K%idsHidden Spring Park and Trails Within Centerville Mayor Paar provided an opportunity for Council Members to add additional items or remove items for further discussion. Council Member Montain desired to make a note regarding Check #31086 but not pull it from consideration. Council Member Love desired to pull Item ##4 for additional discussion. Council Member Love thanked Mrs. Jon (Heidi) Grahek for applying for one (1) of the vacant Parks & Recreation Committee positions. He stated that the Grahek family has endured and continues to endure many personal hurdles but she is steadfast on volunteering for her community. Mayor Paar stated that Mrs. Grahek will be a huge asset on the Committee. #„ y11111�,I pjj�11111e a;Item #4 as vresented. Ali in favor. Motion carried. Administrator Ericson stated that she did attend the Committee's June meeting and he believes that she will be a welcomed addition. 1. Lynn & Associates Proposal for Services — Organization Review a. HueLife Proposal for Employee Engagement/Organization Review Administrator Ericson stated that the HueLife Proposal was presented at Council's previous meeting, tabled and Council requested additional proposals. He stated that he has met with Mr. Jim Lynn regarding the presented proposal. He is highly regarded in his field and has worked with many communities in the past. Administrator Ericson also stated that Mr. F is providing a good value for services offered and has been contracted by the City in the past- He noted that both have phDs in organizational dcvelopment and would serve the City well. Council Member Koski questioned if Council chose to move forward with a Personnel Committee, shouldn't that Committee have input in Ifiring consultants for staff t® He also requested infonnation from the League of MN cities irgarding training. Administrator Ericson concurred with comments that had been made and stated that has spoken with three (3) consultants with one not being able to provide samices wi the $2,000 level. Administrator Ericson stated that he believes that either Mr. Fursman Mr. Lynn could provide the services to engage long time employees and Co a t Mil', Members in Mt,ining/onboarding. He reminded Council of their goals and stated onboarding was never received following his hiring. He stated that he has spoken wi Ms. Laura Kushner from the League regarding the institution of a Personnel Policy he beheved that it is not needed. Council Member Love questioned whether there was a memorandum in a packet regardmg the hu-ing of a consultant and Administrator Ericson stated that there was. Council Member Love stated that he reviewed all packets and he was unable to locate one. Local Government Officials Meeting, May 31,2011W, W City of Centerville Council Meeting Minutes June 1, 2017 Administrator Ericson state1 that he a Council1 1 attended r Local topics.Government Officials Meeting where emergency management and transportation were the Council Member Koski stated that Mr. Terry Stoltzman and Mr. Jerry Striech discussed emergency management and discussion was had regarding the Highway 97 interchange. He also stated that a legislative summary was also given and that it was a very good meeting. Council Member Koski stated that an interested developer appeared before the Planning & Zoning Commission to discuss a potential mini -storage facility which would be approximately 8,000 square feet with eight individual units. He also stated that the Commission discussed on street parking and current regulations. Council Member Montain stated that the Parks & Recreation Committee welcomed Ms. Heidi Grahek and discussed the Music in the Park series'. Mayor Paar thanked Mr. Tom Lee for his efforts in organizing these events. Mayor Paar stated that Transient Permits are needed to sell goods and services door-to- door and residents are encouraged to hire contractors who are licensed, bonded, insured and secure their own permits. Mayor Paar stated that the State of MN has a contractor recovery fund that a homeowner can recover funds from a contractor is services are not delivered or sub -standard. Mayor Paar also stated that he and the Administrator attended a meeting earlier in the morning with the Chain of Lakes Rotary Club. He stated that the members are community minded and assist in making the communities a better place to work and live. Mayor Paar noted that the Administrator recently celebrated his birthday and thanked him for his service. Mayor Paar stated that Mr. & Mrs. Jon Grahek lost a son in February and recently Jon was diagnosed with cancer. He reported that Mr. Grahek has service on the Parks & Recreation Committee and currently on the Planning & Zoning Commission. Mrs. Grahek is now currently servicing on the Parks & Recreation Committee. He also stated that they have a huge battle to contend with and requested that Council and residents keep their family in their hearts and prayers. Mandatory Municipal Water Connection Deadline (December 31,2012, Council reviewed the presentation contained in their packets regarding individual residences that have not been connected, assessed and reasons for Council previous decisions. Lengthy discussion was regarding the item, requested additional hiformation and determined that they would schedule another Work Session on the issue. The Instructors that currently teach for the fire academy are paid by the Fire Protection Council and then given a 1099 at the end of the year. According to the Fire