Mr. Keleha: appeared before Co1;lIlcil and asked that the Developer's Agreement be amended to .reflect that the park dedication fees he is paying on Phase I covers both Phase I and Phase IT. Mr. Keleher explained that the previous property owner had piles of black dirt on the property that needed to be removed as part of the approved grading plan. He then explained 'that one of the neighboring property owners is enCroaching onto his property and they will be having it surveyed and asking that the fence be moved back. . He further commented that once things are resolved with the property line issues the area would be landscaped and that should appease the resident concerns. 2. Mr. Rick Fox.. Rehbein Properties and Mr. Dennis Shudy. Centervi11e Redi-Mix Mr. Rick Fox from Rehbein Properties addressed Council and asked for authorization to make a payment of $4,879.64 to pay off the assessments for the 1.3 acre parcel purchased by Mr. Shudy. city Attorney Hoeft indicated that the City would consider it a partial' payment of an assessment and it requires no Council actio;o. Mr. Shudy indicated that he and Rehbein would add wording to the purchase documentsk.that the remaining assessment amount would be attached to the larger remaining parcel and that no .further assessments are pending on the 1.3 acres he is purchasing. Council told Mr. Fox and Mr. Shudy that they should contact Staff should they need any further documentation in order to record documents with the County. VI. PUBLIC BEARINGS 1. Request for Lot Split- Mr. John Dahl. 7334 Brian Drive Mayor Sweeney opened the public h~g at 7:15 p.m. . '.' . . . . Mr. Dahl appeared bef~re Council and provided ~ overview ofhiS request.for a lot split Council Member Broussard Vickers indicated that the Planning Commission reviewed . the memo from Mr. Patzer concerning the water and sewer stubs and also took testimony Page 3 of 10 City ofCentervi11c November 10, 2004 Council Meeting Minutes from neighbors that are concerned about potential drainage issues. She then indicated that the Co~on recommended approval peI;1.ding approval by the City Engineer of the drainage plan. . Council Member BroUssard Vickers indicated that it was mentioned that' mitigation was already done on the wetland. . . MI. Dahl explained that they had purchased wetland credits for the area of the driveway. Mr. Dahl's engineer explained the proposed driveway and discussed it with Council and Staff. City Attorney Hoeft indicated that the Council need only be concerned with wliether the request meets the requirements for a lot split and Staff will handle the sewer and water stub along with the building permit and engineer approvals. . . Greg Carpenter of 7328 Brian Drive indicated that he is not oppo~ to the lot split but is concerned about drainage as his lot is the lowest. He then Said that in the photocopied drawing the drainage easement was removed and he is concerned that it waS removed from the plat. City Attorney Hoeft explained that the original plat had not been c~ed and the drainage easement remains. He:further . noted that the drawing ~tted with the application is a survey drawing and not the plat. Mr. Dahl's engineer'indicated that the wetland has no natural inJ,ets and only accepts water from the backyards in that immediate area. . Council Member Broussard Vickers indicated that she liked using the qualifications survey last time and woUld like to do so again. ColDlcil discUSsed the proposal from Mr. Lynn and Council Member.Broussard Vickers requested that the language of the agreement be amended to reflect a time that the City could expect to begin interviewing candidates and to include language for a guarantee should the employee not stay one year a new search would be done at no cost to the City. Interim Administrator Mayor Sweeney indicated that he had no issue with using Mr. Lynn for some facilitation type duties of the City Administrator but he would like. to assign the day oto day operations to be handled by existing Staff. Council Member Lee indicated that he feels the chain of cotiunand should be utilized which means that.theresponsibilityofalls to Mr. Meyer, as the Finance Director, and he can delegate the tasks. 