A copy of the draft Enabling Resolution is on file and available for inspection in the office of the City Administrator. The draft amended and restated Enabling Resolution authorizes the EDA to exercise all powers granted to economic development authorities and housing and redevelopment authorities under state law, and designates that the EDA will be governed by a five member Board of Commissioners, two of whom will be members of the City Council of the City. Upon approval of the Enabling Resolution, an initial organizational meeting of the EDA will be held at a later date. All interested persons may appear and be heard at the public hearing either orally or in writing, or may file written comments with the City Administrator before the hearing. Dated: June 14, 2017. RESOLUTION ENABLING THE ESTABLISHMENT OF THE ECONOMIC DEVELOPMENT AUTHORITY OF THE CITY OF CENTERVILLE, MINNESOTA, PURSUANT TO MINNESOTA STATUTES, SECTIONS 469.090 THROUGH 469.1082, AS AMENDED BE IT RESOLVED by the City Council (the "Council") of the City of Centerville, Minnesota (the "City"), as follows: Section 1. Recitals. 1.01. The City is authorized pursuant to Minnesota Statutes, Sections 469.090 through 469.1082, as amended (the "Act") to establish an economic development authority for the City, and this Council desires to do so in order to promote certain economic, commercial, housing and industrial development and redevelopment goals and objectives. 1.02. This Council hereby fords that the encouragement and financial support of economic development and redevelopment in the City is vital to the orderly development and is in the best interests of the health, safety, prosperity and general welfare of the residents of the City. 1.03. The City has caused notice of a public hearing on the establishment of an economic development authority to be published in the Quad Community Press, a newspaper of general circulation in the City, once each week for two consecutive weeks (June 20 and June 27, 2017), and pursuant to such notice, a public hearing on the proposal has been held by this Council on the date hereof, at which hearing all persons desiring to present their oral or written comments on the proposal were given an opportunity to do so. Section 2. Establishment of Economic Development Authority. 2.01. Pursuant to the Act, the Council establishes an economic development authority for the City to be known as the Economic Development Authority of the City of Centerville, Minnesota (the "EDA"). 2.02. The EDA shall be governed by a board of commissioners consisting of five members, two of whom shall be members of this Council, and the remaining three shall be residents of the City. The initial appointments of the non -Council EDA commissioners shall be for the following terms: one for three (3) years, one for four (4) years, and one for five (5) years. Thereafter, the terms of the non -Council commissioners shall be six (6) years and until their successors are appointed and qualified. The terms of the Council members serving as EDA commissioners shall coincide with their respective terms of office on this Council. Each commissioner of the EDA who is a member of this Council shall cease to be a commissioner effective at such time as he or she is no longer a member of this Council; and a successor commissioner shall be appointed pursuant to the Act to serve the remainder of the applicable term (if any) so vacated. Section 3. Powers. 3.01. The EDA shall have all powers given to an economic development authority pursuant to the Act, as the same may be amended or supplemented from time to time, including the powers of a 2 housing and redevelopment authority contained in Minnesota Statutes, Sections 469.001 through 469.047, as amended, and the powers of a city under Minnesota Statutes, Sections 469.124 through 469.134, as amended. 3.02. The sale of all general obligation or revenue bonds of the EDA must be approved by the Council before such bonds or obligations are issued. 3.03. The EDA shall follow the budget process for City departments as provided by the City and as implemented by the Council. 3.04. All actions of the EDA must be consistent with the adopted comprehensive plan of the City and any official controls implementing the comprehensive plan. 3.05. The general budget of the EDA must be transmitted and approved by this Council at the same time as the City's general budget. 3.06. Notwithstanding Section 469.101, Subdivision 4 of the Act, the EDA may not take or attempt to take any property within the City by eminent domain without the prior approval of this Council. 