A RESOLUTION RECOGNIZING PATRICK BRANCH FOR HIS YEARS OF
DEDICATED PUBLIC SERVICE ON THE CENTERVILLE PARKS &
RECREATION COMMITTEE
WHEREAS, Mr. Pat Branch was first appointed to the Parks & Recreation Committee
by the City Council on December 26, 2007, and
WHEREAS, Mr. Pat Branch has served the citizens of Centerville from December 26,
2007—July 26, 2015 as a Parks &Recreation Committee Member, and
WHEREAS, Mr. Pat Branch has provided excellent leadership, demonstrated initiative
and perseverance through difficult budget/economic times, and
WHEREAS, Mr. Pat Branch was appointed Chair by his peers in 2010 and continued to
serve in that capacity until his volunteered resignation in 2014; and
WHEREAS, Mr. Pat Branch is a leader that is respected by his fellow Committee
Members, City staff and elected officials he has served with. As a colleague, he has
always treated his fellow Committee Members with respect and valued their opinions
even when they disagreed with him, and
WHEREAS, the Council recognizes that when an individual serves, so serves their
family and the Council recognizes and acknowledges their sacrifices.
NOW, THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF
CENTERVILLE, MINNESOTA, expresses its regrets to seeing him leave this
honorable service; but, wishes him and his family well. We thank him for his dedication
to the community as he has served others through his choices. The City of Centerville
wishes you every success in your future. You will truly be missed.

Hello Mike- The city has a JPA for 21'ave to the south of Main Street. This last winter,Centerville was plowing 21'ave
and Lino Lakes plowed their portion of Mound Trail. With the new JPA's,Centerville will plow Cedar Street and Lino

JOINT POWERS AGREEMENT
BETWEEN THE CITY OF LINO LAKES
AND TIRE CITY OF CENTERVILLE
REGARDING 21sT AVENUE ROADWAY,
PHASE I,RWMOVEMENTS AND
MAINTENANCE
THIS AGREEMENT,made and entered into on the day and year hereinafter set
forth by and between the City of Lino Lakes and the City of Centerville;both of which
are governmental subdivisions of the State of Minnesota located in the County of Anoka.
RECITALS
a. The City of Lino Lakes and the City of Centerville desire to improve 21�`
Avenue by constructing street,curb and gutter between Main Street and 600 feet south of
Main Street and storm sewer from Main Street to the south.
b. The City of Lino Lakes has prepared a feasibility study of the Project as
defined by this agreement.
C. A portion of the Project is to be constructed within the corporate limits of
the City of Lino Lakes and a portion is to be constructed within the corporate limits of the '
City of Centerville. (Exhibit A).
d. Subject to the terms hereof,Lino Lakes is assuming full responsibility for
the design and construction of the Project to be built both within the corporate limits of
Lino Lakes and Centerville.
e. Lino Lakes and Centerville recognize and acknowledge that the Project
will benefit both Lino Lakes and Centerville.

L Lino Ickes and Centerville will both assess the benefited properties within
their jurisdictions for all,or a portion of the relevant costs of the Project,all as is more
fully set forth below.
PURPOSE
The purpose of this Agreement is to set forth the terms of the agreement Lino
Lakes and Centerville have reached regarding the design and construction,maintenance
and financing of the Project both within the corporate limits of Lino Lakes and
Centerville,in accordance with Minnesota Statutes,Section 471.59.
AGREENlEi`IT
NOW,THEREFORE,in consideration of the mutual undertakings herein
expressed,Lino Lakes and Centerville agree as follows:
1. Lino Lakes is responsible for the design and construction of both the
portion of the Project located within Lino Lakes and the portion of the Project located
within Centerville. Therefore,the parties agree that:
a. Lino Lakes shall design the Project, administer the construction and
conduct inspections of the construction process. Centerville shall have the right to
inspect,review and comment upon constmction of the Project. Centerville shall have the
right to review and approve the final plans and specifications prior to advertisement for
bids.
b. For purposes of performing its obligations under this Agreement,
Centerville hereby grants to Lino Lakes the rights to use the streets,public ways, and
easements of Centerville for purposes of constructing the Project,including any
excavations necessary to perform work incidental to the performance of this agreement;

