic control issues with the projects being completed at different times. Additional discussion ensued regarding the payment management plan projecting smaller projects being addressed in 2016, an opportunity for the Royal Meadows Development being added during that year and questioned whether the lower bidder for the 2015 Mill & Overlay Project would honor his bid with the removal of the development. Engineer Statz stated that he would contact them to ascertain their desires. Mr. Tim Rehbine, 7062 Dupre Road, questioned the life expectance of seal coating and the mill and overlay process and why if the life expectance is doubled for the mill and overlay why are you assessing for it. Council Member Fehrenbacher stated that if the City did not assess for the project, taxes would need to be increased to cover the expenditures. Discussion ensued regarding previous costs of maintaining roadways (sealcoating/total reconstruction) and their associated assessments to residents and city costs, benefits to abutting property owners, extended life of the roadway and proposed cost of the assessment being $525. Legal Counsel Glaser stated that if any resident had objections to the assessments they needed to provide a formal appeal in writing including their name and address this evening and further objections would need to be filed with the courts. Council Member Love stated that he would be abstaining from voting on the item later in the meeting due to several issues; one being that he is scheduled to be assessed and does not agree with the assessment procedure with this project versus increasing taxes to complete the project. Motion carried. V. APPROVAL OF AGENDA Mayor Wilharber added Check #29261-29264, and the Mayor brought to members attention numbering issues with X. New Business, added Item #5, Res. #15-OXX — Ordering Improvement and Accepting Bid for Construction of Improvement, added Item #6, Res. #15- OXX — Adopting Special Assessments on 2015 Street Mill and Overlay Improvements. Mayor Wilharber also brought to the members' attention that Item 1. c., Centennial Fire District Update was added under Council & Administration Announcements. Motion by Council Member Love, seconded by Council Member King to approve the Agenda with the above stated amendments. All in favor. Motion passed. VI. APPROVAL OF MINUTES 1. March 11, 2015 City Council Meeting Minutes Mayor Wilharber provided Council Members with an opportunity to amend the presented minutes. Motion by Council Member Fehrenbacher, seconded by Council Member Paar, to approve the minutes of the March 11, 2015 City Council Meeting as presented. All in favor. Motion passed. VII. Motion by Council Member Fehrenbacher, seconded by Council Member Paar to approve Consent Agenda as presented. All in favor. Motion passed. VIII. OLD BUSINESS 1. None. Page 5 of 9 5 City of Centerville Council Meeting Minutes March 25,2015 X. NEW BUSINESS 1. Res. #15-013 — Supporting the Reconstruction of the Interstate 35/Trunk Highway 97 Bridge and CSAH32 Ramps Council discussed concern for financial obligation by supporting this resolution and it was determined that there was none. Motion by Council Member Love, seconded by Council Member King to adopt Res. #15- 013 — Supporting the Reconstruction of the Interstate 35/Trunk Highway 97 Bridge and CSAH32 Ramps with the removal of Forest Lake and replacement of Centerville in the fourth Whereas as Amended. All in favor. Motion carried. 2. Centerville Lions Request for Permits Associated with Annual Lions Cadillac Dinner — April 18, 2015 6:00 p.m. — 10:00 p.m. &Waive Fees a. 1 to 4 Day Temporary/Event On Sale Liquor License b. Raffle The item was previously discussed. Motion by Council Member Fehrenbacher, seconded by Council Member Paar to Approve the Requests of the Centerville Lions for Permits Associated with their Annual Lions Cadillac Dinner with Fees being Waived as presented. All in favor. Motion carried. 3. MCMA Intern Program Administrator Ericson stated that he felt the program was strong for both the intern and the city as both good benefit from expertise of each other and matching grant funds. Administrator Ericson stated that he would formulate a job description for the intern with a focus on the goals of Council. Administrator Ericson stated that traditionally this a 3-6 month position and he would speak with the Finance Director regarding funding. Council Member King questioned the grant funds and how they are obtained. Administrator Ericson stated that the funds are obtain from the MCMA which receives its funding through memberships, donations and professionals giving back. Motion by Council Member Love, seconded by Council Member King to Approve the Submission of the MCMA Internship Program Application as presented. All in favor. Motion carried. 