To: City of Centerville's Mayor,Jeff Paar, Administrator, Mark Statz, The Park&Recreation Committee.
Subject: Resignation Letter
With an apprehensive and sad heart, I'm submitting this resignation letter. I am resigning my position as a member of
the Centerville Park and Recreation Committee as of February 28,2019. I'm leaving for personal reasons only. I've had
thirteen years of great memories. I've met some great people and neighbors I would have never met if not for being on
P&R. I've participated in at minimum 90 percent of meetings and 90 percent of all our activities throughout those
years. My goal over the years with my volunteer hours, in my decision making and my voting as a committee member
was to make Centerville a better City we all want to live in.
Some thoughts. My wife Nancy and I moved to Centerville in January of 2005. 1 meet my new neighbor Suzanne also in
that month. I mentioned to her I wanted to get involved in the City by volunteering in something and she suggested
P&R. My application was accepted and approved by the City Council at their February 2005 meeting. My first meeting
with P&R was the March 2005. During those years we talked, laughed, mourned,researched,and discussed many
things and ideas. Also, listened,questioned and received input from City staff,County staff and the public. Over the
years P&R has made many recommendations to City council for passage of our activities and expenditures. Most of
them without much of a yearly budget. Most additions to our Parks and Trails have been from government grants,
non-profit contributions or loans. Some from our own fundraising.
Some more thoughts. As a committee,we've tried to involve different segments of our city's population by sponsoring
many kinds of events and making each Park's amenities a little different. Our events have been memorable for those
who participated in them. Some committee ideas worked well and are now annual events. Some of our current annual
events:Skate Nights/Hay Rides, Park Clean-up days, Music-In-The-Park concerts,5K/8K Runs/(Skate-only two years)
and Movies-in-The-Park
And a few more thoughts. Over those thirteen years, major changes and additions to the City have been due to
countless hours of planning by P&R,City and County Staffs and others. One major addition is Trails and Sidewalks.
Amen to the trails that that completed a circle around Centerville Lake(no more riding/walking on the dirt shoulder of
a two-lane road). Trails have provided a huge impact to the health and wellbeing of those who use them. Another big
one,the City's purchase of the old St. Paul Waterworks caretaker property and converting it into a very nice Hidden
Spring Park. P&R had an opportunity and had major input to what we thought the theme and layout of the Park should
be. Other additions to City parks;a skateboard park, new children's playground, purchase of our own sound
equipment, new playground equipment,a regulation outdoor volleyball court,a shelter with electricity by the ball
fields,addition of Cornerstone Park, basketball hoops in hockey rink, Lakeside Park,and the latest a children's sliding
hill. Four Eagle Scout projects that I can remember. One of them I've taken on since 2009,over the years by cleaning
out and repairing twenty some Bluebird houses twice a year. Each year we make changes and refine activities. Even
small things like adding s'mores makings to Skate Night.
No more thoughts,just a couple fond P&R activity memories: In 2005 getting to know the parks by participating in Park
Cleanup Day. A P&R fundraiser in 2006,watching all the children and teachers from our grade school walking to
LaMotte Park on a very beautiful spring day to watch in amassment as elephants raise a big circus tent...Our first 5K/8K
Run/Walk postponed due to the morning thunder storm,to a very hot and humid afternoon...Our first Music In The
Park trying to figure out the new sound equipment...Watching Children being amazed as their parents lift them up to
pet Duke&Dan during our winter skate night...On a perfect summer evening listening to great music,enjoying
conversation with my wife and neighbors all while watching as the sun set creating a gorgeous sunset in the clouds.
I could go on and on, but I won't. I've rambled long enough, it's time to close(don't want it to run two pages).
Thank You,Thank you to all Committee Members,City staff both past and present. Time for someone new to
experience it, make their own memories and impact our community. By the end of February, I will have compiled a
thumb drive of all my files and photos over the years and give to City staff. Oh yes,and return the city's laptop.

Thank you for giving me the opportunity to submit this proposal to provide you with lawn care for the
City of Centerville.
The pricing for the city is outlined on the next page.The price will be per application for fertilizing and
broadleaf weed control, as well as crabgrass pre-emergent in the spring.
We will be using both liquid, and granular fertilizer with liquid weed control.The fall application of
granular fertilizer will have a mixture of organic in it. The granular fertilizer will help with sustained
feeding which will help minimize surge growth. Surge growth can lead to increased mowing frequency,
plus weaken the plant and make it vulnerable to disease, insect, and drought problems.
