PRESENT: Mayor Jeff Paar Council Member Steve King Council Member Russ Koski Not � Council Member D. Love Council Member Matt Montain ABSENT: None. STAFF: City Engineer Mark Statz City Attorney Kurt Glaser City Administrator Mike Ericson COUNCIL MEETING I. CALL TO ORDER Mayor Paar called to order 6:30 p.m. II. PLEDGE OF ALLEGIANCE III. APPOINTMENTS/PRESENTATIONS 1. None. IV. APPROVAL OF AGENDA Mayor Paar added Check #30911-30926 under Consent Agenda. Motion by Council Member Love, seconded by Council Member Montain to approve the Agenda with the Above Noted Additions. All in favor. Motion carried. V. APPROVAL OF THE MINUTES 1. March 8, 2017 City Council Meeting Minutes Mayor Paar provided Council with an opportunity to make modifications. City of Centerville Council Meeting Minutes March 22, 2017 Mayor Paar requested that his name be corrected on page 1 and that at the top of page 5, second sentence should read April rather than May. Motion by Council Member Love, seconded by Council Member King, to approve the March 8, 2017 City Council Meeting Minutes with the Noted Amendments. All in favor. Motion carried. VIII. CONSENT AGENDA 1. City of Centerville March 9, 2017 through March 22, 2017 Claims (Check #30899-30910) & (Check #30911-30926) 2. Centennial Lakes Police Claims through March 16, 2017 (Check #11340- 11354) & (Check #11355-11373) 3. Centennial Fire District Claims through March 10, 2017 (Check #7791-7799) w/Payroll Check #7787-7790 Mayor Paar provided an opportunity for Council Members to add additional items or remove items for further discussion. Council Member Montain requested that Check #30907 be pulled for additional discussion and consideration. Discussion ensued regarding the need for three individuals to have memberships for Sam's Club and Administrator Ericson stated that he would not recommend this and requested that it be held. Motion by Council Member Koski, seconded by Council Member Montain to approve the Consent Agenda as Presented Except for Check #30907. All in favor. Motion carried. IX. OLD BUSINESS 1. Ruffridge Johnson Equipment Company, Jon Pederson Agreement (City Agreement) Administrator Ericson stated that several meetings have taken place with Mr. Pederson, Mr. Thorson, Mr. Halverson, Mr. Arnt and Staff to discuss soil conditions totaling $23,000, amount of site pads, interpretation of DEED'S "Shovel Ready" certification, building permit fees versus developer responsibilities totaling $27,375 and the significant investment that the City has made in the property. Staff recommendation is to decrease the purchase price rather than setting a precedence by granting the waiving of fees requested by Ruffridge Johnson Equipment Company. Posting of the roadway 9 Ton allowing for their equipment needs rather than 7 Ton, and issues with RCWD and their regulations from ten (10) years ago. Page 2of6 City of Centerville Council Meeting Minutes March 22, 2017 Lengthy discussion ensued by Council regarding whether the City was considered the developer with the Shovel Ready sites, the delayed requests from Ruffridge Johnson, the first agreement withdrawal, full purchase price and request for fee reductions. Council's repeated its desire to work with Ruffridge Johnson, whether the property was marketed at the fair market value price versus discounting at this point. There were several versions of building plans being submitted by Ruffridge Johnson, due diligence period ending in eight days and the need to review the City's fee schedule. Attorney Glaser stated that the "Shovel Ready" program came together very quickly by DEED to spur economic growth and City's invested in the program anticipating receiving benefits from DEED and their marketing. Motion by Council Member Love, seconded by Council Member Montain to Reduce the Purchase Price of 2065 Commerce Drive by $50,375 or from $950,000 to $899,625. Additional discussion ensued regarding authorizing Staff to present the offer to Ruffridge Johnson with the understanding that no additional negotiations will take place. Council Member Love desired to modify his motion to authorize staff to present the offer to Ruffridge Johnson with the understanding that no additional negotiations will take place. Council Member Montain accepted the friendly amendment. All in favor. Motion carried. Engineer Statz requested that Council all Staff to address RCWD's concerns regarding pond maintenance responsibilities and the posting of Commerce Drive being a 9 Ton roadway. Engineer Statz stated that he believe Commerce Drive had been constructed as a 10 Ton roadway. Brief discussion ensued regarding the City ability to modify the posting of the roadway at any time. Council Member Love, seconded by Council Member Koski to Designate Commerce Drive as a 9 Ton Roadwav Year Round, to Authorize Staff to Work with RCWD Regarding a Maintenance Agreement for the Ponding(s) Within the Clearwater Business Park & Community. All in favor. Motion carried. X. NEW BUSINESS 1. Minnesota Historical Society Grant Agreement — Dupre Antique/Artifacts Administrator Ericson stated that Council included its 2017 Focus Goals to develop a Dupre Antique/Artifact historical display. Craig Waldren from Hamlin University, provided the City of Centerville with a graduate student who was looking for a Capstone Project, Dave Perrault. Mr. Perrault drafted a MN Historical Society Grant Application and was successful on obtaining a grant of $5,977. Administrator Ericson stated that this Page 3 of 6 %G City of Centerville