Centerville today.
Centerville continues to be a rapidly growing community. In 1993, the City celebrated its new City Hall and

REPORTING RELATIONSHIPS
Centerville is a Plan A form of government with the City Administrator reporting to the five member City
Council consisting of the Mayor and four councilpersons at large. The new Council member elected to
replace the Mayor-Elect's seat served on the City's Planning and Zoning Commission.
BACKGROUND AND EXPERIENCE REQUIRED
The successful candidate should have the following experience and knowledge:
. A Bachelor's Degree is required and a Master's Degree is preferred.
. Three to five years of increasingly responsible managerial experience in local government as a City
Manager, Administrator, Assistant City Manager or Assistant Administrator.
. Working knowledge and first hand experience with state and local laws concerning land use,
planning, zoning, subdivision planning and lot splits.
. Working knowledge and first hand experience with city economic development and redevelopment.
. Experience with special assessment laws (such as TIF), and the financing of public improvements
as well as financing for new developments.
. Must have experience dealing with budgeting, long-range financial planning, municipal finance and
experience working with financial consultants.
. Must have experience in attracting, hiring, managing, retaining and developing staff.
. Live within a commutable distance to Centerville.

Plans and organizes the work that goes into providing services established by past and current
decisions of the Council. Carries out policies adopted by the Council and developed by staff.
Manages responses to public requests and complaints or areas of concern. Evaluating and keeping

2. FISCAUBUSINESS MANAGEMENT
Plans and organizes the preparation of an annual budget with documentation that conforms to
guidelines adopted by the Council. Administers the adopted budget with approved revenues and
expenditures. Plans, organizes, and/or supervises the most efficient economic utilization of
manpower, materials, and machinery. Plans and organizes a system of reports for Council that
provide the most up-to-date data available concerning expenditures and revenue. Plans and
organizes maintenance of City-owned facilities, buildings, and equipment.
3. PROGRAM DEVELOPMENT AND FOLLOW-THROUGH
Plans and organizes on-going programs and services to City Government. Works on researching
program suggestions by Council and staff and the reporting of the results of the analysis. Maintains
knowledge of current and innovative trends in the area of services being provided by local
jurisdictions, and incorporates that knowledge in program suggestions and performance improvement
initiatives. Plans and organizes work assigned by the Council so that it is completed with dispatch
and efficiency. Ensures that programs are implemented effectively.
4. RELATIONSHIP WITH MAYOR AND CITY COUNCIL
Maintains effective communication, both verbal and written with the Mayor and Council. Maintains
availability to Council. Is approachable. Establishes and maintains a system of reporting to the
Council current plans and activities of the staff. Plans and organizes materials for presentations to the
Council, either verbally or written, in as concise, clear, and comprehensive a manner as possible.

Maintains awareness of developments and plans in other jurisdictions that may relate to or affect City
governments. Establishes and maintains a liaison with other governmental jurisdictions in those
areas of service that that could improve or enhance the City's programs or services. Maintains
communications with governmental jurisdictions with which the City is involved or has interactions.
8. PROFESSIONAUPERSONAL DEVELOPMENT
Periodically engages in assessment processes to determine strengths and areas of need for growth

v. A W ARDS/PRESENTATIONS/APPEARANCES
1. CSAH 14 Concerns and Issues of Mr. Lee L' Allier, 1973 Main Street
Mr. Lee L' Allier of 1973 Main Street appeared before Council and presented a
handwritten letter outlining his concerns with respect to the CSAH 14 project. He stated
that several area businesses are in the process of discussing the proposed project and
everybody appears to be in agreement that the goal is to come up with a project that is
best for the City and that is safest for the City. Mr. L' Allier asked Council if a meeting
with residents and business owners would be appropriate prior to the Public Information
meeting with the County on December 9. He stated he is interested in receiving input
from the Council prior to the Public Information Meeting.
Council Member Capra stated there was some discussion earlier about holding a Council
Workshop on December 1 st to discuss the project prior to the Public Information Meeting
on December 9, 2004 at 5:00 p.m. at the Wargo Nature Center. She added that the
County has indicated it will have a revised plan available on December 9 that should
address some of the issues raised at the previous Open House.
Mayor Sweeney stated the revised plan from the County will show modifications
including allowing a full access at Cottonwood, allowing a full access on 20th for the
shopping center, and allowing left turns off of Main Street at 21 st.
Ms. Bender stated that Mr. Fischer has indicated that he is not available on December 1 st
to meet with Council; he has further indicated that if Council felt that a work session
would be beneficial after the December 9 meeting, he would be willing to schedule one.
Mr. L' Allier expressed concern regarding the speed limits on CSAH 14 and stated they
would like to see the speed limits reduced. He added that Hugo's speed limit is 40 mph
and Lino Lakes' speed limit is between 30-35 mph, while the speed limit in Centerville is
45 mph.

