CALL TO ORDER. The meeting was called to order at 6:30 p.m. by Chair Mosher. 1. Roll Call II. PLEDGE OF ALLEGIANCE III. ROLL CALL Members were present and accounted for. IV. PUBLIC HEARING(S) 1. Request for Conditional Use Permit — 7095 — 21" Avenue South (Luther Towing & Service, Inc.) Chair Mosher opened the public hearing at 6:31 p.m. Mr. Craig Kozar, owner of ADL Auto Repair & Drive Shafts, Inc., was present and stated that he had signed a lease with Mr. Keaton Luther, owner of Luther Towing & Service, Inc., believing that his operation fit into the zoning of the building. Mr. Luther was present and stated that he had been operating at the location for two (2) months, signed a two (2) year lease and desired continued operation at the site. Mr. Luther stated that he applied for a Conditional Use Permit several months ago. No members of the audience provided input. February 7, 2017, Planning & Zoning Commission Meeting Minutes Chair Mosher provided Commissioners with an opportunity to make modifications to the presented minutes if they desired. Motion by Chair Mosher, seconded by Commission Member Broussard Vickers to Approve the February 7, 2017 Planning & Zoning Commission Meeting Minutes as presented. Commissioner Haiden abstained. Motion carried. VI. OLD BUSINESS 1. None. VII. NEW BUSINESS 1. Request for Conditional Use Permit — 7095 — 21St Avenue South (Luther Towing & Service, Inc.) a. Findings of Fact b. Draft Conditional Use Permit Lengthy discussion took place regarding the current business practices of Luther Towing, owners integrity, threatened litigation, hours of operation, amount of vehicles stored indoors/outdoors, "salvage" operation(s), amount of damage to a vehicle and determination of storage at the Centerville location versus Maplewood, visual appearance of the site as it can be viewed entering the City along Main Street, towing vehicles are generally taken home by the drivers, fencing/screening options, enforcement, and length of time that a vehicle is under Mr. Luther's care. Discussion also took place regarding the differences between granting a Conditional Use Permit versus an Interim Use Permit. Mr. Kozar was not in favor of fencing any area(s) to allow this operation and Mr. Luther reviewed and concurred with the proposed Draft Conditional Use Permit. Motion by Commissioner Broussard Vickers, seconded by Commissioner Haiden to Recommend to Council Approval of the Findings of Fact and Draft Conditional Use Permit as presented. All in favor. Motion carried. Page 2 of 3 City of Centerville Planning and Zoning Commission April 4, 2017 2. Review Concept Plan — 7357 — 20th Avenue North (Moore Property) Mr. Todd Christianson presented the Commission with a Concept Plan for the development of 19 homes on the 20 acre parcel. He stated that he understands that the property is very wet in areas, he will need wetland mitigation, ditching and has been working with RCWD regarding the proposed development. He also stated that he is willing to pay park dedication fees, desires to construct several walkouts and R2A — High Density Single Family homes with smaller lot size requirements. Mr. Christianson stated that he desired to commence construction this year and would be appearing before them shortly with a preliminary plat for the development. 3. Review Concept Plan — 7265 Main Street Mr. Rich DeFoe presented the Commission with a Concept Plan for the development of the parcel for residential housing. He stated that he desired to construct a cul de sac within the development and plans were very preliminary at this point. Consensus of the Commission was that they favored a residential development on this property. 4. Comprehensive Plan Discussion took place regarding the current Comprehensive Plan, the required update, cost of an update and the need to consider the future. The Commission requested that Staff provide research regarding "Dynamic Signage" or the amount of time that any one message can be lit up. VIII. ANNOUNCEMENTS IX. Please note that this information is subject to change. The most current information can always be found on the website. Also, please remember that additional information may be requested during the review process for clarification and accuracy by the Technical Review staff. If you have any questions, please contact your Sector Representative. LAND USE Forecasts and Community Designation ❑ Include a table of forecasted population, households, and employment for 2020, 2030, and 2040, consistent with the Council's forecasts. ❑ Remember, Council forecasts must be used consistently throughout your entire comprehensive plan. ❑ Your transportation plan needs to allocate forecasts to transportation analysis zones (TAZs). ❑ Your water and wastewater plans need to reflect forecasts to plan for urban services. ❑ Your land use plan must reflect and be coordinated with your forecasts. ❑ Include a map acknowledging your regional Community Designation(s) and acknowledge the overall density expectations for your Community Designation(s). ❑ Each Community Designation identifies both Council and Community Roles in Thrive's land use policy section. Plans must be consistent with Community Roles for your Community Designation(s) as well as Community Roles that apply to everyone. Existing Land Use ❑ Provide an Existing Land Use Map with a land use legend. ❑ Provide an Existing Land Use Table. Calculate total acres and percent of total acres for each land use category. ❑ Land uses categories on the map and in the table, as well as any text references must all be consistent with one another. ❑ Show existing regional parks, park reserves, and special recreation features with a land use of "Park" (or your equivalent) on your Existing Land Use Map. Future Land Use ❑ The Future Land Use plan must be consistent with the Council's forecasts of population, households, and employment and identify sufficient land to support your community's forecasted growth. ❑ Provide a Future Land Use Map and land use legend, including density ranges for all land uses that allow residential development. Provide a Future Land Use Table. Calculate total acres and percent of total acres for each land use category for each 10 - year planning period (2020, 2030, and 2040). ❑ Define each land use category shown on the Future Land Use Map. Land use categories must be used consistently throughout your plan. ❑ Land use categories must include types of allowed uses and the minimum and maximum densities ("the allowable density range") for all categories that allow residential uses. Allowed uses should include a description of allowable housing types such as single family, detached, duplexes, townhomes, etc. ❑ For each "mixed use" category, define an expected share of individual land uses and identify the permitted density range for residential uses. For example, Mixed Use Downtown might have an expectation of 30% commercial, 40% office, and 30% residential with a density of 10-15 units per acre. ❑ Acknowledge Council -approved master plan boundaries of regional parks, park reserves, and special recreation features by guiding the properties with a land use of "Park" (or your equivalent) on your Future Land Use Map. For Communities within the Metropolitan Urban Service Area (f: USA) and Rural Centers: ❑ Identify employment locations and provide a measurement of intensity of planned employment. Employment locations are typically the areas guided for commercial, office, industrial and institutional uses. Acceptable measurements of intensity include Floor Area Ratio (FAR), building footprint or impervious coverage. Ranges for measuring intensity are acceptable. Page - 1 i METROPOLITAN COUNCIL LOCAL PLANNING HANDBOOK Print Date: 3/15/2016 Checklist of Minimum Requirements for Centerville For Communities with Special Resources: ❑ See the Special Resources section within the Land Use Plan Element for requirements for Critical Area Plans, Historic Preservation, and others. Density Calculations ❑ Identify where forecasted residential growth will happen on your Future Land Use Map. Show expected new development and re -developed areas. ❑ Identify what density range is expected for each residential land use in your community. ❑ Identify when residential development or redevelopment is anticipated to happen. See the Handbook section on Staged Development and Redevelopment. ❑ The average net residential density for your community must be consistent with the density requirements for your community designation. ❑ Provide a minimum and maximum value for each residential density range. (Zero is not an acceptable minimum. The maximum value must be a whole number.) ❑ Use the lowest allowed residential density from land use ranges in your calculations. For example, a land use that permits a density range of 3-5 units per acre must use 3 units per acre in all density calculations for this land use. This ensures that even at the lowest permitted density, the community will be developing at densities that meet overall density expectations. ❑ Focus on areas of change. Show us which planned land uses have changed from your previously approved plan and where new land uses (change or development intensity) is planned/expected. ❑ Provide the net developable acreage for each residential land use. It's OK to exclude wetlands and natural water bodies, public parks and open space, arterial road rights-of-way, and natural resource lands protected by local plans and ordinances (i.e. steep slopes, wetland buffers, tree preservation) from area calculations. Stormwater ponds, utility easements, local roads, and local rights-of-way cannot be excluded from area calculations. ❑ The information you develop in your land use plan carries over to other elements of your comprehensive plan. The areas and densities in the land use plan must be consistent across elements related to forecasted growth, wastewater, water, housing, and transportation. For Communities with an Affordable Housing Allocation: ❑ Guide residential land at densities sufficient to create opportunities for affordable housing using one of the following options outlined in the Housing Plan Element. Refer to the Projected Housing Need section. Staged Development and Redevelopment `' ❑ Identify potential local infrastructure impacts for each 10 -year increment. ❑ Demonstrate that the municipality is capable of providing services and facilities that accommodate its planned growth. ❑ The staging plan or likely development phasing must be consistent with the volume of anticipated sewer flow identified in your community's Local Sewer Plan. ❑ The staging plan or likely development phasing must support and be consistent with your community's share of the Region's Need for Affordable Housing for 2021 - 2030. For Suburban Edge, Emerging Suburban Edge, Rural Centers, and Communities with Orderly Annexation Agreements (OAAs): u Map stages of development in 10 -year increments (existing, 2020, 2030, and 2040). ❑ Provide a table of staged development in 10 -year increments. The table must include future land uses, area in acres, density ranges, and total residential units by each 10 -year time increment. Natural Resources ❑ Describe your community's goals, intentions, and priorities concerning preservation, conservation, or restoration of natural resources in your community. Special Resource Protection ❑ All plans must include a protection element for historic sites. ❑ All plans must include policies for the protection and development of access to direct sunlight for solar energy. Solar access is addressed in depth under the Resilience section. ❑ All plans must identify whether or not aggregate resources are available within the community. For communities with aggregate resources, additional requirements apply. Page - 2 1 METROPOLITAN COUNCIL LOCAL- PLANNING HANDBOOK Print Date: 3/15/2016 Checklist of Minimum Requirements for Centerville TRANSPORTATION Transportation Analysis Zones ❑ Include a table allocating forecasted population, household, and employment growth by TAZ for 2020, 2030 and 2040. ❑ Describe how you have allocated demographic growth based on your plan's assumptions for guided future land use (e.g., density, mix of uses, locations for new development, highway/transit access, redevelopment, etc.). ❑ When doing your land use planning, accommodate development densities, around transit consistent with density expectations established in Chapter 3 of the 2040 Transportation Policy Plan (2040 TPP). Roadways ❑ Describe and map the functional classification of all existing and proposed roads within your community, using the functional classification system described in Appendix D of the TPP and the roadway classification map currently recognized in the region. ❑ Maps must reflect the