STAFF: City Attorney Kurt Glaser Interim City Administrator Dallas Larson City Engineer Mark Statz COUNCIL MEETING I. CALL TO ORDER Mayor Paar called to order 6:30 p.m. II. PLEDGE OF ALLEGIANCE III. SET AGENDA Mayor Paar added Check 431428-31439; Item 43. Valley Paving, Inc. — Final Payment, 2017 Mill & Overlay Project; Item 44 Administrator Interviews; and Item 45 Columbus Asphalt Plant under New Business. Motion by Council Member Love, seconded by Council Member Montain to approve the Agenda as Amended. All in favor. Motion carried. IV. APPOINTMENTS/PRESENTATIONS 1. None. V. PUBLIC HEARING 1. Review of Interim Use Permit—Rehbein Black Dirt Operation City of Centerville Council Meeting Minutes October 25,2017 Interim City Administrator Larson stated that he had invited Mr. Rehbein to the Council meeting to review compliance with his Interim Use Permit. Interim Larson stated that the City has concerns regarding: material tracking into the street, the amount of soil being stored on the site, material complying with the permit (granular and compactable or black dirt), restoration of the area around the cul-de-sac and access from Fairview Avenue, and the submittal of a Surface Water Management Plan (SWPPP). Engineer Statz stated that several months prior Mr. Rehbein was asked for information regarding soils and Mr. Rehbein's own Soils Engineer stated that the soils needed to be blended with additional materials and dried before they could be compacted to meet specification for building site soils. He also stated that Mr. Rehbein has received numerous letters from the city requesting that he file a SWPPP, which is specifically required by the NP. even though RCWD and the MPCA did not require one. Interim Administrator Larson stated that since the distribution center has been constructed, 21st Avenue was extended past the site, hauling to the site has been modified with the driveway being significantly shorter, allowing for soils to be tracked into the roadway. Mr. Rehbein has been receptive to requests for cleaning; however the City would prefer that has was proactive regarding the necessities of cleaning and initiate this requirement without the City's contact. He also stated that the current IUP is set to expire on December 31, 2018 and that any remaining material must be hauled away or graded and seeded, not later than December 31, 2019. If the material that was brought to the site is sub-standard soil, there is a potential for a large liability to remove substandard soil. It was suggested that the owner provide bond or letter of credit to ensure that the site is completed to the City's requirements when the IUP expires. Discussion ensued regarding United Properties' option to purchase all of the Rehbein property and the potential for them to use the soils. Mr. Rehbein addressed Council stating that he has completed other requirements of the IUP and feels that a SWPPP is not required as two outside entities have stated that they do not require such a document and his unwillingness to complete this requirement which could cost $10,000. He insisted that the soil will be removed next year, as several housing projects will commence in nearby locations and utilize the soils for building pads. Mr. Rehbein stated that he has not received complaints from residents nor has the City. He mentioned that his property is being taxed as a commercial operation so that his taxes are high on the property. He also stated that he has kept a 50' buffer from the creek and installed silt fencing. Discussion ensued regarding United Properties' damage to Fairview Street due to construction of the distribution center and their liability for same. City Attorney Glaser stated that this is being handled with them. Engineer Statz stated that the City has been contact by the City of Lino Lakes regarding the SWPPP and cleaning of the roadway. Mr. Rehbein stated again that he has never been contacted regarding cleaning of the roadway. Mr. Rehbein stated that if Council desired for the soils to be gone by the summer there is a good possibility for it to be removed by June of 2018. Page 2 of 7 City of Centerville Council Meeting Minutes October 25,2017 Numerous questions ensued regarding the needed mixing of the current soil along with moisture content to make to soils usable and whether they will be removed from the site prior to the NPs expiration date. Mr. Rehbein stated that the construction season is coming to an end so it is unlikely that the material will be removed this year but would attempt to ensure that it is removed by June 1. Council felt that July 1 would be a more appropriate date and Mr. Rehbein would again be request to appear before Council at that time. City Attorney Glaser stated that Council, if desired, has every right to modify the existing lUP due to the fact that Mr. Rehbein is not adhering to the agreement. Motion by Council Member Koski, seconded by Council Member Love that the City Council determines that Mr. Rehbein has been found in violation of several IUP conditions (soil type, cleaning of roadway and lack of a completed SWPPP) further that he be given until July 1, 2018 to rectify violations. All voted in favor except Council Member Montain opposed. Motion carried. VI. APPROVAL OF THE MINUTES 1. September 27, 2017 City Council Meeting Minutes Mayor Paar provided Council with an opportunity for amendments. Motion by Montain, seconded by Council Member Koski to Approve the September 27, 2017 Council Meeting Minutes as presented. All in favor. Motion carried. 