Council Member Paar stated that because of the continued growth in the area, the County
is interested in making traffic flow better overall and the County has indicated if traffic is
slowed with reduced speed limits, it will cause more back -ups.
Council Member Broussard Vickers stated the three main issues appear to be the speed
limit, the turn lanes, and the lights.
Mr. Bill Krohn of 1969 Main Street expressed concern about the speed limit near the
school and stated he would like to see the speed limit reduced in that area.
Council Member Broussard Vickers stated the City can express its concerns to the
County regarding the speed limits but it is ultimately the County's decision.
Council Member Paar stated it appears there is a consensus that the speed limit is too
high and stated it may be worthwhile to ask the County to change the speed limit to 35
mph on the entire stretch of CSAH 14 from Hugo to Lino Lakes. Council Member Lee
concurred and noted a single speed limit would be easier to enforce.
Council Member Parr stated it will be important to get as many interested people at the
Public Information Meeting on December 9th to provide the County with as much citizen
input as possible.
Mr. Krohn asked if a petition could be prepared for presentation to the County on
December 9th that outlines all of their concerns.
Mayor Sweeney encouraged Mr. Krohn to prepare a petition that lists their concerns and
to have as many people sign it as possible and present it to the County on December 9th.
Mayor Sweeney stated he is interested in seeing what the County brings forth on
December 9th and to make a decision at that time on how to proceed.
Council Member Broussard Vickers expressed concern that the County may tell us that
we are trying to accommodate very few at the danger of very many.
Mr. L' Allier reiterated they are interested in the safety of everybody, not just a few. He
expressed his appreciation to the Council for discussing his concerns.
Council Member Capra asked if the Council would like to proceed with a Workshop
Meeting on December 1 st without Mr. Fischer being in attendance. Ms. Bender stated that
SRF indicated they would be willing to attend the December 1st meeting.
Mayor Sweeney asked if it would be possible to get a copy of the revised plan from the
County prior to December 1 st.
Mr. Patzer replied that staff will be meeting with the County on November 30th for the
purpose of discussing the road design.

It was the consensus of the Council to hold a Workshop Meeting on Wednesday,
December 1, 2004 for the purpose of discussing the CSAH 14 project with all interested
parties. Staff was directed to send appropriate notices out with the date, time and
location of the Workshop Meeting.

VII. NEW BUSINESS
1. Executive Search - City Administrator
Council Member Capra stated there are two proposals for the services of Mr. Lynn, one
for staff team building and leadership training and the other for facilitating the City
Administrator search and selection process. She asked Mr. Lynn if he was amenable to
the revisions made to the proposal. Mr. Lynn replied the documents are satisfactory to
him and represent standard practice in the industry.
Motion by Council Member Caora. seconded by Council Member Paar. to aoorove
the Prooosal for Services - Staff Team Buildin2 and Leadershio Trainin2. with
James J. Lynn. Ed.D. LP. Lynn & Associates. Ayes - 4. Nays - 1 (Broussard
Vickers). Motion carried.

the Prooosal for Services - Facilitatin2 the Search and Selection Process. with
James J. Lynn. Ed.D. LP. Lynn & Associates. All in favor. Motion carried
unanimously.
Dr. Lynn stated that he will be meeting tomorrow morning with staff to discuss the plan
for working together during the interim period until a new City Administrator is hired.
2. Resolution #04-054 - Calling for Public Hearing on Delinquent Sewer. Water and
Garbage Services for Residents Associated with the 3rd and 4th Quarter 2003, 1st
and 2nd Quarters of 2004 Billing Cycles
Council Member Broussard Vickers asked if the certification fee of $25 was sufficient to
cover staff costs associated with collecting on the delinquent accounts and felt the fee
should be increased.
Ms. Bender suggested the Council consider the certification fee when the fee schedule is
reviewed.
Motion by Council Member Caora. seconded by Council Member Paar. to aoorove
Resolution #04-054 as oresented. All in favor. Motion carried unanimously.

