The purpose of this meeting is to determine whether taxable property in the jurisdiction has been properly valued and classified by the assessor, and to determine whether corrections need to be made. If you are still not satisfied with the valuation or classification after discussing it with your assessor, you may appear before the local board of appeal and equalization. This is the same course as the annual 2016 and earlier Centerville Festival of the Lakes runs. Cen- terville Parks and Recreation Committee has elected to alter their Fete des Lacs running course for 2017. We may revisit the decision to stick with the older course later in the year. • This is a fund raising event for No One Left Hungry Foundation. Marsha Marcussen is the founder and principle operating officer. She has established strategic relationship with and works in cooperation with Union Gospel Mission, a homeless shelter in St Paul. • This funds raised in 2015 and 2016 were used to provide shoes, sleeping bags, blankets and warm clothing to the homeless and to support homeless shelters in St Paul and Anoka. The funds raised in 2017 will be used for a similar purpose. • The event benefits the homeless in Minnesota. People in need from rural and suburban areas tend to migrate to the larger cities. It is the intention of the event organizer to ben- efit those in need where ever they are in our State. Thus the statement of purpose is to benefit the homeless in Minnesota rather than Anoka or Ramsey Counties. • The race committee members are all volunteers. Joe explained that Oppidan needs the additional time to reduce its project costs and to confirm financing on the project. According to Joe, construction bids came in much higher than expected. Consequently, Oppidan has had to reduce the size of its project to get costs to an acceptable amount. I have agreed to give Oppidan a 10 month extension starting April 1, 2017 and ending January 31, 2018. 1 have also set April 2, 2018 as the closing date if Oppidan ultimately proceeds to close on the two properties. I will attempt to respond to the bulleted items that I provided in my February 9 email and which is highlighted below: Impact on city municipal wastewater cost from switching flow period for cost allocation between 2016 and 2017. Unfortunately, we have not completed the 2018 cost/flow allocation process yet which includes flow generated in 2016. In order to re-create the 2017 cost/billings, we'll need to finalize the 2016 flow determination (at least the first half). We plan to compete the 2018 cost/flow allocations next week or the following week. We can then rerun the 2017 using the old flow period model for Centerville and compare how the switch of flow period impacted the City. • Does MCES have reserves in its budget? If so, how much, how is the reserve created, how large of a reserve can be accumulated and how are reserve funds used? • MCES keeps an operating reserve fund that has a minimum reserve balance requirement (10% of operating expenses excluding debt service cost). • At the end of 2016 we had some excess reserves as the balance was $19.2 million and the minimum balance requirement was $14.3 million. • The excess reserves are mainly used to decrease future Municipal Wastewater Charges. For example, for the 2018 budget that we are working on now, we may create a budget that has a deficit that is funded from reserves. In other words, the MWCs will be set lower than they otherwise would be. • Summary of communities having large 2017 cost increases. See table below. The list below ranks from High to Low the cost increase for the communities that experienced increases in their 2017 wastewater bills from the Council. It reflects those that had an 8% or higher increase. Centerville is located near the center of the list with an 11.62% increase. Most of the higher increases are attributable to growth that occurred within the community and many of those are smaller sewered areas. Thus growth had a greater impact. Communities that are listed in red text have 100% of their flow estimated based 27 I hope that last night's Council meeting achieved what you wanted it to. I felt that from the questions and discussions, the City Council members lacked the level of clarity that you and staff had at our meeting last week. I would appreciate it if you could pass on my thanks to Mark Statz for clarifying some of the questions and providing some background. Findings and Decision The Planning & Zoning Commission met on April 4, 2017 to hold a public hearing to consider a after the fact request of Luther Towing/Owner Keaton Luther for an Conditional Use Permit for property owned by Barbara J. Kozar Trustee and James R. Kozar Trustee, located at 7095 — 2e Avenue South, Centerville, MN (PIN #R24-31-22-23-0011), Lot 7, Block 1, Industrial Park, Subject to Easements of Record. FINDINGS: 1) The Planning and Zoning Commission opened the hearing but no one offered comment. During committee debate, the Commission heard comments from the applicant, Keaton Luther, and Mr. Craig Kozar. 