We use stabilized Nitrogen as well as lower salt index potassium sources and micronutrients, in our
liquid application, compared to other companies who do not. The stabilized Nitrogen will help with
reduced flush growth, compared to non-stabilized liquid fertilizer sources.
I have been in business for 14 years(20 years in the industry) servicing both WI and MN. I take pride in

Standard Terms and Conditions
1. I an. I he term of this Agreement shall be three(3)years from the date signed by you,the Customer. I his Agreement shall automatcal I renew for additional one(1)year terms unless canceled in writing by
either party no less than sixty(60)days written notice prior to the end of the then-current term.
2.Price increases.(a)increase in Property Ste.Because the size of your property is a significant factor in determining the cost of TruGreen's services.TruGreen may increase the specified charges
proportionally to reflect any additional costs incurred should you add property under this Agreement.(b)Fuel,Material,and Labor Cost Increases. Because the product,labor,and fuel costs constitute a significant
portion of TruGreen services.TruGreen may increase the price hereunder in the event of a cost increase in any of these areas.Similarly.Trug reen may experience cost increases as a result of other unforeseen
circumstances,including,but not limited to,m changes in government regulation,etc.To offset cost increases based on any of these issues.TruGreen shall provide you thirty(30)day written notice prior to any
such necessary price adjustment,including a statement of the associated reason.If you do not object in writing to the price adjustment within such thirty(30)day period,the Agreement shall continue thereafter at
the adjusted price.If you object you and TruGreen will enter into a ten day good-faith negotiation period. If a mutual Iyacceptable solution cannot be reached during such ten-day period,either partlymay
terminate this Agreement upon thirty(30)days written notice.(c)Annual Price Increases.TruGreen may elect to in crease the price of services under this Agreement after the first year or after any subsequent
anniversary date of the Agreement by a percentage amount not to exceed five percent 5%of the then current price,or consistent with any increase in the current consumer price index,whichever is greater.With
the exception of increases as described in subparagraphs(a)and(b)of this parag mph 2.TruGreen shall not increase its prices on an elective basis more frequently than once during any Agreement year.
3. Payment Terms.Payment is due to TruGreen within 30 days after the invoice date. In the event you fail to make payment when due.TruGreen reserves the right to terminate this Agreement.A late service fee
equal to the lesser of 1.5%per month(18%a.p.r.)or the maximum interest rate allowed by IawwilI be charged on any balance unpaid over thirty(30)days.A service charge of$25.00 will be charged for any
returned check.Should it become necessary to bring an action to collect amounts due under this agreement,you agree to pay all costs of such collection including,but not limited to,any reasonable outside
counsel,in-house counsel,paralegal or other professional fees and court costs.
4.Check processing policy ACH.When you provide a check as payment,you authorize TruGreen either to use information from your check to make a one-time electronic fund transfer from your account or to
process the payment as a check transaction.If TruGreen uses information from your check to make an electronic fund transfer,funds maybe withdrawn from your account as soon as the same daywe receive
your payment,and you will not receive your check back from your financial institution.Returns: in the event that your payment is returned unpaid,you authorize us the option to collect a fee as allowed by lawn
through an electronic fund transfer from you account.
5.Termination.In the case of your non-payment of default.TruGreen has the right to terminate this Agreement immediately upon notice to you.You may cancel this Agreement for material breach by TruGreen
provided that TruGreen is provided written notice by you of the details of the breach,and thereafter fails to cure the breach within thirty(30)days after said notice.Additional termination provisions for landscape
companies,property management companies,agents and other similar entities.To the extent you represent one or more property owners and/or properties covered under this agreement,and in the event such
owner terminates your contract with you.To the extent that this Agreement applies to other properties,not terminated by the owner,this Agreement shall continue in full force and effect with regardto such other
properties.
6.Sale of Property.You agree to notify TruGreen in writing immediately in the event that you sell any property which is the subject of this Agreement TruGreen shall make the appropriate adjustment in price to
accommodate the reduction of square footage treated in the event that property is sold.In the event all property which is the subject of the Agreement is sold,this Agreement shall be terminated upon receipt by
TruGreen of your written notice that you have sold the property.