3. Hardwood Creek - Judicial Ditch #2 (Support Water Quality)
Council Member Capra stated she requested this item be placed on the Council agenda.
Mr. Wayne LeBlanc, Peltier Lake Association Chairman, appeared before Council and
presented information regarding four available options for Hardwood Creek, including
ditching to profile, meandered channel at profile, stable stream rehabilitation, and
ongoing maintenance. He stated that stable stream rehabilitation appears to be the best
option for improving the federally-designated impaired waters of Hardwood Creek and
Peltier Lake.
Council Member Broussard Vickers asked who would pay for the ditch repair. Council
Member Capra replied federal funds are used through the Rice Creek Watershed District.
Mr. LeBlanc explained that the Rice Creek Watershed District has stated it will pursue
minimum maintenance on the existing ditch and mitigate by building holding ponds
further downstream, west of Highway 61. He stated the Rice Creek Watershed District
will be meeting on December 8th to review this matter.
Mayor Sweeney stated that the goal of the project should be to seek a solution that aids in
improving the water quality of Peltier Lake. He added if a series of holding ponds
accomplishes this and is more favorable to property owners, then that is what should be
supported by the City.
It was the consensus of the Council to direct staff to prepare a letter to the Rice Creek
Watershed District indicating that the Centerville City Council supports a Hardwood
Creek/JD2 repair that creates the best possible water quality in Peltier Lake.
4. Possibility of Rescheduling December 22, 2004 Regularly Scheduled Meeting to
Truth in Taxation Hearing Continuation Meeting of December 20,2004
Ms. Bender requested clarification regarding the rescheduling of the regular Council
meeting on December 22, 2004 and whether it was Council's desire to move the
December 22,2004 regular Council meeting to Monday, December 20,2004 to be held at
the same time as the Truth in Taxation Hearing.
It was the consensus of the Council to move the regular Council meeting from
Wednesday, December 22,2004 to Monday, December 20,2004, to be held at the same
time as the Truth in Taxation Hearing.
5. Liquor/Tobacco License Renewal 2005
Council Member Capra stated Ms. Bender and Chief Makela have discussed having the
BCA conduct background checks for the tobacco licenses. Ms. Bender noted that the
BCA is allowed by statute to conduct background checks with respect to liquor licenses.

Council Member Capra stated the Council may wish to review and amend the tobacco

Ms. Bender reviewed the tobacco compliance check failure for Trio Inn. She stated that
Centennial Lakes Police Department has been providing the services of background
checks only to the extent of their records and local police department records. She stated
that Council may wish to consider language allowing a Criminal History Data check
(Felony Level Crimes) or to consider the City of Plymouth's tobacco/best practices
ordinance and adopt a similar ordinance for tobacco.

7. Staff Get Together
Ms. Bender requested Council input about holding a get together for staff during the
holidays and had received a request from a Council Member to open the discussion about

Attorney about this and requested that if a get together is planned, that it be held in early
2005 after the holidays.
Council Member Capra stated tax dollars should not be used for the get together and each
person should pay their own way.

8. Staff Memo Regarding Day-to-Day OperationslPersonnel Issues
Ms. Bender requested Council input regarding a proposed memo to staff regarding day-
to-day operations/personnel issues and requested approval to distribute the memo to staff
Mayor Sweeney stated it was his understanding that when the Council assigned the
interim administrator duties to Ms. Bender and Mr. Palzer, the Finance Director would
not be supervising Ms. Bender. He stated that as co-interim administrators, Ms. Bender
and Mr. Palzer report to the Council. He stated that the Finance Director will continue to
supervise the bookkeeper and receptionist.
Mayor Sweeney stated that Ms. Bender had requested clarification regarding who she
reports to as co-interim administrator.
VITI. OLD BUSINESS
1. Ordinance Codification Update
Ms. Bender explained the proposed fees by American Legal Publishing Corporation
(ALP) for completing the draft ordinance codification started for the city in 1998. She
stated ALP will charge $2,120 to complete the draft, including subdivision and zoning,
$1,000 to incorporate six years' worth of ordinances and amendments, and $22 per page
to incorporate the subdivision and zoning regulations in full. She stated that the
subdivision ordinances and zoning ordinances can simply be referenced; thus, the $22 per
page expense will not be incurred.