3.07 As a means of more clearly setting forth its powers and rules of procedure, at its initial organizational meeting the EDA shall adopt a set of Bylaws, which shall, among other things, establish the general policy duties and provide for the appointment of the President, Vice President, Treasurer, Assistant Treasurer, and Secretary. The initial Bylaws and subsequent amendments thereto must also be approved by a majority vote of this Council. Adopted by the Centerville City Council this 28`h day of June, 2017. ATTEST: Mike Ericson, City Administrator 3 Jeffrey Paar, Mayor CITY OF CENTERVILLE CITY COUNCIL MEETING MINUTES May 24, 2017 6:30 p.m. Pursuant to due call and notice thereof, the City of Centerville held their regularly scheduled meeting of May 24, 2017 at City Hall, 1880 Main Street. PRESENT: Mayor Jeff Paar Council Member Russ Koski Council Member D. Love di Council Member Matt Montain Nj,' A& PPrr; Council Member Steve King ABSENT: None STAFF: City Engineer Mark Statz City Attorney Kurt Glaser COUNCIL MEETING I. CALL TO ORDER Mayor Paar called to order 6:30 p.m. II. APPOINTMENTS/PRESENTATIONS 1. Mr. Todd Steffen, Corner Express — Anoka County Outstanding Business Recycling Award Mr. Steffen was unavailable to attend and Mayor Paar read the Certificate to the public. He thanked Mr. Steffen and his employees for their efforts and congratulated them on their award. 2. Mr. Wayne Whitwam — Principal, Centerville Elementary School Mayor Paar stated that he reached out the Mr. Whitwam and invited him to Council to recap the 2017 school year. Mr. Whitwam introduced himself to Council, stated that he received his five (5) year recognition pin, several other members of Staff. Mr. Whitwam stated that Ms. Michele McClellan, a 0 Grade teacher at Centerville Elementary, was named Teacher of the Year, that the Elementary School is offering a pilot AVID program to its students. The program is offered to High School age students assisting them in college readiness and success will 4 City of Centerville Council Meeting Minutes May 25, 2017 assist 3rd, 4th and 5th grade students in gaining important study habits similar to the High School AVID program which prepares students for college readiness and success. Council viewed a short YouTube made by Centerville Elementary students regarding the achievements made and new programs that have been instituted throughout the year. Several Council Members commented that the school is taking shape and looking great. Mr. Whitwam thanked Council for their time and invitation. III. APPROVAL OF AGENDA Mayor Paar added Check #31046 through #31054 under Consent Agenda Item #1. Mayor Paar noted that Council had before them replacement pages 2-9. Council Member Love requested that New Business be moved and discussed prior to Old Business as members of the audience were present for that item. Motion by Council Member Love, seconded by Council Member Montain to Approve the Agenda with the Above Noted Amendments. All in favor. Motion carried. IV. APPROVAL OF THE MINUTES 1. May 10, 2017 City Council Meeting Minutes Mayor Paar provided Council with an opportunity to make modifications. Council Member King stated that he was opposed to the Local Water Plan due to disclaimers, warranties and responsibilities and stated that there was no mention of Climate Change Modeling Plan. Motion_ by Council Member Montain, seconded by Council Member Koski with the above referenced amendments. Council Member King Abstained. Motion carried. V. CONSENT AGENDA 1. Encroachment Agreement — 7162 Mill Road, (Draintile, Landscape Block & Flowers), 1' from Property Line Mayor Paar provided an opportunity for Council Members to add additional items or remove items for further discussion. Motion by Council Member Love, seconded by Council Member King to approve the Consent Agenda as Presented. All in favor. Motion carried. VI. NEW BUSINESS 1. Discussion on Motor Vehicle Traffic on Trail Council Member Love stated that his neighbor Mr. Paul Luther, 1955 Eagle Trail has discussed with him concerns for motor vehicle use on the trail near their homes and concern for pedestrian and bicyclists safety. Discussion ensued regarding license plate numbers, reporting with Centennial Lakes Police Department, signage being removed by offenders/young adults and placing seasonal barricades. Lengthy discussion was had regarding damaging the trails by landscape firms, liability if someone was injured, damaging due to vehicle weight, ownership of the easement that the trail is on, barricading the trail that extends from Eagle Trail to 20a' Avenue and between 6851 and 6847 Beaver Pond Way to the trail behind the homes/within the Anoka County Rice Creek Regional Park, alerting both the Centennial Lakes and Lino Lakes Police Department and reporting back within a month. Motion by Council Member Montain, seconded by Council Member Koski to Install Seasonal Barricades on Both Trails, Provide Council with a Report in One (1) Month and Contact Centennial Lakes Police and Lino Lakes Police Department Notifying Them of Same. All in favor. Motion carried. Mayor Paar reminded the audience and public that the trails should not be used by motorized vehicles and they are built for use of pedestrians and bicyclists only. 2. Discussion on City Council Computer Tablets Mayor Paar stated that several months ago the City of