7. LIABILITY.TRUGREEN IS RESPONSIBLE FOR DIRECT DAMAGES RESULTING FROM ITS NEGLIGENCE BUT IS NOT RESPONSIBLE FOR ANY INDIRECT,INCIDENTAL,CONSEQUENTIAL,PUNTIVIE,
OR SPECIAL DAMAGES ARISING OR RESULTING FROM THE PERFORMANCE OR NONPERFORMANCE OF ANY OBLIGATIONS UNDER THE AGREEMENT INCLUDING,BUT NOT LIMITED TO,LOSS OF
PROFITS OR INCOME,REGARDLESS OF THE BASIS FOR THE CLAIM.
8.Dutyto inspect.You have a duty to inspect the property within fifteen(15)days after service has been performed by TruGreen,if you believe TruGreen provided deficient work,you agree to notify TruGreen
immediately in writing,. Ifwritten notice is not received by TruGreen within fifteen(15)days after the date of service,you agree that any and all claims alleging damage of any nature or to recover past payments
and/or rights to withhold future payments due under this Agreement are waived.
9. Notice to tenants,employees,invitees.To the extent necessary,you have a duty to notify all tenants,employees,visitors and any other invitee on the premises of a scheduled service prior to the performance of
anyscheduled service by TruGreen.
10. No Warranties.Except as expresslyset forth in this Agreement.TruGreen makes no warranty or representation of anykind,expressed or implied,concerning either products used or services performed,
including no implied warranty of m erchantability ore fitness of the product for any particular purpose and no such warranty shall be implied by law,usage of trade,course of performance,course of dealing,or on
any other basis.
11. Force majeure.Except for the payment of TruGreen's invoices owned byyou.If either TruGreen or you shall be prevented or delayed in the performance of anyor all of the provisions of this Agreement,by
reason of anylabor dispute,industry disturbance,delay in transportation,governmental,regulatory or legal action,act of God or anycause beyond such party's control,the obligations hereunder of such party shall
be extended for as long as such cause shall be in effect and any delayor loss suffered bythe other party shall not be chargeable in anywayto such party,provided,however,the other party suffering such cause
shall immediately notify the other party of such inability and shall use reasonable efforts to rem edy sam a with all reasonable dispatch. If any event of force m ajeu re should prevent a party from performing its
obligations under this Agreement for a period of ninety consecutive(90)days,the other party shall have the right to cancel the Agreement upon notice to the party unable to perform its obligations.
12. No assignment.You shall not have the right to assign this Agreement or agree to the transfer of this Agreement byoperation oflaw or otherwise without the prior written consent of TruGreen.This Agreement
shall be binding upon,and shall inure to the benefit of,the parties hereto and to anypermitted successors and assigns.
13.Watering Cultural Practices.The success of this program depends on proper watering,mowing and cultural practices.Some products used by TruGreen may include label directions requiring the watering of
the material after application. If any of these products are used on the property.TruGreen will provide you with watering instructions following the application and you agree to assume such watering responsibility.
Climate conditions,soil conditions,plant diseases,plant material,and miscellaneous external factorswill impact response to treatment. Results for difficult-to-control diseases will vary depending on environment,
culture and agronomic programs used or treatment applied.Treatment for diseases may include additional cost.Consult your TruGreen specialist for details.
14. Modification of program.This program consists of lawn care and/or tree and shrub care as indicated above.Specific products,rates of application and method of application will varywith the season,weather
conditions,and the needs ofyour lawn as determined byyour TruGreen specialist.Your regularly scheduled programs maybe modified depending on the weather and the condition of your landscape.The
application methods and procedures used to perform service under this Agreement will be determined solely by TruGreen.Your TruGreen specialist will keep you informed on any modifications to this schedule.
15. Insects and Borers.Total insect elimination is not desirable with any program because beneficial insects will be lost along with the targeted pest.Plants invaded by borers have a high probability of death or
decline.Sound cultural practices and control applications may extend the life of some plant species.Treatment for boring insects may include additional cost.Consult your TruGreen specialist with details.
16.Authorization to provide service.TruGreen agrees to furnish labor and materials for purposes of this Agreement and is authorized by you to treat the property at the address shown above.You represent and
warrant to TruGreen that you are the owner of said property,or in the event that you are not the owner of the property to which this Agreement applies,you represent and warrant that you have the legal authority to
execute and bind the owner of the property to the terms and conditions of this Agreement.