Ms. Bender stated Metro Land Surveying and Engineering is working with Mr. Drilling
to correct the grading activities for this site.
2. Council/Committee/Staff 2005 Achievements Update
Ms. Bender stated the memo regarding 2005 projects has been sent to staff, the
committees and commissions as requested.
3. 1540 Peltier Lake Drive
Mr. Palzer stated staff has contacted the resident on three separate occasions and
requested access to do an inspection and access has been denied. He stated staff will
request the City Attorney draft an administrative warrant.
4. Eagle Pass Drainage
City Engineer Peterson stated all repairs have been completed and they inspected the
property today.
5. Governing Board Meeting
Council Member Lee requested Council input regarding the City's position with respect
to ownership of the building, maintenance of the building, as well as the formula for
operating costs. He stated he would like to see ownership in the building be 1/3 each for
the three cities.
Council Member Broussard Vickers agreed that 1/3 each would be ideal.
Mayor Sweeney stated he is opposed to locking the City in for 15 years with a percentage
formula whereby Circle Pines or anyone entity is a majority stakeholder.
Council Member Broussard Vickers suggested having Circle Pines and Centerville at
35% each, with Lexington at 30%, with voting rights representative of an entity's
ownership in the building.
Mayor Sweeney stated the Police Governing Board will meet on November 30, 2004 at
7:00 p.m. in Circle Pines. He stated that the proposal will come back to Council for
consideration.

6. Staff Update
Ms. Bender reported that staff met with legal counsel, Mr. Meyer and representatives of
Pheasant Marsh Ground Development on November 181h to again discuss the funding
hurdles with Phase 1 and 2 and to discuss Phase 3. She stated another meeting has been
scheduled for December 2nd at 1:30 p.m. and City Engineer Peterson will attend that
meeting.
Ms. Bender stated that Mr. John Thill contacted staff and has indicated that the
Centerville businesswomen's group has declined to take over the parade. She stated that
Mr. Thill will come before the Council to discuss this further.
Council Member Capra stated if no one agrees to take over, the City can choose to cancel
the parade. She indicated she attended the Centerville businesswomen's meeting and
agreed to act as the go-between for the parade pending a decision by the City. She stated
the City may wish to retain its permit pending that decision.
Mayor Sweeney expressed concern that there is not enough community involvement with
the parade.
It was the consensus of Council to direct staff to obtain the permit from Anoka County.

Our 2005 rates reflect our commitment to remain cost competitive while offering the breadth of services
with the depth of experience you expect from your consulting engineer. While we understand the limited
financial resources of our clients, we are operating in an economy where it is becoming increasingly
costly to hire and retain talented engineers and specialists. This is driven by a declining number of
students entering engineering and other technical fields as well as record numbers of engineers and
specialists nationwide who are entering or becoming eligible for retirement. The increased costs of
health, professional liability insurance and software licensing, combined with the increased costs of hiring
talented staff, cause us to adjust our rates by an average increase of 4%.

