HomeMy WebLinkAbout2018-10-02 P & Z Minutes - Approved CITY OF CENTERVILLE PLANNING AND ZONING COMMISSION Pursuant to due call and notice thereof, the Planning and Zoning Commission held its regular meeting on Tuesday, October 2, 2018 at 6:30 p.m. PRESENT: Chairperson Darrin Mosher Commissioner Linda Broussard Vickers Commissioner Mark Haiden 0 Commissioner Darrell (DJ) Olson, Jr. U Commissioner Ben Fehrenbacher Commissioner Nick Twohy 0 U10 ulj ABSENT: Commissioner Kim Ganzel STAFF: City Administrator/Engineer Mark Statz OTHERS PRESENT: City Council Liaison Russ Koski L CALL TO ORDER. The meeting was called to order at 6:30 p.m. by Chair Mosher. 1. Roll Call II. PLEDGE OF ALLEGIANCE III. APPROVAL OF AGENDA Administrator Statz requested that Item 3, of Old Business, regarding Comp Plan revisions be pulled from the agenda. Motion by Commissioner Haiden, seconded by Commissioner Broussard Vickers to Approve the Agenda as presented, with noted deletion of Old Business Item #3. All in favor. Motion carried. IV. AWARDS, PRESENTATIONS, APPEARANCES 1. None. V. PUBLIC HEARINGS 1. None. VI. OLD BUSINESS 1. Alex's Lawn and Turf, LLC—Conditional Use Permit Amendment Application Page 1 of 4 City of Centerville Planning and Zoning Commission October 2,2018 Administrator Statz addressed the commission on the progress made in negotiating some common ground conditions that could be used in a revised CUP, which are presented in the memo included in the meeting packet. The commission generally found the conditions outlined in the memo to be an appropriate balance between business and resident interests. The Chair then invited the following people to address the commission, regarding the issue: Mr. Peter Beck, Beck Law Office, Legal Representative for Alex's Lawn and Turf, addressed the Commission, stating that they had reviewed the proposed conditions for a revised CUP and that Alex's could agree to some of the conditions, but felt that many of them were too restrictive and would hinder Alex's ability to be a successful business. Mrs. Tammy Bednar, 7068 Cottonwood Court addressed the commission as an informal representative of the neighborhood as a whole. She said, while she was appreciative of some of the items listed in the memo, it seemed as though many of the items discussed with Mr. Statz, at their recent meeting, were left out of the list of proposed conditions. She did not feel that there were enough concessions made to effectively reduce the noise issues. Mr. Alex Shuda, Owner/Operator of Alex's Lawn & Turf, stated that he felt the condition he offered of vacating the lease property to the west of the city's water tower would make a substantial difference in the noise, since there is a lot of activity in that area and it is the closest to the neighborhood. Also, he pointed out that they are willing to purchase the fountains, but would not be able to accept responsibility for their installation or maintenance. Considerable discussion was had about whether or not the existing CUP allows two businesses to operate on the site (Alex's and Yard and Quarry Direct) and whether or not the existing CUP allows retail sales. Motion by Commissioner Haiden, seconded by Commissioner Olson to request legal counsel's opinion on whether the existing Conditional Use Permit allows two businesses to operate out of the site and/or retail sales. All in favor. Motion carried. 2. Bay View Villas —Review of Dock Requirements Administrator Statz explained that representatives from the Bay View Villas development were asked to appear in front of the commission again to review the proposed requirements for docks in their development. At the time they last appeared, and gained approval of a preliminary plat, they had stated there would only be one dock, for day-time tie-up use available to the upland 9 homes. Since that time, their statements at the city council meeting and in their marketing materials has tended to stray from those restrictions. Mr. Jim Boo addressed the commission and asked that they be allowed to have two docks, with two slips each (total of 4 slips) for the upland nine homes to share. Page 2 of 4 City of Centerville Planning and Zoning Commission October 2,2018 A short discussion took place among commissioners with their being general support for this change. Motion by Commissioner Broussard Vickers, seconded by Commissioner Haiden to Recommend Approval of a change to the approved restrictions on docks in the Bay View Villas development to allow two (2) docks, with two (2) slips each (total of 4 slips) to be shared among the upland 9 homes. All in favor. Motion carried. VII. NEW BUSINESS 1. Concept Plan Review—Downtown Block 7—Mr. Nathan Gunn A concept plan for constructing 21 attached townhomes on the city-owned property on Block 7 in the downtown area was presented along with information on anticipated valuation and proposed purchase price. An additional concept was presented showing 30 attached townhomes if the two remaining homes on this block could be acquired. Discussion ensued, regarding the Downtown Master Plan and its guidance towards a French Quarter style architecture and the need for these types of treatements along Centerville Road in addition to streetscaping and needed street improvements on Sorel Street and possibly Goiffon. The commission was not opposed to the overall layout of the proposal, but it lacked detail in terms of architecture. The types of homes shown in the material presented did not appeal to the commissioners for this site, at least not to be fronted on Centerville Road. Being that this was a concept plan presentation, there was no official action taken by the commission. 2. Code Amendment Discussion—Chapter XX Drone Ordinance Due to a lack of time, the commission elected to push this item to a future meeting. VIII. APPROVAL OF MINUTES 1. Minutes were not available at this time IX. Announcements and Updates 1. Council Member Liaison Council member Koski gave a brief update of recent council activity and thanked the commission for their hard work. 2. Watermark Development (Lino Lakes) Administrator Statz gave some information on the timing and construction of the Watermark development in Lino Lakes.
