REQUIREMENTS AND ADDING THE M-2 DISTRICT
NOTICE IS HEREBY GIVEN, that the Planning and Zoning Commission of the City ofCenterville will
be meeting to consider the proposed ordinance modifying the M-l District requirements and adding the M-2
District on Tuesday, May 2, 2006 in the Council Chambers of City Hall located at 1880 Main Street,
Centerville, Minnesota commencing at 6:30 p.m. or shortly thereafter.
The ordinance modifies the regulations for the permitted uses and special requirements for the M-I District
and establishes the M-2 District and its regulations. Regulations specifically require that any development
comply with "Downtown Redevelopment Master Plan".

SECOND SERIES
AN ORDINANCE AMENDING CHAPTER 154 OF THE
CENTERVlLLE CITY CODE BY MODIFYING 1\1-1 DISTRICT REQUIREMENTS
AND ADDING M-2 DISTRICT
THE CITY OF CENTERVILLE ORDAINS
Section 1. Code Section 154.090 shall be amended to read as follows:
154.090 MIXED USE DISTRICT (M-1).
(A) Pl/11Jose. It is intended that the M-l District implement the "Master Plan and
Development Guidelines for Downtown Centerville," adopted by the City Council on
January 11, 2006 (the "Redevelopment Plan"), and provide for the unique layout and
character of a traditional central business district with retail, professional office,
accessory residential and other mixed uses
(B) Permitted lIses.
( I) Retail sales conducted within structures, but excluding automobile and
motorized equipment sales, truck stops, gasoline and fuel sales and drive-through
restaurants;
(2) Repair and service conducted within structures, but excluding automobile
and motorized equipment repair;
(3) Professional, business, and health care offices;
(4) Residences above the first floor;
(5) Theaters and recreational businesses conducted within structures; and
(6) Public parks and buildings.
(C) ,SjJecial require/1leJ1ts. The following special requirements are intended to
implement the Redevelopment Plan, which is incorporated herein by reference
(I) Existing uses that are not in conformance with this section may not be
expanded, but may continue as nonconforming uses. These nonconforming uses may be
repaired and maintained and are allowed minor improvements that do not expand the use.
(2) In making decisions about land use compatibility and dimensional criteria
for uses and structures, the City shall have broad discretion to protect the public health,
safety and welfare: and to protect the integrity of the M-l District and surrounding
residential neighborhoods. Redevelopment of any parcel shall be accomplished by
submitting application as a Planned Unit Development.
(3) Driveway access to any use shall not be permitted from Centerville Road or
Main Street but rather planned side streets and alleys must be used for such access.
(4) The Redevelopment Plan establishes a shared parking plan. Applicants for
permits shall indicate how they will conform to the parking plan, including potential
dedication of property for shared parking or public parking lots. The City shall have
broad discretion in determining whether to accept ownership and maintenance of shared
parking facilities. Maintenance of public parking and other public facilities may be
accomplished through creation of a Downtown Service District and may include
maintenance assessments or user fees.
(5) The architectural design and exterior building materials used in connection
with any new or expanded use or structure shall be consistent with any architectural
design or aesthetic control requirements e~1ablished by the Redevelopment Plan. The
City will engage the services of a consultant architect to assist with the review The cost
of such services may be charged to the applicant.
(6) Stormwater management will be accomplished through regional stormwater
facilities. Construction of the stormwater facilities may be accomplished through
coordinated private improvements and public improvements, and maintenance of the
stormwater facilities may be accomplished through district-wide assessments and user
fees. Individual stormwater improvements that are not part of the planned regional
stormwater management facilities are not permitted in the M-l District.
Section 2. A new Code Section 154 091 shall be inserted to read as follows:
154.090 MIXED USE NEIGHBORHOOD DISTRICT (M-2).
(A) Purpose. It is intended that the M-2 District implement the "Master Plan and
Development Guidelines for Downtown Centerville," adopted by the City Council on
January 11,2006 (the "Redevelopment Plan"), and provide tor higher density residential
uses and accessory retail and office uses to complement the adjoining M-l District and
existing neighborhoods.
(B) Permitted uses.
(1) Residential uses with a density between 12 and 30 units per acre.
(2) Ground level retail or offices up to 25% of a stmcture, provided that the use
is on a corner lot.
(3) Public parks and buildings.
(C) Special requiremellts. The tollowing special requirements are intended to
implement the Redevelopment Plan, which is incorporated herein by reference.

