Resolution #06-027 - Authorizin! ~e oflnvovement Bond - 21st Avenue BackAgP- RoadlHunter's Crossin! 3 Addition Finance Director Meyer appeared before Council and explained the request for bonding to Council noting that the setup is a 15 hear issue and the best guess is it should sell for about 4.75% for this type of issue and this Resolution would begin the bond prOC!'SS. Mayor Capra asked why they are being combined. City Administrator Larson indicated that one of the reasons is to have cash flow to carry the other lots. Mayor Capra questioned whether StatT should facilitate the sale of the bond and asked what the savings would be and if the bond rating would be affected. Finance Director Meyer indicated the City would save $18,000 by having him do the sale rather than Northland Securities. City Administrator ~n indicated that they would like to use the dirt for filling in the basement at the property being purchas~ &om the St. Paul Water Utility. Mayor Capra indicated there is legislation out there concerning transportation and if it is passed CenterviI1e resideDts would pay $80.00 and Porest Lake would only pay $8.00 so Staff is looking into that. CALL TO ORDERIROLL CALL At 8:45 p.m., the council reconvened its JNeti", following the work session. 2. ITEMS FOR DISCUSSION a Performance Review - City Administrator, Mr. Dallas Larson The Council discussed with the City Attorney the need to close the meeting to discuss the perfortM~ of the City Administrator, DaDas Larson. Mr. Larson requested that the meeting be kept open and the Council determined to leave the meeting open. The Council reported the results of its review to City Administrator Larson, each Council member in turn expressing their opinions on how he had met their expectations. Motion by Council Member Terway, seconded by Council Member Paar that City Administrator Larson be given a satisfactory review and that due to exemplary pelf~ and in recognition of CourtciI's satWaction with Mr. Larson's work, his salary sbaIl be increased to an ,nml.J rate of $83,000 effective April 4, 2006. Also present were Tom Peten10n ofBonestroo & Assoc, and Kurt Glaser, City attorney. 1. The C.ounci1 discussed the implementatiOll of the downtown redevelopment and the need to remain resolved. Requests may come in for variances to do things that are not in compHance with the plan. Allowing significant investment in noDCODformiag uses could undermine the chances for success. Dallas Larson and John Meyer will brins back an Ot""1I8 for a r~ for development proposals in two weeks. 2. The Council reviewed the 21 AvenuelBackage Road and industrial site project and its status. An undisclosed easemeat to Rice Creek Watershed District was discovered through a survey. The entire site of the proposed industrial development would be unbuiIdabIe if the easement were not released by RCWD. It is believed that RCWD will release the easement, but that must be confirmed. The City has been unable to negotiate easements with Sheehy Consuuction, so the attorney will be proceedi1tg with the condetnnation of the needed right of way and easements. The County permit for CSAH 54 entrance has been applied for and a right turn lane will be required. Bids will be received on May 4 and the Joint Powers Agreement with Lino Lakes for 21 sl Avenue is on their agenda for May 9". Bond financing procedures have been initiated. 3. The Council reviewed the CSAH 14 project and the construction schedule that is being suggested by Anoka County. The county would conStruct the east end of the project between the interchange at 3SE and Clearwater Creek: and the north end of the project from Mound Trail to 3SW in 2007 and the middle section of the project in 2008. The Council would like the downtown area up to Centerville Lake added to 2007 construction, if possible. This facilitate the redevelopment of the downtown. 4. Dallas Larson reported that the principals ofBonestroo, Rosene, Anderlik and Associates would like to assign a ditTerent engineer to Centerville to take over the various projects. The Council agreed that could be a good idea and asked that the firm bring the proposed engineer to the next meeting for introductions. The meeting was adjourned at 8:45 p.rn. The rules promulgated by the Minnesota Office of Pipeline Safety (MriOPS) itnposea significant new du,ty on cities to provide information , about the location of private Water and sewer laterals located within public rights-of- Way. In particular, the rules impose new obligations depending on when the :taciIities were or are to be installed. Pre-January 1, 2006 Installations . For service laterals installed before January 1, 2006, the rules require the city to "either locate or provide information as shown on maps, drawings, diagrams, or other records, on the location of a sewer and water lateral. . . "The ruies also _that "if no informa- tion is available on a sewer or Water lateral installed before January 1, 2006, then notify- ing the excavator that no information exists fulfills the requirements of this section. " ' . The obligation of the city to locate or provide information noted in the rule quoted above must be carried out when responding to requests for locates that the city receives from Gopher State One Call (GSOC) beginning January 1, 2006. Post-December 31, 2005 instaDations For service laterals installed after December 31, 2005, the new rules impose a three-part obligation. First, cities are required to "maintain a map, 'a qiagram, a drawing, or geospa- tial information regarding the location of its underground facilities within a public right- of-way. . ." Second, cities must "install a locating wire or have an equally effective means of marking the location of each nonconductive undergrOund :taciIity within a pub- lic right-of-WaY installed after that date." Third, cities must begin locating "the portion ,of the service lateral within the public right-of-WaY. . ." On April 1, the Office of Administrative Hearings (OAH) found that the rules outlined above are reasonable and that cities are expected to fully comply with what the League views as some of the most far-~hing changes to pipeline safety regulation in at least. two decades. The new rules that were announced in the June 6 issue of the State Register amend Minn. Rules chapter 7560. The Minnesota Office of Pipeline