Mr. Tolzmann stated that the commercial market remains flat and no changes were made to land values in this category, whereas, residential values for the most part increased by 3.8%. Mr. Tolzmann stated that preliminary indications are that the market for real estate is coming back with fewer bank owned properties for sale within the community with numbers for last year being 18 to this year being 8. Mr. Tolzmann stated that he has received several inquiries and one appraisal regarding a 19 acre parcel. Mr. Tolzmann stated that no one signed up to be heard this evening and that he is available to discuss issues that residents at any time if they contact him. Mayor Wilharber thanked Mr. Tolzmann for his review and Mr. Tolzmann thanked Council for the opportunity to provide his services to them. Mayor Wilharber offered an opportunity to the public to address the Board, however, those in attendance desired not to speak on the issue. Mayor Wilharber closed the Board of Review & Equalization meeting at 6:22 p.m. I. CALL TO ORDER Mayor Wilharber called the meeting to order at 6:30 p.m. I City of Centerville Council Meeting Minutes April 22,2015 II. PLEDGE OF ALLEGIANCE III. APPOINTMENTS/PRESENTATION 1. Mr. Kevin Knopik, ABDO, Eick&Meyers, Presentation of the 2014 Audit Mr. Knopik introduced himself to Council and stated that he has been the City's lead auditor for five (5) years and would be presenting them with an overview of the City's 2014 financials. Mr. Knopik stated that Abdo, Eick & Meyers, LLP had an unmodified opinion, encountered no issues and their opinion is the same in previous years (proper segregation of duties, internal controls, and levels of funding are satisfactory). Mr. Knopik stated that two (2) items were concerning; an agreement for assessments associated with a joint project between the City of Lino Lakes and the City of Centerville/private property owner; however, an agreement is on file for those assessments and completion of the project did not allow for the terms of the agreement to commence (the agreement did not obtain Council approval) and a public purpose purchase of a retirement gift which was reimbursed in early 2015. Mr. Knopik stated that the City's assets exceed liabilities by $21,944,747 and of that $4,826,082 may be used to meet the City's ongoing obligations. Mr. Knopik also stated that the City's General Fund balance increased $60,417 from 2013, its balance of $1,319,013 is 64.5 percent and exceeds the requirements of 40-50% of the 2015 budgeted expenditures, stated that property taxes are 71.8% of the total fund revenue while public safety services are 54.7% of the expenditures, stated that ongoing evaluation of project will assist in determining whether to close funds or if additional funding sources are needed for deficits, reviewed debt services funds; enterprise funds (water, sewer, and storm water). Mr. Knopik stated that the City is fairly consistent with being below peer groups (communities similar in population and size) similar to in years past. He also stated that new reporting would be required for the upcoming year (GASB 68 and GASB 71) but he would work with staff to complete these additional requirements in a timely and efficient manner similar to all reported. Administrator Ericson stated that he is very comfortable working with ABDO, Eick & Meyers and believes they deliver a very good product. Administrator Ericson also stated that he is confident with staff's abilities and thanked Ms. Paulseth and Ms. Sweeney for their dedicated service. Mayor Wilharber thanked ABDO, Eick&Meyers for their years of service to the City and stated that the City will be receiving their services for the next two years as per their approved contract. Mr. Knopik also thanked the City for the opportunity to provide audit services. 2. Sergeant Pat Aldrich, Centennial Lakes Police Department Presentation of 2014 Annual Report Sergeant Aldrich introduced himself to Council and stated that in 2014 Detective Carlson was promoted to Sergeant and Patrol Officer Jacobson was promoted to Detective with Patrol Officer Stepan declining promotion. Sergeant Aldrich provided Council with a brief review of the 2014 Page 2 of 8 2 City of Centerville Council Meeting Minutes April 22,2015 Annual Report. He stated that Class I crimes (homicide, rape, robbery, aggravated assault, burglary, larceny/theft, motor vehicle theft and arsons) increased slightly with Class II crimes (simple assault, disorderly conduct, drugs/narcotics, DUI, embezzlement, family/children, forgery/counterfeiting, fraud, gambling, liquor law violations, prostitution, sex offenses, buy/receive/possess stolen property, vandalism/damage to property, weapons violations, and other Class 11 offenses decreased slightly. Sergeant Aldrich also stated that juvenile offenses have decreased over the past few years including curfew violations. Council Member Paar stated that this is an annual event of the club to practice their skills and is held at different locations throughout the County. Council Member Paar stated that this would be a 24 hour exercise and they would utilize battery power during evening hours. Council