AN ORDINANCE AMENDING CHAPTER 154 OF mE
CENTERVlLLE CITY CODE BY MODIFYING DEFINITIONS AND CHANGING
REGULATIONS RELATED TO ACCESSORY STRUCTURES
THE CITY OF CENTER\;1LLE ORDAINS:
Section 1. Code Section 154006 Detinitions. The detinition of "Yard, Front" shall be
amended to read as follows:
YARD, FRONT. A yard extending across the full width of the front lot between the side lot
lines and extending from the front property line to the depth required in the yard regulations of
the district in which the lot is located. On a corner lot, both street frontages shall be considered
the front.
Section 2. Code Section 154.022 shall be amended to read as follows:
~ 154.022 ACCESSORY STRIJCTURES AND USES.
( 1) Accessory Structures-Residential U~es
(A) No more than two accessory buildings are permitted on any single-family, detached
dwelling parcel located in any district except R-l. Combined aggregate square footage
for accessory structures shall not exceed 200 square feet or 2% of the lot area,
whichever is greater.
(B) In no event may the combined square footage of accessory buildings exceed the square
footage of the main level of the principal stmcture, except in the R-l District.
(C) No accessory structure may be constructed on a parcel without a principal stmcture
(D) No accessory structure shall be erected or located ,yithin any required yard other than the rear
yard.
(E) Accessory stmctures must have a minimum of a 5-foot interior side setback and a 10-
foot rear setback. Where a rear or side yard abuts a street, an accessory building shall be
set back a minimum of 20 feet from the street property line. No structure may be
placed in an easement except bridges by written permit approved by the City Council.
(F) In case an accessory structure is attached to the main building, it shall be made
structurally a part of the main building and shall comply in all respects with the
requirements of this chapter applicable to the main building.
( G) An accessory building, unless attached to and made a part of the main building, shall
not be closer than 6 feet to the main building, except as otherwise provided in this
section.

(H) The total area of an attached accessOlY building (garage) shall be no greater than 1,500
square feet per level, but in no event may the garage space exceed the square footage of
the main floor of the dwelling
(I) Swimming pools may exceed the size requirements for accessory structures, but shall
not exceed 50% of the rear yard.
(J) The side walls of an accessory building shall not exceed 10 feet in height and the
overall height of the structure shall not exceed fifteen feet, except to match the roof
slope of the principal structure. This provision shall not apply to farm buildings located in
a R-l district.
(K) Arbors. trellises. balconies. breezeways. open porches. detached outdoor living roolUS. and
heating equipment may be placed in a rear yard if it is at least fifteen feet from the rear lot line
and five feet from a side lot line. but may not be closer to a side street property line than the
principal structure.
(L) Neither buildings with metal roofs and exterior walls and covering a total (exterior) area
in excess of 120 square feet, nor any other buildings with metal roofs shall be permitted
in any residential or mixed use districts. Pole-type buildings and rigid frame structures
with membrane roof or sides, are also prohibited all zoning districts.
(M) Buildings exceeding 120 square feet shall be anchored to a concrete floating slab
foundation.
(N) The exterior color and design of an accessory structure shall be similar to the principal
structure.
(2) Accessory .~'f/'1lct1/res. 11011-residel1tialuses. The following standards shall regulate the
construction and maintenance of non-residential accessory structures:
(A) All accessory structures shall be subject to the same setback, height and exterior
finish regulations as a principal structure for the district in which it is located.
(3) Permits. All accessory structures shall require a building or zoning permit from the city.
Section 3. Code Section 154.060, Subd. G shall be amended to read as follows:
(G) AccessOf)' Structures. Garages, accessory structures, screen walls, buildings and exposed
areas of retaining walls shall be of similar type, quality and appearance as the principal structure.
The height of an accessory structure shall not exceed the height of the principal structure.
Section 4. Effective Date. This ordinance shall be effective immediately upon its passage
and publication according to law.