SRF Engineering Clearwater Creek Trail Feasibility Study Proposal

The following motion was made at the October 6, 2004 Parks & Recreation Committee Meeting and
was approved by City Council at the October 13, 2004 City Council Meeting.
Motion was made by Committee Member Peil, seconded by Committee Member Lindsay to
recommend to City Council requesting City Staff contact SRF Engineering for the purpose of
supplying the Parks & Recreation Committee/City Council with a detailed proposal/estimate of
costs involved and what services would be included in a Clearwater Creek Trail Feasibility Study
for the purposes of including the study with future trail grant applications. All in favor. Motion
passed unanimously.
The following excerpt is from the December 1, 2004 Parks & Recreation Committee Meeting Minutes:
SRF Engineering submitted a proposal dated October 28, 2004 to be discussed at the November 3,
2004 Parks & Recreation Committee Meeting. The committee canceled the regularly scheduled
November meeting therefore the item was not discussed until the December 1, 2004 meeting. The
Grant & Trail Subcommittees reviewed the proposal prior to the December meeting and requested SRF
modify the proposal to concentrate on specific issues. The purpose of the feasibility study as
submitted in the proposal is to provide a more detailed assessment of the two trail alignment
alternatives that can be used to assist in the preparation of a 2005 Minnesota DNR Trails and
Waterways grant application. The proposal was pared down to three (3) main bullet points:
1. Gather Background Information
2. Complete Inventory and Analysis
3. Identify Issues Relating to Agency Coordination and Project Phasing
The Parks & Recreation Committee feel this will be an invaluable tool to be used in the grant process.
Working with SRF Engineering will also be beneficial as they are already involved in the CSAH 14
Project. Chairperson Peterson questioned the timetable and whether requesting this study be started
now would allow adequate time to complete the study before the next grant application is due in
February 2005. Committee Member Seeley stated that the majority of the study could be done before
the grant application will be submitted, although some of the project will require more time. The
feedback from the DNR Grant Committee regarding the last grant application was favorable, but the
representative Committee Member Seeley discussed this issue with stated the committee needed to
resolve how to cross over 35E.
Vice-Chairperson LeBlanc updated the committee regarding information he received from Mr. Rick
Arnebeck of the Minnesota Department of Transportation on the status of the DOT 35E Corridor
Study. Mr. Arnebeck said it is progressing and he expected the study could be completed in about one
year. In regards to a pedestrian overpass for 35E, Mr. Arnebeck said it would most likely be
incorporated into the 35E and CSAH 14 interchange reconstruction, but he questioned what side, north
or south, the pedestrian overpass would be located on. Vice-Chairperson LeBlanc suggested the south
side might be best because that is where the trail currently is planned, but added perhaps the study will
conclude something else.
The committee opted to recommend to City Council that SRF Engineering proceed with this feasibility
study as outlined in the proposal.
Motion was made by Chairperson Peterson, seconded by Committee Member Seeley to
recommend to City Council approving the expenditure not to exceed $800 to move forward with
SRF Engineering commencing tbe Clearwater Creek Trail Feasibility Study as outlined in the
proposal submitted. All in favor. Motion passed unanimously.

SUBJECT: PROFESSIONAL SERVICES PROPOSAL-CITY OF CENTERVILLE
CLEARWATER TRAIL FEASIBILITY STUDY
Based upon your request, SRF is pleased to submit this professional services proposal for preparation
of the Clearwater Trail Extension Feasibility Study. The purpose of this feasibility study is to provide
a more detailed assessment of the two trail alignment alternatives that can be used to assist in the
preparation of a 2005 Minnesota DNR Trails and Waterways grant application.
SCOPE OF SERVICES
SRF would propose to complete a feasibility study for the trail corridor alignments as outlined in
Attachment A - Scope of Services. The final end product will be a technical memorandum that will .
encompass the following tasks:
1. Gather Background Information
All background information and existing mapping available from the City and County will be
collected to evaluate the alternate trail corridor alignment as shown in the 2004 trail grant application.
2. Complete Inventory and Analysis
A general inventory and analysis will be completed for the trail corridor alignment going north .
along County Road 20 and connecting across the County Road 14/35E interchange, identifying
potential conflicts with wetlands, vegetation, topography, utilities, drainage ways, roadway
crossings and private property ownership.
3. Identify Issues Relating To Agency Coordination and Project Phasing
Since multiple agencies will require involvement in the planning and design of the trail corridor,
coordination and phasing issues will be identified for each agency to address and a timeline
developed for review, approval, and implementation.
SCHEDULE
SRF will complete this work within a mutually agreed upon time schedule. However, in order to allow
for enough time for preparing a 2005 DNR grant application submission, we would propose to
complete the feasibility study by the end of December 2004.