0 Council" Member. Capra inclicated that she would like to assign tbe interim administrator . duties to a team consisting of the Finance Director, City Clerk, and Public Works Director. She then asked counsel how to appropriately handle this matter so that Staff can be paid for the extra duties assigned. City Attomey Hoeft indicated that Council could state its .intention to compensate for the ~ duties assigned and d,etermine the amount at a later date. The other Staff is eligtDle for overtime at their exiSting rate for helping out with additional duties as needed. . :Mr. patzer and Ms. Bender agreed to accept the interim adminilrtratOr dulies and agreed to meet regularly to ensure that nothing is misSed. . Motion by Connell Member Canra. seconded bv ConncD Member Pur to add $4.00 to.the City Clerk and Public Works Director's hourIv rate to comneniate for the extra resnonsibilitv and duties. r Mr. patzer expressed concern with personnel problems. CoUncil asked that any personnel matters be brought to the attention of the Mayor rather than ~ handled by the Interim Administrators. The Interim Administrators are to handle ~ day to day operations of the office and public-works and delegate ~ as necessary. Council Member Broussard Vickers asked Staff to prepare a memo that spells out the process so that it is clear. Ms. Bender expressed concern with the additional work load as they are already short staffed and behind on projects. Council discussed the hiring of a temporary employee for answering phones and assisting with filing in the office. Council also authorized the Interim Adminis1rators to authorize overtime as necessary but asked that any amounts of 10 hours or more be brought to Council for approval. Council Member Broussard Vickers indicated that she would prefer to see the hourly rate increased by $4.00 or $5.00 to compensate for the extra duties and responsibilities. Council Member Paar indicated that he would like to see at least $4.00. Council Member Capra accepted the friendly amendment to the motion as. did the seconder. VOTE: All in favor. Center Street Monitoring- There was a memo provided indicating that no more monitoring would be done unless further requested by Council. 4. 6931-20th Avenue Mr. Palzer indicated that Rice Creek Watershed District has given Mr. Drilling notice to comply and, ifhe does not do so, they can take action against hiIn. 5. All Co:rDmittees and Staff Memo Council Member Capra asked for Council authQrization for an all committees memo to be sent seeking mput as to priorities for 2005. - Council agreed but specified that participation is vol~ no~ mandatory. _ Mayor Sweeney indicated that a smaller subcommittee of the police gov~ board consisting of an elected official and the City Administrator from each city is being formed to work on neg01ia1iODs regarding the building.- He then said that since'the City does not have a City Administrator at this time he would like to have Council Member - Broussard Vi~kers attend the meetings because he feels that her negotiating- skills would be of assistance during sensitive nego1ia1ions. Council Member Lee indicated that he would like to remain involved and has only missed two meetings over the Qaurse of two years.. H~ then suggested-that Council Member Capra attend as she is the Mayor-Elect. Council Member Capra indicated that she ~()uld like Council M~ber Lee to attend because he has been involved for the last two years. Council discussed the building committee and the steering committee and the . differences of opinion and sensitivity concerning the formula for funding the police department as. well as for funding the cOnstruction of the building and the future ownership percentages. Council Member Paar indicated that he defers to the Mayor and his recommendation. It was determined by coin toss that Council Member Lee would attend the subcommittee meeting on the building. Mayor Sweeney read a thank YQU note from Retired Police Chief Heckman thanking the City for the recognition ofhis years of service. Council Member Paar provided an update on the EDC meeting indicating that plans are under way for the Frozen Fete des Lacs. . . . . Co~cil Member Broussard Yickers indicated that there is one open seat on the ~lannlng Commission and there will be another in January. She also noted that Staff was ~ed to send a note to th~ resident that had asked the City to amend its _on street parking- ordinance to inform her that the City is not interested in any changes at this time. It shows huge spikes of Total Suspended Solids at various locations 0J:l the creek in 2004 from minor maintenance done in early 2004. This is clearly not good. With options 1 and 4 would this would occur for the foreseeable futw'e. This is not good. Option 2 is likely unstable and the numerous other disadvantages are in the report. The best option is to stabilize the stream as explained by Dr. Sandy Verry and the engineers and then, virtua1ly no maintenance of that sort is required. The channel becomes a self cleaning natural system to the best known scientific research. (Note: Side conversations indicate there may be a current problem with snowmobile crossings in winter blocking the creek in spring. Perhaps bridges need to be constructed or snowmobile trails moved where they will not cause a problem.) The below describes Option 3 and is trom page 30 of the engineer's report. "STABLE STREAM REHABILITATION Drainage ditch construction often occurs without