BACKGROUND AND SUPPLEMENTAL INFORMATION:
Subsequent to the August 1, 2018 meeting, the Committee requested additional information regarding the above
stated issue. Attached, you will find a Memorandum from Stantec outlining recommendation(s) for
modifications to the existing City Code.
Please take some time to review the intent of the Committee and regulations that would be imposed.

Reference: Existing Regulations on Electric Scooters and Bikes
The recent influx in availability of low-powered electric vehicles including electric-assisted bicycles and
motorized scooters have shaped new questions regarding the legal use of the public right-of-way.
Centerville City Code (Chapter 70, Section 70.01)adopts Minnesota Statute Chapter 169 regarding
traffic regulations. "The regulatory provisions of M.S. Chapters 168, 169, 170 and 171 [..]are adopted as a
traffic ordinance regulating the use of highways, streets and alleys within the city[..]"
• E-bikes in Minnesota Statutes Chapter 169 (Traffic Regulations) are defined as electric-assisted
bikes that can be propelled at a speed no greater than 20mph (M.S. 169.011 Subd. 27).
169.22 Subd. 4. "(g)A person may operate an electric-assisted
bicycle on the shoulder of a roadway, on a bikeway, or on a
bicycle trail if not otherwise prohibited[on state trails or by local " x
government] , as applicable."

Electric-assisted bicycles appear under the definition "Bicycle"
(169.011 Subd. 4). It appears that they should be treated as
bicycles unless local rules specifically prohibit motorized vehicles.
• Scooters in Minnesota Statutes Chapter 169 (Traffic Regulations)are defined as motorized scooters,
with or without a seat, that reach speeds no more than 15mph on flat surface and have wheels under
12in in diameter. (M.S. 169.011 Subd. 46)
169.225 Subd. 1. "Application of traffic laws. Every person
operating a motorized foot scooter shall have all rights and duties
applicable to the operator of a bicycle, [except with provisions
specific to scooters and where bike laws by nature cannot be
applied to scooters]..."
It appears that scooters should be treated as bicycles unless local
rules specifically prohibit.
• Parking of bicycles (and therefore scooters and ebikes)are allowed on streets and sidewalks so long
as they don't obstruct other traffic.
169.222 Subd. 9. "Bicycle parking.
(a)A person may park a bicycle on a sidewalk unless prohibited or restricted by local authorities. A
bicycle parked on a sidewalk shall not impede the normal and reasonable movement of pedestrian or
other traffic."
(b)A bicycle may be parked on a roadway at any location where parking is allowed if it is parked in
such a manner that it does not obstruct the movement of a legally parked motor vehicle.

It appears that a-bikes and small scooters should be treated as bicycles according to State Statues unless
local rules say otherwise.
Recommendation #1
Stantec recommends the addition of new ordinance language to the City code specific to low powered
vehicles including electric-assisted bikes and motorized foot scooters.
Additional sections should be made to Chapter 73 of the Code (Regulating Special Vehicles on the
Roadways). Additions should include sections:
• 73.02 Definitions: A definition for`electric assisted bicycle' and a definition for`motorized foot scooter'
should each be added to this section. Applicable language can be found in MN State Statutes
Chapter 169.
• 73.03 Special Vehicle Use On Streets: Specific provisions should be added to this section regarding
the use of electric assisted bicycles and motorized foot scooters. General ideas are listed below,
please let us know if you would like us to write specific language.
o Impounding should be authorized when low power vehicles are parked in such a way that
they obstruct the normal flow of motorized, pedestrian, or any other type of traffic.
o Operations should be dictated for low powered vehicles following rules regarding use of
regular, non-motorized bicycles. State Statutes 169.225 Subd. 1 for scooters and 169.22
Subd. 4 for a-bikes can be adopted to code. Low powered vehicles are:
■ Not to be operated on the sidewalk
■ To follow the same laws as bicyclists and generally be operated on the right-hand
side of the street
■ To be parked upright using bike racks when possible, and not obstructing the normal
flow of pedestrian, automotive, or any other type of traffic.
o Shared network services should be allowed to operate on public right of way so long as the
service provider has received written permission from City staff.
Recommendation #2
Stantec recommends the addition of a new chapter under Title VII: Traffic Code. As Chapter 72 is dedicated
to the regulating the use of snowmobiles within city limits, the addition of a new chapter could regulate the use
of low powered vehicles.
Following the same outline as Chapter 72: Snowmobiles, a new chapter would provide a definition for both e-
bikes and foot scooters, state adoption of applicable state laws, and highlight prohibited uses within city limits.
Please let us know if you would like specific language for a new chapter to the code.