Memo to Planning and Zoning Commission
From: Dallas Larson, City Administrator
A local resident has requested that the City consider amending its rules to allow a covered porch
to extend into the required front setback.. Other communities are split on this issue. I looked at
about a dozen zoning ordinances from other cities and found about half are like Centerville and
allow only uncovered entrances to encroach.. Some of those that do permit a covered porch
allow walls, others allow a roof only. Some examples of those that allow this in some form are
indicated below. The name of the city and an excerpt of their code language are indicated.
Cannon Falls
A one story enclosed entranceway for a detached single family or duplex dwelling may extend
into the front yard setback not exceeding four feet.
Brooklyn Park
The following are considered a permitted encroachment into the front setback if they
extend no more than a distance of six feet: balconies and porches, steps, stoops, and the
like provided they do not have a floor higher than the entrance floor to the building and
are not enclosed with windows, screens, or the like, although they may have a roof
Shorewood
A one story enclosed entrance for a detached single-family, two-family or townhouse
dwelling, existing prior to adoption of this chapter, may extend into the front yard setback
not more than four feet. The entrance shall not exceed six feet in width;
Lindstrom
Architectural projections extending not more than three feet into a yard area including
cantilevered roof overhang, except those indicated below
Osseo
A one-story enclosed entrance for a detached one-family, duplex, or townhouse dwelling
may extend into the front yard setback not exceeding four feet
St. Michael
A one-story entrance for a detached single-family or duplex dwelling e~ into the
front yard setback not exceeding five feet, subject to the approval of the _

Acting Chair Klennert Hunt opened the public hearing at 6:33 p.m.
City Administrator Larson indicated that the Church and the most affected property
owner have reached an agreement.

out.

The Commission and Staff discussed the proposed new district and agreed to set a
public hearing to consider it.
Commissioner Wood indicated he would like to leave the Church on its own.
Motion bv Commissioner W 004. seconded by Commissioner Pan,elL to set a

and Creation of tbe M-2 Distritt. AU in favor. Motion carried unanimously.
The Commission agreed that all should be notified to keep them informed and to
improve relations.
2. Proposed Ordinance #93 - Modifying Definitions and Changing Regulations
Related to Accessory Structures
Commissioner Hanzal said he felt the Ordinance was well drafted.
Acting Chair Klennert Hunt asked if swimming pools are an accessory structure.
City Administrator Larson indicated that they are.
Commissioner Hanzal asked if a greenhouse would be included in this.
City Administrator Larson indicated it would be.
Motion by Commissioner Banzai, seconded by Commissioner Love, to set a
public hearing for the May meeting. All in favor. Motion carried unanimously.
V. NEW BUSINESS
1. Mr. Shaun O'Keefe. Purchase Agreement 1605 Peltier Lake Drive - Request