BUDGET
The estimated cost for completing tasks 1-3 of the feasibility study is $800. See Attachment A for an
individual breakdoWn of tasks and corresponding fees..
BASIS OF PAYMENT
SRF proposes to be reimbursed for our services on an hourly basis for actual time expended. Other
direct project expenses such as printing, supplies, reproduction, etc., would be reimbursed at the
current IRS-rate for business miles. Invoices are submitted on a monthly basis for work performed
during the previous month. Payment is due within 30 days.
CHANGES IN SCOPE OF SERVICES
It is understood that if the scope or intent of the work changes, the cost will be adjusted accordingly.
Before any out-of-scope work is done, however, we will submit a budget for the new work and will not.
begin work until we receive authorization from you.

A signed copy of this proposal, either mailed or faxed to our office, will serve as a notice to proceed.

St. Paul Water Utility Prooerty on Centerville Lake
The committee discussed the following correspondence from City Attorney, Mr. Hoeft to Mr. Bill
Tschida, St. Paul Water Utility regarding the City Council's response to the proposed purchase of the
Centerville Lake Property at 1601 LaMotte Drive.
This letter is to confirm our phone conversation of today 's date regarding the status of the City's purchase of
the above-referenced lot. As indicated, the City Council discussed this matter at its last regularly scheduled
Council meeting on October 27, 2004, and determined that it was premature to proceed with fUrther purchase
negotiations regarding the same. Since we last met, the Council has become aware of other possible properties
that may provide access to the lake and tie in with the proposed trail that would run along the south side of the
redeveloped County Highway 14/Main Street.
1 should emphasize that the Council has not closed the door on purchasing the above-referenced lot. However,
it does want to explore these other options that have become available. If at a later date the Council determines
that the LaMotte Drive property is preferable, I'm sure you will be hearing from us. The Council also
understands that the lot may not be available at a later date, and will deal with that situation as it presents
itself.
1 do want to thank both you and Mr. Schneider for taking your time to meet with the City Administrator and
myself Please let me know if there are any further developments regarding this property that you feel the City
should be aware of
Members of the committee felt they were not included in this process and the negotiations for this property
should continue. The majority of the committee felt the property is invaluable to the City of CentervilIe as park
property and would like City Council to reconsider the purchase. The committee discussed that the properties
along CSAH 14 on Centerville Lake will potentially become available with the reconstruction of CSAH 14.
Although there is interest in these properties it was also felt they are too small and without parking to provide an
adequate park area on Centerville Lake. It was also felt that if these properties were made available to the City
of Centerville by Anoka County the price would be minimal. The committee made the following motion and
requested they be added under Appearances to the next City Council Agenda to voice their concerns as a
committee regarding this property.
Motion was made by Vice-Chairperson LeBlanc, seconded by Committee Member Lindsay to
recommend to City Council continuing with negotiations regarding the purchase of the St. Paul Water
Utility Property at 1601 LaMotte Drive. All in favor. Motion passed unanimously.

Truth-in-Taxation
J have prepared an informational handout for the truth-in-taxation hearing
reflecting the preliminary budget from August 2004. Again in 2005, property
taxes attributed to the general fund levy of the City of Centerville will decline.
With changes to be realized in 2005, a budget amendment may be needed to
address theses changes. I have also prepared a resolution adopting the final
property tax levy and budget for 2005.
$410,000 GO Water Revenue Bonds, Series 1996
Following up on the city's debt portfolio and work completed by Ellie, Steve Bubul
of Kennedy & Graven has prepared a resolution calling these bonds on February
1, 2005 resulting in an interest savings to the city.
Northern Forest Products TIF Payment
I have reviewed the Northern Forest Products file and have created a TIF
payments schedule. I have also prepared a claim for a payment to Northern
Forest Products.
Interim Organizational Operations
The council has made appropriate changes for the interim operation that reflects
compensations for the vacant administrator position. This vacancy on the heels
of the vacancy of the Finance Director position has also resulted in Kris Sweeney
completing additional tasks. I would recommend that the city council consider
making adjustments for her additional tasks completed and continuing until the
city has an administrator on board.