(3) "All-terrain vehicle" is specifically defined by Minnesota Statute Section 84.92, subdivision 8,
and means as motorized flotation tired vehicle of riot less than three low pressure tires, but riot
more than six tires,that is limited in engine displacement of less than 1,000 cubic centimeters,
and includes a class I all terrain vehicle and class 2 call-terrain vehicle.
(l.3), treets. "Streets"means any street, highway, avenue,alley,or other public right of way within tile
jurisdiction of the City, including the entire right of vvay.
§ 73.03 SPECUI., VEHICLE USE ON STREETS
(A)Davignation of roadwqy,permit. The City authorizes the operation of all terrain vehicles,mini trucks,
and utility task vehicles on all streets in the City as defined in this ordinance.. Operation of these vehicles
is a privilege which may be revoked at antime if there is evidence that an operator cannot safely
operate the vehicle. Special-vehicles shall be authorized to operate in thefollowing manner-
(1) Issuance of a docurnented permit required. The city may grant and issue a permit document to
the ownerBor a period not to exceed three years, and which may be renewed. There shall be at
the time offilling out the application a per mit.fee as set by the City Council, as adopted.from
time to time.. No permit is valid unless it isPresent when the special vehicle is being operated.
(2) Issuance of as documented permit not required. The city grants a permi it to the operator of a
special vehicle during its use for a commercial or business purpose. Operating a special vehicle
for this limited purpose does notrequire a permit application., fee or documented permit..
(B)Crossing intersecting highways. The operator,under permit for an all terrain vehicle, mini truck,or
utility task vehicle may cross anystreet or highway inte.rsecting a designated roadway.
(C)Application of traffic laws. Every person operating air all terrain vehicle, mini truck,or utility task
vehicles tinder permit on.designatedstreets has all the rights and duties applicable to the driver of any
other automobile or passenger vehicle under state or federal law or regulation except:
(1) where specifically exempted by state law.,
(2) those provisions of law or wgulation that cannot reasonably be applied to an all...terrain.vehicle,
mini-truck, or utility task vehicle, or
(3) as otherwise provided in subdivision D.
(D)Required equipment on mini trucks.Notwithstanding State Statue Sections 169.48 to 169.68, or any
other law, a mini trucls.may be operated under pennit oil designated roadways if it is equipped with:
(1) at least two head lamps;
(2) at least two tail lamps;
(3) front and rear turn signal lamps;
(4) an exterior mirror mounted on the driver's side of the vehicle, and either an exterior mirror
mounted on the passenger's side of the vehicle or an.interior mirror;

TITLE OF ISSUE:
Fete des Lacs Committee Representative
BACKGROUND AND SUPPLEMENTAL INFORMATION:
Administrator Statz recommends that a member of the Committee become an official representative for the
Parks & Recreation Committee on the Fete des Lacs Committee. It is believed that this representative will
work cohesively between the two Committee's on related activities such as the run and other events associated
with Fete des Lacs. They will be meeting on a monthly basis on the third Monday of the month commencing
Monday, January 21, 2019 at 6:00 p.m. at City Hall in Council Chambers.

REQUESTED ACTION:
Appoint a member and alternate to represent the Committee at the Fete des Lacs Committee meetings.

Parks & Trails Plan
BACKGROUND AND SUPPLEMENTAL INFORMATION:
The attached proposal from Stantec, dated November 28, 2018 to provide Administrator/Engineer Statz
assistance with finalizing the Parks & Trails Plan. This amount was included in the proposed budget placed
before Council last evening and they approved same in the amount of$5,000.

$5,000 - General Fund (Budgeted Expense)
REQUESTED ACTION:
That the Committee Recommend to Council the Acceptance of the submitted proposal in the amount of$5,000
(to be expended in 2019).

