The trail is proposed to be an eight to ten foot wide paved trail. Working west to east,as shown in Figure 3, Exhibit A, the existing trail leaves Bunker Hills Regional Park from the south east corner of the park,just north of Blaine High School. It crosses to the south side of Bengal Drive and heads east as an eight foot wide striped on-road bicycle lane. At Jefferson Street the trail changes to a ten foot wide grade separated paved trail behind the curb and travels south on the west side of the street. At the intersection of Jefferson Street and CSAH 14/Main Street,the trail crosses at the signalized intersection to the south side of CSAH 14/Main Street and travels east, crossing over Highway 65 and currently ending at Aberdeen Street. From Aberdeen Street,the proposed trail is to be a ten foot wide grade separated paved trail that follows on the south side of CSAH 14/Main Street to Cloud Drive. If right of way or easements are needed,it is estimated that the width of those easements may be between 15 and 20 feet. It is anticipated that the trail along this stretch will be completed within the next 5-7 years. The trail is existing and complete through this section of Cloud Drive and East Lake Park. Just east of East Lake Park,the ten foot wide paved trail is proposed to travel east through a future development to CSAH 17/Lexington Avenue. The County will work closely with the City of Blaine to ensure that trail easements are acquired and the trail is constructed as development occurs. At CSAH 17, the trail alignment connects to an existing ten foot wide portion of the East Anoka County Regional Trail and travels south on the west side of the road to 109th Avenue. At the signalized intersection at 109th and Lexington Avenues,the trail follows on the south side of 109th to Pheasant Ridge Drive where it currently ends. From there,as shown in Figure 5,Exhibit C,the 10 foot wide paved trail is proposed to follow on the south side of 109th from Pheasant Ridge Drive east to County Road 53/Sunset Avenue. At County Road 53/Sunset Avenue,the Anoka County Highway Department is currently working with the Cities of Blaine and Lino Lakes on a roundabout project at 1091h Avenue and Apollo Drive. At 4th Avenue, the trail crosses to the north side of the street and continues on to CSAH 23/Lake Drive. At the signalized intersection of CSAH 23/Lake Drive,the trail crosses east to Marshan Park,where it travels through the park and heads south to Aqua Lane on the west side of Marshan Lake. At Aqua Lane,the trail travels east through Rice Creek Chain of Lakes Park Reserve and connects to Rice Creek North Regional Trail, Chomonix Golf Course,Centerville Beach,and the public boat access on Centerville Lake. From there the trail travels south and east around Centerville Lake to the City of Centerville's Laurie LaMotte Memorial Park. The trail then travels north along LaMotte Drive to Heritage Street. Just prior to CSAR 21/Centerville Road,the trail travels north and terminates at CSAH 14/Main Street and the Central Anoka County Regional Trail, as shown in Figures 6&7,Exhibits D&E. This designation gives it a regional level of importance to serve regional transportation travel by bicycle and will be appropriately emphasized in regional planning and investment decisions for transportation. Since 11.5 miles of the 14.5 mile trail currently exist, the County is proposing to construct the remaining segments of trail as the county roadways are reconstructed and expanded or as development occurs. Right of way acquisition for the proposed trail segments is anticipated to possibly affect 40 parcels. A list and map of potentially affected parcels is in the Appendix. Acquisition is based on the trail being installed within a typical 120 foot wide county road right of way and is estimated to be$645,000 based on the 2016 assessed valuation. Once this Master Plan is approved,the County will work closely with the cities and the County Highway Department, so that when development plans or reconstruction plans move forward dedicated right of way or easements for the trail are provided for in those plans. This should keep acquisition costs to a minimum. Market rate appraisals have not been conducted to date, but will be conducted prior to any acquisition or funding request to the Metropolitan Council. There are several active MPCA contamination sites within 500 feet of the trail corridor, but these sites are not anticipated to impact the trail or require additional funds for remediation. More information on site locations and descriptions can be found in the Appendix. Page 7 9 DEMAND • ' Demand Forecast Regional parks and trails have been increasing in popularity and as the population grows the need for additional recreation resources and amenities grow as well. The population in the communities surrounding the corridor is anticipated to grow steadily,as is Anoka County,as shown in the Population Forecast table. Population Forecast' YEAR BLAINE • LAKES CENTERVILLE ANOKACOUNTY 2010 57,186 20,216 3,792 330,844 2040 86,000 29,000 4,200 426,080 According to the Metropolitan Council Regional Forecast to 2040,the metro regional area is anticipated to grow by 22%between 2010 and 2040. By 2040,seniors are expected to comprise of 20%of the population and people of color will comprise 40%. As the population increases,diversifies,and ages,demand for easily accessible outdoor recreation opportunities and open space increases. The outdoor recreational use patterns in the metropolitan area have also been growing steadily. Recreational visits to Anoka County regional trails have increased from 504,000 in 2008 to just over 1 million in 2014.2 In addition,according to the 2014 Outdoor Participation Report by the Outdoor Foundation,in 2014,there was a net gain of 700,000 outdoor participants from 2013. Running,jogging and trail running was the most popular outdoor activity with more than 57 million participants and over half of the total 143 million Americans that participated in outdoor activities also walked. With the population growth expected and the increase in recreational visits to regional parks and trails,the demand for additional facilities will only increase. 