principal arterials adopted as the metropolitan highway system in the 2040 Transportation Policy Plan (2040 TPP). ❑ If a community determines that a change to the A -minor arterial system in the community is warranted, a request should be made to the Transportation Advisory Board (TAB) for the change, and TAB's approval secured, prior to reflecting the new classification in the community's plan. Check the council's website or contact Elaine Koutsoukos at 651-602-1717 for more information. ❑ Maps should also show the streets classified by the community as major and minor collectors and local streets. Changes to these streets from the function shown on the regional map are at a community's discretion, and do not need approval from TAB. However, these changes should follow the criteria laid out in Appendix D of the TPP and maintain system continuity. A map or table highlighting any discrepancies between the community's map and the regional functional classification map previously referenced should be submitted to Council staff so the regional map can be updated. ❑ Include the following information for the principal and A -minor arterials: u Identify the existing and future number of lanes. ❑ Map current traffic volumes, including heavy commercial volumes, which include both ADT and HCADT. ❑ Map forecasted 2040 traffic volumes. (This should be done using the Council's regional model, or another method with approval from Council forecasting staff.) ❑ Identify future rights-of-way that need to be preserved. ❑ For other proposed interchange improvements, follow the Highway Interchange Request Criteria and Review Procedure, which can be found in Appendix F of the 2040 TPP. G Incorporate access management guidelines of MnDOT, or those of the county in which your community is located, into your comprehensive plan as well as into your subdivision and zoning ordinances. ❑ Describe recommendations from recent corridor studies regarding roadway improvements, changes in land use, and/or access. Transit ❑ The region has established Transit Market Areas to guide the types and levels of transit service that are appropriate for efficient and effective services. Transit Market Areas are defined in Appendix G of the 2040 TPP by the demographic and urban design factors that are associated with successful transit service. Identify your community in relationship to your transit market area(s). Describe and map the existing and planned transit infrastructure and services in your community, including those of Metro Transit or other regional transit service providers. Communities should include the identification of the following basic elements of the transit system in their comprehensive plan: ❑ Existing transit routes and dial -a -ride services ❑ Existing and planned park -and -rides and express bus corridors ❑ Existing transit support facilities Bicycling and Walking ❑ Describe and map the existing and planned on -road and off-road bicycle facilities in your community. ❑ Map and describe the Regional Bicycle Transportation Network (RBTN) within your community: ❑ Show all Tier 1 and Tier 2 RBTN corridors and alignments. ❑ Show the relationship of the RBTN to the local bicycle network of off-road trails and on -street bikeways including all existing and planned connections. ❑ Include locations of regional employment clusters and activity center nodes (as shown on the RBTN map) and other local activity centers. ❑ For Tier 1 and Tier 2 corridors on the RBTN, describe and map the existing or planned bicycle facility alignments that are within the established corridors; the purpose of these corridors is as a placeholder for cities/counties to designate a planned alignment. If there is a planned alignment that would fulfill the intent of the corridor and that lies within and in Page - 3 i METROPOLITAN COUNCIL LOCAL PLANNING HANDBOOK Print Date: 3/15/2016 Checklist of Minimum Requirements for Centerville line with the corridor's directional orientation that the community would propose to replace the established corridor, map that alignment and denote by indicating it as "proposed for the RBTN." ❑ Analyze and address the need for local bicycle and pedestrian facility improvements to provide connections that remove major physical barriers (i.e., freeways, railroad corridors, rivers and streams) on the regional (RBTN) and local networks. ❑ Discuss pedestrian system needs in a manner that responds to your community designation (as described in Thrive MSP 2040) and addresses the needs of your community. Aviation ❑ Identify policies and ordinances that protect regional airspace from obstructions. Include how your community will notify the FAA of proposed structures. ❑ Recognize seaplane use on surface waters as designated and regulated by MnDOT; communities should recognize these areas on plan maps where appropriate and consider issues of land use compatibility. ❑ Map any facilities such as radio beacons or other air navigation aids sited in off -airport locations and address how they will be protected from physical encroachment and electronic interference through your local ordinance and notification processes. Your system statement will indicate whether your community hosts one of these facilities. Freight ❑ Identify railways, barge facilities and truck or intermodal freight terminals within the community. ❑ Identify other important nodes that may generate freight movement, such as industrial parks and large shopping areas. ❑ Map the road network showing volumes of multi -axle trucks (also known as "heavy commercial average annual daily traffic or HCAADT") for Principal Arterial and A -Minor functional classifications. ❑ Identify any local roadway issues or problem areas for goods movement, such as weight -restricted roads or bridges, bridges with insufficient height or width clearances, locations with unprotected road crossings of active rail lines, or intersections with inadequate turning radii. Page - 4 i METROPOLITAN COUNCIL LOCAL PLANNING HANDBOOK Print Date: 3/15/2016 Checklist of Minimum Requirements for Centerville WASTEWATER Areas Served by the Regional System ❑ A table that details the households and employment forecasts in 10 -year increments through 2040, based on the Council's forecasts and any subsequent negotiated modifications. This should be broken down by areas served by the Metropolitan Disposal System, locally owned