HomeMy WebLinkAbout2018-11-28 CC Minutes - Approved CITY OF CENTERVILLE CITY COUNCIL MEETING MINUTES November 28, 2018 6:30 p.m. Pursuant to due call and notice thereof, the City of Centerville held their regularly scheduled City Council meeting of November 28, 2018 at City Hall, 1880 Main Street. PRESENT: Mayor Jeff Paar Council Member King Council Member Russ Koski Council Member Love Council Member Matt Montain ABSENT: None STAFF: City Administrator Mark Statz I. CALL TO ORDER Mayor Paar called to order 6:30 p.m. II. PLEDGE OF ALLEGIANCE III. APPROVAL OF AGENDA Mayor Paar stated that Consent Agenda Item 41 should read November 15 through November 28 instead of October 24 through November 14 and Check 432271-32294 rather than Check 432271-32287, he added Check 432295-32301 and stated that an Employee Long Term Disability handout was added at the end of the packet. He provided an opportunity for others to add or delete any items. Motion by Council Member Love, seconded by Council Member Montain to Approve the Agenda as Submitted. All in favor. Motion carried. IV. APPOINTMENTS/PRESENTATIONS 1. None V. PUBLIC INPUT ON 2019 BUDGET & TAX LEVIES (TNT HEARING) Finance Director Bruce DeJong reviewed a presentation with Council and stated that Council is providing information to the public regarding the 2019 Budget and Tax Levy. He stated that the General Fund budget is proposed to decrease slightly by $8,000 from the previous year. The debt service levy is set to decrease approximately $71,000 and the general levy was increased approximately $23,000. This equates to a net total levy decrease of$48,342, or 1.75% below the tax levy for 2018. City of Centerville Council Meeting Minutes November 28,2018 He reported that the city will experience major changes in State Fire Aid due to the City of Lino Lakes leaving the Fire District, that it is anticipated with the construction for the three (3) developments that have received approval which will result in building permit revenue being approximately $80,000-$85,000 with property taxes increasing about $23,000 and salaries increasing $36,900 due to the hiring of a part-time Finance Director and a part-time Receptionist. He also stated that lawn mowing costs would be increasing by $6,200 along with EDA funding of $21,800. He stated that with all of the staff recommendations the General Fund Tax Levy would be $2,202,802 which is an increase of$22,822 or a 1.1% increase from 2018. He reviewed the Debt Service Levies by stating that with the amount certified to Anoka County the total tax levy would have swung wildly by dropping in 2019 by $142,000 and increasing approximately $275,000 in 2020. It was felt that a gentle decrease could be realized over a 10 year period by fully funding bond issues in a more predictable pattern by reducing the debt levy by approximately $71,000 in 2019 and $52,000 in 2020. He reported that the Debt Service Levies will remain stable through 2024 with major decreases going forward from there. He reviewed the overall levy's trend from 2014 when it decreased by a half percent and has increased slightly over the next four (4) years. He stated that with the proposed budget it would decrease 1.75% for 2019. He discussed how the Tax Levy is spread throughout the community stating that numerous homes values have been experienced with some increasing more than others due to market conditions, improvements made and other factors. He stated that these incidents are outside of the City's control and are not related to the City's taxes. Discussion ensued regarding tax capacity rates, Council and Staff efforts on decreasing the City's budget and the length of time reviewing and discussing the budget by Council and Staff at Work Sessions prior to this evening. Mayor Paar opened the input portion of the meeting at 6:52 p.m. He provide audience members with an opportunity to speak. No audience members chose to speak. Motion by Council Member Koski, seconded by Council Member King to close the input portion of the meeting regarding the 2019 Budget & Levy at 6:53 p.m. VI. APPROVAL OF THE MINUTES 1. October 24, 2018 City Council Meeting Minutes Mayor Paar provided Council Members with an opportunity for modifications. Motion by Council Member Montain, seconded by Council Member Koski to Approve the October 24, 2018 City Council meeting minutes as presented. All in favor. Motion carried. 2. Council Member Montain stated that he had spoken with the Clerk earlier in the day regarding the minutes, and was not satisfied with them as presented. Motion by Council Member Montain, seconded by Council Member Koski to Approve the November 11, 2018 City Council meeting minutes as presented. All in favor. Motion carried. VII. CONSENT AGENDA 1. City of Centerville November 15, 2018 through November 28, 2018 Claims (Check #32271-32294) & (Check#32295-32301) 2. Centennial Lakes Police Claims through November 21, 2018 (Check#12297-12321) W/Payroll (Check#12314 & 12315) 3. Centennial Fire District Claims through November 13, 2018 (Check#8357-8362) W/US Bank& Payroll (Check#8352-8356() 4. Res. #18-016—Rice Creek Watershed Request for Repair of Judicial Ditch (AWJD3) 5. Res. #18-017—Establishing Precinct and Polling Locations for 2019 Election Year Mayor Paar provided an opportunity for Council to remove any item(s) for discussion. Council Member Montain questioned charges from Otter Lake Animal Hospital and Clerk Bender stated that the owner of the animals had been invoiced. He also questioned a check for Northland Trust and Finance Director DeJong clarified the misunderstanding. Motion by Council Member Love, seconded by Council Member Koski to Approve as presented. All in favor. Motion carried. VIII. OLD BUSINESS 1. Ord. #93, Second Series —2018 Fee Schedule (2nd Reading) Administrator Statz stated that this was the second reading for this ordinance amendment and stemmed from Council's action regarding water lateral fees and connection requirements previously discussed by Council. Motion by Council Member Montain, seconded by Council Member Koski to Adopt Ord. #93, Second Series —2018 Fee Schedule as presented. All in favor. Motion carried. 