Circle Pines purchased tablets for their Council Members in an attempt to relieve costs associated with paper packets and staff preparation time. He stated that he felt that Members could utilize the tablet for packets, emails and retain information for the period of their tenure along with notes of their liking. He also stated that it could be handed down to their successors. Mayor Paar stated that the expenditure would be roughly $600 for the purchase of a two - in -one RCA tablet with a leather case with stand. Page 3 of 7 6 City of Centerville Council Meeting Minutes May 25, 2017 Council Member Montain stated that he currently likes the electronic format, is concerned about monthly copier fees, having instant access for past packets, internet and notes. He stated that it would need to be an all or nothing switch over to make economic sense for the City to incur these expenditures. Council Member Koski stated that $80 each seems to be extremely inexpensive and would like to see options, storage, other manufacturers, longevity, a demonstration of use and overall use of the product prior to purchase. Council Member Love concurred. Council Member King stated that he has never utilized one before and would need training before he felt comfortable using the device. He was also concerned about viruses and potential for something of better quality. Council Member Montain questioned whether he could contact the City of Circle Pines to ascertain a demonstration of their tablets and he was encouraged to contact the City Administrator. Attorney Glaser stated that if a Council Member were to utilize the device for personal data or retrieving personal data and that data would become public information. Attorney Glaser also advised that policies should be in place for these types of devices being offered. Motion by Council Member Montain, seconded by Council Member Love to Table This Item Until Next Council Meeting Allowing Members to Complete Additional Research. All in Favor. Motion carried. Mayor Paar encouraged members to complete desired research on their own via Best Buy, another vendor, Youtube or by reaching out to Council Members of the City of Circle Pines or their Administrator. 2. 13ueLife Proposal for Employee Engagement/Organizational Review Mayor Paar stated that Administrator Ericson requested that the item be placed on the agenda for discussion. He stated that Administrator Ericson believes that this was to occur closer to his hiring and is contained in the 2017 City Focus Goals. Mayor Paar stated that both the Administrator and Mr. Fursman believe that the proposal would review the current operating environment and be a good tool to build upon. City Attorney Glaser stated that upon the request of the Mayor, he presented Council with a proposal for organizing a Personnel Committee. He stated that the language was taken from the City of Lexington's Code and recommended that it be utilized to provide formal evaluations for Department Heads and the City Administrator along with negotiating union contracts. He stated that the Committee would not be involved in the day-to-day operations of the City and its suggested make up would be of two (2) Council Members and himself allowing recommendations to be brought to the full Council. He Page 4 of 7 7 City of Centerville Council Meeting Minutes May 25, 2017 also stated that the make-up of members could deviate from this but within the open meeting law regulations. Council Member King had concerns regarding things being pushed through and desired to ensure that the full Council would receive a recommendation from the Committee and then Council would discuss and make decisions. He stated that he is in favor of the proposal. Council Member Koski stated he feels that the Personnel Committee works well in Lexington, has concerns about current policy, job descriptions and possible need for updating, looking at the League of MN Cities for training opportunities and programs for providing services, costs and providing opportunities for staff to be heard. Mayor Paar stated that in the past he has been in Administrative Offices, does believe that the 2017 City Focus goals address maintaining a high quality staff, but believes that the Committee should be organized first allowing for their research and recommendation back to the full Council regarding educational needs, staff improvement, organizational review, etc. Council Member Montain stated that he has participated in similarly lead sessions and some are good and others are not, he too feels that the 2017 City Focus Goals address maintaining a high quality staff, has concerns that not everyone has the same ideas, does not feel that the Attorney should be appointed to the Committee due to costs, that the Attorney's use in employment matters should be on-call, that most Staff supersede Council in longevity, has concerns for possibility of micro -managing Staff and day to day operations. Council Member King questioned