The City's official controls, the zoning ordinance and subdivision regulations, will ensure day to day monitoring and enforcement of the policy plan. The regulatory provisions of both ordinances, as revised, will provide a means of managing development in the City in a manner consistent with the Comprehensive Plan. The City's Capital Improvements Program will enable needed improvements identified in the plan to be programmed and implemented in a timely and cost effective manner. ( ''FFICIAL '_.ONTROLS As part of the planning process, the City will evaluate its land use controls and consider amendments to existing ordinances which eliminate inconsistencies with the Comprehensive Plan, enhance performance standards, protect public and private investments, conform to mandatory State and Federal regulations and make it an understandable document. The plan identifies a number of specific changes to the zoning ordinance and subdivision regulations which need to be considered by the City which are outlined in Table 8-1. CONOMIC I .DEVELOPMENT In 2017, Centerville formed and Economic Development Authority (EDA) with all the associated powers and responsibilities including taxing authority. The EDA will work on economic development activities including development, redevelopment, and job growth within the City. PLAN AMENDMENT PROCESS The Comprehensive Plan is intended to be general and flexible; however, formal amendments to the Plan will be required when land use elements, development staging or growth policies are revised. Periodically, the City Chapter 8 1 Page 1 6 Centerville 2040 Chapter 8: Implementation should undertake a formal review of the plan to determine if amendments are needed to address changing factors or events in the community. While a plan amendment can be initiated at any time, the City should carefully consider the implications of the proposed changes before their adoption. When considering amendments to this plan, the City will use the following procedure: 1. Amendments may be initiated by land owners, land developers, the Planning and Zoning Commission or the City Council. 2. The Planning and Zoning Commission will direct the City staff to prepare a thorough analysis of the proposed amendment. 3. The City staff will present to the Planning and Zoning Commission a report analyzing the proposed changes, including their findings and recommendations regarding the proposed plan amendment. 4. The Planning and Zoning Commission will decide whether or not to proceed with the proposed amendment. If a decision to proceed is made, a formal public hearing will be held on the proposed amendment. 5. Following the public hearing the Planning and Zoning Commission will make a recommendation to the City Council. 6. The City Council will receive the recommendation from the Planning and Zoning Commission and make a final decision on whether to adopt the amendment. 7. All amendments to the plan must be submitted to the Metropolitan Council for review prior to implementation. .APITAL IMPROVEMENT PROGRAM The City will annually update a five year capital improvements program which identifies major capital expenditures consistent with the Plan. The program includes public and private investments in infrastructure, park and trail development expenditures, infrastructure repair and replacement, building Chapter 8 1 Page 2 7 Centerville 2040 Chapter 8: Implementation maintenance and repair and other planned capital expenditures. Like the Comprehensive Plan, the capital improvements planning process is ongoing and subject to modification, as appropriate. He provided Council with an overview of statistics for the past year which included qualified versus unqualified sales, values and pertinent information involving values of homes for the community along with avenues for residents to appeal their market values. He stated that there were 64 qualified sales from October 1, 2016 through September 30, 2017. He stated that the tax base rose by 7.2% and that to date there are 12 qualifying sales which will be accounted toward 2019. He reported that the median sale price for a home in Centerville went from $235,000 in 2015 to $243,000 in 2017 and he believes that the City will continue with an overall growth in in the market values for 2019. Mr. Tolzmann stated that he has received one appeal and requested to have it noted in the records. Ms. Sandra Arnold, PIN #R15-31-22-44-0005, 7244 Main Street appealed the value of her home as the home received water damage to the basement, all amenities were removed and it is unknown when the basement would be constructed again. Mr. Tolzmann stated upon confirmation of the basement being now unfinished and he recommended a reduction of$9,900 in valuation ($228,000 to $218,900). Mr. Tolzmann thanked the Council for his ability to perform services to the City of Centerville. Motion by Council Member King, Seconded by Council Member Montain to Authorize the Reduction in Valuation for PIN #R15-31-22-44-0005 of$9,000 ($228,000 to $218,900) as Recommended. All in favor. Motion carried. 