and operated wastewater treatment systems, and Community and Subsurface sewage treatment systems. The forecasts used in your wastewater plan must be consistent with the forecasts used throughout your plan, including in land use, transportation, and water supply. WSB staff will prepare a Bicycling and Walking Component of the overall Transportation Plan. 1.5.4 Freight. WSB staff will prepare a Freight Component of the chapter. Existing freight infrastructure, such as railroads, major truck routes and freight generators will also be mapped and potential projects and strategies to improve freight mobility will be identified. Introduction: The introduction of the LWP was originally intended to give a clear definition of why it is required and important for the City to have a LWP and to give the requirements of the governing authorities to keep the City's LWP in compliance. We will review and update this section so the viewer can easily identify the minimum requirements set forth by the governing agencies. This section will be updated to reflect the new LWP review timeline, which is now part of the ten-year Comprehensive Plan cycle. The Plan will discuss groundwater discharge and recharge areas including the identification of potential land uses affecting groundwater. The City will update land use and zoning maps for present and future conditions, as well as a land cover classification map, such as Minnesota Land Cover Classification System (MLCCS) maps. Key Conservation Areas will be identified. We will specifically review the impaired waters list under the water resources section and compare it to the most recent 3o3d impaired waters list from the Minnesota Pollution Control Agency. A map of these waters will be provided. Water bodies with TMDis will be listed in this section. For Centerville, these include Peltier Lake & Centerville Lake TMDL, Lino Lakes Chain of Lakes TMDL, Upper Mississippi River TMDL. The Upper Mississippi River TMDL for bacteria has been set recently, so we will discuss actions for addressing the TMDL in this section. We will perform a review to this information and work with the City to verify any changes or additions that are needed to remain in compliance with the section. iv. Hydrologic Calculations/Modeling Parameters: This section covers the water quantity and NURP standards when designing storm water ponds and other stormwater features. We will update the design storm parameters to reflect the new NOAA Atlas 14 Rainfall data that has become the new industry standard. The LWP will address physical changes to the stormwater system, and if there are changes, these will be reflected in an updated map of the system. It is our understanding there is not a City-wide stormwater model for the City of Centerville and this proposal does not include time for the development of any hydrologic or hydraulic modeling. Stantec is aware the Rice Creek Watershed District has created a district -wide hydrologic and hydraulic model. Stantec well request to obtain a portion of the model that includes the City of Centerville to try to gather information on drainage areas and paths of stormwater runoff, as well as to provide information about future conditions and intercommunity flows. The model outputs might also help identify and acknowledge future changes to structures that have potential for overtopping, as well as impacts of future land use changes on peak water elevations at storage areas that are currently at risk to flooding due to the more intense storms that are occuring. Additionally, RCWD requires an updated floodplain map, which will also be acquired by the RCWD and based on their District - Wide Model. v. Water Resources Management Objectives and Policies: The current water resources management objectives and policies cover items related to: water quantity; water quality; recreation; fish and wildlife; enhancements of public participation through information and education; public ditch systems; Design with community in mind 5 April 26, 2017 Mike Ericson Page 4 of 7 Reference: City of Centervllle Local Water Plan groundwater; wetlands; and erosion. Stantec will review each objective and policy and recommend revisions to the City based on requirements of the watersheds and other agencies with jurisdiction in the City of Centerville that are currently stricter than the City's requirements. Specific RCWD regulations require that the City address 1) its volume debit and how to the City plans to address this debit, 2) strategies in place to manage water volumes in land- locked areas to minimize flooding, and 3) opportunities for stormwater reuse. vi. Water Resources Management Plan: The water resources management plan section highlights the requirements the City currently enforces to meet the water resources management objectives and policies section. We will review this section and make revisions based on the new requirements. We will also review the City's official controls to ensure we are staying consistent with your codes and ordinances. If we feel your ordinances and codes could be updated during our review, we would make those recommendations to the City. We will specifically review the water quality section to ensure the protection methods in place are adequate to meet the official controls. This section will also include an assessment of the existing and potential water resources related problem within the City, and potential funding opportunities for the City. Reuse opportunities will be identified, in accordance with RCWD's rules. vli. Implementation Program and Capital Improvement Projects (CIP): Stantec will work with the City to update your implementation plan. We will evaluate the items in the current Capital Improvement Plan (CIP) in section S of the LWP and determine what items have been accomplished, what items are no longer applicable to the CIP, and what items have yet to be completed. To be in compliance with the new regulations, we will create a CIP table to include the schedule of each project, the estimated cost of each project, and the funding source of each project, in addition to a year by year analysis. This table will prioritize the nonstructural, programmatic, and structural solutions we have identified. An additional table will be created that describes each component of the implementation program that will detail the schedule, estimated cost, and funding