NOTICE IS HEREBY GIVEN that the Planning and Zoning Commission of the
City of Centerville, Minnesota will meet and consider resident input regarding a
proposed lot split, rezone and a Comprehensive Plan amendment of 7384 Old Mill
Road. Applicants desire to split the easterly six (6) acres from the ten (10) acre
parcel which would require a rezone from R-1 (Rural Residential) to R-2 (Single
Family Residential). The request to split the parcel in this fashion is per a private
settlement agreement between the two owners of the property. The Commission
will meet on November 1, 2016 commencing at 6:30 p.m. in Council Chamber of
City Hall located at 1880 Main Street, Centerville, MN 55038.
The City Hall is ADA accessible. Requests for hearing assisted devices or a
sign language interpreter must be received before 4:00 p.m., October 26, 2016. All
persons interested are invited to attend and to be heard, verbally or in writing. You
may call City Hall at (651) 429-3232 if you have any questions.

meeting on Tuesday, October 4, 2016 at 6:30 p.m.

I. CALL TO ORDER. The meeting was called to order at 6:30 p.m. by Chair Mosher.

1. Request for Conditional Use Permit 2030 Main Street, Mr. Gary Spanier (Rumble
Industries) — Operate a Motor Vehicle Sales & Service Business (Primarily
Motorcycles, ATV's & Snowmobiles)
Chair Mosher opened the public hearing at 6:31 p.m.
Mr. Gary Spanier, Rumble Industries, introduced himself to the Commission and noted that he
was moving to the building due to restricted size limitations, ease of access and poor visibility in
his existing location in Spring Lake Park. He stated that he has been a responsible business owner
in Spring Lake Park and looks forward for the opportunity to become the same within Centerville.
Mr. Spanier stated that he has had an opportunity to meet with Staff, discuss issues, reviewed the
proposed language contained in the Draft Conditional Use Permit and concurs with the proposed
conditions.

Chairperson Mosher opened the public hearing at 6:33 p.m.
Mr. Magdik introduced himself to the Commission, stated that the lot is very odd sized, felt that
the lot could not be utilized to its full potential if not allowed the variance, felt that the hardship
was not doing of his own and to make it feasible to build a desirable home he needed the
encroachment.
Mr. Frank Zimny, 7252 Main Street, stated that he felt that if a variance was granted it would be
setting precedence which could cause future issues for the City.

The Commission reviewed the Draft Conditional Use Permit, and questioned whether Mr. Spanier
could comply with the regulations set forth in the Draft Conditional Use Permit. Mr. Spanier
stated there would be no problem.

Mr. Zimny mentioned that one house has been entirely demolished to the foundation and rebuilt
on the lake and again stated that he has concern for setting precedence.
Mr. Hal Wagner, 1525 Peltier Lake Drive, stated that he is the abutting property owner, previously
requested to purchase the lot, and is also concerned for setting precedence by granting a variance.

Mr. Magdik explained that he desired to build a 5,000 square foot home, utilizing the building pad
shown on a survey that he was provided by the City at the time of purchase, felt that the desired
home should have the ability to enjoy the natural resource of the lake similar to all others that
reside on the lake, that he only intended to encroach by 5'-10' into the lake setback and that he did
not create the any hardship. He stated that the survey was incorrect at the time of purchase.
Lengthy discussion ensued regarding Finding of Fact provided by City Attorney Glaser, municipal
sewer regulations associated with the lake, ability of Mr. Magdik to decrease the size of the home
allowing for a deck which meant that Mr. Magdik was in fact making his own hardship, and
setting precedence.

3. Hamlin University Capstone Project (EDA/EDC)
City Administrator Ericson reviewed with the Commission the excellent report and analysis of the
City EDA vs. EDC by two (2) graduate students in the Hamlin University Masters Public
Administration Program. He stated that no action was required.
4. Rehbein Black Dirt — Interim Use Permit
City Administrator Ericson shared with the Commission the current Interim Use Permit for the R
& R black dirt operation. He noted the City receives $3,000-$6,000 annually for the trucking of
black dirt. He stated that no action was required.
5. Frank Zimny - Variances
Mr. Zimny addressed the Commission with his many years of volunteer service on the
Commission. He noted a very good website "Story Poles" (prior to construction, story poles can
be requested or required to depict the outline of a project. In some neighborhoods, story poles are
erected to depict the outline of a proposed home addition, garage or landscaping, merely to satisfy
a neighbor or a home owners associated.) He stated that the poles can be required by City
Ordinance, a homeowner's association architectural committee and are certified by a licensed land
surveyor, civil engineer or architect.