12a City of Centerville Council Meeting Minutes April 25,2018 Discussion ensued regarding the value of municipal water connection and whether it truly increases the valuation of a home/property, if 7244 Main Street finished the basement at a later date, when would the valuation be increased, review of all building permits prior to the end of year and including those improvements when placing a valuation on a home/property, the age of structures and upkeep and how that effects the valuation of a home/property. Mayor Paar thanked Mr. Tolzmann for his services, explanations and report. Mayor Paar opened the Board of Appeal & Equalization Public Hearing at 6:47 p.m. for Public Input. No audience members showed an interest in addressing the Board. Motion by Mayor Paar, Seconded by Council Member Love to Close the Public Hearing of the Board of Appeal & Equalization at 6:48 p.m. Motion by Council Member Montain, Seconded by Council Member Koski to Close the Board of Appeal & Equalization Meeting at 6:49 p.m. All in favor. Portable Restroom at Cornerstone Park Page 3 of 7 12c City of Centerville Council Meeting Minutes April 25,2018 Administrator Statz stated that lengthy discussion was had at Council's previous meeting and the item was tabled. He stated that the Parks & Recreation Committee voted unanimously to approve installation of one (1) ADA accessible portable restroom installed at Cornerstone Park for the summer. He reported that the Bald Eagle Water Ski Club would participate in 50% of the cost with it being $105/28 days (4 months = $420). Lengthy discussion ensued regarding the cost, screening; many previous discussions throughout the years regarding portable restrooms, installation, odor, etc. Additional discussion took place regarding location within the park, visibility of traffic, staff discretion regarding the possibility of it needing to be moved, complaints, etc. Motion by Council Member Love, seconded by Council Member Koski to Authorize Rental of One Additional Portable Restroom to be Placed Within or Near Cornerstone Park for four (4) months. Mayor Paar questioned whether to include the screening with the motion and Administrator Statz requested a separate motion for the approval of screening following the first water ski show. All in favor. Motion carried. 2. Assign EDA Representatives from City Council Administrator Statz stated that the Council had previously discussed this item at the work session prior to the meeting and consensus was that the last Monday of every month would be the regularly scheduled meeting date commencing at 6:30 p.m. The Mayor questioned whether Council needed to interview candidates with three (3) vacancies existing and three (3) applicants having applied. City Attorney stated that Council could appoint the candidates, meet with them in May and determine if the 4th Monday of the month was a viable meeting date. He stated that it could be changed at a later date but should be routine going forward. Motion by Council Member Montain, seconded by Council Member Love to Schedule EDA Meetings on the 4th Monday of Each Month Commencing in May. All in favor. Motion carried. Discussion ensued regarding the use of City Code, Chapter 31 in regards to By-Laws and additional discussion took place regarding stipends being similar to other Committee/Commission positions. Administrator Statz stated that applications have been received from Mr. Gary Spanier (Rumble Industries), Mr. Jeff Hanzal (Hanzal Construction and Mr. James Weatherhead. Discussion ensued regarding Council appointments being Mayor Paar, Council Member King and Council Member Koski being the alternate. Res. #18-004—Authorizing Conveyance of Real Property to Jon & Sophie Pederson City Attorney Glaser stated that the proposed resolution is in preparation for closing scheduled for Monday, April 30, 2018. He stated that Administrator Statz is scheduled to be out of town in training that day so he would be attending the closing. He also stated that the resolution authorizes the City to sell 2065 Commerce Drive to Jon & Sophie Pederson. Motion by Council Member Love, seconded by Council Member Montain to Adopt Res. #18-004 — Authorizing Conveyance of Real Property to Jon & Sophie Pederson as Presented. All in favor. Motion carried. IX. NEW BUSINESS 1. Review Changes to the Fee Schedule and Schedule Public Hearing Administrator Statz stated that staff has polled neighboring communities of similar size, staff has reviewed escrow amounts and found that the City's are very low. He also stated that the amounts take into consideration fees of consultants, attorneys and protect the City from a developer disappearing subsequent to the City reviewing concept plans, rezoning, etc. Attorney Glaser stated that the Administrator has the ability to negotiate with a developer as to charges and use of consultants but it is not allowed after the fact. Council Member Koski stated that development fees should not be bore by taxpayers. Administrator Statz stated that the City is following the new procedure and will be hold a public hearing regarding the fees with tonight's review acting as the first reading. He stated that the fees are not land use fees but he desired to be safe. No action is needed at this time as it is the first reading of a proposed Fee Schedule amendment. 2. Street Sign Replacements Administrator Statz stated that the Federal Highway Administration has adopted the Manual on Uniform Traffic Control Devices (MUTCD) which requires road managers nationwide to install and maintain traffic control devices on all public streets, highways, bikeways and private roads open to public travel to a certain standard. He stated that signs have become old, faded and outdated. The manual requires that inventory be taken of all signage regarding reflectivity and the Public Works Director has completed this task. He felt that a purchase of half of all signage within the City needed replacement at this time. Administrator Statz stated that Mr. Palzer obtained several quotes with the lowest being placed for consideration. Motion by Mayor Paar, seconded by Council Member King to Table the Item Until Such Time Additional Quotes are Contained for Consideration with at Least One Quote from the State Purchasing Cooperative. Council Member Montain requested that additional quotes be obtained prior to the submitted quote expiring. All in favor. Motion carried. Mayor Paar requested a quick refresher on when the City was required to obtain bids and quotes. Attorney Glaser stated that it is always best to obtain at least two (2) quotes and competitive bids starting at a value of$100,000, however a best practice would be at a level of$50,000. Discussion ensued regarding cooperative purchases and whether the City took advantage of them. It was stated that on several items in the past such as salt for streets, software purchases, street sweeping services, etc. Administrator Statz stated that later in the year, the City will propose purchasing trucks for Public Works and utilize the state bids for that item due to the value of the purchases and the State's completed research on competitive pricing which is how companies are placed on the Purchasing Cooperative. 