1 Metropolitan Council,Thrive MSP 2040 Forecasts,Adopted May 28,2014 2 Annual Use Estimate of the Metropolitan Regional Parks System for 2008&2014,Metropolitan Council Page 8 10 DEVELOPMENT CONCEPT Development Concept The Anoka County's parks and trails system provides outdoor recreation opportunities in the northern metropolitan area and the Bunker-Chain of Lakes Regional Trail has been identified in the County's 1996 20/20 Vision Plan and the Comprehensive System Plan for the Parks and Recreation Department,which was adopted by the County Board of Commissioners in 2006. The development concept is to provide a 10 foot wide paved trail that provides a critical link between the Bunker Hills Regional Park and the Rice Creek Chain of Lakes Park Reserve. The trail links the cities of Blaine, Lino Lakes and Centerville and it connects to the East Anoka County and Rice Creek North Regional Trails. In addition, the trail connects to the Central Anoka County Regional Trail which then connects to the Washington County Regional Trail system. The trail provides links to several schools, such as Blaine High School, Roosevelt Middle School,Johnsville and Northpoint Elementary Schools in the City of Blaine and the Centennial Middle and Blue Heron Elementary schools in the City of Lino Lakes. The trail provides easy access from the surrounding residential areas to the various restaurants,businesses and retail establishments in the cities. Figures 8 illustrates the development concept for this trail. The trail is proposed to be a 10 foot wide paved off-road trail. Where space is an issue,the trail may be separated from the roadway through grade differentiation,by placing the trail behind a six inch curb in more urban type settings where space is a premium or by creating a grade separated buffer between the trail and roadway in more rural type settings. The width of the buffer would depend on the speed and type of the roadway. The remaining sections of trail are proposed to be constructed adjacent to the roadways, but separated by a buffer,similar to Figure 9. .s ; _ .rte= r €a-s PRII Figure 9 Since the majority of the trail exists,establishment of the trail in those existing ! areas will be relatively easy through the installation of new directional and J way finding signs along the route. Trailhead signs, as illustrated in Figure 10 are proposed at the major BUNKER intersections along the trail. Way-finding directional • . signs, as illustrated in Figure 11, will be posted along the trail at decision points as well. Figure 11 The trail is proposed to cross over Interstate 35W at County Road 53/Sunset Avenue. The current vehicular bridge is a narrow two lane bridge without any pedestrian accommodations. Therefore,Anoka County proposes to either include the regional trail into the bridge reconstruction project when that occurs or construct a separate Figure 10 Page 10 12 DEVELOPMENT CONCEPT pedestrian bridge over Interstate 35W to provide safe crossing over the freeway. Refer to Figure 12 for an example of a pedestrian bridge/overpass. Figure 12 Regional trailhead facilities are located at Bunker Hills Regional Park and Rice Creek Chain of Lakes Park Reserve. These parks provide ample parking,restroom facilities and additional trails and amenities within the parks.There are City owned facilities located at Lakeside Commons Park and Beach in the City of Blaine and at Marshan Park in the City of Lino Lakes. These facilities provide ample parking and restroom facilities as well as additional outdoor recreation amenities. Storm water management for the proposed trail is to follow the requirements of the MN Department of Natural Resources,MN Pollution Control Agency,Army Corps of Engineers,Coon Creek and Rice Creek Watershed Districts,and any other permitting and regulatory agency requirements at the time of construction. For example,in certain jurisdictions,water quality treatment for a trail can be achieved through a minimum of a five foot wide vegetated filter strip or vegetated open space located down-gradient of the trail. The ownership and maintenance of the storm water management facilities will be the responsibility of Anoka County within county jurisdictions and the cities within their respective jurisdictions. Prior to the trails construction a Natural Heritage Information System review will be conducted to determine if any rare species or rare natural resources features are located within the trail alignment. General findings show there is one vertebrate animal of threatened status within 500 feet of the existing trail alignment. There are none located near the sections of trail still to be constructed,therefore no impacts to rare plants or animals are anticipated that would require additional costs for mitigation or avoidance. An archaeological survey will be conducted if required and wetland delineations will be performed to determine boundaries, so that the trail may be developed in a way that reduces and/or includes mitigation of the impacted wetlands. Page 11 13 DEVELOPMENT CONCEPT In addition,soil borings may be taken to ensure proper construction in areas where soils are questionable. Since this trail alignment is proposed to traverse open green space areas,wildlife friendly erosion control materials and native seeding will be incorporated into the trail design. Since the majority of the trail already exists within the current land uses,issues between the trail and current land uses are not anticipated. Education and enforcement is provided through the Anoka County Park Rangers,the local police departments and the Anoka County Sheriff's Department, {,r, „ sawn'! as shown in Figure 16. 