sources for each component including annual budget totals. As part of the implementation plan, Stantec will clearly define the roles and responsibilities of the community for carrying out the implementation components of the LWP. vill. Stormwater Charges: This section discusses the stormwater utility fees that are charged to City residential, commercial, industrial properties as well as new development. We do not anticipate a change to the stormwater utility fee section. If the City would like to revisit this section and update, Stantec can work with the City to update their stormwater utility fee for an additional fee. ix. Amendment Procedures: The current amendment procedures section of the LWP discusses the amendments and future updates process. Stantec will review this section as well as the watershed organization plans to verify the review and adoption process still meets the requirements of the local watershed Design with commun'rfy in mind 5 April 26, 2017 Mike Ericson Page 5 of 7 Reference: City of Centerville local Water Plan organizations. If necessary, we will update the LWP to clearly define the process by which amendments are made to the LWP that follow the watershed organizations' procedures. x. Technical Appendices: The following maps are included in the appendix of the City's LWP: Location Map; USGS Topographic Map; NRCS Soils Map; National Wetland Inventory mapping; MLCCS Land Cover Map; Existing Land Use Plan; 2030 Future Land Use Plan; Zoning Map; Floodplain Map; Storm Sewer & Drainage Basin Map; and the Capital Improvement Plan Map. We envision changes to these maps being minor updates. We will work with the City to verify any changes that must be made to these maps and coordinate with the City's comprehensive land use plan team to obtain their updated land use plan and 2040 future land use plan for the report. We will include the City's SWPPP as technical appendix, as well as MnDNR approved Floodplain & Shoreland ordinances, if applicable. Currently the following codes are included in the City's LWP: City Code Chapter 157: Erosion Control; City Code Chapter 155: Flood Damage Prevention; and City Code Section 156.133: Special Provisions Related to Development or Building on Lands within loo Feet of Centerville Lake, Peltier Lake, or Clearwater Creek. We will work with the City to identify any other codes that are applicable to this LWP and attach it as part of the LWP. 4. LOCAL WATER PLAN REPORT DELIVERABLE a. Prepare a user-friendly report that can be read by a non-technical audience yet still provides sufficiently detailed technical data for use by the City in storm sewer planning. b. Include graphics, figures and maps to clarify items discussed in the report. c. Provide draft and final reports as follows: i. First draft for City staff review ii. Second draft for submittal to watersheds and Metropolitan Council 1. Respond to review comments and update report accordingly iii. Final report for City approval and use d. Prepare a separate reproducible summary suitable for public distribution. e. Present the results of the report at a City Council or other public meeting, at the City's direction. COMPENSATION AND SCHEDULE Stantec proposes to provide the City of Centerville with professional engineering services required to provide the services described herein regarding the Local Water Plan. Stantec anticipates providing the completed, draft surface water plan for city review within six months of the authorization to proceed. To aid in a timely review, the District asks that you complete this checklist prior to submitting your local plan. (B) General minimum requirements. The following minimum requirements, as set forth, shall apply to all buildings that may be erected, converted or structurally altered in commercial districts. (C) Off-street parking. Off-street parking shall be provided as required in this chapter. (D)Buffer zone between commercial and residential districts. Where a commercial district abuts a residential district, any new development shall include a buffer zone. There shall be a protective strip of not less than ten feet in width. This protective strip shall contain no structures, shall not be used for parking, off-street loading or storage, and shall be landscaped. The landscape treatment shall include a compact screen wall or fence, but shall not extend within 15 feet of the street right-of-way. The planting or fence design must be approved by the site plan review process. The site plan review process requires review by the Planning and Zoning Committee and the City Council, as set forth in this chapter. (E) Screening requirements. If the City Council requires any type of screening as a condition for a variance, conditional use, or interim use permit, the applicant shall comply with the following conditions: (1) File a copy of the screening plans with the Zoning Administrator; (2) The screening, planting or construction, or both shall be complete within one year from the date of the building permit, subject to extension by the City Council; and (3) The screening shall be maintained after completion. (F) Landscaping. A minimum of ten percent of any lot shall be green space. Three percent of the surface area of the land within a parking area shall be landscaped with grass and shrubbery or other approved ground cover. Landscaped areas will continue to be maintained by the property owner on a continuous basis. Green areas within abutting street rights-of-way will also be maintained by the property owner. Other requirements are set forth in this chapter. (G)Accessory Structures. Garages, accessory structures, screen walls, buildings and exposed areas of retaining walls shall be of similar type, quality and appearance as the principal structure. The height of an accessory structure shall not exceed the height of the principal structure. (H)Permitted encroachments. The following shall not be considered as encroachments on setbacks subject to other conditions within this chapter: off-street parking spaces, flues, belt course, leaders, sills, pilaster, lintels, cornices, eaves, gutters, awnings, open terraces, service station pump islands, open canopies, steps, chimneys, flagpoles, ornamental features, open fire escapes, sidewalks and fences, except as hereinafter amended. (I) Driveways. (1) No driveway shall be located within 100 feet of any right-of-way line of