4. Hugo Area Business Association Membership Page 6 of 9 6 City of Centerville Council Meeting Minutes March 25,2015 Administrator Ericson stated that the city is already a member of the Quad Area Chamber of Commerce which provides networking for businesses and others with similar interests; however, the Hugo Area Business Association would also provide the same opportunities. Council felt that is was a minimal cost ($165/year) and would benefit the city. Motion by Council Member Fehrenbacher, seconded by Council Member Love to approve membership in the Hugo Area Business Association by the City of Centerville as presented. All in favor. Motion carried. 5. Res. #15-014 — Ordering Improvement And Accepting Bid for Construction of Improvement Engineer Statz stated that Council must consider moving forward with the project as is or modifying to remove any part(s) of it. Engineer Statz stated that a change order can be made to exclude things from the original bid such as the Royal Meadows Development is Council chooses. Mr. Stanley Angerhofer, 1989 Cardinal Drive, questioned when and what was going to be done within his development (Royal Meadows). Council questioned Mr. Angerhofer as to the effects of delaying the work within his development would have on him. Mr. Angerhofer did not believe it would be an issue if Council deferred the area to a later date. Mr. Angerhofer also questioned why a mill and overlay does not come out of taxes similar to a seal coating. Engineer Statz again stated that the life expectancy of the road way would be extended longer than if it was sealcoated and there is much more of an expense to provide the mill and overlay. Additional discussion occurred regarding removing Robin Lane North, South, West and Cardinal Drive, funding, assessments, and the $120,000 quote for reconstructing of the downtown intersections. Motion by Council Member Paar, seconded by Council Member Fehrenbacher to Approve Res.#15-014—Orderiny- Improvement and Accepting Bid for Construction of the 2015 Mill & Overlay and Authorize Engineer Statz to Complete a Chany-e Order for the Removal of Robin Lane North, South,West and Cardinal Drive From the Original Bid. Discussion ensued regarding the amount that would be saved by this change order ($175,000), future budgeting and consideration of adding the Royal Meadows Development back into the projects for 2016 or 2017 and funding for completing for the entire project as bid and the concrete intersection. Finance Director Paulseth stated that if Royal Meadows was removed and the colored concrete intersections were completed this year there would be a amounts remaining for overages; however, if both projects were completed in their entireties there would be no funds for overages. Page 7 of 9 7 City of Centerville Council Meeting Minutes March 25,2015 Mr. Angerhofer questioned the cost of the assessment in 2017 if that is when the Royal Meadow Development would be added back in and Council stated that would be up to the Council at that time with public hearings being held similar to this evening. All in favor. Motion carried. 6. Res. #15-015 — Adopting Special Assessments for the 2015 Street Mill and Overlay Improvement with the Deletion of Robin Lanes North, South, West and Cardinal Drive Legal Counsel Glaser stated that Staff has provided two separate resolutions for Council to choose from; one resolution has the option to impose interest 30 days from this evenings meeting if the resolution is adopted and the other has the option to impose interest as of July 1, 2015. Legal Counsel Glaser also stated that Council must determine the period that the assessment will run, three (3), four(4) or five(5) years. Engineer Statz stated that he felt that July 1, 2015 would be a good date as the project should be completed by that date. Discussion ensued regarding the amount of the assessment and whether it could be deceased if Council desired. Legal Counsel Glaser concurred. Motion by Council Member Paar, seconded by Council Member Fehrenbacher to Adopt Res. #15-015 — Adopting Special Assessments for the 2015 Street Mill and Overlay Improvement with the Deletion of Robin Lanes North, South,West and Cardnal drive for a period of three (3) Years Interest will Commencinp- July 1, 2015. Council Member Love abstained. Motion carried 4/0. XI. COUNCIL & ADMINISTRATION ANNOUNCEMENTS 1. Administrator Report a. Metro Cities Annual Meeting, Thursday, April 16, 2015, 5:30 p.m. — 8:00 p.m. — Administrator Ericson stated that if any Council Member were interested Staff would RSVP for them and properly notice the meeting. b. NE Metro Water Summit — April 9, 2015 — Administrator Ericson stated that he and the Mayor would be in attendance. C. Centennial Fire District Update — Administrator Ericson stated that the two (2) Mayors and Administrators met on Monday to discuss the 2015 budget and continued commitments of the two (2) cities to work together and that the Fire Chief Pat Devaney has given notice of his intent to terminate his employment as of April 13, 2015. 