2. October 11, 2017 City Council Meeting Minutes Mayor Paar provided Council with an opportunity for amendments. Motion by Koski, seconded by Council Member Love to Approve the October 11, 2017 Council Meeting Minutes as presented. All in favor. Motion carried. VI. CONSENT AGENDA 1. City of Centerville October 12, 2017 through October 25, 2017 Claims (Check #313405-31427 W/Voided Check#31405) & (Check#31428-31439) 2. Centennial Lakes Police Claims through October 12, 2017 (Check#11643-11664) 3. Centennial Fire District Claims through October 18, 2017 (Check#7996-8005) & Payroll (Check#7991-7995) 4. Encroachment Agreement, 1654 Hunters Ridge Lane—Fence Mayor Paar provided an opportunity for Council Members to add additional items or remove items for further discussion. Motion carried. VI. OLD BUSINESS 1. Bike Path Bollards Interim Administrator Larson stated that Council previously passed a motion to install bollards on two (2) pedestrian trailways as vehicle traffic had been reported driving on the trail. Interim Larson stated that these were not installed; however, monitoring of the areas has occurred and no complaints or events have taken place since the item was brought to the City's attention and several violators were spoken to. It was also stated that cameras were placed near the areas of previous activity and have not detected additional violations. Two (2) concerns of Council were that public safety is foremost and that ordinances are enforced. Council consensus was that the bollards should not be placed and no further action was needed at this time. IX. NEW BUSINESS 1. Consideration of Cancellation of November 22 & December 27, 2017 Council Meetings Due to Holidays Interim Administrator Larson stated that in years past, Council has cancelled these meetings due to Holiday travel and vacations. Mayor Paar could call a meeting if needed. Discussion ensued regarding Council Member availability for potentially rescheduling these meetings closer to the middle of the months. It was determined that the November 8 would remain the same due to a schedule public hearing. Motion by Council Member Montain, seconded by Council Member King to Cancel the Regularly Schedule Council Meetings of November 22 and December 27, 2017 and Reschedule the December 13, 2017 to December 20, 2017. All in favor. Motion carried. 2. Review Pavement Management Plan Engineer Statz stated that staff has met and discussed that in 2018 and 2019 no roads are earmarked for reconstruction or mill and overlay. He stated that the downtown area is in much need of repair and that the Council may desire to complete a project in that area. He stated that as of 2019 if nothing is completed that will be an anticipated million dollars in the fund. He also stated that the break in the schedule would allow the city to complete the downtown area without the need for bonding. Discussion ensued regarding the need for full reconstruction and installation of watermain. It was felt that the lead time would allow the city to obtain competitive bids and cost approximately Page 4 of 7 City of Centerville Council Meeting Minutes October 25,2017 $700,000. Interim Administrator Larson stated that the City could apply for a grant through the County to assist individuals with funding for the watermain connection, if they met income guidelines. Discussion ensued regarding the separation of the two (2)projects as financing could be from the Water Fund and Street Funds. It was felt that the water main could be installed in 2018 with paving in 2019. Council Member King felt that a 2" overlay was sufficient for the area rather than a complete reconstruction. Engineer Statz stated that this discussion took place previously and there were complicating factors with adding a crown to the roadways and curbing. He also stated that if municipal services were not installed it may put those services off an additional 10 years. It was the consensus of Council to again discuss the issue once the new City Administrator is on board. Interim Administrator Larson stated that Staff would prepare information for obtaining a grant for water connections. 3. Valley Paving, Inc. —Final Payment, 2017 Mill & Overlay Project Engineer Statz stated that the contractor has submitted all required forms and the project has been completed to the City's specifications. Motion by Council Member Love, seconded by Council Member Koski to Approve Valley Paving, Inc. — Final Payment, 2017 Mill & Overlay Street Proiect as presented. All in favor. Motion carried. 