whether the entire Council would be made aware of the meeting of the Personnel Committee. City Attorney Glaser stated that the meeting of the Committee would generate notification to Council members; however, does not require that legal notification be given that they are meeting as they are not a quorum of elected or appointed individuals. Council Member Paar strongly agreed that no micro -managing would occur, that the Committee is just another tool that can be utilized. Council Member Love stated that the Agenda Item of HueLife Proposal morphed into the potential for forming a Personnel Committee and believes that the HueLife Proposal should be tabled with discussion of the Personnel Committee at their next meeting. City Attorney Glaser stated that the Council does have discretion to add items to their agenda at their meeting and that it ties into what the Administrator proposed regarding an organizational review. Council Member Montain stated that he felt it was a step-by-step process. Page 5 of 7 E'? Council Member Koski questioned the proposal for HueLife and proceeding forward. Council Member Love amended his motion to include the tabling of Hue/Life Proposal. Council Member Koski accepted the friendly amendment. Council Member Koski questioned whether two (2) separate motions needed to be made. Council Member Montain questioned establishing a Personnel Committee prior to contracting services with the Committee making recommendations to the full Council. Council Member King stated that he does not want to just consider one (1) consultant if Council choses to hire for services. All in favor. Motion carried. I.X. OLD BUSINESS 1. Ruffridge Johnson Equipment Company, Purchase Agreement — 2065 Commerce Drive Attorney Glaser stated that he has been working with Rufftidge Johnson Equipment Company, their Staff and owners Mr. & Mrs. Pederson regarding the new purchase agreement. He stated that the purchase agreement is the same as the previous one with conditions of a one (1) year period and obligation to buy the City's property if the 1031 exchange property is sold. Council had concern regarding 10 days rather than seven (7) days and Attorney Glaser stated that was an informality and closing would occur simultaneously. Motion by Council Member Montain, seconded by Council Member Love to Approve the Purchase Agreement as Presented. Discussion ensued regarding whether if they sell their property without utilizing the 1031 what ramifications does the City have, if selling utilizing the 1031 exchange they must purchase and close within six (6) months another parcel/building, not binding forever through the agreement, concern that if he is offered more money for their current property and not through their existing purchase agreement with Oppiden they would not have to purchase the City's property and the City Attorney's belief that Ruffridge Johnson's attorney addressed the City's concerns correctly. All in favor. Motion carried. X. COUNCIL & ADMINISTRATION ANNOUNCEMENT Page 6 of 7 Z City of Centerville Council Meeting Minutes May 25, 2017 1. Administrator Ericson a. Anoka County Recycling Award — City of Centerville Administrator Ericson was absent from the meeting. Council Member King stated that the NMTV is completing a study on closed captioning with new equipment. Council Member Koski expressed gratitude to Corner Express and its employees for implementing recycling and congratulated them on receiving an award. Council Member Montain reminded the audience and public of Parks & Recreation events with Music in the Park happening every Tuesday evening at Hidden Spring Park commencing at 6:30 p.m and Movie in the Park scheduled for September 16, 2017 with the movie to be determined. Mayor Paar gave a brief review of upcoming events: Fete des Lacs, registrations being accepted for the parade, runs, volleyball, kickball and softball tournaments and paddleboard and kayak races. He also reported that Garage Sale Days was June 9 and 10 with Clean Up Day on June 17, 2017. Mayor Paar stated that residents may be unaware that Waste Management offers yard waste and branch pickup curbside for $7.50/month during the summer months but billing will be yearly. Mayor Paar thanked individuals that are serving in the armed forces and those that have served as Memorial Day was upcoming. XII. Mayor Paar & City Council Members 00 Mike Ericson, City Administrator From: Charles Roberts, Administrative Intern Date: May 18, 2017 Re: Recommendations on City Council Tablets Computers Background: With the increasing availability of technology, city governments have the opportunity to use new technology to streamline, simplify and beoome more efficient with both funds and time. By embracing new technology, cities not only help themselves work better, but ensure that the citizen's tax dollar are wisely spent. One of the 2017 City Council Focus Goals was to "increase technology to better serve our residents". One technology which Centerville