a street intersection. The distances shall be measured along the property line from the corner right-of-way and county line. 339 1 Page (2) Access drive onto county roads shall require a review by the City Engineer. This review shall be measured along the property line from the corner right-of-way and county line. (J) Refuse. (1) Garbage and rubbish containers shall be placed at the rear of the premises or in a manner as to be out of view from the street. In no event shall containers or their enclosures be placed or maintained in a way to unreasonably interfere with the use or enjoyment of adjoining property. (2) All garbage containers shall be screened with a suitable enclosure. (K)Permitted uses. See Table 156-A.1. (1) Uses not explicitly enumerated in this section as permitted uses, but closely similar thereto as determined by the Planning and Zoning Commission, provided these uses are not explicitly mentioned as permitted or conditional uses elsewhere in this Chapter. (L) Conditional uses. (1) Automobile and motorized equipment sales and service, excluding salvage operations, provided; (a) the outside sales lot shall not be larger in square footage than the one and one-half times the square footage of the building devoted to the related business. (b) the sales lot used to park vehicles to be sold or serviced shall be separate and distinct from the area of the premises used to park vehicles necessary to satisfy the minimum parking required by this Code. (c) all repair assembly, disassembly, or maintenance of vehicles shall occur within a closed building except minor maintenance including tire inflation, adding oil and wiper replacement. Vehicles that are inoperable or are missing body parts shall be stored inside a building or in a properly screened area, provided however that vehicles which are inoperable, missing body parts, or are unlicensed may not be stored outside a building longer than 90 days. (2) Farm implements sales and service; (a) the outside equipment storage lot shall not be larger in square footage than one and one- half times the square footage of the building devoted to the related business. (b) all repair assembly, disassembly, or maintenance of vehicles and implements shall occur within a closed building except minor maintenance including tire inflation, adding oil, and wiper replacement. Vehicles that are inoperable or are missing body parts shall be stored inside a building. 3401Page (3) Building supply sales and storage yards; (a) the outside equipment and inventory storage lot shall not be larger in square footage than one and one-half times the square footage of the building devoted to the related business. (4) Funeral homes and mortuaries; (5) Animal clinics. (M) Commercial exterior building materials. (1) Except as otherwise regulated herein, the exterior wall surfaces of all new or expanded commercial buildings shall consist of face brick, finished block or other textured masonry product approved by the Planning and Zoning Commission. (2) Exceptions to all masonry exteriors may be considered and approved by the Planning and Zoning Commission provided the following findings are met: (a) The combination of exterior materials is used as an architectural complement to the structure; (b) The combination of exterior materials used is not inconsistent with the quality and appearance used on similar buildings in the same zoning district or neighborhood; (c) Site conditions limit public exposure to certain exterior surfaces where masonry products are not proposed; and (d) An exterior wall may be temporary and a future expansion area of a structure and be subject to removal or redesign as an interior wall. (3) Buildings are required to have contrasting architectural features and must be designed to be aesthetically pleasing. (N)Interim uses in B-1 District. (1) Industrial uses that existed on a site in the I-1 Industrial district as a legal, fully conforming use prior to the site being rezoned from I-1 to B-1, may continue and be expanded on that site as if located in an I-1 District until the use is changed to a use that is permitted in this district. After it is changed to a use permitted the B-1 district, it may not thereafter be used except as permitted in this district. Where the proposed change from I-1 to B-2 has been initiated by the City, the Planning and Zoning Commission shall simultaneously with making such zoning change, determine whether such parcel is a fully conforming industrial use qualifying for interim use status. (A)Purpose. It is intended that the 1-1 District provide opportunities for light manufacturing and industrial uses, trade businesses, machine shops and other more extensive land uses. (B) General minimum requirements. The following minimum requirements, as set forth herein, shall apply to all buildings that may be erected, converted or structurally altered in industrial districts. (C)Setbacks. Specific setbacks are set forth in Appendix A, Table 1, District Regulations Lot and Yard Requirements. In addition, side yards facing streets on corner lots shall be considered the same as front yards. Where a front yard or side yard of a corner lot faces a residential district across a street, the setback from the street shall be not less than 60 feet. (D) Off-street parking. Off-street parking shall be provided as required by this chapter. All open street parking areas having more than six parking spaces shall be effectively screened by a wall, fence of acceptable design or compact hedge along all sides which adjoin or are directly across the street from the property in a residential zone or institutional use. The wall, fence or hedge shall be maintained in good condition. Plans for fencing shall be approved by the City Council. The fence shall not be used for advertising purposes. (E) Buffer zone between industrial and residential districts. Where the side yard of any industrial district abuts a residential district, the minimum side yard setback shall be 60 feet. Parking of vehicles will be permitted within 40 feet of the side yard line. All side yard areas not utilized for parking shall be landscaped with screening provided along the side lot line to within 15 feet of any public right-of-way. (F) Screening requirements. If the City Council requires any type of screening as a condition for a variance or, conditional use, or interim use the applicant