Council Meeting Minutes March 22, 2017 would start the process of obtaining software and equipment to inventory and catalog the items. He reported that he would oversee the grant and gain assistance from the Maplewood Historical Society and Ms. Rose Kubiatowicz, Have Gloves Will Travel, LLC, will be completing the cataloging of items. Administrator Ericson stated that Staff is excited to commence the first phase of heritage preservation in Centerville. Mayor Paar stated that the Dupre family was one of the first families in Centerville, have been very generous with the City in providing their family treasures for display at last year's Fete des Lacs celebration and providing the City with this opportunity. Council thanked Mr. Perrault for his grant writing abilities. Council Member Koski, seconded by Council Member King to Authorize Staff to Entering into the Minnesota Historical Society Grant Agreement as presented. All in favor. Motion carried. 2. City Code 111, Liquor Regulations a. Kelly's Korner Request for Amendment Administrator Ericson stated that upon the request of the owners of Kelly's Korner, they would desire for Council to consider allowing On -Sale, Sunday licensees, that meet the definition of a restaurant, club, bowling center or hotel with a seating capacity for at least 30 persons, to commence at 8:00 a.m. with the sale of alcohol coinciding with State Statute. Ms. Vicki Byrne and Mr. Jeff Schultz believe that their business needs to be competitive as clients have stated that they are traveling outside of Centerville to obtain/be served an alcoholic beverage with their Sunday breakfast. City Attorney Glaser noted the close proximity of the elementary school to two (2) of the eligible licensees and stated that there could be some concern for special events held at the school. Discussion ensued regarding eligible licensees (Kelly's Korner, Southern Rail, and Wiseguys), special licenses, additional fees, regulation, concerns for outdoor noise and activities, Off -Sale licensees having the new ability to sell commencing July 1, 2017, and needed notification of the Church and school of a modification if deemed appropriate. Council Member King was extremely concerned for additional outdoor noise that could arise for this modification, the Centennial Lakes Police Departments policing of noise and other residents that could be affected by this proposed ordinance amendment. Motion by Council Member Love to Amend City Code 111 to Allow Eligible On - Sale, Sundav Licensees to Commence Serving Alcohol at 8:00 a.m. per MN State Statute. Attorney Glaser stated that striking City Code, Chapter 111.07, subsection (F) would allow for 8:00 a.m. serving. Seconded by Council Member Montain. All in favor. Motion carried. X1. COUNCIL & ADMINISTRATION ANNOUNCEMENT 1. Administrator Ericson Administrator Ericson reported that Staff has been working closely with Ruffridge Johnson Equipment Company. Council Member Paar requested that Administrator Ericson report on the status of 7281 Main Street in his updates to Council. Administrator Ericson stated that an additional report from Olson Sewer has been received and provided to the property owner. Council Member Koski stated that he was not available to attend the Shake Your Shamrock events but heard that it was a good event. He congratulated Finance Director Paulseth for remaining on board with the City. Council Member Love stated that the League of Minnesota Cities recently provided its members with a Member Center and hoped that the City, if needed, utilized it. Council Member King stated that he would be attending the upcoming I-35/WE Corridor meeting. Mayor Paar reported that he and Administrator Ericson will be attending the League of MN Cities Legislative Conference with MN Cities, Counties, Townships and School Districts. He also reported that he would be meeting with Administrator Ericson at Kelly's to discuss the upcoming Fete des Lacs Celebration. Mayor Paar thanked all who participated in the Shake Your Shamrock event along with the organizers and Kelly's Korner. He stated that it was a well -attended event. Mayor Paar reminded residents to shop local. Mayor Paar stated that Council would be moving into a Work Session following the Adjournment of this meeting. X11. ITEMS OF DISCUSSION 1. Economic Development Authority Mayor Paar informed the Council that this item is important and staff noted that it is included in the 2017 City Council Focus Goals. 2. City Survey — Residents Mayor Paar suggested a survey of residents and Council agreed to add this to the 2017 City Council Focus Goals. 3. Water Connection Deadline Date (December 31, 2017) Mayor Paar informed Council of this issue which has a long history with the City not collecting connection fees from residents. Subsequent to discussion, Council directed Staff to provide additional information for further discussion at a work session solely for this item. 4. City Code, 150.30, Sump Pump Required Mayor Paar desired to provide residents with a friendly reminder that sump pumps are required to discharge to resident's rear yards rather than laundry tubs or floor drains as the City pays for the treatment of that water. He desired to have information placed on the Reader Board and in the Utility Bills. This item was placed on the Reader Board previous to this meeting and will be placed on the (March/April) utility bills forwarded to residents on May S, 2017. Staff noted that it would also be placed in the upcoming newsletter. VIII.