3. Acceptance of Centerville Lions P & R Donation Administrator Statz stated that generally the Centerville Lions make an annual donation to the Parks & Recreation Committee. Council Member Montain thanked the Lions for their generosity. Motion by Council Member Montain Council Member Koski stated that he attended the Lions Cadillac Dinner and felt that they host a tremendous event and they rarely look for recognition. He also stated that they are a dedicated organization and are very important to the community. seconded by Council Member Koski to Accept the Centerville Lions Parks & Recreation Donation of$500 as presented. All in favor. Motion carried. Mayor Paar stated that the Lions host many events throughout the year and desired to thank them for making Centerville a great place to live. X. COUNCIL/ADMINISTRATOR ANNOUNCEMENTS Administrator Statz provided Council with his report and stated that he was willing to answer any questions. He stated that his sixth (6th) month review is fast approaching. Council chose to schedule his review for the second meeting in May. Council determined that they would complete a review, schedule a Closed Executive Session for May 23, 2018 following their regularly scheduled meeting for the purpose of completing Administrator Statz's review. Staff was directed to forward to Council the appropriate review forms via email. City Attorney Glaser stated that Friday April 27, 2018 was Citizen Law Day at the Court House with many clinics being provided to citizens for free from 8:30 a.m. —3:00 p.m. Council Member Montain stated that he would be attending the Fire Protection Council meeting the following evening and stated that they would be discussion the budget. Mayor Paar reminded the audience of the City's Facebook page and the Fete des Lacs Facebook page for the most current news. Mayor Paar stated that the following day would be Service Day for Centennial High schoolers, they would be serving in the community and he would be attending Centerville Elementary School in the morning and then speaking at the High School right before lunch. Mayor Paar stated that the City is in need of volunteers for Fete des Lacs and that individuals/teams may register for events at: fetedeslacs.org XIII. Discussion ensued regarding whether or not the second "Whereas" clause of the presented resolution was correct, due to the fact that it states that the City is going to sell the property to "...Jon R. Pederson and Sophie Pederson, husband and wife, acting as individuals;..." Without the attorney being present, the Council attempted to allow some flexibility for the attorney to make a change in that whereas clause if it turned out that it was indeed, incorrect. WITNESSETH: WHEREAS, DEVELOPER has received a Conditional Use Permit from the MUNICIPALITY's Planning and Zoning Commission and City Council the development of its dealership site on Lot 2, Block 1 Clearwater Business Park. WHEREAS DEVELOPER is required by said approvals, at its own expense,to complete the construction of the development site in accordance with the plans reviewed and approved by the City Building Official; WHEREAS the parties to the Agreement wish to establish a mechanism to secure the obligations of the DEVELOPER for the work as set forth below; and WHEREAS,the MUNICPALITY will also serve as the BANK in the capacity of escrow agent and maintain escrow funds in a unique account. NOW THEREFORE,the parties hereby covenant and agree as follows: 1. DEVELOPER will, at its own expense, complete the following installation as depicted and in accordance with the specifications set forth in the Site Plan and related documents entitled T1.1, A1.1- A10.2, 51.1-54.4, Cl-C4.2, created by Rosa Architects and Stroh Engineering, and as reviewed by the City Building Official. 2.TIMELINES a. DEVELOPER shall construct and complete improvements as set the forth in Paragraph 1 (hereinafter the "Completion Period")within 18 months from the day the MUNICIPALITY issues a Building Permit, and the City shall grant reasonable continuances of this deadline. b. DEVELOPER shall replace or repair any defective or improper work or materials which may be identified as such by the MUNICIPALITY as a public improvement and/or within a public right of way or easement, within three (3) years after completion of the improvements set forth in Paragraph 1 by the MUNICIPALITY(hereinafter the "Warranty Period"). For the purpose of this Agreement, "completion" shall be deemed to have occurred when the Municipality has inspected and approved the installation of the Improvements and issued written notice to the Developer that the installation thereof is complete. 3. Upon "completion,"the CITY shall provide DEVELOPER and BANK written notice of completion. 34 4. For the guaranty of DEVELOPER's performance of all requirements hereinabove set forth, DEVELOPER and BANK agree that cash in the amount of$10,000.00 shall be held in escrow by the BANK and shall be available for payment to the MUNICIPALITY in accordance with the terms herein set forth. The funds in the escrow account shall not be diverted, applied, set off or disbursed except in accord with the terms hereof.The MUNICIPALITY shall be the sole beneficiary of the escrow account and shall have sole power to draw funds from the account, in accordance with the terms of this agreement. Nothing herein shall relieve the DEVELOPER from the obligation to pay any additional costs, if actual costs exceed the above-stated cost. If the MUNICIPALITY files with the BANK a statement that the DEVELOPER is, in the judgment of MUNICIPALITY, in default under the terms of this Agreement,the BANK shall pay monies from said escrow fund to the MUNICIPALITY, in the amount(s) requisitioned by the MUNICIPALITY to complete the Improvements and satisfy the requirements in this Agreement. 