Dear Mark,
We appreciate the opportunity to assist you and the City of Centerville with the City's Park Plan. Our
understanding of the project and our scope, for a lump sum amount of$5000, is as follows:
Stantec will assist you, as the principal author of the document, and provide you with:
o An aerial photo graphic of each park with amenities called out (8 parks). Each park would
have its own 8 '/2 x 11 sheet for the document. These will be used for future planning,
when the City elects to replace playgrounds, add a bench, etc. CIP items could also be
called out on these maps. Initially, drafts would be produced for the City to review and
provide redlines of the amenities and CIP items for Stantec to add to the final versions.
o Incorporation of your narrative (just text) into a document, with a table of contents,
chapters, appendices, etc.
o A peer review of the document to provide guidance. This would include an initial review of
an outline of the plan, then a second review of the final draft (2 reviews total).
It is our understanding that the Parks CIP and the City's Comprehensive Plan are approved and the
underlying data that goes into the Park Dedication Fee calculation is already determined. The City will
supply photos and the list of amenities and CIP items for each park, and their relative locations.
This letter and scope of services represent the understanding between the City and Stantec in respect to
this Project and may only be modified in writing signed by both of us and is subject to the current Master
Services Agreement between the City and Stantec.
If this letter satisfactorily sets forth conditions of our Agreement, please sign in the space below and
return one copy to our office. Thank you for the opportunity to provide these services.

MEETING MINUTES
Pursuant to due call and notice thereof, the City of Centerville's Parks & Recreation Committee
held a scheduled meeting on November 7, 2018 at City Hall, 1800 Main Street.

I. CALL TO ORDER
Committee Member Amundsen called the November 7, 2018 meeting of the Parks &
Recreation Committee to order at 6:37 p.m. in the City Administrative offices.
II. APPROVAL OF AGENDA
Motion made by Committee Member Wae2he, seconded by Committee Member
Amundsen to approve the Agenda with the following additions: #2. Sledding Hill &
#3. Scooters/Motorized Bikes, both under Unfinished Business; #3. Staff Update
under Announcements/Updates. All in favor. Motion carried
III. APPEARANCES/APPOINTMENTS/PRESENTATIONS -NONE
IV. UNFINISHED COMMITTEE BUSINESS
1. Skate Night Planning - January
There was discussion to include the sledding hill as part of Skate Night as was
done in 2018 to introduce the sledding hill as another fun park activity. See the
minutes of the October 10, 2018 for additional details of this event.
2. Sledding Hill
If including promotion of the sledding hill, it was suggested to have some types of
competition, as was previously done, with prizes, i.e. 1st, 2nd & 3rd place medals,
etc. This activity would be promoted as an extra activity, along with Skate Night.
3. Skate Night/Hayride Planning—February

Motion made by Committee Member Amundsen, seconded by Committee
Member Seeley to recommend to the City Council to approved the
expenditure of up to $1,000 towards the cost of the havride plus any
incidentals needed for this activity. All in favor. Motion carried.
4. Scooters/Motorized Bikes
There were concerns about children riding on the streets; discussed to possibly
stencil information on streets &paths for shared usage.
Motion made by Committee Member Wae2he, seconded by Committee
Member Erickksen-Grahek to place this topic on the December agenda for
further review, discussion, evaluation and to determine if there should be
changes to the ordinance(s). All in favor. Motion carried.
This motion overrides the portion of the motion dated October 10, 2018 regarding
the Scooters/Motorized Bikes.
V. COMMITTEE BUSINESS (NEW) -NONE
IV. APPROVAL OF THE MINUTES
Motion by Committee Member Wae2he, seconded by Committee Member
Erickksen-Grahek to approve the minutes of the October 10, 2018 regular meeting
as submitted. All in favor. Motion carried.
VII. UPDATES/ANNOUNCEMENTS
1. Council Update—Council Member Montain
a. RJ Property & Maintenance is the new contractor for lawn mowing services
for City owned property.
b. Budget was increased by a few thousand dollars.
c. Anoka County Fire Maintenance plan to set up a mobile unit during the Fete
des Lacs, using drones, radio communications, demonstrating equipment and
showcased their unit.
2. P & R Vacancy
The city is currently accepting applications for the position.
3. Staff Update
a. Bayview Villas was approved for 18 units. There is approximately $75,000
value in park fees.
b. Anoka County Regional Park Plan is moving forward, including signage for
the Burial Mound.

c. An email was received from Ms. Leslie Russell, whose daughter, Ellie had
organized her Cub Scout den to pick up garbage at Royal Meadows Park on
Wednesday, Oct 17 at 5:00 p.m.