Safety (MnOPS) proposed the rule changes as part of a "continuing effort to increase public safety." The League and other municipal interests argued that use of locating wire is inherently unreliable. MnOPS reasoned that cities have the right to require that installers infonn them about, and provide information on. new service laterals installed and connected to the city's water and sewer facilities. MnOPS declined the suggestion that cities and municipal utilities put forth that there be a pilot project or study before imposing the requirement to locate nonconductive facilities. Cities said the requirement to install tracer wire or other means of locating sewer laterals was unreasonable because current technology often does not work; is not accurate; and that locating wires are unreliable when used at the depths water and sewer laterals are found in Minnesota. Cities also asked for a standard statewide locating wire installation standard. These concerns were dismissed. On the other hand, MnOPS also rejected a recommendation by private utility contractors that the rule be expanded to include the entire length of the service lateral, from the water or sewer main to the building. This was rejected because "the Depart- ment's jurisdictional authority may be brought into question with respect to codes, such as the Building Code." MnOPS acknowledged no current technology is 100 percent accurate, but that locating wire, as a minimum standard, was reasonable. The Minnesota Rmal Electric Association (MREA) also opposed any service latera1locating and marking by electric utilities, because they do not own. install, or m;lintain the lines beyond the meter. The MnOPS response was similar to the one they made to cities: that primary locating responsibility needed to be placed on the entity in the best position to maintajll records and locate ~rground facilities-the opQIators. Recommendations 1. To meet the new obligations under the rules it is important that cities develop a system to manage those installing facilities in the right-of-way. Some cities have already done this through use of a right-of-way management ordiDance; for others this will require adopting new local regulations. At the very least, every city with water and sewer facilities needs to estab- lish a right-of-way excavation permit process that meets its needs. At a minimum, such an ordinance should require notice to the city; a city approval process; and a requirement mandafjng the installers provide the city with required information on the location of the facilities they have installed. Ideally cities would reCeive accumte as-built maps or records of the type the city uses. 2. The city must develop a system to respond to excavators who will request information about the location of pre-January 1, 2006, installations through GSOC. The city is only required to provide the best available information. Some cities, how- ever, may want to embark on a citywide mapping effort in order to meet this 9bligation. This may requite training of existing staff or contracting with a private firm. 6. The city may want to consider developing more stringent requirements for firms and contractors undertaking "trenchless" excavation in the right-of-way. For instance, at minimum the city should: A. Require an excavation permit just like other street excavations. B. Enforce the Minn. Stat Sec. 2160 requitement that excavators "pot-hole" when crossing "tnark:ed" sewer and water laterals." " " " C. Report to MnOPS excavators that are not appropriately "pot-holing." The city should docmment and ~tain records of these reports. D. Consider requitements that prohibit trenchless excavations more than' 4 feet below-grade without specific permission from the city. All cities must focus serious attention on the new rules. While the rules constitute a significant unfunded mandate, cities should exer- cise their authority to pass along many of the costs as part of an excavation permit process. Cities should also seriously consider increased regulation of "trenchless excavators", since this type of instaDa1ion will likely be the cause of "hits" of municipal facilities. The Structure was constructed in 1994 and provides conveyance of Clearwater Creek under Brian Drive. Inspection Information Bonestroo inspected the structure on May 2, 2006. The structure was inspected utilizing a canoe with a two person crew in the canoe and one person on the bank. The personnel in the canoe were Matt Jensen and Joel Benton, with Ryan Goodman on the creek bank. Structural Condition The structure is generally in good condition above the waterline, with little to no corrosion. There is localized damage to the south culvert. There is damage located at about the center of the culvert, just east of the center joint, at approximately 1 o'clock when looking east The culvert condition below the waterline could not be assessed. The culvert damage consists of a triangle shaped tear about one foot long by 6 inches high and a dent just to the west at the same elevation which is about 1 foot in diameter. This damage was caused during the reconstruction of Brian Drive on September 20, 2004. Reportedly, the contractor that caused the damage covered the tear with a metal plate (a typical manhole cover plate) and encased the plate with concrete. Both culverts have experienced slight distortion, which according to the most recent inspection report, likely occurred during original structure construction. There is some misalignment of the culvert joints but there is no infiltration of water through the joints. Hydraulic Condition The inspection was conducted during a higher water condition, with the area receMng occasional rain over a period of four days prior to the inspection. Based upon the water staining on the inside of the culverts, the high water is approximately 4 inches above the condition during the inspection. Clearwater Creek was flowing through both the north and south culverts from east to west. The culverts were flowing at one-third full. There was no ponding upstream of the culvert, so it is assumed that the culverts are functioning properly. There was excessive vegetation at the inlet and outlet of the north culvert. Brush, trees, and debris have accumulated and are causing restriction to the creek flow, particularly at the inlet (east end).