6.The MUNICIPALITY will promptly submit to the DEVELOPER a copy of such statement as it files with the BANK.The consent of the DEVELOPER to payments by the BANK to the MUNICIPALITY shall not be required or solicited. 7.The MUNICIPALITY shall not file with the BANK a statement of default until ten (10) days after notice has been sent by it to the DEVELOPER by certified mail, return receipt requested, setting forth its intention to do so. 8. All monies released by the BANK to the MUNICIPALITY pursuant to Paragraph 4 shall be used by the MUNICIPALITY solely for the purpose of performing obligations imposed upon the DEVELOPER by that portion of this Agreement upon which the DEVELOPER is then in default. Any work to be performed by the MUNICIPALITY pursuant hereto shall be let on a contractual basis, or on a time and material basis or shall be performed by the MUNICIPALITY with its own work force and equipment or shall be accomplished in such a manner as in the judgment of the MUNICIPALITY shall accomplish the work most expeditiously and economically. 9. A packet will be developed to present the various education materials to the property owners and others within the DWSMAs. Additional packets will be provided to new property owners and facility operators. A.Wellhead Protection Awareness Project Objective- The cooperation of property owners, facility operators and others is critical for the City to achieve our wellhead protection goals. The Wellhead Protection Awareness Program is intended to gain the cooperation of residents and business operators in the City's wellhead protection efforts. Actions: (1) The Wellhead Protection Plan Manager will notify property owners that they are located mftin the City's DVVSMA. The nofification will include a wellhead protection education packet providing information on the City's wellhead protection program. (2) The Wellhead Protection Plan Manager will installed signs in the right of way indicating the boundaries of the DWSMas. (3) The Wellhead Protection Plan Manager will include wellhead protection information in their annual water quality report of their water supply system. (4) The Wellhead Protection Plan Manager will prepare a press release and issue a briefing report for nevispaper and other media outlets on timely issues that coincide with an initiative such as an abandoned well information meeting or the installation of DWSMA zone signs. (5) The Wellhead Protection Plan Manager will make DWSMA maps available to consultants, septic system evaluators, and other interested persons that perform environmental evaluations. The packet will include contact numbers to obtain consultative services from City, County and State program staff(i.e. utilities, hazardous waste management, and petroleum tanks programs). (2) The Wellhead Protection Plan Manager will utilize newsletters, cable access, news releases and other forums to promote the proper management of hazardous materials including use of the Anoka County Household Hazardous Waste drop-off facility. Seal Abandoned Wells Objective- Enhance the protection of the City's Its by Cooperating with the MOH Well Management Program to seal all abandoned wells within the DVYSMAs. Actions: (1) The Wellhead Protection Plan Manager will investigate potential sources of financial assistance and the establishment of a program to assist property owners in sealing their abandoned wells. The investigation will include Federal and State grant programs and a City low-interest loan program. (2) The Wellhead Protection Plan Manager will notify property owners vath the probability of a well located on their property. The notification will include contact numbers for property owners to obtain consultative services regarding methods to locate and seal abandoned Its and an announcement of a public informational meeting. (3) The Wallhead Protection Plan Manager will sponsor a public meeting in which MDH Well Management staff will provide an informational program and answer questions. (4) The Wellhead Protection Plan Manager will request that the MDH provide a copy of well sealing reports. The location of the sealed wells will be verified and placed in the building officials parcel files. When application is made to demolish a building the records will be reviewed to determine if a well search is required. Actions: (1) The City Wellhead Protection Plan Manager will request the M L)H to provide a copy of reports for new well construction in the City. The City will place the copy into the building official's file for the parcel. If information regarding the location of the well is insufficient to determine the parcel location -the City will notify the MDH and request that they follow up with the licensed well contractor to obtain sufficient information. (2) The City Building Official will place the copy of the well record in the parcel file which is reviewed when application is made for building permits or lot development. (3) The City Utilities Department will require owners of buildings that switch from a private weIl to City water submit a copy of the well sealing report within 6 months, If the well remains in use the property owner must submit a statement of the intended use of the weII. The well sealing report or statement of intended use will be forwarded to the building official to be place in the parcel file. Cooperator(s): Minnesota Department of Health.