4. Administrator Interviews Scheduled for Monday City Attorney Glaser stated that interview candidates do not become public until Monday. He stated that all will be completing police backgrounds checks. He questioned Council Members as to potential questions for candidates and stated that each interview would take approximately 45 minutes with four (4) candidates participating. He also stated that Council would be conducting the interviews at a Special Meeting and could make a determination at the end of the meeting if they desired. Attorney Glaser stated that the meeting would be open to the public however Council could close the meeting for action if desired. Mayor Paar thanked Interim City Administrator Larson, City Attorney Glaser and Council Member Montain for their input regarding pre-interview candidates and phone interviews. He stated that the process has gone smoothly. 5. Columbus Asphalt Plant Interim Administrator Larson stated that he had spoken with the Manager of Running Aces who stated that he is very concerned about the proposed asphalt plan and that city's procedures associated with authorizing the plant in a district that is not properly zoned for the proposed Page 5 of 7 City of Centerville Council Meeting Minutes October 25,2017 activities of the asphalt plant including crushing and recycling of products. Interim Larson drafted a letter from Council regarding proper zoning, increased traffic, odor, etc. Council concluded that the letter was well drafted, however, they did not feel that it was the City of Centerville's place to instruct them on how to operate or make decisions within their community. Council stated that they felt that the letter being forwarded from Interim Larson to the City Administrator may be a better avenue for Centerville's concerns to be received. Mayor Paar stated that Commissioner Sivarajah and County Engineer Fischer are very aware of concerns of residents and for increased roadway traffic. X. COUNCIL/LEGAL/INTERIM ADMINISTRATOR ANNOUNCEMENTS Interim Administrator Larson reported that Council had suspended the on street parking regulations due to resident construction throughout July, August, September, October and a portion of November. He stated that as of November 15, 2017 all residents would again need on street parking passes to park their vehicles on the roadway between the hours of 3:00 a.m—7:00 a.m. Interim Administrator Larson stated that Waste Management's current contract expires February 1, 2018 and if Council desired staff would commence going out for Requests for Proposals (RFPs). He also stated that Council could extend the current contract for a period of two (2) years allowing additional time to secure RFPs. Council consensus was to obtain proposals and staff would prepare an RFP by early December. Council Member King reported that North Metro Cable saved approximately $2,254 per city on new purchased equipment associated with the HD conversion and that Mr. Mike Bradley would be working on proposed ordinance language regarding small cell towers for members of the commission and if interested it would cost each city approximately $750. City Attorney Glaser stated that the City of Bloomington was one of the first communities to address the issue and has about two to three revisions since their first code. He stated that he has also been following the legislation and their code. Council Member Love thanked Interim Administrator Larson for his acceptance of coming back to the city and stated that it is a pleasure working with him again. Council Member Montain thanked spectators and participants in the Centerville Lions and Centennial Fire District Chili Cook-off recently. He stated that he attended the recent Anoka County Fire Protection meeting where they considered hiring an additional employee for dispatch with a cost of$1,000/year. He also stated that the Chiefs felt that this was a position that needed immediate filling. Mayor Paar requested an update on the City of Centerville's Facebook page from Interim Administrator Larson. Interim Larson stated that he felt that this would be a project for the new Administrator. Mayor Paar also requested an update regarding a private, in-house server versus Metro-I Net. Interim Larson stated that he had scheduled an upcoming meeting with the City's current IT provider for the following week and would be bringing information back to Council Page 6 of 7 City of Centerville Council Meeting Minutes October 25,2017 for consideration. Mayor Paar stated that he also attending the Chili Cook-Off and it appeared to be a great event. Mayor Paar reported that long-time resident Louis Thill had recently experience a stroke and is currently in transitional care. He requested that Council and residents keep him in their prayers. He stated that Mr. Louis Thill is the father of Mr. John Thill long time Lion member. Mayor Paar also reported that a recent Festival Re-Cap meeting was held where four (4) members (himself, P & R Member Mr. Chris Bettinger, Officer Bill Jacobsen and Anoka County Radio Club Member Bob Cordell) were in attendance. He stated that he will attempt to organize an additional meeting to obtain a Committee Chairperson, discuss donations, date, fireworks, etc. sometime in November. Mayor Paar stated that Public Works Technician Peterson assembled a "Flushable Wipes" display in the entry way of City Hall. He reported that "Flushable Wipes" are not flushable and a costing the City approximately $10,000 to $12,000 per year in repairs. He stated that the City would again put an article in the newsletter and requested that the newspaper also place an article as this is affecting every city in the United States. XI.