Mr. O'Keefe indicated that the lot next door to Mr. Sahlstrom was for sale but
now Mr. Sahlstrom property is for sale and this is a double lot as evidenced by
survey, which he then provided to the Commission.
Mr. O'Keefe indicated that the first half of the lots in the area look to be 75 feet in
width and then it goes up to approximately 90 feet of lakeshore.
Mr. O'Keefe indicated that Anoka County requires 100 feet oflakeshore so this is
nonconforming but according to the neighborhood it would fit in with the makeup
of the neighborhood.
Mr. Sahlstrom indicated that in order to make the payment on the building to get a
mortgage he had to mortgage the lots and at that time they were combined into a
single lot.
City Administrator Larson explained that the house straddles the property so there
is no way to split it without tearing the home down and, even if you do, it does not
meet the minimums. He then said that the only way to do this is to change the
minimum lot size on lakes.
Mr. O'Keefe indicated that he and his brother wish to build houses on each lot.
City Administrator Larson indicated that the Ordinance would need to be
amended to allow 75 foot lots.
Mr. O'Keefe indicated that the frontage along the lake is 174.2 feet.
Acting Chair Klennert Hunt indicated that most of the lots in the area are 75 feet
wide so it would fit but the Zoning Ordinance does not distinguish between the
newer wider lots and the existing older neighborhoods.
Acting Chair Klennert Hunt suggested a townhome or duplex with a zero lot line
between the homes.
City Administrator Larson indicated the City could have a different rule on Peltier
Lake by amending the Ordinance. He then said that the minimum lot size is
15,000 square feet.
Mr. O'Keefe indicated that he feels the lot size would be approximately 12,000
square feet per lot if the watershed property was purchased and the lots were split.
City Administrator Larson asked how much the water utility is willing to sell.
Mr. Sahlstrom indicated it is 26 feet.

Commissioner Wright said that the lot width would match the surrounding area if
you do different zoning for Peltier Lake.
Commissioner Wood indicated that he does not want to change the rules and then
find out that the County would not agree. He then said that he does not see a
hardship and there is the issue of the lots not meeting the minimum square footage
requirements.
Acting Chair Klennert Hunt indicated that the City cannot help with this as it just
will not work.
Commissioner Wood said that a duplex would be allowed based on the rules but
the City cannot do a lot split.
Mr. Sahlstrom thanked the Commission for trying to find a way to make it work.
Mr. O'Keefe thanked the Commission for the attempt to work it out.
2. Royal Excavating Site Plan (2044 Gateway Circle)
Mr. Black of Royal Excavating indicated that they would like to make this the
location of Royal Excavating and then provided an overview of the site plan for
the Commission.
City Administrator Larson indicated that metal is not allowed as a construction
material in the industrial or commercial districts.
Mr. Black indicated that above the elevations if they brought the block wall above
the doors they would have to put a header in for the doors all the way across.
Commissioner Hanzal indicated that the City has held everyone else to masonry
standards and he is concerned that other business owners would not be pleased.
Acting Chair Klennert Hunt indicated that she does not think this meets the
Ordinance but it does fit in with the other styles of the buildings there and it may
be necessary to make allowances for this type of situation.
Mr. Black indicated that the vents shown on the picture would not be done on this
building.
Commissioner Love indicated that the City is looking at developing the
downtown and he does not want to set precedent of changing rules up and down
because then others will ask for consideration of change.
Commissioner Wood suggested that the applicant go and ask what else can be
done to mitigate it without breaking the Ordinance.

Acting Chair Klennert Hunt said that she would prefer a revised plan. She then
said that the building looks nice but it does not meet the Ordinance as written.
City Administrator Larson suggested having the metal wall section above the door
but continue the wall of masonry up to the roof
Mr. Black said that may be possible but he would have to look at it. He then said
that he would make the change and asked for the Commission to send it on to
Council for approval subject to the recommended change.
Mr. Black indicated that they will fence in the yard for security.
Commissioner Wright asked if there is a lot of hazardous materials stored on site.
Mr. Black indicated that they are required to provide adequate storage on site as
per the Fire Code. He then said that there are two floor drains and there is a trap
to separate them to be cleaned out on a regular basis.
Motion by Wood. seconded by Love. to recommend <;;ouncil aooroval of the
site olan based on the requirement that the metal be decorative exceot over
tlJe doors. that the concrete 20 no to tbe roof. and that ~pproYal is subiect to
review and aooroval of Staff. All in favor. Motion carried unanimouslv.
City Administrator Larson asked the applicant to redraw the plan and provide it to
Staff for consideration.
