The proposal subdivides two parcels into 34 single-family lots at 7384 and 7396 Old Mill Road. The subject property is approximately 20 acres on the northern border of Centerville and is surrounded by existing residential to the west and south and the potential for residential to the east and north. Acorn Creek Park abuts the property on the southeast corner. The northern boundary is the City limits with Lino Lakes. The Planning and Zoning Commission reviewed these applications at their meeting on July 31, 2018. ®r"',ed "Al J Af 1 i RIrv W „+fly'.,p;cr„wuw r;,w;n"n rrw'W„taaw„Armr,r ,+waruwurgae/,mwa.w ,,of y< r 1 V NDN r / If rs✓ 0 90 'o'd"'q rr: j t r g r , / R o 1 0 ' f h ill.A ✓f 11 4,11111111111 Ir Ie l M pp l 1 ✓ % m 'r fRY i 1 i fy i f t ilii7i J f /l le"'If; n \offlhC,P YfiYfii In rnln(i August 8, 2018 Centerville City Council Page 2 of 6 Old Mill Estates-Preliminary Plat and Rezoning PLANNING ISSUES DISCUSSION 1) Comprehensive Plan and Zoning ,, g In the 2030 Comprehensive 196 Plan, the property is guided r 384 ,G, R Low Density Residential. Preliminary Plat The applicant is requesting approval of a Preliminary Plat for 34 single-family residential lots. In the original submittal, New Street A connects to Old Mill Road and ends in a cul-de-sac and new Street B connects to Old Mill Road and Revoir Street to the south. There are two "remote" lots proposed on the east side of the project that are accessed by a private drive. b. Rezoning The applicant is requesting approval to rezone the properties from R1 Rural Residential to R2A Single Family Residential. All lots meet the minimum of 11,500 square feet and 80-foot width. The property is about 19 acres total, of which 5 are wetland, leaving 14 acres net. 34 lots = 2.4 units/acre. wfflh r„ ?rnrnunii,/ in rrfirrl August 8, 2018 Centerville City Council Page 3 of 6 Old Mill Estates-Preliminary Plat and Rezoning 3) Planned Unit Development The applicants originally submitted an application for a Conditional Use Permit for a Planned Unit Development to address any non-conforming lots and the private drive. At question were the two remote lots since their configuration and use of a private road were not in conformance with the City code. City staff worked with the development team to bring the lots and street into conformance to avoid a PUD. The compromise recommended by the Planning Commission would have all lots in compliance with the City's standards including public road access. 4) Street layout As proposed, Street A is a 720-foot long cul- de-sac that connects from Old Mill Road and runs east-west through the development. Street ,,,,,, „ B also begins from Old Mill Road and connects to the existing Revoir Street cul-de-sac to the , y , t AN south. 5) Trail/sidewalk connections a. An existing sidewalk runs along NPIN ayagp/rlriii lro vuryiiDrJDIIU'1VyuVJyJJyI JG11nYJJ)JpJ) Old Mill Road from Revoir Street and ends at the southern edge of the proposed development's property line. The plat does not provide a level of detail to identify sidewalks on the two new streets. b. A trail or sidewalk through the development that connects to Acorn Creek Park would be desirable. Encouraging active modes of transportation can reduce car traffic impacts while traveling to existing nearby community amenities. The two residential developments bordering the park are connected to it via a trail or sidewalk. wfflh r„ ?rnrnunii,/ in rrfirrl August 8, 2018 Centerville City Council Page 4 of 6 Old Mill Estates-Preliminary Plat and Rezoning c. Extending the sidewalk connection on the east side of Old Mill Road would be preferable. While this too would dead end on the northern boundary of the development, the land to the north is developable and could eventually extend the Old Mill Road sidewalk further north to Peltier Lake in Lino Lakes. A connected sidewalk would allow Old Mill Estates residents to walk south to Main Street, Centerville Road, and Centerville Elementary School. 6) Drainage plan a. Wetlands-The inventory identifies a significant area of wetlands in the northeastern and eastern portions of the development area. A narrow strip of wetland exists in the far northwestern corner and another is in the middle of the site where Street B turns south to connect to Revoir Street. The preliminary plat proposes four areas of wetland fill totaling 13,125 square feet, or 0.3 acres. b. Drainage -The proposed development includes a long narrow stormwater pond in the center of the site to capture runoff throughout the development. A small pond is included in the northwest corner. Drainage swales between each lot direct water away from wetlands and the residential development south of the site. PRELIMINARY PLAT CONCEPTS Developer Todd Christianson came to the Planning & Zoning commission on July 31 with a revised concept plan "Concept B." The Planning and Zoning Commission recommendation resulted in a further revised "Concept C." a. Concept B. i. Trail.A public trail was proposed to connect Street A with Street B for improved pedestrian and bicycle access south to Acorn Creek Park. ii. Private road connection. The private road was revised to connect to Street