40 Current practice partners Anoka County with the local cities through either a Memorandum of Understanding(MOU)or a Joint Powers Agreement(JPA)to provide for the maintenance of regional Figure 16 trails. Typically,the MOU or JPA is executed prior to trail construction and outlines what agency is responsible for general routine maintenance of the trail and what agency is responsible for capital improvements to the trail in their jurisdiction. The County is typically responsible for the routine maintenance of trails within regional or county park lands. This includes such maintenance as mowing,sweeping,plowing,clearing,debris removal,and patching for example. Outside of regional and county park facilities,the local cities are generally responsible for routine trail maintenance. Solid waste is typically collected from trash receptacles located along the trail at regular intervals. Anoka County inspects trails annually and provides the capital improvements that are needed and provides the long-term maintenance required,such as bituminous overlays,and trail reconstruction. Trail signage is provided and maintained by either the City or the County as determined in the JPA. Annual maintenance costs for the trail are estimated to be about$10,000. This includes funding for sign replacements,minor bituminous repair and crack-sealing. Revenue for the operation and maintenance of the trail comes from the Anoka County Parks and Recreation Department's annual operations and maintenance budget,which includes revenues from picnic shelter rentals,room rentals,programs,parks entrance fees and the County general fund. Supplementary funding is provided through the Regional Park Operations and Maintenance Grant Program. Page 16 18 PUBLIC PARTICIPATION Public Engagement and Participation Figure 17,illustrates the population racial density by census tract for the service area of the trail and reached out to those communities for comment on the master plan. The County conducted a public comment period,published the master plan on the County website,sought input on the plan at the Anoka County Fair and attended local community events to receive public input. A partnership with the local cities, the Parks and Recreation Department and the TMO, developed a bike/walk map for the County. Refer to Figure 18 for an example this project. This project was in cooperation with the Blue Cross Blue Shield"Do"campaign. In addition, the County was able to create the Go Anoka County website �= i (goanokacounty.org). This site was created to provide information related to parks and recreation facilities and promote access to those facilities to make it easier to recreate outdoors. The majority the service area consists of 2.1 to 4.3%of the population being below the poverty level. This is based on the 2006-2010 American Community Survey 5-Year Estimates,as shown in Figure 19. In addition,the Anoka County Traveler Transit Link,as shown in Figure 20 and Metro Mobility dial-a-ride services provide transportation for a minimal fee. Transit Link will pick up and drop off passengers anywhere there is an address or cross street,or anywhere along the regional trail as long as the vehicle does not have to back up. Currently all of the vehicles are equipped with bike racks so passengers wishing to bike on the trail could use Transit Link to preschedule a trip to/from anywhere along the trail that a large vehicle can access. Once built,the trail will provide a no cost alternative transportation option to Figure 20 residents in the area. The trail and any facilities and amenities along the trail will conform to the standards mandated by the Americans with Disabilities Act. There should be a pedestrian bridge over Lexington where this trail meets Lexington Avenue to allow safe east/west crossing over CSAH 17 to new sports complex and residential development. Response: The suggested pedestrian bridge would need to demonstrate a benefit to the regional system to be included in the regional trail master plan. 2. There appears to be a new sports complex on Lexington just about the point where the new trail will intersect with Lexington. There will need to be a cross walk and light there even though the trail does not run through that new sports complex.The new trail section will provide easy access to the new sports complex from The Lakes area. Response:A cross walk and light would need to be agreed upon by the City of Blaine and the County Highway Department and is not included within this trail master plan. 3. Can the section between the Lakes and Lexington be combined with Blaine's wetland trail? Response: In discussions with City of Blaine staff, it was decided that the trail should avoid the wetland area and follow the future proposed parkway through the future development area. 4. Verify Blaine's trails on 109th, can those be combined? Response: The proposed regional trail utilizes a portion of a City of Blaine proposed trail along 109'h. Both trails are proposed to follow the alignment of 109th. 5. 1 took several diversions into neighborhoods and Lockness Park. I assume that the new trail will follow the power line that runs from the end on the trail in The Lakes neighborhood and Lexington. That appears to me to be the best route. Response:The trail route from the Lakes neighborhood to Lexington Avenue is proposed to follow a future parkway as part of a future development project in the area. 6. What is the weight limit on our trails? Many maintenance and utility vehicles(Xcel)on them and edges of trail broken up because of it. Response: Per the MN/DOT Bikeway Facility Design Manual,principal loads will normally be from maintenance and emergency vehicles. These vehicles should be restricted to axle loads of less than 4.0 or 5.0 ton, especially in the spring. 