Protection Councils Attorney we are acting as though the instructors are Independent Contractors but do not meet the IRS guidelines for an Independent Contractor (Topic 762 - Independent Contractor vs. Employee). The two choices the Anoka County Fire Protection has for instructors are having independent Contractors or have them as Employees. An Independent contractor must have control of their work schedule, provide their own equipment, and have their own insurance. This would not work since the academy sets the schedule and provides the apparatus/equipment. The Fire Protection Council is not in a position, nor do they wish to be, of having employees, which would require managing payroll taxes and everything else that comes with managing employees. The Fire Protection Council has been advised to have a MOU from each city that provides instructors to the fire academy. The Attorney stated "We're basically "borrowing' each city's employee and the city itself is required to compensate/ insure. Then ACFPC can agree to reimburse the city." As stated in the attached MOU the ACPFC shall reimburse the City for provng the Instructor at a rate of $501hr worked as defined by ACFPC. IN AND THE crry OF MINNESOTA WHEREAS, the Anoka County Fire Protection Council (hereinafter "ACFPC") operates as an independent Joint Powers Arraignment between multiple jurisdictions in Anoka County organized under Minn. Stat. 471.59 , and WHEREAS, the stated purpose of the ACFPC is to join together to improve the efficiency and effectiveness of fire and emergency services to the public within the geographic service area of the member jurisdictions to cooperatively address its member's long term needs for fire -fighting and emergency equipment, fire records data systems, fire-fighter and EMS training, fire prevention, fire inspection, fire -related public education, and other fire and emergency related essentials; and WHEREAS, the ACFPC desires to work cooperatively with its member cities to develop and implement fire protection related training through the ACPFC Fire Training Academy, and WHEREAS, the City of (hereinafter "City") is a member of ACFPC; and WHEREAS, the ACFPC, wishes to obtain the assistance and services from member cities of their qualified firefighter personnel that have been trained in various aspects of providing fire protection/ emergency responder services, and to utilize these individuals to provide training as instructors (hereinafter "Instructors") at the ACFPC Fire Training Academy. NOW THEREFORE, THE ANOKA COUNTY FIRE PROTECTION COUNCIL AND THE CITY OF 'MUTUALLY UNDERSTAND AND AGREE THAT: 1. If requested by ACFPC, the City shall coordinate with ACFPC to provide Instructors certified in certain areas of fire protection/ emergency responder training for the purpose of conducting training sessions or seminars. The City shall have the final authority whether to approve or deny the request by ACFPC for a certain Instructor for the requested training session or seminar. 2. The Instructor at all times shall remain a [volunteer] [paid on call] [full time] firefighter with the City. As such, the Instructor will continue to be paid by the City for the training time at the firefighter's standard training related pay in accordance with the City pay policies for conducting such training sessions or seminars. The City shall be expressly responsible for the payment of any applicable benefits to the Instructor, and shall cover all of the cost for maintenance or repair of any of its own equipment. 3. The Instructor shall at all times conform to the City's administrative and personnel policies, or other applicable rules and regulations of the Fire Training Academy. M 4. The City shall indemnify, defend, and hold harmless ACFPC for all claims, damages, losses, and expenses, including attorney's fees, for all of the acts or omissions arising out of the Instructor conducting the training session or seminar. 5. ACFPC shall reimburse the City for providing the Instructor at a rate of fifty dollars ($50.00) per hour worked as dcfined by ACFPC. 6. This Memorandum of Understanding may only be amended by a written docLunent fl,=cuted by both parties. 8. This Memorandum may be terminated by either party up sixty (60) days written notice. A summary of the facts involved is presented below: Where water is available o 109 users are not hooked to city water 0 This results in the loss of w0 WAC fee per resident o 42 of those have not paid for their portion of construction costs for the water main and lateral pipe to their property. 0 This results in the loss of the $6,500 "Lateral Fee" per resident o Total of +/- $500,000 in unrecovered capital costs o Deadline to hook to water is 12/31/17 for all but 6 residents o All 109 members of this group have been notified of their obligation to connect [Ateral.Fee The current Lateral Fee is $6,500. This Fee has not increased in many wears and is currently undervalued. Staff proposes a new Lateral Fee for 2018 of $8,000. Given the short time period before this deadline passes, staff's recommendations are to change the trigger(s) to connect to City water: Send a letter to all 109 landowners with the following information • Deadline history reminder — 12/31/17 • Deadline will be waived for those who have paid a Lateral Fee. • For those who have not paid a Lateral e:"'. will be waived if that Fee is paid at the 2016 rate ($6,500) Payment plans could be arranged for up to 5 years by assessment to the property.