2) The subject property is located within the B-1 (Commercial) zoning district with a similar use allowed (Automobile and Motorized Equipment Sales & Service; Excluding Salvage) with provisions for granting a Conditional Use Permit with reasonable conditions. The subject property and vicinity was previously zoned for industrial use. Uses in the vicinity are still transitioning from industrial to commercial use. 3) Luther Towing operates a business similar to a salvage operation. Luther tows vehicles in need of repair; many vehicles are inoperable or are missing parts. The City is highly concerned for appearance of the subject property, crime and public safety from stored vehicles, repairs and sale of parts, environmental ramifications, and the general appearance of a "junk yard" type business. 4) Luther Towing has a two (2) year lease with Craig Kozar, son of property owner's Barbara. J. Kozar Trustee and James R. Kozar Trustee. Luther Towing has been operating this business at the subject property since December, 2016 without first obtaining a Conditional Use Permit. Mr. Keaton Luther, President, Luther Towing has been untruthful about business practices during discussions with City Staff and the City Attorney. Not until after several stern warnings were issued by the City Attorney did Luther Towing apply for a Conditional Use Permit. 5) The proposed use of the site by Luther Towing is partially consistent with the Comprehensive Plan as long as service equipment/towing equipment is stored on site and towed/third-party vehicles are stored or standing inside the structure on the site. The proposed use of storing damaged vehicle outside the building is inconsistent with the Comprehensive Plan and a permit for this purpose is prohibited in this zoning district. Luther Towing stated they have an alternative site where vehicles may be stored. Off-site storage or 42 inside storage of third -party owned vehicles is in the best interest of the City of Centerville. The operation of a salvage yard is inconsistent with the City's Code and Comprehensive Plan and is strictly prohibited. In order to distinguish the practice of storing third -party owned vehicles inside the building from a salvage operation, the permit does not allow for repair, dismantling or `parting -out' of vehicles, no vehicles or parts thereof may be transacted on the premises, and this permit strictly forbids any other business practice normally associated with vehicle salvage operations. 6) The owner(s) of the property shall provide the City of Centerville with legal authorization to lease said site and apply for the Conditional Use Permit as the property is held in Trust by Barbara J. Kozar and James R. Kozar, parents of Craig Kozar. Lake ° Hilltop 54 Metropolitan Council Reform • The Metropolitan Council in the greater Twin Cities area has major responsibilities, such as waste water treatment, transit, distribution of federal funds for road projects, parks, etc., metropolitan economic development, and any other projects the council initiates. • The metropolitan planning organizations are required by the federal government for the distribution of federal transit dollars. In all other jurisdictions across the country and in the state of Minnesota, these organizations are made up of elected officials or a combination of elected officials and appointed individuals. In Minnesota, the Metropolitan Council is solely appointed by the Governor and serves at the will of the Governor. • In essence, the Metropolitan Council is an arm of the state and not representing the citizens of the greater Twin Cities metropolitan area. The appointees aren't elected, but have the right to tax and, one could say, this is "taxation without representation." • A group of counties and cities are challenging the organizational structure of our Metropolitan Council'. They have identified six principles: A majority of the council members should be elected officials. 2. Cities should have direct control over the appointment of city representatives. 3. Counties should directly appoint county representatives. 4. The terms of the Metropolitan Council should be staggered and not contiguous with the Governor. 5. Representation should be from every metropolitan county government. 6. Voting should be based on population with checks and balances. 