7. There is a"this trail is not maintained"sign on East Anoka County Regional Trail on Lexington Avenue. Response: This comment is unrelated to this master plan amendment,but the information will be investigated. 8. Signage will be a big issue. That is a very complex route and many of the turns are not obvious. 37 Response:Upon completion of the trail, wayfinding signs as discussed in the master plan will be installed. 9. What about a user fee to help offset the shrinking O&M funds for maintenance? Response:The concept for a trail user fee would be too difficult to implement,collect and enforce and would set an undesirable precedent for the Regional Trail System. 10. Use wood chips on trails where snowmobiles ride and increase signage to make them aware of designated and undesignated snowmobile trails. Fine those who go off designated trails. Response: While this is unrelated to this master plan amendment, the information will be shared with our operations and maintenance staff. 11. Install a "Trail Under Water"sign before the trail goes underneath CSAH 14 at Rice Creek(Peltier Launch). Response: While this comment is unrelated to this master plan amendment, the information will be shared with Parks staff. 12. Where did the demand for trails originally come from? Who decided that all these connections need to be made? Provide some info on history of trail demand. Response: The history of bicycle trails or sidepaths as they were known then,goes back to the 1890's, when bicyclists were looking for places to ride. In 1897, the"rail to trail"movement was born. This movement was hoping to induce the railway companies to build cycle paths along their rights of way. Additionally,riders in New York came up with the idea for a "sidepath", which is a separate bicycle specific network of paths. Many states and cities has built a successful network of paths, chronicled in "Sidepaths", the magazine for the movement. But as cars became more numerous, many of these sidepaths were paved over, but in 1964, the Department of the Interior produced the "Trails forAmerica"report, which called for new hiking trails and bikeways. 1 Over the next few decades,as the population and vehicle travel grew,so did the demand for separated trails for pedestrian and bicycle use. Now, trails are used not only for recreational purposes but also as alternate modes of transportation. 13. The crossing over Hwy 65 needs to be more pedestrian friendly. There should be more signage to alert drivers entering and exiting to yield to pedestrians. Response: While this option may be possible within County owned parkland, it would require additional right of way acquisition costs elsewhere along the trail corridor. The County feels that the existing retail areas and schools providing parking options along this trail and therefore does not feel this option is necessary for inclusion in this this trail master plan. 18. Clean the trails in the spring. Response:This comment was shared with county maintenance staff. 19. The biggest item in your propose budget is the bridge over 1-35W at Sunset. Sunset is a county road and it is in terrible shape. Can we assume that Sunset will soon be rebuilt. If so,will that bridge be replaced? Maybe a bike lane on a new Sunset/1-35 could be done at a more reasonable cost than the bridge you have pictured in your plan. Response:As outlined in the master plan, the County proposed to either include the trail when the existing vehicular bridge is reconstructed, or to provide a separate pedestrian bridge, if the trail cannot be included with the bridge reconstruction. 20. Could you use a decommissioned bridge for the ped bridge over 35W? Response:Any decommissioned bridge would need to be reviewed by a structural engineer prior to determining its use and approved by the Minnesota Department of Transportation and the County Engineer. 21. Road and trail from 52 to Cloud Drive is scheduled for construction Fall 2016. Response:No response is required. 22. There is a potential K-4 school going in on the northwest corner of 17 and 1091H Response: This trail plan should not have an impact on future development in this area. 23. Infinity campus, located off of 109th is planning a major expansion. Response:The proposed trail should not have an impact the proposed expansion. 24. Have we considered using the Lexington/35W crossing instead of the Sunset/35W crossing? 39 Response:This option was examined. The preferred alignment is to cross at Sunset, due to its proximity to schools, residential housing and retail. 25. What strings are attached to the Met Council funds? Response:Potential Metropolitan Council Funding sources used for regional trail construction include the Metro Parks and Trails Legacy Grant Program, which is a formula driven appropriation from the State, administered and distributed through the Metropolitan Council and the Regional Parks and Trails Capital Improvement Grant Program, which is a State and Met Council Bonding program, which is administered and distributed through the Metropolitan Council. As with any grant, there are requirements that must be met. These requirements are included within each grant agreement received by the County. These requirements are reviewed for compliance prior to the execution of the grant agreement contracts. Typical requirements for these types of grants include: 1. The facility must be owned by a public entity and shall remain in public ownership. 2. The County records a State of Minnesota General Obligation Bond Financed Declaration. 