2. Council & Staff Reports Page 8 of 9 8 City of Centerville Council Meeting Minutes March 25,2015 Council Member Fehrenbacher stated that he and Administrator Ericson participated in a recent Centennial Lakes Police Department Governing Board meeting where they were given instruction on the use of issued firearms to all officers within the department. Council Member Paar desired to have staff forward a reminder that the Fire Steering Committee meeting would be taking place at the Circle Pines City Hall and no longer at the Lino Lakes Fire station. Council Member Paar also stated that their next meeting was scheduled for April 9, 2015. Mayor Wilharber requested that Council Member Love be in attendance. Mayor Wilharber stated that Centerville Road will be closed from Main Street to Dupre Road commencing April 6, 2015 and only those that live within the vicinity or owner a business will have access through that area. The Centennial Lakes Police force will be enforcing allowable access due to the safety of the construction crew members. XIII. The contractor shall provide a steel support beam and Board forces will chain the conduit to the beam, observe the culvert construction and backfilling, and remove the chain. 2. Conditions All work shall be performed in accordance with good engineering practices and in accordance with approved plans for the CSAH Reclaim/Overlay and Reconstruction Project S.A.P. 002-621-010 on file in the offices of Board and City. 3. Notification Permittee or Permittee's contractor shall notify Board's Vadnais Supervisor at least 48 hours in advance of permitted activity to schedule inspection and coordination of work. The German Institute for Risk Assessment responded that the work group reviewed only a selection of what they had reviewed earlier,and argued that other studies among which the well-cited cohort study Agricultural Health Study do not support the classification.m The IARC report did not include the German regulatory study published in December 2014, nor did it include industry-funded studies.The IARC also does not conduct risk assessment:their goal is to classify carcinogenic potential, and "a few positive findings can be enough to declare a hazard,even if there are negative studies as well. Glyphosate (N-(phosphonomethyl)glycine) is a broad-spectrum systemic herbicide used to kill weeds, especially annual broadleaf weeds and grasses known to compete with commercial crops grown around the globe. In 2007, glyphosate was the most used herbicide in the United States agricultural sector, with 180 to 185 million pounds (82,000 to 84,000 tonnes) applied, and the second-most used in home and garden market where users applied 5 to 8 million pounds (2,300 to 3,600 tonnes); in addition, industry, commerce, and government applied 13 to 15 million pounds (5,900 to 6,800 tonnes).'''With its heavy use in agriculture, weed resistance to glyphosate is a growing problem. While glyphosate and formulations such as Roundup have been approved by regulatory bodies worldwide and are widely used, concerns about their effects on humans and the environment persist. Glyphosate's mode of action is to inhibit an ewe involved in the synthesis of the aromatic amino acids: tyrosine,tryptophan, and phenylalanine. It is absorbed through foliage and translocated to growing points. Because of this mode of action, it is only effective on actively growing plants; it is not effective as a pre- emergence herbicide. Some crops have been genetically engineered to be resistant to glyphosate(i.e., Roundup Ready, also created by Monsanto Company). Such crops allow farmers to use glyphosate as a postemergence 1 21 herbicide against both broadleaf and cereal weeds,but the development of similar resistance in some weed species is emerging as a costly problem. Roundup Ready soybean was the first Roundup Ready crop. Regulatory and scholarly reviews of the toxicity of glyphosate found it to be relatively safe as an herbicide. Thr German Federal Institute for Risk Assessment published a toxicology review in 2013, which found that "the available data is contradictory and far from being convincing" with regard to correlations between exposure to glyphosate formulations and risk of various cancers, including non-Hodgkin 1 ren hp oma (NHL).w Volume 1,pp 6"6 A meta-analysis published in 2014 identified an increased risk of NHL in workers exposed to glyphosate formulations.' In March 2015 the World Health Organization's International Agency for Research on Cancer published a summary of its forthcoming monograph on glyphosate, and classified it as "probably carcinogenic in humans" (category 2A)based on epidemiological studies, animal studies, and in vitro studies. Human toxicity Human acute toxicity is dose-related. Acute fatal toxicity has been reported in deliberate overdose.[46][471 Early epidemiological studies did not find associations between long-term low-level exposure to glyphosate and any disease.