A RESOLUTION ADOPTING THE FINAL PROPERTY TAX LEVY FOR THE
CITY OF CENTERVILLE FOR THE YEAR 2005
WHEREAS, the city council of the city of Centerville did adopt a proposed property tax
levy for the year 2005 on the 8th day of September, 2004, in the amount of$1,700,000;
and,
WHEREAS, the council did hold a public hearing on the 8th day of December, 2004 to
obtain input regarding said levy and adoption of the final property tax levy.
THEREFORE, BE IT RESOLVED that the city council of the city ofCenterville
hereby adopts the final property tax levy for the year 2005 in the amount of $1,700,000..
BE IT FURTHER RESOLVED that the Finance Director is authorized and directed to
certify said property tax levy to the Minnesota Department of Revenue and forward a
copy of this resolution to the Anoka County Auditor.

The call date on the above bonds is February 1,2004. Since the interest rate on the
remaining principal varies from 5.10% to 5.40%, it would probably be prudent to
pay the bonds otTo Since many of the assessments have been prepaid and the City has
the money, the additional fees associated with refunding the bonds would make
refinancing a less desirable option.
The amount of principal due is $190,000. Since 30 days notice is required to call the
bonds, there will also be approximately $1,200 in interest due. The balance of the
Elementary Water Main Debt Service Fund is $140,895.33. The City will be collecting a
total of $35,694 in special assessments over the next three years. There will be a shortfall
of over $14,000 in the fund even with an early payoff. However, waiting until the
maturity date of the bonds may result in more than double that amount.
If Council wishes to payoff the bonds, it will be necessary to make a temporary
transfer of $50,000 from the General Fund or one the Enterprise Funds. As
assessments are received, the transfer will be repaid. After all the assessments have been
received (2006), a portion of the transfer (approx. $14,000) will become permanent.

When the City adopted the new 2000 International Building Code, the part pertaining to
grading was modified by the State and not included on all of the sample ordinances
forms. The State did adopt, as an option for jurisdictions, the Appendix "K" chapter from
the 2002 supplement to the 2000 mc code. The Appendix "K" covers very general
grading requirements which are less restrictive then the previous chapter 33 grading
provisions of the 1997 Uniform Building Code. The Chapter 1335, Floodproofing
Regulations, parts 1335.0600 to 1335.1200 also fit into this category.
I recommend that the City amend Ordinance #76 as presented so that we may continue to
issue grading permits and provide some minimal regulation of grading activities within
the City.

NOTICE IS HEREBY GIVEN, that the Planning & Zoning Commission and the City
Council of the City of Centerville will consider amending Ordinance #76 to contain new
language as follows:
This municipality adopts Minnesota Rules; Chapter 1335, Floodproofing Regulations,
parts 1335.0600 to 1335.1200 and Appendix Chapter K (Grading), of the 2002
Supplement to the 2000 International Building Code.
The meetings will be held on Tuesday, December 7, 2004 & Wednesday, December 8,
2004 commencing at 6:30 p.m. or shortly thereafter. The meetings will be held in
Council Chambers at City Hall, 1880 Main Street, Centerville, Minnesota 55038

The City Council of the City ofCenterville, Minnesota, does ordain:
SECTION 1. CODES ADOPTED BY REFERENCE.
The Minnesota State Building Code, as adopted by the Commissioner of Administration
pursuant to Minnesota Statutes Chapter 16B.59 to 16B.75, including all of the
amendments, rules and regulations established, adopted and published from time to time
by the Minnesota Commissioner of Administration, through the Building Codes and
Standards Division is hereby adopted by reference with the exception of the optional
chapters, unless specifically adopted in this ordinance. The Minnesota State Building
Code is hereby incorporated in this ordinance as if fully set out herein.
SECTION 2. APPLICATION, ADMINISTRATION AND ENFORCEMENT.
The application, administration, and enforcement of the code shall be in accordance with
the Minnesota State Building Code. The code shall be enforced within the extraterritorial
limits permitted by Minnesota Statutes, 16B.62, Subdivision 1, when so established by
this ordinance.
This code shall be enforced by the Minnesota Certified Building Official designated by
the City of Centerville to administer the code (Minnesota Statute 16B. 65), Subdivision 1.
SECTION 3. PERMITS AND FEES.
The issuance of permits and the collection of fees shall be as authorized in Minnesota
Statutes, 16B.62, Subdivision 1.
Permit fees shall be assessed for work governed by this code in accordance with the
Schedule Resolution adopted by the City of Centerville on an annual basis. In addition, a
surcharge fee shall be collected on all permits issued for work governed by this code in
accordance with Minnesota Statute 16B.70.
SECTION 4. VIOLATIONS AND PENALTIES.
A violation of the code is a misdemeanor (Minnesota Statutes 16B.69) and Minnesota
Rules, Chapter 1300.
SECTION 5. BUILDING CODE OPTIONAL CHAPTERS.
The Minnesota State Building Code, established pursuant to Minnesota Statutes 16B. 59
to 16B. 75 is hereby adopted as the building code for the City of Centerville. The code is
hereby incorporated in this ordinance as if fully set out herein.

