HomeMy WebLinkAbout2015-11-02 P & Z Minutes - Approved CITY OF CENTERVILLE PLANNING AND ZONING COMMISSION Pursuant to due call and notice thereof, the Planning and Zoning Commission held its regular meeting on Monday, November 2, 2015 at 6:30 p.m. PRESENT: Chairperson Darrin Mosher Commissioner Russ Koski Commissioner Matthew Montain Commissioner Mark Haiden Commissioner Nick Twohy ABSENT: Commissioner Tom Wood STAFF: City Administrator Mike Ericson City Engineer Mark Statz OTHERS PRESENT: Council Member D. Love I. CALL TO ORDER. The meeting was called to order at 6:30 p.m. by Chairperson Mosher. 1.Roll Call II. APPEARANCES 1. Mr. & Mrs. Josh Dahl, 1634 Hunters Ridge Lane – Request Variance to Construct Screen Porch 2’ within 10’ Setback Mr. & Mrs. Josh Dahl appeared before the Commission inquiring about building a screen porch two (2) feet within the required ten (10) foot setback. Mr. & Mrs. Dahl stated that they had been told by two (2) staff members that more than likely that their request would be denied as it did not meet the criteria for granting a variance; however, they determined that it would be best to speak with the Commission regarding their desire. Mr. Dahl stated that he had constructed the home following all setback requirements not taking into account an afterthought of desiring to construct a screened porch which he desired to encroach into the ten (10) foot side setback area by only two (2) feet. Lengthy discussion ensued regarding setback requirements, variance requirements, the property owners’ responsibility for not creating their own hardship and the inability of the Commission to grant their request due to the latter. III. PUBLIC HEARING(S) The Chair opened the public hearing at 7:07 p.m. Page 1 of 4 City of Centerville Planning and Zoning Commission November 2, 2015 1. City Code, Chapter 156, Subdivision 156.166 – Parking Requirements (Other Industrial or Warehouse) Administrator Ericson noted previous discuss of the Commission regarding neighboring communities requirements, the City’s Commercial Broker, Mr. Lou Suski’s comments and comments from current property owners. Administrator Ericson noted that no verbal comments were received. No one from the public was present. Motion by Commission Member Mosher, seconded by Commission Member Montain to Close the Public Hearing at 7:12 p.m. All in favor. Motion carried. 2. City Code, Chapter 155, Flood Damage Prevention Administrator Ericson noted previous discuss of the Commission, the need for approval due to the City’s desired participation in the Federal Emergency Management Agency’s Flood Insurance Program, previous work with Rice Creek Water Shed District in updating the map, individual property owner’s participating in the Flood Plain Study area (Lessard, Rehbein and Muellner) and allowing for the revised Flood Insurance Rate Map to become effective December 16, 2015. Engineer Statz reviewed the provided Minnesota Department of Natural Resources Flood Plain Draft Ordinance with the Commission. Lengthy discussion ensued and several minor modifications were made allowing the Ordinance to compliment the City. Administrator Ericson noted that no verbal comments were received. No one from the public was present. Motion by Commission Member Mosher, seconded by Commission Member Haiden to Close the Public Hearing at 7:18 p.m. All in favor. Motion carried. IV. OLD BUSINESS 1. Discussion on Downtown Master Plan & Development Guidelines The Commission briefly discussed the Plan. Motion by Commission Member Montain, seconded by Commission Member Koski to table the item to the next regularly scheduled Commission meeting in December. All in favor. Motion carried. V. NEW BUSINESS 1. Recommendation to Council to Amend City Code, Chapter 156, Subdivision 156.166 – Parking Requirements (Other Industrial or Warehouse) Page 2 of 4 City of Centerville Planning and Zoning Commission November 2, 2015 Motion by Commission Member Montain, seconded by Commission Member Koski to Recommend to Council the City Code, Chapter 156, Subdivision 156.166 – Parking Requirements (Other Industrial or Warehouse) amendment as presented. All in favor. Motion carried. 2. Recommendation to Council to Amend City Code, Chapter 155, Flood Damage Prevention Motion by Commission Member Haiden, seconded by Commission Member Montain to Recommend to Council the City Code, Chapter 155, Flood Damage Prevention with the Discussed Amendments. All in favor. Motion carried. 3. Rush Line (Pre-Project Development Study) Administrator Ericson updated the Commission on the status of the study and the removal of the I- 35E corridor for BRT and further study. 4. Discussion on City Policy for Municipal Lighted Board @ City Hall Administrator Ericson stated that upon a request from a local business to place an upcoming event on the City’s lighted board out front, the City has no policy for usage but standard practice has been for non-profit or City sponsored event, Staff received two (2) policies from other cities. Discussion ensued regarding researching language through the League and it was felt that the two (2) policies received were sufficient and that a policy could be drafted incorporating the language and be forwarded to the Commission for the next meeting. Motion by Council Member Montain, seconded by Commission Member Koski to table the item to the next regularly scheduled Commission meeting in December. All in favor. Motion carried. 5. Acceptance of Resignation of Commission Member James Flint Administrator Ericson stated that a Certificate of Recognition had been drafted for presentation to Mr. Flint. A member of the Commission stated that Mr. Flint is very busy with his family. The members thanked him for his years of service. VI. DISCUSSION ITEMS None. VII. CONSIDERATION OF MINUTES 1.September 1, 2015 Planning & Zoning Commission Meeting Minutes Page 3 of 4 City of Centerville Planning and Zoning Commission November 2, 2015 Motion by Commissioner Mosher seconded by Commissioner Koski to approve minutes from the September 1, 2015, meeting as presented. All in favor. Motion carried. VIII. ADJOURNMENT Motion by Commissioner Montain, seconded by Commissioner Mosher to adjourn the meeting at 8:35 p.m. All in favor. Motion carried.