shall comply with the following conditions: (1) File a copy of the screening plans with the Zoning Administrator; (2) The screening, planting or construction, or both shall be complete within one year from the date of building permit, subject to extension by the City Council; 342 1 Page (3) The screening shall be maintained after completion; and (4) A dollar amount of one and one-half times the estimated cost of planting and construction of the screening shall be filed with the city in the form of a cash escrow or letter of credit. The cash escrow or letter of credit amount shall be forfeited to the city if any provisions of this section are violated. (G)Landscaping. A minimum of ten percent of any lot shall be green space. Three percent of the surface area of the land within a parking area shall be landscaped with grass and shrubbery or other approved ground cover. Landscaped areas will continue to be maintained by the property owner on a continuous basis. Green areas within abutting street rights-of-way will also be maintained by the property owner. For the purpose of this zoning district, car, vans and pickup trucks parked outside and used by employees and/or visitors in the normal course of the business operation will not be construed to 343 1 Page be outdoor storage. Further, outside parked trucks and semi -trailers used in the normal business commerce will not be construed to be outdoor storage: (1) Provided that the total number of trucks and semi -trailers does not exceed the number of docks and/or bay doors; and (2) This use is not construed as an operation listed as a conditional use in any industrial zone. Environmental review Minnesota has adopted a comprehensive and detailed environmental review program to determine the significant environmental effects of private and governmental actions. The idea behind the program is that if governmental bodies require documents that identify the environmental consequences of a proposed development and those documents are available to the public, decision -makers can incorporate environmental protection into the proposed development. The law prohibits the issuance of permits or development prior to completion of necessary documents. The state -mandated environmental review process usually occurs in conjunction with the city's administration of its zoning ordinance. The environmental review process may require the city to delay consideration of an application. The 60 -Day Rule allows an extension for these purposes. E. Fees and escrow Proper zoning administration may require significant financial commitment from a city. However, a city may establish land use fees under the Municipal Planning Act sufficient to defray the costs incurred by the city in reviewing, investigating, and administering an application for an amendment to an official control, or an application for a permit or other approval required under the zoning ordinance. Fees are required by law to be fair, reasonable, proportionate, and be linked to the actual cost of the service for which the fee is imposed. All cities are required to adopt management and accounting procedures to ensure fees are maintained and used only for the purpose for which they are collected. Upon request, a city must explain the basis of its fees. If a dispute arises over a specific fee imposed by a city related to a specific application, the person aggrieved by the fee may appeal to district court provided the appeal is brought within 60 days after approval of the application and deposit of the fee into escrow. I must say it was very refreshing to meet with a City that is open for business. I know that does not mean anything is a given for this project, but it is always much better to work with folks who actually want the business versus those who don't or who don't care. Thank you again for that. As we spoke about we feel the storage units are a great buffer and will be a very good neighbor to the residential neighbors because the storage units are about as low traffic, low noise and low impact you could possibly hope for. If that site were a B-1 business use, who knows what could end up being there and there is really nothing the neighbors could do to stop it. For example, a quick review of the B-1 zoning code allows things like automobile and motorized equipment sales and service, car washes, eating and drinking establishments, fuel sales, liquor stores, retail sales and service, etc all of which could be much worse in terms of the residential neighbors. Imagine a restaurant with drunk people at 1:OOAM or loud music from the outdoor patio or a liquor store, there is no question the storage units is a great use for the property. We understand of course that the zoning would need to be changed and we are hopeful the Planning Commission and 1 Council will have the wisdom to see the decision would be a good one for the impacted residents. Along the back, there would be fencing (actually all four sides get fenced) and landscaping along the property line in the rear to help with the transition. Once the units are built and filled, the developer, Don Hawkins experience in doing this over many years is you will see only one or two cars a day to the facility. The facility is typically open from 5:30AM to 10:OOPM. He says opening early is pretty important because sometimes contractors will store stuff they will want to get before heading to a job in the morning. With the buildings running the direction shown on the sketch I provided, the neighbors would only even see someone when someone on the rear units are there, otherwise they wouldn't even know someone is there. On the building timeline it is worth noting the vertical construction will go relatively fast as the developer, Don Hawkins builds some the masonry components off site and assembles in somewhat a modular way. Don says the actual vertical construction only takes about 7-10 days per building. As agreed, attached are the pdf files of the hand outs from yesterdays meeting. I believe the architect Robert Johnson agreed to prepare a site plan today or tomorrow instead of using the one I had. I did attach my sketch as a back up but I am sure the one the architect will provide will look much different as my sketch was simply for discussion purposes only. We met with the Watershed yesterday after out meeting and learned that there was still an open permit relating