A RESOLUTION ADOPTING THE FINAL PROPERTY TAX LEVY FOR THE CITY OF
CENTERVILLE FOR THE YEAR 2005
WHEREAS, the City Council of the City of Centerville did adopt a proposed property tax levy for the year
2005 on the 8th day of September, 2004, in the amount of $1,700,000; and,
WHEREAS, the Council did hold a public hearing on the 8th day of December, 2004 to obtain input regarding
said levy and adoption of the final property tax levy.
THEREFORE, BE IT RESOL YED that the City Council of the City of Centerville hereby adopts the final
property tax levy for the year 2005 in the amount of $1,700,000.
BE IT FURTHER RESOLVED that the Finance Director is authorized and directed to certify said property
tax levy to the Minnesota Department of Revenue and forward a copy of this resolution to the Anoka County
Auditor.

1. The City has issued and sold its General Obligation Water Revenue Bonds, Series 1996, dated
August 1, 1996 (Bonds) in the total principal amount of $410,000, of which $190,000 are currently outstanding.
Bonds maturing after February 1, 2004, are subject to redemption and prepayment on that and on any date
thereafter at a price of par plus accrued interest.
2. It is determined that it is in the best interests of the sound financial management of the City that
Bonds maturing on February 1 in the years 2005 to and including 2008, comprising all of the Bonds subject to
redemption, be prepaid and redeemed on February 1, 2005 and those Bonds are hereby called for redemption on
that date.
3. The Registrar is authorized and directed to publish, in accordance with law, a notice of call for
redemption of the Bonds in the form attached hereto as Exhibit A and to mail a copy of the notice to the original
purchaser of the Bonds.

Records indicate that the Trio Inn has been tobacco compliance failure free for the last
five years.
Previous practice has been to impose administrative fines by resolution (per Ordinance
#66) for violations of the ordinance.
Research shows that previously the administrative fines that have been imposed for other
licensees are as follows:
Second violation in three years - Kelly's ($500.00)
Three violations in three years - Tom Thumb ($750.00 & Non-Renewal)
I was unable to locate a resolution for Tom Thumb's first violation in 2000; however, it
appears that the administrative fine would be $250.00 for first violations.

consideration of this issue.

The Police Department conducted Tobacco Compliance checks on November 19th, 2004
for the Cities of Circle Pines, Lexington, and Centerville. One of the businesses in your
city that are licensed to sell tobacco failed the check. I directed an underage buyer into
these businesses' for the purposes of ensuring that they are taking the appropriate
measures to sell their tobacco products only to adults. The businesses that failed the
compliance check are listed below.

The employee that sold the tobacco to the underage buyer was cited for the violation
under state statue 609.685. This violation is a Misdemeanor. I am advising you of the
violation since this sale to the underage buyer is also a violation of your city ordinance.
Because of this, there may be civil sanctions that you can impose on the tobacco license
holder for this business. Please feel free to contact me if you have any questions regarding

concerns regarding Judicial Ditch #2/Hardwood Creek maintenance. The Ditch/Creek is
not located within our community; however, it affects the water quality of Peltier Lake
which a portion is located within our community.
Council is aware that there are four (4) options for maintammg Judicial Ditch
#2/Hardwood Creek and their consensus was that your expertise would ensure that the
best water quality flowing into Peltier Lake would be achieved with the most
economically feasible option. If was felt that the Board would consider Council's input
preserving and retaining the best water quality flowing into Peltier Lake with the method
that is chosen as their priority.
Council also feels that to sustain/retain water quality currently and in the future, it is
important that they are a part of the decision making process, are involved and would like
to be kept abreast of your decisions regarding this matter.