B rather than terminating in a cul-du-sac as was proposed in Concept A (original submittal) for a continuous connection from Street A to Street B for residents and emergency vehicles. b. Concept C. i. Trail. The public trail proposed in Concept B was extended to follow the east-side of Street B to cross the private road and connect to Acorn Creek Park. ii. Sidewalks. Sidewalks have been added to the south side of Street A, north side of Street B, and the east side of Old Mill Road through the length of the development site. This would connect to the public trail and through to the residential development to the south and Acorn Creek Park. iii. Private road. The private road was revised to be a rpublic street connecting with Street B and terminating in a cul-du-sac rather than connect with Street wfflh r„ ?rnrnunii,/ in rrfirrl August 8, 2018 Centerville City Council Page 5 of 6 Old Mill Estates-Preliminary Plat and Rezoning A. As a public street it would meet the requirements of a public roadway. This revision was made to accommodate the original number of lots proposed in Concept A and eliminate issues surrounding private roads. iv. Stormwater. The ponding areas have been expanded to more thoroughly accommodate stormwater away from the wetlands and residential properties to the south. v. Additional lots. Concept C below shows options for additional lots along the new road to the east. This depiction is only an example of what is possible and needs to be evaluated for feasibility by the applicant. Sidewalks shall be included on the east side of Old Mill Road from the existing sidewalk to the south and the property's northern site boundary, on the south side of Street A, and on the north side of Street B. b. The proposed private road in the eastern portion of the development shall be public and meet the requirements of a public road. The section of private roadway to the north that meets the Street A cul-de-sac shall be eliminated with a new cul-de-sac. The new public road shall accommodate any lots that conform to zoning and other applicable standards. ,li wiir'1 r„ ,rnrnunii,/ in rrfirrl August 8, 2018 Centerville City Council Page 6 of 6 Old Mill Estates-Preliminary Plat and Rezoning c. The developer shall work with the City Engineer to further evaluate the water drainage system along the southern site boundary for potential impacts to adjacent residential backyards. d. The development shall include a trail as proposed in Concept B as shown in the Planning & Zoning Commission meeting on July 31, 2018. The trail shall connect Street A to Street B and extend on the east side of Street B to the connection with Revoir Street and Acorn Creek Park. e. The rezoning from R 1 to R2A is contingent on approval and recording of the development's Final Plat. NEXT STEPS City staff will continue working with the applicants to implement City Council conditions in a Final Plat. The Final Plat will return to the City Council for approval along with a developer's agreement. ,,,I i wfflh r„ ?rnrnunii,/ in rrfirrl CITY OF CENTERVILLE PLANNING AND ZONING COMMISSION Pursuant to due call and notice thereof, the Planning and Zoning Commission held its regula meeting on Tuesday, July 31, 2018 at 6:30 p.m. 0' PRESENT: Chairperson Darrin Mosher 0 ' Commissioner Linda Broussard Vickers Commissioner Mark Haiden Commissioner Kim Ganzel Commissioner Darrell (DJ) Olson, Jr. ABSENT: Commissioner Nick Twohy Commissioner Ben Fehrenbacher STAFF: City Administrator/Engineer Mark Statz City Planner Beth Elliot(Stantec) OTHERS PRESENT: City Council Liaison Russ Koski L CALL TO ORDER. Informal Review, 1721 Heritage Street—Fence Location The following item was handled after New Business: Mr. Ed Szulim of 1721 Heritage Street appeared before the Commission for an informal review of a proposed fence. He made an appearance last meeting as well. Mr. Szulim's lot is unusual because it is on a corner, with the home facing the long side of the lot, not the narrower side. This leaves him with nearly no backyard whatsoever. The side yard to his west is spacious enough for a fenced-in area but code does not allow this. Mr. Szulim was seeking the Commissions informal thoughts on what could be done to achieve his goals of having a reasonable fenced-in area. The Commission understood his plight and thought the use seemed reasonable, but had mixed thoughts on whether or not the situation would lend itself to a variance. Page 1 of 4 City of Centerville Planning and Zoning Commission July 31,2018 Mr. Szulim was told that a fence could be placed in an east-west direction across his property from a point 10' back from the front of his home. The commission is interested in reviewing this portion of the code, but at this time, it is all that is allowed. V. PUBLIC HEARING/INPUT 1. Old Mill Estates Mr. Todd Christianson and Jim MacKinnon have submitted an application for Preliminary Plat, Rezoning and a Conditional Use Permit for a Planned Unit Development. The preliminary plat contains 34 single family lots and is proposed for an R2A zoning on two, contiguous 10 acre parcels owned by Mr. Fischer and Ms. Fruth, respectively. Administrator Statz gave an overview of the application along with Staff's recommendation that action on the plat be tabled to allow the developer to redesign his plat with a more interconnected street network. Mr. Statz showed a concept of such a design, drafted by the city's planning consultant. Additionally, a hand-out was distributed and read through, outlining the sections of the city code and comprehensive plan which supported staff's position. Chairman Mosher asked the applicant to give an opening statement. Mr. Christianson stated the reasons for the design of his proposed plat and explained how he felt staff's concerns could be addressed through the addition of trails and sidewalks. He also expressed that their engineers had tried several layouts similar to the one drawn by the planners, but they all resulted in the loss of at least one lot, if not two. With the loss of one or two lots and an additional 300 feet of street required by the alternate layout, it made the economics of the development untenable. Further, in looking at the connecting road, Mr. Christianson did not see why anyone would use it except for the rare inter-neighborhood trips, most of which are within walking distance anyway. Mr. Christianson was asked about the estimated home values he thought would be built and stated that he expected them to be approximately $500,000. Chairman Mosher opened the Public Hearing for a Preliminary Plat, Rezoning and Conditional Use Permit for a Planned Unit Development for Old Mill Estates at 7:15 D.M. The following people addressed the commission during the public hearing: Cathy Fruth —7384 Old Mill Road: Mrs. Fruth stated she is one of the landowners selling to the developer and supports the layout as presented and doesn't see a need for the additional road connecting streets A and B, proposed by the planner. She is a long time resident of Centerville and has plans to move out of state. Fred Fischer—7396 Old Mill Road: Mr. Fischer stated that he is the other property owner selling to the developer. He has also been a long time resident and has enjoyed living in the community. He is in support of the proposed development. Page 2 of 4 City of Centerville Planning and Zoning Commission July 31,2018 Mark Cunningham — 1853 Revoir Street: Mr. Cunningham is the second to last lot on Revoir Street. He reminded the commission that this neighborhood is the only R5-zoned development in the city. He does not wish to have two backyard neighbors and prefers that lot lines of the new homes line up with those on his block. Mr. Cunningham enjoys living on a dead end and has concerns with the landscaping and drainage in his and other neighboring backyards. Having larger homes that sit several feet higher than the ones along Revoir also concerns Mr. Cunningham, in that they will be the dominant feature on the landscape and will "all that [they] see". Mr. Cunningham approached the podium a second time to ask if the higher valuation of the new homes would drive his value up and therefore raise his taxes. Administrator Statz said that if his valuation went up, his taxes would go up since property taxes are based on valuation. Mr. Cunningham again spoke, asking if the rezoning was "spot zoning"because their R5 is the only one in the area. Planner Beth Elliot explained that the rezoning was not "spot zoning" because all of the zoning in the area was low density residential and fit within the context of the neighborhood and was consistent with the comprehensive plan. Mary Franzen — 1845 Revoir Street: Ms. Franzen was concerned with drainage coming from the new development, into her backyard. Administrator/Engineer Statz showed the grading plan on the screen and explained the existing and proposed drainage patterns. He explained that in a 100 year rainfall, water would come from the proposed development, via an emergency overflow (EOF) route, into her backyard. Her backyard has a storm drain and should also have an overland EOF. The city intends to do an audit of EOFs around the city and would work with the developer to ensure that the one serving her backyard is checked before approval of this development. Jodi West — 1825 Revoir Street: Ms. West also had drainage concerns along the south edge of the new development and in the back yards of those along Revoir. She would also like to see the new development be zoned R-5 to match their development. BJ Ison —7375 Old Mill Road: Mr. Ison had concerns about connectivity of the roadway network. He also wondered if the southern of the two roads could end in a cul-de-sac at the west end, to eliminate a connection to Old Mill Road. He is concerned with headlights shining in his windows from the new road. Nick Jones — 7379 Old Mill Road: Mr. Jones shared Mr. Ison's concerns and asked if there would be any assessments to adjacent properties. Administrator Statz stated that there were no proposed assessments associated with this development. Page 3 of 4 City of Centerville Planning and Zoning Commission July 31,2018 Motion by Commissioner Broussard Vickers, seconded by Commissioner Haiden to close the public hearing. All in favor. Motion carried. The Public Hearing was closed at 8:05. VI. OLD BUSINESS 1. Old Mill Estates a. Preliminary Plat b. Conditional Use Permit for a Planned Unit Development c. Rezoning (Rl to R2A) Discussion among the commission ensued. Commissioners did not favor the interior connecting road layout proposed by the planners. They felt that the addition of trails and sidewalks could serve the purpose of connecting the neighborhood and giving access to the park. Consensus was also that the layout, as presented, was reasonable. The commission discussed issues with private roads and eventually proposed that the private road be made public, and that it be ended in a cul-de-sac, connecting to Street B, with the connection to Street A being eliminated. This change, would allow conforming lots in the eastern portion of the plat and would eliminate the need for a PUD. Motion by Commissioner Broussard Vickers, seconded by Commissioner Haiden, to recommend approval of the Preliminary Plat and rezoning, as presented with the following conditions. 1. a. Sidewalks shall be included on the east side of Old Mill Road from the existing sidewalk to the south and the property's northern site boundary, on the south side of Street A, and on the north side of Street B. 2. 3. The developer shall work with the City Engineer to evaluate the water drainage system along the southern site boundary for potential impacts to adiacent residential backyards. 4. The development shall include a trail as proposed in Concept B as shown in the Planning & Zoning Commission meeting on July 31, 2018. The trail shall connect Street A to Street B and extend on the east side of Street B to the connection with Revoir Street and Acorn Creek. 5. The rezoning from Rl to R2A is contingent on approval of the development's Final Plat. All in favor. Motion carried. Remainder of Draft Minutes are unfinished at this time... CITY OF CENTERVILLE REQUEST FOR COUNCIL ACTION J`' o Agenda Item# Department: Requested Council Meeting Date: Administration August 8, 2018 TITLE OF ISSUE: Letter of Credit Policy BACKGROUND AND SUPPLEMENTAL INFORMATION: City code, section 153.36 requires a developer's agreement for new subdivisions. The code requires that : "The performance of the contract shall be financially secured by a cash escrow deposit or irrevocable letter of credit as hereinafter set forth." The code further lays out the requirements of the LOC. However, it simply says that the "Release of the letter of credit will be determined by Council resolution." Specifics of the process for LOC reductions and final release, therefore, need further clarification. Staff felt this might best be done through a policy. Attached is a draft of that policy for your review. COST AND SOURCE(S) OF FUNDING: No cost. Procedure for requesting a reduction to the amount of a Letter of Credit a. A request to reduce a Letter of Credit must be recommended by Staff and approved by City Council action (usually on a Consent Agenda). b. Make request in writing along with supporting documents. Reduction requests must be accompanied by a line-item pay request to the contractor, or similar detailed accounting of the work representing the corresponding reduction to the Letter of Credit. c. Staff needs time to review and process the reduction request. Deadline to submit a reduction request is two weeks prior to any given City Council meeting. d. If approved, the City Administrator will author a letter approving the amount of the reduction. The letter will be addressed to the Financial Institution that issued the Letter of Credit. The party requesting the reduction will be responsible for having the Financial Institution issue a new or amended Letter of Credit under the same terms as the original instrument. 2. Frequency for requesting a reduction to the amount of a Letter of Credit a. Requests may be made on a monthly basis. b. More frequent requests for reductions may be made. However, administrative costs associated with these requests will be charged and payable before the City will consent to the reduction. 3. Minimum amount of Letter of Credit A letter of credit cannot be drawn down to less than 5 %of the original value of the Letter of Credit or$20,000, whichever is greater, until the agreement governing the project is satisfied. 4. Letter of Credit Reduction Guidelines a. Reductions to a Letter of Credit will be made in the amount of the value of improvements complete and approved, as documented in the submitted materials, plus the multiplier used to calculate the original Letter of Credit. For example, if a LOC is issued at 150%of the estimated value of improvements, then LOC reduction requests would be granted in the amount of 150%of the value of work completed, subject to the minimum restrictions stated above. b. The city shall reserve the right to issue reductions in any amount less than the requested reduction, if, in the opinion of staff or council, a portion of the work completed is not acceptable. Alternatively, the city may simply deny the entire reduction request for the same reason. 5. Governing authority a. The terms of any written contract or agreement with the City in conflict with this policy is the controlling.
