CITY OF CENTERVILLE
PLANNING AND ZONING COMMISSION
Pursuant to due call and notice thereof, the Planning and Zoning Commission held its regular
meeting on June 2, 2015 at 6:30 p.m.

I. CALL TO ORDER.
The meeting was called to order at 7:10 p.m. by Chairperson
Mosher as Commission Member Montain was called out on a Centennial Fire District fire
call.

II. APPEARANCES
1. Mr. Mike Lobinsky, 6833 Lakeview Drive, Lino Lakes
Mr. Lobinsky stated that he is the buyer of the lot at 1407 Mound Trail. He will build a home on
the property, however, his current construction plans include a porch that would extend into the
rear yard setback by approximately 4’. He was advised by staff to apply for a variance or attend
this evening meeting to ascertain the Commission’s views on the item.
Discussion was held by the Commission regarding variance requirements and the fact that Mr.
Lobinsky would be inflicting a hardship on himself and he may not meet the requirements for a
variance.
Motion by Commissioner Montain, seconded by Commissioner Wood to schedule a public
hearing for the July 7, 2015 P & Z Commission meeting, if Mr. Lobinsky determines he desires to
apply for a variance and staff will continue to assist Mr. Lobinsky in his plans. All in favor.
Motion carried.

1. Metropolitan Council Draft Water Resources Policy Plan – Review & Comment
The commission briefly discussed the item and will continue to review the plan.

2. Amend Conditional Use Permit 6995 – 20 Avenue South, Mechanical Air Systems,
Inc.
Administrator Ericson explained that language was contained in the original Conditional Use
Permit “3. Conditions. This permit is issued subject to the following conditions: a) This
Conditional Use Permit is not authorized until and unless the Plat for Center Villa Second
Addition is properly recorded with Anoka County by April 25, 2015) and due to the delay in
closed this language should be modified to June 30, 2015 rather than May 30, 2015.
Administrator Ericson stated that the anticipated closing was scheduled for June 25, 2015.
Motion by Commissioner Montain, seconded by Twohy, to recommend to City Council
approval of the amended language as submitted. All in favor. Motion carried.
V. NEW BUSINESS
1. City Code 150, Section 150.30 Sump Pump Required
a. (2) Outlet shall be to rear yard of the property
Lengthy discussion ensued regarding the current code. Discussion about the request to modify
code allowing discharge in the front yard for specific summer months allowing for rear yards to be
dry and the Commission’s decision that the current code requirements should remain and be
enforced.
2. Downtown Master Plan & Development Guidelines
Administrator Ericson stated that the current Master Plan for the Downtown is very outdated.
Discussion by the P & Z on up dating it to current standards and expectations of both the
Commission and the Council. Administrator Ericson felt that this would be helpful in attracting
businesses to the community.
3. Encroachment Agreements
a. When (After Installation/Prior to Installation)/Who Authorizes (P &
Z/Council/Staff)?
Administrator Ericson stated that the current procedure has been that the applicant applies for an
encroachment agreement prior to installation, however, on occasion there have been times where it
has been after the fact. Administrator Ericson stated that generally encroachment agreements are
submitted for construction within a drainage/utility easement and range from fences, sheds and
retaining walls. Subsequent to inspection of the property by the City and review of
topographically information, the Building Official either approves or denies the request. If he
approves the request then it goes before Council for their consideration and approval or denial.
Administrator Ericson questioned whether the Commission would like to review the requests or
has reviewed the requests in the past.

The Commission stated that they have not reviewed the requests in the past and felt that the
current procedure has not caused any concerns or been preserved as subjective so continuing with
the current practice was acceptable.

VII. CONSIDERATION OF MINUTES
1.May 5, 2015 Planning & Zoning Commission Meeting Minutes
Motion by Commissioner Montain seconded by Commissioner Mosher to approve minutes
from the May 5, 2015, meeting as presented. All in favor. Motion carried.
VIII. ADJOURNMENT
Motion by Commissioner Wood, seconded by Commissioner Mosher to adjourn the meeting
at 8:20 p.m. All in favor. Motion carried.