could quickly benefit from is tablet computers. Tablet computers are smaller and a more mobile version of traditional laptop. Listed below are some of the advantages and disadvantage of tablets, along with short explanations. Pro: 1. More mobile — Tablets are easy to carry and stored inside briefcases and bags 2. Cheaper — Because of their smaller construction and fewer components, tablets can be far less money to purchase than traditional laptops 3. Touchscreen — All tablets use touchscreen interfaces. Once familiarized with touchscxeens they become a quick and easy way to use your tablet 4. Longer battery life — Depending on usage and maker, tablets also tend to have better battery life and most can easily last long enough between charges Con: 1. Less powerful — Because of their smaller size, tablets cannot physically accommodate as many or as powerful processors as larger laptops 2. Not as user friendly — Most people are generally familiar with traditional desktops and laptop, however tablets are still relatively new and fewer people have had as much contactlusage with them 3. Factors such as cost, fimctionality and ease of use were considered. As with most consumer products, there is a range of tablets on the market. Staff worked to find a tablet which would have both the functionality that would make it useful to the City Council but also one which would be within budget. I contacted Patrick Antonen, the City Administrator of Circle Pines. He provided a significant amount of excellent information. Administrator Antonen has had previous experience with providing city councils with tablets and integrating them into the council's activities. He had several helpful insights on how best to help city councils to make use of their new technology. Based on his pasted experiences, Administrator Antonen recommended looking into purchasing the RCA Galileo 2 in 1 tablet. After doing further research on the RCA Galileo 2 in 1 tablet, staff generated the following recommendation, Recommendation: Staff recommends that the City Council: 1. If you are not the intended recipient, please delete all copies and notify us immediately. ® Please consider the environment before printing this email. 25 Small Cities Assistance Program Program Overview The Small Cities Assistance Program was created in 2015 to provide funding for construction and maintenance of roadways in cities with a population less than 5,000. Minnesota Statute 162.145 provides details on the program. The program is administered by MnDOT's State Aid for Local Transportation Division with the funding distributed by the Minnesota Department of Revenue. Program Guidance and Criteria Guidance Eligible local agencies include cities that do not receive municipal state aid under Statutes 162.09 to 162.14. This primarily includes all cities that have a population of 5,000 or less. The Commissioner of Revenue distributes the funds to cities in the same manner as local government aid under chapter 477A. Generally, cities will receive 50% of the payment in July and 50% of the payment in December. For 2015 payments, the December amount will be slightly different from the July amount due to a recalculation after the July payments had been made. Criteria The preliminary aid to each city is calculated as follows: • 5% equally allocated to all cities • 35% allocated based on each city's share of lane miles of municipal streets compared to the total municipal lane miles of all eligible cities • 35% allocated based on each city's share of population compared to the total population of all eligible cities 25% allocated based on each city's share of the state aid adjustment factor compared to the sum of the state aid adjustment factor for all eligible cities o The state aid adjustment factor is the greater of zero or: ■ 0.005 minus ■ The number of lane miles of county state aid highway in a city compared to the total lane miles of county state aid highways in eligible cities 26 The final aid to each city is the lesser of: • The preliminary aid or • The maximum aid, which equals 3.5 multiplied by the unweighted average amount of assistance to a city in a year. Use of Funds The funding is for the construction and maintenance of roads located within the city and can include land acquisition, environmental analysis, design, engineering, construction, reconstruction and maintenance. Timeline for Use of Funds There is no specified timeline by when the cities need to use these funds. However, it is recommended that they be used within two years of receiving the initial payment. Accounting of Funds The cities are not required to submit a report on how the funds were expended. Each city is required to follow appropriate accounting practices to clearly show that the funds they received have been used on the eligible items listed above and in the statute. One recommendation is to establish a separate account for these funds and then reduce that account as eligible expenditures are incurred.