[48][4911501 In 2013 the European commission reviewed a 2002 finding that had concluded equivocal evidence existed of a relationship between glyphosate exposure during pregnancy and cardiovascular malformations and found the evidence "fails to support a potential risk for increased cardiovascular defects as a result of glyphosate exposure during pregnancy."' A 2013 review found that neither glyphosate nor typical glyphosphate-based formulations (GBFs)pose a genotoxicity risk in humans under normal conditions of human or environmental exposures."'' Pompeo, a member of the Republican Party which purports to stand for states' rights and is allegedly anti-big government,wants to create yet another federal government- run program? This time,to certify non-GMO? We fail to see how that's preferable to just requiring food manufacturers to do what they already do in more than 60 other countries— simply state whether or not their products contain GMOS? The DARK Act 2.0 was introduced on the heels of a hearing held this week by the House Committee on Agriculture to, the committee said, examine the"Cost and Impacts of States Implementing Mandatory Biotechnology Labeling Laws."During that hearing, industry trotted out all of its talking points, including false claims that labeling will cost food manufacturers millions of dollars, a cost they'll have to pass on to consumers. Never mind that study after study has proven otherwise. That food manufacturers change their labels all the time. And that in countries where GMO labeling is required, costs have not been passed on to consumers. Pompeo's bill has nothing to do with protecting consumer or states' rights, and everything to do with protecting the profits of those companies—like Monsanto and Coca-Cola—who have essentially written this law. Pompeo's DARK Act!: BLOG POST OF THE WEEK Sorry, Monsanto. x 3 30 A few weeks ago, I spoke by phone with Cathleen Enright, executive vice president of the Biotech Industry Organization (BIO). (Long st r ). During the course of our conversation, when we touched on the subject of the science behind the debate over whether or not GMOs are "safe" (me arguing that there's no scientific consensus on safety) Enright said, "Then you must not believe in climate change, either." I glossed over that accusation, though it struck me as odd. And random. Until less than a week later, on March 9 (2015), an article appeared in the Guardian under this headline: "The anti-GM lobby appears to be taking a page out of the Climategate playbook." That's when I realized what I should have known. Enright's comment wasn't random at all. It's just a new twist on an old talking point—from an industry on the verge of crumbling under the weight of an avalanche of new credible, scientific evidence exposing not only the dangers of GMO crops and the toxic chemicals used to grow them, but the extent to which both Monsanto and U.S. government agencies like the EPA, FDA and USDA have covered up those dangers. (Side note: Turns out the authors of the Guardian piece all have ties to, surprise, the biotech industry). Mostly. x The people who advise the U.S. Department of Agriculture (USDA) on what to tell Americans to eat have issued their latest round of new recommendations. According to the Dietary Guidelines Advisory Committee (DGAC),Americans should eat "less red and processed meat." For two reasons. One,too much red and processed meat is unhealthy. And two, the production of red and processed meat is bad for the environment. We agree that Americans should eat less meat in general,including less red meat. We also agree that red and processed meat—when that meat comes from factory farms—is bad for your health,bad for the environment and has no place in the American diet. However, red meat derived from animals raised on pasture,using sustainable rotational grazing practices, is not only good for your health (when eaten in moderation), but also improves the environment. So where do we come down on the new dietary guidelines recommendations? We're siding with the advisory committee because the committee didn't look at the impact of grass-fed, pastured red meat—a growing market that the Organic Consumers Association 5 32 fully supports. It only analyzed the impact of red meat from factory farms on human health and on the environment, and concluded, rightly so,that red and processed meat from factory farms is bad for both. We have concluded that we desire for Council to also consider the inclusion of wording "if the qualifying employee chooses this option"to the Unused PTO Leave Pay, C end of sentence. It has proven to be time consuming to differentiate these benefits during payroll and it is felt that all staff should be treated the same. We have concluded that we desire for Council to also consider removing the language "EXCEPTION. New employees hired after December 31, 2011, shall not be permitted to use employer contributions to contribute to items C or D" at the end of the section for 11.2 Cafeteria Plan. 86 01/01/2013 Accumulation: The maximum compensatory time accumulation