to the development that happened to the west in 1998. Apparently there was some work to be done to Outlot A to fill the larger wetland but that was never done. I guess the seller got sick and has had serious health issues that may have prevented him from completing this. Also, we learned the Watershed has a flood plain of 900.8+/- (that is not great). All this to say we really don't know a whole lot more then before we met with them, but the Watershed is going to look into the history of permits, etc. Mike Brass expressed that there was a planning commission meeting coming up this Tuesday and if it was possible to get feedback by then it would be great. It is good to know there is no buffer requirement from wetlands that Rice Creek specifically requires. The parties have an interest in adjoining real estate situated in the City of Centerville, County of Anoka, State of Minnesota, and described, respectively, as follows: Lot 1 Block 1 Center Villa, Anoka County, Minnesota to be referred to as Lot 1 and Outlot A, Center Villa, Anoka County, Minnesota to referred to as Outlot A B. The parties desire to create a common driveway between the above- described adjoining lots owned by them for the benefit of each of them. In consideration of the above recitals and the terms and covenants of this agreement, the parties agree as follows: 1. The cost of moving and or creating the new entry from 20th Avenue North will be paid for by the owners of Out lot A, at their sole cost and expense Maintenance for the Shared driveway will be born by the owners of Lot 1 until Outlot A is sold and being used by Outlot A. Once Outlot A is using the shared driveway the maintenance shall be shared evenly between Outlot A and Lot 1. 2. The easement created by this agreement is superior and paramount to the rights of either of the parties to this agreement in the respective servient estates so created, and the parties further agree that it is a covenant that shall run with the land, unless agreed by both parties to change the easement. (A) Every vehicle parked upon any street with a curb shall be parked parallel to the curb and with the right- hand wheels of the vehicle within 12 inches of the curb. On other streets, a vehicle shall be parked to the right of the main traveled portion thereof and parallel thereto and in a manner as not to interfere with the free flow of traffic. These requirements shall not apply, however, to any vehicle disabled upon any street, but any police officer may require the person in charge thereof to move it to a place of safety, and if the movement is not made or if any motor vehicle is left alone or abandoned in that position, the officer may provide for the removal of the vehicle to the nearest convenient garage or other place of safekeeping. (B) No person shall stop, stand or park a vehicle, except when necessary to avoid conflict with other traffic or in compliance with the directions of a police officer or traffic -control device, in any of the following places: (1) On a sidewalk; (2) In front of a public or private driveway; (3) Within an intersection; (4) Within ten feet of a fire hydrant; (5) On a crosswalk; (6) Within 20 feet of a crosswalk at an intersection; (7) Within 30 feet upon the approach to any flashing beacon, stop sign or traffic -control signal located at the side of the roadway; (8) Between a safety zone, unless a different length is indicated by signs or markings; (9) Within 20 feet of the driveway entrance to any fire station and, on the side of the street opposite the entrance to the fire station, within 75 feet of the entrance when properly sign -posted; (10) Alongside or opposite any street excavation or obstruction when the stopping, standing or parking would obstruct traffic; (11) In the roadway side of any vehicle stopped or parked at the edge or curb of a street; or (12) At any place where official signs prohibit stopping. (C) No person shall, for camping purposes, leave or park a house trailer on any street or the right-of-way thereof. 571Page (D)No person shall stop or park a vehicle on a street when directed to proceed by any peace officer with authority to direct traffic. (E) No vehicle shall be parked on any street for the purpose of displaying it for sale. (F) (1) No vehicle, except an emergency vehicle on an emergency call, shall be parked between the hours of 3:00 a.m. and 7:00 a.m., and no vehicle shall in any case be parked upon any street in any one place for a longer continuous period than 24 hours. (2) (G) (1) (2) (3) City Council. Penalty, see § 71.99 However, these restrictions shall not apply to the parking of one vehicle on the street due to new construction during the months of March through May of each year. The City Administrator may issue temporary permits to park on streets during restricted times. The permit shall state the duration and location for which the permit is valid. A fee may be charged for such permits in accordance with a resolution adopted by the Ord. #16, adopted 06106/1969, Ord. amended 02/0911972, Ord. amended 03/28/1984, Ord. amended 12/1211984 § 71.02 TOWING OF ILLEGALLY PARKED VEHICLES. Any vehicle parked in violation of the city code or in violation of state law may be removed by towing at the direction of the city police to a suitable place for storage until claimed by the owner or agent of the owner. The owner or other person responsible for such parking of the vehicle shall be liable for the reasonable cost of such towing and storage upon conviction for such illegal parking. The city shall in no way be liable for any damage to any vehicle which has been ordered towed away. Ord. 2d #24, amended 12/10/2008 § 71.99 PENALTY. Any person convicted of violating any provision of this chapter shall be guilty of a misdemeanor but if a minimum fine or imprisonment is prescribed by the State Highway Traffic Act for an offense, the penalty shall apply to a person convicted of the same offense under this chapter. When my college age son gets back for the summer we have to shuffle cars all the time. It would seem like a great idea if we were permitted to park on the street from May 15th thru September 15`h. I totally understand during the winter months, but in the summer I don't see the problem. Other than street sweeping I don't see what could be the issue. I thank you in advance for looking into this for the residence of Centerville.