Member Paar stated that the Club desired expedition of their request due to scheduling with other groups. Council Member Paar explained that the Parks & Recreation Committee would be receiving the Special Event Permit Application along with the Police and Fire Departments. Motion by Council Member Paar, seconded by Council Member Love to approve the Anoka County Radio Club Request for Special Event Permit — Field Day Exercise, June 26-28, 2015 (24 hr. operations), LaMotte Park Parking Lot as presented subiect to Centennial Police & Fire approval. Discussion ensued regarding waiving the park usage fee for this request, but requiring the $100 deposit which would be refundable upon successful cleanup/inspection of the park area of usage. Council Members Paar and Love accepted a friendly amendment to the motion including waiving of the park usage fee but collecting the a deposit of$100 and if the park received a successful inspection following their usage it would be returned to them. Purchase Agreement for Lot @ 7212 Mill Road Mr. Lou Suski introduced himself and stated that he would like to present Council with a purchase agreement in the amount of $45,000 from Boulder Contracting. Ms. Suski stated that several months ago Council agreed to reduce the original listing price of $65,000 to $50,000. Mr. Suski stated that the purchaser desires to close on or about May 29, 2015, however, the purchaser has requested "Seller warrants that the lot is buildable Page 4of8 4 City of Centerville Council Meeting Minutes April 22,2015 without extra ordinary costs". Attorney Glaser stated that if Council desired that language could be striken, initialed and the agreement returned to them for their consideration. Mr. Suski stated that he had received an additional inquiry, informed them of the offer and its presentation to Council but no additional contact has been received from this individual. Council Member Love questioned whether the offer was a fair offer and Mr. Suski felt that it was. Motion by Council Member Love, seconded by Council Member Paar to approve the submitted purchase a reement for 7212 Mill Road in the amount of $45,000, staff would strick the language "Seller warrants that the lot is buildable without extra ordinary costs", initial it and forward it back to Boulder Contracting. Update— 1691/1695 Main Street Properties Mr. Suski updated Council on the status of 1691/1695 Main Street by stating that Council had approved an extension until May 31, 2015 and hopefully the proposed buyers will have an agreement with the abutting property owners for purchasing their property by then. Administrator Ericson stated that he recently met with representatives from Schwieters Companies, Inc. and made site visits to property within the city. Mr. Suski stated that he has not received additional inquiries regarding other properties available. Mayor Wilharber reported that Alex's Lawn and Turf has been making significant improvements to the City's old Public Works site. 2. Approval of Annual Audit - 2014 Item was discussed previously. Motion by Council Member Paar, seconded by Council Member Love to approve the 2014 Audit as presented. Council Member Love stated that the City's cost of providing public safety (fire/police) is higher than peer groups. Administrator Ericson introduced Ms. Stacie Kvilvang. Ms. Kvilvang introduced herself to Council by stating that many similar municipalities have utilized her services and hosted round-tables which are full day or half day type meetings that bring together developers and brokers. Ms. Kvilvang stated that this assists in discussions for development, interest, and availability of property. Ms. Kvilvang also stated that most of the services that she provides are free or at minimal cost and she has worked with Administrator Ericson in the past. Motion by Council Member Paar, seconded by Council Member Love to work with Ms. Kvilvang, Ehlers and staff regarding economic development. All in favor. Motion carried. 4. XI. COUNCIL & ADMINISTRATION ANNOUNCEMENTS 1. Administrator Report Administrator Ericson apologized for his lateness and stated that he had attended the annual Centennial Fire District Awards Ceremony and Centerville Lions' Cadillac Dinner this weekend. Administrator Ericson stated that both events showed the residents of Centerville and surrounding communities that we have great personnel that provide essential roles/services within the area. Administrator Ericson stated that the Lions presented the Parks & Recreation Committee with a$500 donation and he expressed the Committee's gratitude. 