and Centerville hereby agrees,through its departmental agencies,to cooperate to the
fullest extent in the protection of any excavations or barricades that may be necessary for
the work performed by Lino Lakes.
C. Lino Lakes agrees to notify and coordinate with businesses in Lots 7,8
and 9 of the Centerville Industrial Park(along the existing gravel segment of 21a
Avenue) as early as practical the construction schedule of the Project.
2. Construction costs and design engineering shall be divided proportionally,
50%to Lino Lakes and 50%to Centerville,for the Project. Legal,administrative and
construction engineering costs shall be paid separately by each City.
3. Each city has the right to terminate Agreement prior to award of
construction contract.
4. Each municipality shall be solely responsibly for their share of the costs of
the Project. Each municipality shall be responsible for the sale of bonds,if any, and levy
of special assessments against properties within their cities boundaries.
5. City of Lino Lakes shall receive,from the City of Centerville,monthly
payments,as certain portions of the construction are completed. The Project amounts are i
then due and payable for work completed. Upon completion of the entire Project,the
City of Lino Lakes shall prepare a final cost statement and submit it to the City of
Centerville. Payment of the statement shall be completed within 45 days upon receipt of
the statement.
6. Before this Agreement shall become binding and effective it shall be
approved by an appropriate resolution of the City Council of Lino Lakes and of the City
Council of Centerville,which shall be attached hereto as Exhibits B and C,respectively.

7. The City of Lino Lakes shall maintain 21"Avenue by performing annual
street sweeping,crack sealing and pothole filling. The City of Centerville shall maintain
214 Avenue by plowing snow and winter sanding/de-icing.
8. The City of Lino Lakes and the City of Centerville will sealcoat the
roadway on a 5-7 year interval by separate cost share agreement.
9. Other projects,such as reconstruction and overlays, shall be completed by

separate agreement between the City of Lino Lakes and the City of
Centerville.
10. The City of Lino Lakes shall maintain the storm sewer consisting of
performing periodic inspections of the conveyance system/pond and by
taping any necessary corrective action,all by a separate cost share
agreement-

2016 Thin Bituminous Overlay Project
At your request we have prepared the following scope of services and fee proposal for engineering services
related to the 2016 Thin Bituminous Overlay project. Those services include:
Feasibility Report
A portion of the costs of the past two projects have been specially assessed. This requires a feasibility
report under MN Chapter 429 law. We will complete the feasibility study, prepare for and attend both the
Public Improvement Hearing and Assessment Hearing. Our proposal anticipates these hearings to be
conducted on the same night as regularly scheduled City Council Meetings. We also assume that the City
Clerk will prepare the preliminary and final assessment rolls for the project as she has for past projects.
The other element included in the Feasibility Report stage is the evaluation of streets scheduled for overlay.
This involves a tour, with the Public Works Director, of the streets scheduled for overlay as well as others
which may not have been on the schedule, but which the Public Works Director feels should be examined
for possible inclusion in the project. This work is necessary to give the Council an informed opinion on the
appropriateness of an overlay for the programmed streets.
Plans and Specifications
In 2014, we developed a set of programmatic plans and specifications for the Thin Bituminous Overlay
program which we continue to use for each project. Minor modifications to these specifications are made
each year to adapt to new MNDOT bituminous specifications, or to refine our approach to the program
based on our experiences with last year's project. Plans are, of course, updated to show this year's streets
and reviewed for any changes to the standard details that may be appropriate.
Assistance with Bidding
As part of this phase, we will publish an advertisement for bids(ad costs paid by city) as required by public
bidding law,answer bidder questions, produce and distribute Addenda, attend the Bid Opening,and
produce and review a Bid Tabulation. Once bids are received and presented to the City Council for award,
contracts will be prepared and distributed for execution.

Construction Phase
This proposal assumes that the city's Lead Project Inspector, Greg Burmeister will continue in his role as
the primary,on-site representative during construction. We would support him with the following tasks:
• Preparation for and attendance at a Preconstruction Conference
• Periodic support of City's Project Inspector(Greg Burmeister) during construction (<5 hrs/wk)
• Production of minor Change Orders
• Issuance of Pay Requests; final payment after review of IC-134s, Lien Waivers
These services would be provided for the scope of the proposed 2016 Thin Bituminous Overlay Project
which includes(see attached):
• Meadow Circle • Deer Court
• Meadow Court • Hunters Trail
• Cottonwood Court • Mill Road
The preliminary construction cost estimate for these improvements is$220,000.
Fees
Based on the scope of work and scope of project outlined above, the following is a summary of our not-to-
exceed fees. Our work would be billed on a monthly basis, in accordance with our Master Services
Agreement and per our current rate schedule. The values in the table below would not be exceeded
without a change in scope and written permission from city officials.

Schedule
It is our understanding that the City Council would like to take bids prior to adopting their final budget for
the year, in December. This would allow the Council to more accurately understand the ability of their levy
to fund the overlay program in 2016. In order to accomplish this, we propose the following schedule:
