HomeMy WebLinkAbout2018-07-25 CC Minutes - Approved CITY OF CENTERVILLE CITY COUNCIL MEETING MINUTES July 25, 2018 6:30 p.m. Pursuant to due call and notice thereof, the City of Centerville held their regularly scheduled City Council meeting of June 25, 2018 at City Hall, 1880 Main Street. PRESENT: Mayor Jeff Paar Council Member Steve King Council Member Russ Koski Council Member Matt Montain Council Member D. Love ABSENT: None STAFF: City Attorney Kurt Glaser City Administrator Mark Statz I. CALL TO ORDER Mayor Paar called to order 6:31p.m. II. PLEDGE OF ALLEGIANCE III. APPROVAL OF AGENDA Mayor Paar noted the following amendments to the Agenda; under VII. Consent Agenda, Item 41, added (Check 431977-32018) w/voided Check 431985, 31977 & 31989 (pages 15a & 15b) and, under IX. New Business, Item l.a. Findngs of Fact, Item l.b. Resolution 418-OXX Authorizing Variance (Pages 42-43), and Item 2. Special Assessment Agreement — 1299 Mound Trail (pages 44-52). Motion by Council Member Love, Seconded by Council Member King to Approve the Agenda as noted. All in favor. Motion carried. IV. APPOINTMENTS/PRESENTATIONS 1. None. V. PUBLIC HEARING 1. None. VI. APPROVAL OF THE MINUTES City of Centerville Council Meeting Minutes July 25,2018 1. July 11, 2018 City Council Meeting Minutes Mayor Paar provided Council Members with an opportunity for modifications to the submitted minutes. It was noted that the minutes were incorrect and should, instead, reflect that Council Member Koski had motioned for adjournment, King 2na Motion by Council Member Koski, seconded by Council Member Montain to Approve the minutes with noted change. All in favor. Motion carried. VII. CONSENT AGENDA 1. City of Centerville July 11, 2018 through July 25, 2018 Claims (Check#31977- 32018) wNoided Check#31985, 31977 & 31989) 2. Centennial Lakes Police Claims through July 18, 2018 (Check#12092-12113) 3. Centennial Fire District Claims through July 10, 20198 (Check#8244-8250) 4. Successful Performance Review—Ms. Kris Sweeney, Senior Account Clerk (Completion of 18 Years) 5. Res. #18-OXX—Assigning Duties as they Relate to Handling Banking Transactions for the City of Centerville Mayor Paar provided Council with an opportunity to discuss any item(s). Motion by Council Member Koski, seconded by Council Member Love to Approve the Consent Agenda as presented. All in favor. Motion carried. Mayor Paar congratulated Kris on her 18 years with the city, noting that she is a huge asset to city and her hard work is much appreciated. Others echoed the mayor's comments. VIII. OLD BUSINESS 1. 1737 Main Street Asbestos Abatement Administrator Statz stated that the former office of the Paul Steffel insurance agency, previously a residential home, is owned by the city. Councils previous direction was to look into whetehr there was a market to have the home moved. Staff has found no market to move the home and demolition would be the next option. The first step to demolition is to get a clean bill of health. Quotes have been received to complete the asbestos abatement. Paul Palzer, Public Works Director has suggested using the quote of TL Enterprises, despite it being $5 higher than the other quote, since the other quote had exceptions regarding cleaning costs. NEW BUSINESS 1. Variance Request for 1965 South Robin Lane a. Findings of Fact b. Res. #18-OXX—Authorizing Variance Mark stated owners/developers here and before P & Z variance garage for driveway, garage not built with building and driveway can not sqeeze 9 is less variance for chunck of land until 14' between house and property line some reasons found to be good candidate neighbor is a park and not effecting anything, passive part of park and fact lot and many in neighborhood need garages and reasonable use of property and no other place to put garage and driveway. Next two properties also have garages in rear. King not sure how get to garage or where to put it. Love questioned utilities. Mark stated encroachment along with this and some sort of utilitiy down line go through park. Love since our land up against do we seed footage. Variance has to be not created by land owner and they are building garage. Kurt we allow accessory structures and everyone has a garage and allow property owners to reasonably utilize their property. Kurt what is different is you could fit a whole driveway on other lots and plat that we approved and we should not have approved and City caused while plating and did not create we gave them odd sized lot. Doug Kruse and permit granted by City and 2' variance and get back to the garage. Love back of their lot and no screening to businesses and very interesting and see straight through and think businesses should have screening. Mark larger discussion on code enforcement and most not allowed under code. Mark revisit code enforcement both residential and business and not anti-business and tricky and help eda through that. Code enforcement can be Council and staff and want to discuss strategies and p & Z if do something different and ordinance antiquated. Mark commercial code enforcement and viewed as antibusiness and hard enforcement and businesses will say that and eda strategies with that and would like to share with EDA. Screening and whether or not required and if not there before and it may not be required to add screening. Russ P & Z healthy discussion not created by landowner and if not variance and straiten property line and sell part of park and sell to them. P & Z reasonable and gave a permit and now tell cant get back there. Kurt helped draft documents and P & Z on board. King because on property line and if City has anything to do to disrupt their driveway and future protection for driveway and notice to new homeowner and City not come in do something to that. Kurt nature of variance takes care of both issues. Written and defined and recorded with property and then we do something against that it would be eminent domain. Love fence, Mark they would need encroachment agreement and along there there is a chain link fence. Driveway will be in 5' set back and on their property by 2' and still 3' to property line. Special Assessment Agreement—1299 Mound Trail Kurt stated home sale and condition to hook up to city water supply and worked out situation with homeowner and seller make connection within 4 months and lender allowed to do and use money out of escrow and included bids and if do not do in 4 months we do and take out of escrow and if over we will specially assess. They will do privately and if they do not we will step in. Kurt what learned and more details in ordinance and if city has a hand in it very expensive and $19,000 in escrow. Kurt provision for costs from escrow. Matt interest is coming from their escrow account or city charging. Kurt interest does not happen until they fail and assess and interest is on assessment itself and pay within first year. Mark Kurt fees and owner asked if can be waived and reason felt that this is something that City had worked out ahead of time and not unique to their property and Kurt stated could be as much as $500 and within motion and an obligation and think something that they requested and we look at and may be appropriate. Mark useful going forward and used again and waive his fee and reuse for every other house. Kurt stated $240. Kurt first time any one done this and first time legal document. King they bought property with understanding they needed to connect and and knew that. Only a week before closing we got wind of this and fairness of this and we will use this again. King a week before. Mark council direction but do not have an ordinance. We do not have catch that everyone that makes a sale. You passed a resolution not a law. Assessment search and Teresa notifies them. Ordinance on books many years, and do not stop sale of house in violation and need ordinance to stop sale and what discovered and nice tool for people to finance and required of ordinance and time of sale is not in there and person able to finance a part of home sale and if bought house without issue and a year later enforce water connection and they would have to get an additional loan. King what is the difference with any other homeowner and options still up to them and come to us and request an assessment and not protected in that fashion. Kurt if done in home. Teresa just a motion and not a code amendment and overextended with motion and legal mechanisms. Mark allows sale to go forward without a hitch and mechanism to finance. Jeff conversation and how do this and assume. Ordinance is in the past. Montain approve special assessment, legal fees waive, Love 2nd Montain disappointed King pass just specific to property and discuss issue in meantime. Montain end hookdate—talk about other issue next month and only for 1299 Mound Trail. Unanimously Mark come back up on agenda 1st meeting in September. D few short things and thank Matt for attending Police and thank yous Susan Love announce parade and Ben organizing parade and Fete committee Mark and Teresa and Thank Mayor Jeff Paar and twitting and face book and a great week last week. Koski P & Z variance on Robin Lane and enjoy last weeks festivities and great week and thank everyone for hard work, effort and volunteers and Mayor a lot of time and recognize him for that and thought events were wonderful and good events and not sure we know talented and dedicated people and thank for what did. Night to Unite and good time to know neighbors, Fire meeting and thanks for last week and good responses. Jeff did have fire steering meeting last week and discussed duty crew and use what we have for rest of year and 3% under budget to date and 2019 our portion $11,652 and discussed did move the funds forward to purchase fire trucks and we thought good idea to build fund up and added $20,000 additional for that line item and help with needed fire trucks and desire to be ongoing and discuss where at and each city and approved for this year and reason for our increase and police decrease of$7500 for total. Calls are a small portion up and spoke of duty crew chief has not had a lot of people wanting to fill spots and revisit next year and concerns are hours of operation 6 a.m — 6 p.m. harder to get volunteers and could be changes with individuals retiring and keep attempting to find solutions to work. Jeff stated Matt brought up night to unite and St. Gen's Chicken Dinner August 19, 2018 great event and encourage everyone to go. Jeff festival so many to thank D & Susan huge announcer for parade and do fantastic job, North Metro community photo and at all events, Council for approving funds, Russ and Matt involvement and public safety also and Russ with line up. Ben Fehrenbacher ochastrated all of that and people that helped with lineup are actual residents. Dan Capra and Mark Sundquist. CLPD and CFD and huge participants and keeping to safe. Bill Jacobsen at all events and thanks, CERT — Michelle Lakso and Radio Club volunteer their time and have them help out, Tom Lee, Bald Eagle, P & R committee and City staff and Lions club some many people public safety at school and thank school for use of parking lot — overall thank you to all for making possible and sponsors and businesses donated time and money made possible. Ben a lot with parade and D helped out as well. Hope next year continue to move forward. Started in 1990 and piece on North Metro Cable and started by City parade and fireworks and now 5 day celebration and 28th year and grown to a bigger festival. 1971 and Mill Road 1854 Charles Peltier saw mill on Clearwater creek.