is €arfy (40) ei hte 80 hours unless a higher amount is established by the City Council. Use of Compensatory Time: Employees may request and use compensatory time off in the same manner as other leave requests. Supervisors shall normally grant such requests,even if another Employee must be called in to cover the hours,unless it causes a serious disruption in business operations. Exempt Employees: Exempt Employees are expected to work whatever hours are necessary in order to meet the performance expectations outlined by their supervisors. Generally, to meet these expectations, and for reasons of public accountability, an exempt Employee will need to work forty (40) or more hours per week. Exempt Employees do not receive extra pay for the hours worked over forty (40)in one workweek. Salary Basis: Exempt Employees are paid on a salary basis. This means they receive a predetermined amount of pay each pay period and are not paid by the hour. Their pay does not vary based on the quality or quantity of work performed, and they receive their full salary for any day in which any work is performed. The City will only make deductions from the weekly salary of an exempt Employee in the following situations: A) The Employee is in a position that does not earn personal leave and is absent for a day or more for personal reasons other than sickness or accident. B) The Employee is in a position that earns personal leave,receives a short term disability benefit or workers' compensation wage loss benefits, and is absent for a full day due to sickness or disability, but he/she is either not yet qualified to use the paid leave or he/she has exhausted all of his/her paid leave. C) The Employee is absent for a full workweek and, for whatever reason, the absence is not charged to paid leave (for example, a situation where the Employee has exhausted all of his/her paid leave or a situation where the Employee does not earn paid leave.) D) The very first workweek or the very last workweek of employment with the City in which the Employee does not work a full week. In this case,the City will prorate the Employee's salary based on the time actually worked. E) The Employee is in a position that earns paid leave and is absent for a partial day due to personal reasons,illness or injury,but: • Paid leave has not been requested or has been denied; • Paid leave is exhausted; • The Employee has specifically requested unpaid leave. F) The Employee is suspended without pay for a full day or more for disciplinary reasons for violations of any written policy that is applied to all Employees. Page 13 of 51 Adopted 12 09,01/23/2013 87 01/01/2013 Unused PTO Leave Pay: Any unused Personal Time Off leave may be paid out at termination subject to the following rules and regulations: (A) The Employee must be in good standing and give proper notice of termination in the case of resignation. (B) Qualifying Employees shall receive pay for all of their unused PTO accumulated at the time of termination. (C) For tenon-bargaining umt employees,unused PTO at termination shall be paid into an employee's Health Care Savings Plan if the qualifying employee chooses this option. See Appendix A for details. 8.4 Donation of Personal Leave General: With the expressed written approval of the City Council, City Employees may donate accrued PTO in one-hour increments to fellow Employees experiencing extended time off due to a serious medical problem or condition and who have no accumulated PTO or compensatory time. The use of this donated personal leave must be approved by the Department Head and the City Administrator and will be converted to the receiving Employee's hourly rate. This subdivision does not apply to part-time, temporary or seasonal positions. The donation of personal leave from one Employee to another shall be subject to the additional following terms and conditions. (A) A written request to donate personal leave must be made to the City Council via the City rAdnunistrator. (B) The City.Administrator shall have the right to deny use of donated personal leave or limit its use in the best interests of the City. 9. LEAVES OF ABSENCE 9.1 Unpaid Leave General: The City Administrator may authorize an unpaid leave of absence for up to ten (10)days. Unpaid leaves of absence for greater periods must be authorized by the City Council. Decisions on unpaid leave of absence requests will normally take into consideration the Employee's performance, length of service and the general interest of the City. No Employee benefits will be earned by an Employee while on unpaid leave of absence and an Employee will not accrue or be paid holiday pay or PTO leave while on leave of absence. Leave of absence hours will not count toward seniority and all accrued PTO must normally be used before an unpaid leave of absence will be approved. 9.2 Medical Leave General: Full-time employees may take of to six (6) weeks of unpaid leave for reasons relating to family and medical care.