2. Council & Staff Reports Council Member Fehrenbacher stated that he had attended a recent water meeting in Hugo and was very impressed with the attendance of representatives from the MN Department of Natural Resources, affected community leaders, state and local representatives and felt that it was an informative meeting. Legal Counsel Glaser stated that there are numerous bills/legislation making its way through the house and senate and it will be interesting to watch what happens Page 7 of 8 City of Centerville Council Meeting Minutes April 22,2015 and the activeness of local leaders requesting that things be stalled until research is completed rather than attempting to fix a problem that may not exist or be effective. Council Member Love reported that the Centennial Fire District Steering Committee was cancelled due to lack of quorum. Council Member Love questioned staff regarding the sale of the property along Main Street (7261 Main Street) and status of the purchase agreement. Legal Counsel Glaser stated that Mr. Magdik has been contacted, has paid all appropriate fees to this point and the property is slated to be closed on June 14, 2015 barring any unforeseen issues. Mayor Wilharber gave a brief update on the Centerville Road project stating that utility poles had recently been relocated, storm sewer/culvert replacement had been completed and barring any severe weather the project should continue without delay. Both the Mayor of Circle Pines and Commissioner Sivarajah attended the Centerville Lions' Cadillac Dinner and he thanked them for their attendance. X. I spoke to Jason Rud about these changes and am satisfied with his explanations. Overall, these are mathematical changes to the existing boundaries and markers. None of the boundaries or markers have changed from those approved by the P&Z and Council. All of the changes to the southeast corner of the drawing were made at the request of the County. Specifically: 1) the easement line formerly reading 148.93 feet was reduced to 129.57 feet, indicated a difference between that line drawn to the boundary of the property to a change to the line of the southernmost easement. 2) similarly, the line distance formerly reading 147.71 feet was likewise reduced to 128.46 (and the position of this indicate was moved on the drawing to the opposite side of the county's easement line.) 3) the northern end of that easement line formerly reading its width at 7.09 feet was change to 10.00 feet to show the proper width at its bend north. 4) one additional distance of 241.12 was added to the final plat to indicate the interior distance of the north- south easement line. 5) at various points on the final plat a few additional arrows and labels have been added.+ At this time I cannot see how any of these changes are practically different from those approved on the Preliminary Plat,however, this is technically different than those previously approved. Onboarding—Brimeyer/Fursman Services Mayor Wilharber explained the onboarding survey and its intended purpose to Council by stating that it allows the new Administrator (Mike Ericson) to obtain input from Council as to expectations, styles of communication, immediate priorities, expected approaches to issues and special concerns. Mayor Wilharber also stated that it provides Mr. Ericson with performance expectations, readiness for change and identify risk factors. Mayor Wilharber stated that Mr. Fursman would work with Council to determine the specific survey form to utilize to assist Mr. Ericson in succeeding with Council's desires and future avenues. Council questioned Mr. Ericson regarding this proposal and Mr. Ericson stated that it would provide him with a wealth of information to obtain optimum efficiency and a clear picture of Council and their desires. Trail Easement Correction. Council Member King requested that language be added that the Metropolitan Council designed the regional water supply project and Council concurred. Administrator Ericson stated that if Council desired Staff would forward the resolution to legislators, Metropolitan Council, Minnesota Department of Natural Resources and local representatives from neighboring communities. Reaffirming Final Plat, 6995 — 2e Avenue South with Promissory Note for Park Dedication Fees Lot 1 ($3,806,Center Villa, Second Addition) Attorney Glaser stated that the Lessard's had been given 60 days to file the approved plat, they did not do so due to the existing tenant's financing falling through. Attorney Glaser stated that another buyer is in place,the plat needs to reaffirmed and a requirement of the reaffirmation was that park dedication fees be paid in the amount of$3,860. Attorney Glaser also stated that the Lessard's have requested that they be allowed to enter into the submitted Promissory Note rather than paying the fees up front. Attorney Glaser stated that if the Lessards' fail to comply with the Promissory Note, a lien will be placed against the proceeds of the sale and if a sale does not occur,the$3,860 will be assessed to their property taxes commencing 2016. Administrator Ericson stated that Mechanical Air Systems, Inc.,an HVAC company, has shown interest in the property and has submitted for a Conditional Use Permit. Administrator Ericson also stated that the Planning & Zoning Commission would be considering scheduling a public hearing at their next meeting. Administrator Ericson stated that Mechanical Air Systems, Inc. is a reputable company with fourteen (14) employees, Miller Mobile Marine will unfortunately he vacating the property at the end of April and staff has met with the potential buyers regarding their use of the building,outside storage and fire suppression requirements which are not needed.