3. Prevailing Wages 4. Res. #15-030 — A Resolution Recognizing Patrick Branch for His Years of Dedicated Public Service on the Centerville Parks & Recreation Committee Mayor Wilharber read the resolution and presented Mr. Branch with it along with a commemorative#1 race bib signed by members of the Parks &Recreation Committee. Mr. Branch stated that he enjoyed his time serving on the Committee and felt that they accomplished many projects through sponsorships, donations and volunteer hours. Mr. Branch listed some of the many projects that were accomplished through the proceeds from the 5K/8K Run/Walks throughout the years (park benches, basketball court, volleyball court, Music in the Park equipment, etc.). Mr. Branch felt that the continued efforts of the Committee would serve the residents and patrons of the community well into the future and thanked Council for its support over the years. 2. Anoka County Commissioner Rhonda Sivarajah & Transportation Division Manager Mr. Doug Fischer—CSAH14/Main Street Improvements 41 City of Centerville Council Meering Minutes September 23,2015 Mayor Wilharber commended Anoka County and Project Manager Mr. Bruce Luikart for services he provided during the Centerville Road/CSAH21 street reconstruction project. Transportation Division Manager Fischer stated that not only is Mr. Luikart a dedicated employee of the County but he is also a Centerville resident. Commissioner Sivarajah stated that she and the County have always appreciated the partnership that City Staff and the community have had during recently road projects and this fall, they will be working with MNDot to install flashing yellow/red arrows turn arrows at the intersection of 20th Avenue and Main Street. Commissioner Sivarajah stated that it was anticipated once the wiring, analysis and timing are determined they would be installed weather dependent. Commissioner Sivarajah also stated that the County and MNDot will be correcting the large hump in the east lane (traveling west bound) on the Main Street overpass (I35E) bridge. Commissioner Sivarajah stated that this was not a small project due to the curb, gutter and inside lane obstacles. Mayor Wilharber stated that the Centerville Road reconstruction was a tremendous project with the elimination of ditches and the addition of the trail, new asphalt, drainage and turn lanes. He stated that he is impressed with the amount of individuals utilizing the trail and requested that the County and municipalities work together on mapping trails. Council Member King requested finalizing the cost-share numbers for budgeting purposes associated with the Centerville Road project. 3. Mr. Mike Rogers, Ramsey County Regional Railroad Authority, Rush Line Corridor—Update Mr. Rogers introduced himself to Council and gave a brief overview of the Rush Line Corridor Pre-Project Development Study. Mr. Rogers stated that the study area involved 30 miles between the Union Depot in St. Paul and Forest Lake, the results of the study show that the primary need for services is in the southern end of the corridor where housing and job densities were higher along with environmental and cultural impacts being lower in the northern end of the corridor. Mr. Rogers also stated that the Tier 1 results of the study have shown the possibility for light rail transit/diesel multiple unit along the County/Railroad right of way from downtown to White Bear Lake, or Bus Rapid Transit along the County/Railroad right of way from downtown to Forest Lake with the same mode along White Bear Avenue and US Highway 61 from downtown to White Bear Lake, however the I35E corridor will be removed from the list for future studies. Mr. Rogers stated that continued public engagement efforts will take place with additional routes and modes of transportation being analyzed and studied and an anticipated completion date of 2016 with environmental studies in 2017. Mayor Wilharber questioned that with the installation of light rail or bus rapid transit along the County/Rail right of way along Highway 61 whether that would eliminate the current pedestrian trailway. Mr. Rogers stated that it would not and that there was sufficient space to allow the construction and leave the trailway undisturbed. Mayor Wilharber stated that the public's participation in the meeting that took place in Forest Lake was minimal and transportation was a huge community asset. Mayor Wilharber also commented that the new park and ride at 21s' Page 2 of 8 42 City of Centerville Council Meeting Minutes September 23,2015 Avenue is utilized much more than the church's parking lot. Mr. Rogers stated that studies have shown that ridership has increased and will continue to increase. Additional discussion took place regarding funding, ridership, growth, the potential for future consideration/upgrades, etc. Mr. Rogers stated that additional information may be obtained by contacting himself, through the Rush Line Corridor Web Site or Facebook and any modifications or outcomes from the continued study he would keep the Council informed of. Council Member King questioned what factors played a part in determining that the Royal Meadows Development was entirely within the Well Head Protection Area. Engineer Statz stated that the close proximity of the existing wells determines the area along with many other factors. Engineer Statz stated that the Department of Health desires for communities to commence work on their amendments two years prior to when they are due and they are due every 10 years. Council Member King requested that he receive a copy of the City's current Wellhead Protection Plan. Engineer Statz stated that the new report would include old and new maps if modifications were made and that Council Member King would be provided with a copy. Ms. Diane Hankee, City of Lino Lakes City Engineer — West Cedar Street Agreements a. Res. #15-OXX — Approving the Joint Powers Agreement