taking stream morphology into consideration. Most notably, ditches often lack: a meander pattern and a two-stage relationship between a main channel and a floodplain. The Stable Stream Rehabilitation alternative would create a properly sized meandered base channel lower than the existing channel, a connected and properly sized floodplain also lower than the existing floodplain, and a stable meander pattern. Figure 7 shows a cross-section of this alternative. Figure 7. Dr. Verry recommended that a new channel be created off of the existing ditch and allowed to stabilize for one growing season before ditch flows are diverted. The reasons for this are: · Reduced risk: of c~el block failW'eS · More stable peat for construction as verified through the von Post analysis · Easier constructability without active ditch flows · Significantly less water quality impact both during construction and long-term Related to this alternative is the restoration of the Hardwood Creek corridor (Appendix 11). This initiative is in accordance with the District goals of land and water conservation and wetlands management. The District sought partnership in applying these goals to JD2 and was awarded a grant by the Legislative Commission on Minne-nta Resources (LCMR) of$800,OOO for the purpose of creating a restored riparian corridor. :Flood Mitigation The model results for the 2-year and l00-year storms for both existing and proposed oonditions, as well as with the 100-year storm for projected future 1and1.1Se are shown on Figures 8 through 10. These figures illuStrate that a moderate drop in maximum water levels (~ng from approximately 0-2 feet) along the corridor is expected under.proposed oonditions, relative to existing conditions, for the 2-year and l00-year storm events. MaiDteDance The overall approach with the stable stream. design is to create a self mS\inttim1\8 system. However, it is expected for the first three to five years that minor repairs and maintenance will be required while the stream. settles into equilibrium oondition. This option will still require active beaver management 8nd dam removal in order to tnaitttain the desired drainage. Future Stonnwater ConveyaDce The proposed channel desigrl will provide the needed capacity for future needs based on the City of Hugo's land use plan. If the hydrology of the watershed changes significantly due to a change in the city's la>>duse plan, then the stream will need to be adjusted to establish a new equilibrium. However, this is an unlikely scenario due to the small portion of the watershed that is currently forecasted to experience more intensive urban development, specifically in the very southwestern portion of the watershed. The major change would be from agricultural (pasture with some row crop) to estate residential. Also, development will be subject to RCWD and Hugo regulation of peak and volume oontrols. From a hydrologic pe1spective, this does not imply a large change in I'UIlOft: and the channel as designed wiU accommodate these future flows for the 20-year planning horizon. Bioloak Condition The meandered channel will be approximately 300A.longer than the straight channel and will be connected with its floodplain. This will lead to improved flow regimes downstream and improved habitat for the biota by creating structural features such as pools and riftles (Karr, 2002). Downstream Water Quality This design will increase the interaction of the in-stream flow with the floodplain and will allow settling, storage, and recycling of in-stream nutrients in channel and on the floodplain. Additionally, the meandered channel will have more benthic, or stream bottom, surface area, which will improve in-stream water quality. Dissolved nutrients are primarily removed by sorption, or attachment, onto bottom sediments or through uptake by microbial oommllnities on the stream. bottom (Mulholland et aI., 1985), and in-stream. processes are important determinants of stream. water nutrient ooncentlations (Mulholland and Hill, 1997). It is anticipated that the new water tower located at 7087 - 20th Avenue South will be operational by june of2oo5. Within this same letter, it was requested that you work with the City regarding renegotiating our existing contract with your company. WIthstanding your letter dated November 9, 2004, we have not received any contact from your company regarding this issue. We do understand that the current contract contains language regarding relocation of services and we did notify you of our intentions; however, we would appreciate the opportunity to renegotiate the current contract associated with the new site. lf you desire any additional information regarding this issue, please feel free to contact Mr. Paul Patzer at (651) 429-4750 regarding permits or myself at (651) 429-3232 regarding contract negotiations.
