HomeMy WebLinkAbout2018-05-01 CC Special Meeting Minutes - Approved CITY OF CENTERVILLE CITY COUNCIL SPECIAL MEETING MINUTES May 1, 2018 6:30 p.m. Pursuant to due call and notice thereof, the City of Centerville held a Special City Council meeting of May 1, 2018 at City Hall, 1880 Main Street. PRESENT: Mayor Jeff Paar Council Member Russ Koski Council Member D. Love A pp r o N' a d Council Member Matt Montainll 1, ABSENT: Council Member Steve King STAFF: City Administrator/Engineer Mark Statz COUNCIL MEETING L CALL TO ORDER Mayor Paar called to order 6:30 p.m. II. NEW BUSINESS 1. Sale of 2065 Commerce Drive a. Administrator Statz explained that Mr. & Mrs. Pederson desired to purchase the property through a limited liability corporation rather than themselves. He stated that at Council's meeting of April 25, 2018 they approved Res. #18-004 which sold the property to the Pederson's and to rectify the City's oversight the propose Res. #18-05 would need to be adopted as submitted. Discussion ensued regarding whether or not the second "Whereas" clause of the presented resolution was correct, due to the fact that it states that the City is going to sell the property to "...Jon R. Pederson and Sophie Pederson, husband and wife, acting as individuals;..." Without the attorney being present, the Council attempted to allow some flexibility for the attorney to make a change in that whereas clause if it turned out that it was indeed, incorrect. Therefore the following motion was made: Motion by Council Member Montain, seconded by Council Member Love to Adopt Res. #18-05—Authorizing Conveyance of Real Property to Jon and Sophie Pederson and Assignment to Ruffrike-Johnson 1031, LLC as presented or as amended after review of the second "Whereas" clause bythe City Attorney. The allowed amendment by the City Attorney, under this motion would be restricted to the issue of the stated buyer in the second "Whereas" clause. All in favor. Motion carried. Authorize Mayoral Signature on Warranty Deed Along with Associated Documents Brief discussion was had regarding the additional documents. Motion by Council Member Montain, seconded by Council Member Love to Authorize Mayoral Signatures on the Warranty Deed Along with Associated Documents as Presented. All in favor. Motion carried. Discussion ensued regarding whether in Mayor Paar's absence could the Acting Mayor, Council Member Love sign the needed documents. Consensus was that it seemed that the previous authorization for Mayoral signature would extend to the Acting Mayor in the absence of the current Mayor. III. ADJOURNMENT Motion by Mayor Paar, seconded by Council Member Montain to Adiourn the Special Council Meeting of May 1, 2018 at 6:42 p.m. All in favor. Motion carried.