Between the City of Lino Lakes and Centerville Regarding West Cedar Street Paving b. Res. #15-OXX — Approving Joint Powers Agreements Between the City of Lino Lakes and Centerville Regarding Maintenance of West Cedar Street Administrator Ericson stated that Council tabled the above stated agreements at its last meeting due to lack of history of the project, timing of the work versus the agreement and invited Ms. Hankee to provide the history, timing events and discuss the agreements. Ms. Hankee introduced herself to Council and stated she was not the Engineer that was employed with the City at the time that negotiations took place in late 2014 but she was aware that the previous City Administrator for Centerville and the Lino Lakes Administrator had negotiated a price; however, was unaware of the status of the agreement, thought that it had been approved and proceeded with the work. Ms. Hankee stated that she was excited for the new development further down on W. Cedar Street since asphalting the roadway allowed for reduced maintenance costs, she worked with the Public Works Department regarding construction timelines, driveway aprons, etc. Page 4of8 44 City of Centerville Council Meeting Minutes September 23,2015 Mayor Wilharber stated that it appears that the between the hiring of the new City Administrator, transferring responsibilities and hiring of a new City Engineer for the City of Lino Lakes the agreements for asphalting and maintaining the roadway were overlooked. Both Council Members Fehrenbacher and King felt that the City of Centerville received no benefit from the project and truly it was the City of Lino Lakes that had received 100% of the benefit from the project due to the new development and road maintenance costs. Discussion ensued regarding timing of the agreement versus the construction of the roadway, lack of Council action prior to construction without an agreement, negotiation by City Staff without Council authorization, 100% benefit to the Northpointe Development and whether there was a benefit to the City of Centerville. Mr. Burmeister stated that the City of Centerville does receive a benefit from the roadway being asphalted, i.e. maintenance vehicles remain in clean condition, less repairs due to dirt roadway, building cleaning costs are decreased and that staff was under the impression that the City had already approved the necessary agreements for the construction. Council Member Love questioned whether the City of Lino Lakes had approved either of the agreements without the City of Centerville's approval or prior to construction. Ms. Hankee stated no but she had emails that stated that the City of Centerville would entertain the construction, costs negotiated with it and an agreement for maintenance. Council Member Love questioned why the roadway was not paved to its terminus and Ms. Hankee stated that this is a temporary roadway and future development would determine building the roadway to standard including turn lanes onto 20th Avenue. Ms. Hankee stated that during construction, Centerville Staff required the contractor to pave the three driveway aprons 15' to 20' similar to other road projects and standards. Ms. Hankee stated that this increased the City of Centerville's cost of the project by approximately $8,000; however, due to the confusion with the Joint Powers Agreement they would not be asking for that payment. Mayor Wilharber called for a vote. Council Member King requested clarification of the costs associated with the roadway and aprons provided at the City's Public Works site. Ms. Hankee clarified $10,000 for the City's portion of the roadway and $8,000 for the aprons, however they would not be asking for the $8,000. Council Member King also asked what the total costs of the project were for the City of Lino Lakes and Ms. Hankee replied 50%were paid by the developer of the total $125,000. Motion by Council Member Fehrenbacher, seconded by Council Member Love to approve Res. #15-OXX — Approving the Joint Powers Agreement Between the City of Lino Lakes and Centerville Regarding West Cedar Street Paving as presented. Council Members Paar and King opposed. Motion carried. b. Res. #15-OXX — Approving Joint Powers Agreements Between the City of Lino Lakes and Centerville Regarding Maintenance of West Cedar Street Page 5 of 8 45 City of Centerville Council Meeting Minutes September 23,2015 Discussion ensued regarding if the City of Centerville's portion of the pavement of the roadway was 10% of the costs then all maintenance should be 10%, lack of street sweeping equipment, maintaining individual ditches, agreement termination date, construction of standard roadway and its shared costs and maintenance. Motion by Council Member King, seconded by Council Member Fehrenbacher to table this agreement to the next meeting to allow staff to revise it. All in favor. Motion carried. Ms. Hankee stated that the Cities of Lino Lakes and Centerville continue to discuss a Joint Powers Agreement regarding the maintenance of 21"Avenue North. 