2. 2019 Budget and Tax Levy Adoption Administrator Statz stated that the budget and tax levies presented are as previously discussed and requested any additional input from Council. Motion by Council Member Koski, seconded by Council Member King to Adopt Res. #18- 018 —Adopting Budget& Tax Levies for 2019 as presented. All in Favor. Motion carried. Page 3 of 6 City of Centerville Council Meeting Minutes November 28,2018 IX. NEW BUSINESS 1. Southern Rail a. Liquor License Semi-Annual Compliance Check City Attorney Glaser stated that there was a recent violation at Southern Rail where an undercover, underage individual was served. He stated that the owners of Southern Rail (Jeff Schultz and Victoria Bryne) were both in the audience and they were requesting deviation from the recommended penalties due to providing both staff from Southern Rail and Kelly's Korner additional education through the MN Licensed Beverage Association. Attorney Glaser stated that City Code refers to penalties for first violations of$500 fine and five (5) days of the business being closed. Attorney Glaser explained that City Code is a recommendation, there has been no violations within the last three (3) years (look back period) and the owners have terminated the individual who violated the law. Mrs. Vicki Bryne stated that the Centennial Lakes Police Department used to provide training for liquor establishments and their employees but have not for over a year. She stated that they employed the Beverage Association and all staff participated. She also stated that she felt that ongoing training was all that they could do and continued carding of individuals. She stated that the server was a close friend and was terminated. Attorney Glaser stated that the server would be prosecuted. Council Member Love asked if there were additional facts that Mrs. Bryne would like to explain and she stated that the incident occurred during Happy Hour, the server was under stress and had many things on her mind and busy. She stated that this is not something that either her or Jeff take lightly. Council Member Koski questioned whether employees had been through training previously and Mrs. Bryne stated that through CLPD except for a year. She stated that the MLBA training was much more extensive. Council Member Montain stated that when his family owned the Trio Inn they opted to pay the fine rather than appealing to Council just to get the issue done with. He stated that he is not in favor of closing a business and would like it on the record if there is another violation. Council Member Montain also stated that he would abstain from voting on this item because the owners are his aunt and uncle. Administrator Statz and City Attorney Glaser stated that if there is another violation within a year, penalties could change and Council has the ability to look at what happened here and consider the recommended penalties and impose what they wish. Motion by Council Member Love, seconded by Council Member King to Waive the Monetary and Closure Penalties Based on the Bar Owner's Auressive and Comprehensive Efforts to Ensure Future Compliance with a Reservation of the Right to Enforce Said Penalties (in Addition to Other Prescribed Penalties) if Similar Violations Occur Within Page 4 of 6 City of Centerville Council Meeting Minutes November 28,2018 One Year of the Initial Offense. All in favor with Council Member Montain abstaining. Motion carried. b. Liquor License (Renewal) i. On Sale ii. Sunday Motion by Council Member Love, seconded by Council Member Koski to Approve as presented. All in favor. Motion carried. X. COUNCIL/ADMINISTRATOR ANNOUNCEMENTS 1. Administrator/Engineer Report Administrator Statz stated that his Administrator Report was in the packet but desired to provide information regarding Employee Long Term Disability insurance and requested Council to could make the decision as employees would either pay for the disability insurance from their monthly cafeteria allotment or their owns funds. Council has concerns regarding whether the City would need to fund the program in any way. Administrator Statz stated no. Council consensus was that the Administrator could make the decision if staff desired to participate. Council Member Koski thanked Administrator Statz for being an active member of the Quad Area Chamber of Commerce and thanked City Clerk for duties associated with elections. He stated that Council will have a new member in the upcoming year. Mayor Paar clarified that Council would have one (1) meeting in December and that would be taking place on December 12, 2018 at 6:30 p.m. Administrator Statz stated that there would be no Work Session that evening. Mayor Paar stated that the Planning & Zoning Commission will be meeting on December 4, 2018, the EDA would be meeting on December 5, with the Parks & Recreation Committee meeting on the 5 t also in Administrative Offices. Mayor Paar stated that City Hall will be closed on December 24 and 25 in observance of the Christmas Holiday and that the Regularly Scheduled Council meeting of December 26 was cancelled. Mayor Paar stated that the Centennial Fire Santa Parade would be Monday December 10, 2018 at 5:30. He also stated that Toys for Joy are accepting toys at City Hall through December 18, 2018. He stated that both of these events are on the City's Web Site and Facebook page. Mayor Paar stated that he would be attending the Rush Line Corridor meeting in Maplewood tomorrow. He reported that Michele Lakso, new Council Member, would be meeting with him to be brought up to speed on Council items. Mayor Paar reported that the Centerville Lions Annual Ice Fishing Contest was scheduled for February 16, 2019 and information could be found on the Lions Facebook page. Mayor Paar stated that former Vikings player Tommy Kramer would be a Kelly's Korner on Friday at 7:00 p.m. XIII.