55 LOCAL GOVERNMENT OFFICIALS MEETING March 29, 2017 Buffering Legislation Background The Minnesota legislature passed a law regulating what can be planted within 16.5 feet of a public ditch and 50 feet of a public waterway. This action is referred to as a buffer zone. If a landowner does not have the proper vegetation within the boundaries of the public water area or the ditches there is an enforcement action that can be taken. The Minnesota Board of Water & Soil Resources (BWSR) has responsibility for the overall processes as related in this statute. Counties, Watershed Districts and in certain cases cities, are given the option of being the enforcement entity over landowners in violation of this statute. The following identify some of the criteria as relates to the buffering statute. • A Minnesota Statute was passed mandating a strip of land called a "buffer" between certain types of waterways and certain types of land use. • Land adjacent to public water requires a 50 -foot strip between the waterway and certain types of land use. • Ditches are required under the statute to have a 16.5 -foot strip of land adjacent to the ditch where land reuse is controlled. • The land use specifically prohibited things such as row crops (such as corn and beans) things such as sod and grass are not considered prohibited. Feed lots and other types of land use could also be prohibited. • Minnesota DNR is responsible for developing maps of the public waterways and ditches across the state of Minnesota. • The local soil and water conservation district has the responsibility to identify those parcels that are not in compliance with the law. The soil and water conservation district communicates with the landowner identifying that there is a problem. If the problem is not rectified the enforcing authority is notified that the landowner is in violation. • The Minnesota Soil and Water Resources (BWSR) ultimately has the responsibility to enforce the statute. • BWSR encourages counties, watershed districts, and in some cases cities to take over the responsibilities of the enforcement. BWSR has requested that counties, watershed districts and others make a decision by the end of March whether they are going to be the enforcement entity or BWSR. If a county or watershed district chooses to be a part of the program or to be relieved of the responsibilities can do it at any time with a 60 -day notice. • The time table for enforcement is as follows: o Public waters November 1, 2017 o Ditch issues November 1, 2018 • If a county chooses to be the enforcement entity they are responsible for all the public waters located in the county. If a Watershed District chooses not to be the enforcement entity for ditches. We had a very nice and calm discussion. I was honest with him and stated that I was the one pushing for Waterworks to come down. I told him based on the information from our Public Works, CLPD, City Staff, and residents the building needs to come down for safety reasons. I also mentioned that we are trying to attract business to Centerville and that building does not aid in that. Rich argued that the building is still structurally safe and does not purpose any hazards to the city. I told him we could go around and around on this, but we will just have to disagree. I mentioned that we have been lenient because on the him removing the building because he had plans for development. I also mentioned that everything has fallen through, but Waterworks is still standing. I stated that he received a letter in July 2016 that something needed to be done and nothing has happened and that is why we are were we are. Rich showed me plans for 11 executive homes on the site and he has plans to sell his home and build a smaller home on the Waterworks site. He wants to wait to remove Waterworks until they start excavating the land were the new lots/homes would go. He said he has talked with Rice Creek and believes he has everything figured out, but is going to get in touch with them and Mike Ericson again. I asked what his time frame was for this and he said by summer. I told him this would be a different story if we saw development happening and progress being made, but the past 15 years we have seen nothing. I told him everything has to go through P and Z and they meet monthly and with al the permits etc, this could take a long time and council may not want to wait that long. 59 Rich does not want come in front of council to air all of this out. He wants to know if we could "push" the tearing down of Waterworks off since he has plans for development. He also mentioned with his development City water would be brought in and that may add getting water Lavalle Drive? Kurt, is there a way we could have closed executive session with Mr. Dafoe present to discuss his development plans, a timeline, and councils wishes? If we cannot with Rich present, can we with just the council, Mike, Paul Palzer, and yourself to discuss options? I want to get something resolved sooner than later because I know we have a court date coming up. I told Rich I am not making any promises, but wanted to meet with him to see if we can come to some sort of agreement. The bottom line is he holds the cards for development on his land. We can take Waterworks down, but that does not mean he will start any type of development.