2. Discussion on Ordering of Feasibility Report for 2016 Thin Mill & Overlay Project Engineer Statz stated that Council desired to obtain quotes for this project prior to final approval of the 2016 Budget due to funding, state aid, franchise fees and levy increase in anticipation of the project. Engineer Statz also stated that when requesting bids from contractors he would allow for project decreases if Council desired to remove roadways. Discussion ensued regarding trail maintenance, City Hall parking lot resurfacing, inter-fund loans and payback schedules, park/trail dedication fees, curb replacement, special assessments, length of time to implement franchise fees, dedication of those fees to roadway Capital Improvement Project and whether contingencies would be built in to the project. Engineer Statz stated that two areas of concern would need curb replacement due to sanitary sewer lines heaving and addressing funding and contingencies built into the estimate for the project. Administrator Ericson stated that Council would need to make a final decision on whether or not to assess franchise fees to Connexus and Xcel Energy customers on behalf of the City, that many municipalities are completing the same processes and that it is a very political issue. Administrator Ericson also stated that Xcel Energy is approximately three months behind in implementing fees and Connexus process is much shorter. Motion by Council Member Fehrenbacher, seconded by Council Member Love to order a Feasibility Report for the 2016 Thin Mill & Overlay Project and approve Stantec's Proposal for Associated Services in an Amount Not to Exceed $9,000 as presented. All in favor. Motion carried. IX. NEW BUSINESS 1. Reader Board Request — Open House (Ultimate Martial Arts, 6845 — 20th Avenue South, Ste. #160) Administrator Ericson stated that the City recently received a request from a business to promote their open house on the City's Reader Board. Motion by Council Member Fehrenbahcer, seconded by Council Member Paar to Deny the Current Request Due to Lack of Policv and Forward to the Planning & Zoning Commission for Review. All in favor. COUNCIL & ADMINISTRATION ANNOUNCEMENTS Mayor Wilharber stated that he had received a letter from a resident residing at 7384 Old Mill Road requesting driveway repair,previous road project, special assessments and exposed utilities Discussion ensued regarding previous declined offerings of paving the lower portion of the driveway and previous City favorable court action regarding special assessments and driveway concerns of the owner. Council concurred that Administrator Ericson would continue to work with the property owner, research the item and keep Council abreast of the situation. 1. Administrator Ericson Administrator Ericson stated that he continues to have discussions with Mr. Rich DeFoe and has advised him to contact a broker for the sale of the old Waterworks site. Administrator Ericson stated that he recently met with staff from North Metro TV regarding Centerville marketing and history videos. 2. Council Engineer Statz stated that with the new FEMA map, the City's floodplain ordinance would need to be updated and the Planning & Zoning Commission would be considering calling a public hearing at its November meeting and then it would be forwarded to Council for consideration in December. Engineer Statz stated that all wetland transactions had been completed for the 2013 Trail project closing it out. Engineer Statz also stated that Anoka County has yet to provide remaining invoices associated with the CSAH21/Centerville Road project but anticipate receiving them prior to Council's final approval of the 2016 budget. Council Member King stated that a Joint meeting would be held with the North Metro TV Commission and Administrators on October 6, 2015 for discussion of a proposed franchise agreement with CenturyLink. This is all due to the City of Centerville lowering the road at the bottom of my driveway 5 feet. As you know,before the Clearwater Creek development my driveway was STREET LEVEL. During the time of the Clearwater Creek Development it had been stated at the City Council meetings, that all property owners affected by this development,that there properties would be cleaned up and returned to their original state.This was stated by our ex mayor Capra.When the road was re- established, I came home from work and found a driveway lowered by 5 feet. I complained and was promised that the City would have to resolve this matter. I then went to a City Council meeting about this issue and all they wanted to do was patch the bottom. I would not agree to this as it would not resolve the problem of the erosion. At this meeting the City also stated that my property would not be assessed until the driveway was fixed. The City went ahead and assessed me anyway. I have been trying to resolve this issue through my attorney which supposedly has been talking the the city attorney,but as you can see nothing has been done. In the assessment, 1 am paying for sidewalks which the city decided not to install. It is my belief this did not happen due to the elevation drop in front of my property ave to install a retaining wall along the front of the property to make it work. Why am I paying for som thing I did not receive? I believe the law is any drop over 2 feet requires a retaining wall. I have had contractors out to see how this driveway can be repaired. They had told me the only way is to have retaining walls to stop the erosion.Also,being the drop of the driveway is so great there is only 1 inch of soil remaining on top of all the utility and gas lines. I have been a resident of Centerville since 1979 and I am quite upset about the way the city keeps ignoring me and not trying to resolve the issue. You have assessed me$90,000.00. You have not gone through with anything I was promised to get this issue taken care of. I have to have this matter taken care of properly as I fear the gas line will get hit with snow removal this winter. Having completed more intensive reconstructions or pavement replacement projects on most city streets, the city's streets are now just in need of more routine maintenance. Given some experience with prematurely failed seal coats and with new information from the Minnesota Department of Transportation, it was decided to move to a program of thin bituminous overlays, rather than traditional chip seal projects. This year's project would mark the 3rd consecutive year of administering the Thin Overlay Program. PROJECT FINANCING The city council has recovered portions of the project costs through special assessments in each of the two previous years,with the remainder coming out of the City's general levy budget for the Thin Overlay Program.This report outlines similar project financing methods. Locations were determined by the Centerville Thin Overlay Program's goal of overlaying streets around the age of 15 years since the last improvement, coupled with site investigations by the city engineer and public works director to assess the condition of various streets. All streets listed will receive either a 1 or 2-inch mill and overlay. The mill depth will transition from 1 or 2-inches at the edge to 0-inches at the crown. Milled areas will receive bituminous tack and a bituminous wear-course. All castings will be adjusted with steel insert adjusting rings. Minimal curb and bituminous patching needs will be addressed by the City's public works department prior to the project bid. This cost estimate is based on bid prices from the last two years' actual bid costs. Other construction costs outside the main project bid include materials and labor costs for improvements the public works department may make to the roads ahead of the project,such as minor curb replacements, bituminous patching, catch basin repair or storm sewer crossing repairs. SOFT COSTS In addition to construction costs, other costs which affect the overall project costs include engineering feasibility, design and construction administration costs. These costs are included in the total project costs presented below. In general, this law allows municipalities to assess benefiting properties for all or a portion of the cost of public improvements. The maximum amount which can be assessed is the lesser of the total project costs (divided uniformly over the same classes of property) or the increase in property value afforded by the improvement to the benefiting properties. For this project, residential property assessments have been calculated on a per parcel basis and the commercial property assessments have been calculated based on front footage. Front footage assessment amount is based on the$47 centerline foot cost estimate for Mill Road. Then divide by two for a front foot cost to get$23.50/front foot.Then, we evaluated the amount being assessed in residential areas as a percentage of the project costs and came up with a rate of approximately 25%. Finally, applying that same percentage to the front foot cost, gives a value of$5.875/front foot. The City Attorney has offered an opinion that cemeteries are exempt from special assessments according to MN Statute 306.14. Therefore, the St. Genevieve cemetery along Mill Road will not be assessed. The area to be assessed is shown on Figure 3 in the appendices. RECOMENDATIONS The following are our recommendations if the Council wishes to move forward with this project: 1. Accept this report and adopt its findings. 2. Call for and hold a Public Improvement Hearing, notifying affected residents. 3. Consider any changes to the project scope (including cancelation or delay of the project) based on public input. 4. Bare spots in the rain gardens were given a final inspection by Rice Creek Watershed District and passed, enabling them to close out our permit.) A final pay request, releasing final retainage has been prepared atter review of the contractor's final documentation and is on this week's City Council agenda for approval. 2. Centerville Road (CSAH 21) Reconstruction (193801639). All work is complete. County staff and the contractor are going over final invoices and pay quantities. We hope to have a chance to review the proposed final pay request shortly so we can report back to the city council on final costs. 3. 21st Ave., North of Main St. (193802667). City staff is working with Lino Lakes staff on some easement issues and getting record plans submitted. 4. 2016 Thin Overlay Program (193803352). The Feasibility Report will be presented at this meeting. We are working towards the council's goal of bidding the project before year-end in order to understand, more dearly, the projects budget implications, prior to adopting the final levy. 5. Wellhead Protection Plan Update — Phase I (193803358). Our staff has been working on compiling data from several sources to begin work on the project. 6. Miscellaneous(193803123). • A public hearing has been scheduled for the next Planning Commission meeting for the new Floodplain Ordinance which must be adopted by the City Council prior to December 16, 2015. Adopting this ordinance ensures the city will remain in FEMA s flood insurance program. • City Staff will be contacting the school to set up a meeting for us to review the districts proposed parking lot and driveway redevelopment. This project may have implications on the City's downtown redevelopment strategy, especially north of MainStreet. • We have been working with the City Attorney to revise language in the proposed Cedar Street Maintenance Joint Powers Agreement. • The City received notice that they will be required by the DNR to submit an updated Water Supply Plan by December of 2016. We will be working with the public works department to formulate a plan to address this requirement. • Rice Creek Watershed District has requested an accounting of at least 3 years of usage for the storm water reclamation system at LaMotte Park per their Memorandum of Agreement(MOA) with the City. This accounting will determine the actual functional capacity of the system and therefore how much storm water treatment "credit' the city will have banked. With this information, the City can then determine whether or not there is a need to pursue ways of pumping more water, through a heavier watering schedule, or through the expansion of the irrigation system footprint. There are several contingency plans in place for simple, inexpensive expansions.