17. MANDATORY ARBITRATION.Any claim,dispute or controversy,regarding any contract,tort,statute,or otherwise("Claim"),arising out of relating to this agreement or the relationships among the parties
hereto shall be resolved byone arbitrator through binding arbitration administered bythe American Arbitration Association("MAAK),under the AAA Commercial or Consumer,as applicable. Rules in effect at the
tine the Claim is filed("AAA Rules").Copies of the AAA Rules and forms can be located at www.adr.org or by calling 1-800-778-7879.The arbitrator's decision shall be final,binding,and non-appealable.
Judgment upon the award maybe entered and enforced in any court having jurisdiction.This clause is made pursuant to a transaction involving interstate commerce and shall be governed by the Federal
Arbitration act.Neither party shall sue the other party other than as provided herein or for enforcement of the clause of the arbitrator's award;any such suit maybe brought only in Federal District Court for the
District or,if any such court lacks jurisdiction,in any state court that has jurisdiction.The arbitrator,and not any federal,state,or local court,shall have exclusive authority to resolve any dispute relating to the
interpretation,applicability,unconscionability,arbitrability,enforceability or formation of this Agreement including any clam that all or any part of the Agreement is void or voidable.However,thepreceding sentence
shall not apply to the clause entitled"Class Action Waiver."
18.CLASS ACTION WAIVER.Any claim must be brought in the parties'individual capacity,and not as a plaintiff or class member in any purported class,collective,representative,multiple plaintiffs,or similar
proceeding("Class Action").The parties expresslywaive any ability to maintain any Class Action in any forum.The arbitrator shall not have authority to combine or aggregate sim ilar claims or conduct any Class
Acton nor make an award to any person or entity not a party to the arbitration.Any claim that all or part of the Class Action Waiver is unenforceable,unconscionable,void,or voidable maybe determined only by
court of competentjurisdiction and not by an arbitrator.THE PARTIES UNDERSTAND THAT THEY WOULD HAVE HAD A RIGHT TO LITIGATE THROUGH A COURT,TO HAVE A JUDGE OR JURY DECIDE
THEIR CASE AND TO BE PARTY TO A CLASS OR REPRESENTATIVE ACTION,HOWEVER,THEY UNDERSTAND AND CHOOSE TO HAVE ANY CLAIMS DECIDED INDIVIDUALLY,THROUGH
ARBITRATION.
19. Unless expressly noted otherwise herein,this Agreement and any invoice issued by TruGreen pursuant to the terms hereof,set forth the entire understanding of the parties,and supersede any and all
proposals,negotiations,representations and prior agreements relating to the subject matter of this Agreement,written or otherwise,including,without limitation any sales agreement previously executed by the
parties.To the extent that any terms set forth in an invoice should conflict with the terms set forth in this Agreement,this Agreement shall control. No terms,conditions or warranties other than those stated herein
or in any invoice issued by TruGreen,and no agreements or understanding,oral or written,in anyway purporting to modify these conditions shall be binding on the parties hereto unless hereafter made in writing
and signed by authorized representatives of both parties.
20.This customer service Agreement is only valid if accepted by you within 30 days of the date submitted to customer.

Decertification of Tax Increment Financing (TIF) District 1-7
BACKGROUND AND SUPPLEMENTAL INFORMATION:
Staff is proposing that the City Council decertify TIF District 1-7. The District was established on January 2,
2013 and no activity has taken place to date. The district has not incurred any expenditures that are allowed to
be repaid with TIF within five years of its establishment. That means that the district will not be able to fully
reimburse any qualified expenses on the property that may be incurred prior to its mandatory decertification
date of. Any development that requires TIF on these parcels would be better served through establishment of a
new district according to Northland Securities, the city's financial advisor.

A RESOLUTION DECERTIFYING
TAX INCREMENT FINANCING DISTRICT NO. 1-7
OF THE CITY OF CENTERVILLE
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CENTERVILLE, MINNESOTA
WHEREAS, on January 2, 2013, the City of Centerville (the "City") established its Tax Increment Financing
Redevelopment District No. 1-7 (the "District"); and
WHEREAS,Minnesota Statutes, Section 469.174 to 469.179 (the "TIF Act") authorizes the City Council to
decertify a tax increment financing district on any date after all the bonds and other obligations have been
satisfied; and
WHEREAS,the City desires by this resolution to decertify the District effective December 31, 2019, by which
all taxing jurisdictions will benefit from an increased tax base effective for taxes payable in 2020; and
WHEREAS,the City Council acknowledges such action will be taken by Anoka County to decertify the
District as a tax increment district and to no longer remit tax increment from the District to the City after
December 31, 2019.
NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Centerville that:
1. The City Administrator is authorized and directed to provide Anoka County with documents
related to decertification of the District, to submit the Confirmation of Decertified TIF
District form to the Office of the State Auditor and take any other steps required for
decertification by December 31, 2019.
2. The City Administrator is authorized and directed to determine the amount of excess tax
increment in the account for the District and to return all excess tax increment to Anoka
County for redistribution to other taxing jurisdictions within nine months after the end of the
year.

Election to Not Waive Statutory Tort Limits
BACKGROUND AND SUPPLEMENTAL INFORMATION:
Each year, the League of Minnesota Cities Insurance Trust (LMCIT) asks City Councils, as part of the
insurance contract renewal to decide if they want to waive the Minnesota State statutory liability limits. Those
limits are $500,000 for an individual claimant and $1,500,000 for all claimants for a single incident. If liability
limits are waived, then the liability limit goes up to $2,000,000 per claimant and per incident. Staff is proposing
that the City Council elect to not waive the liability limits,just as it has in the past. The waiver form is attached
for your review.

The decision to waive or not waive the statutory tort limits must be made annually by the
member's governing body, in consultation with its attorney if necessary.
Members who obtain liability coverage from LMCIT must decide whether to waive the statutory tort liability limits
to the extent of the coverage purchased. The decision has the following effects:
• If the member does not waive the statutory tort limits, an individual claimant could recover no more than
$500,000 on any claim to which the statutory tort limits apply. The total all claimants could recover for a single
occurrence to which the statutory tort limits apply would be limited to $1,500,000. These statutory tort limits
would apply regardless of whether the member purchases the optional LMCIT excess liability coverage.
• If the member waives the statutory tort limits and does not purchase excess liability coverage, a single claimant
could recover up to $2,000,000 for a single occurrence(under the waive option,the tort cap liability limits are
only waived to the extent of the member's liability coverage limits, and the LMCIT per occurrence limit is
$2,000,000). The total all claimants could recover for a single occurrence to which the statutory tort limits apply
would also be limited to $2,000,000,regardless of the number of claimants.
• If the member waives the statutory tort limits and purchases excess liability coverage, a single claimant could
potentially recover an amount up to the limit of the coverage purchased. The total all claimants could recover for
a single occurrence to which the statutory tort limits apply would also be limited to the amount of coverage
purchased,regardless of the number of claimants.
Claims to which the statutory municipal tort limits do not apply are not affected by this decision.

for an Interim Use Permit, paid associated fees and presented a letter of support from
United Properties who holds a standing purchase agreement on the property.
Ms. Bender stated that in the packet, Administrator Statz recapped the meeting with Mr.
Rehbein which lists requirements that were discussed. Ms. Bender stated that the same list
is incorporated in the presented Findings of Fact and Draft Interim Use Permit contained in
the packet.
Mr. Rehbein was present and stated that he concurred with the Findings and was agreeable
to the Draft Interim Use Permit.
The Commission questioned whether noise complaints had been received, if there were
difficulties with the current operation or enforcement issues. Ms. Bender stated that no
noise complaints had been received, have had issues with street sweeping and
miscommunication regarding a No Rise Certificate in the past. Ms. Bender stated that Mr.
Matt Rehbein has been responsive to calls and requests. The Commission also questioned
accounting and oversite of hauling records. Mr. Rehbein stated that data has been kept on
their end, reconciled monthly and forwarded to the City for review. Mr. Rehbein
questioned Ms. Bender whether there have been problems/inaccuracies in the past and Ms.
Bender replied no.
Mr. Nick Arnt, Arnt Construction, stated that the Rehbein's and United Properties desired
to improve the site to become "pad ready" for two (2) building sites. He stated that this
would allow for more desirable sites as the construction timeframe would be shortened
along with making marketing easier.
Discussion ensued regarding equipment availability for street sweeping. Mr. Rehbein
stated that he has equipment available along with Mr. Arnt stating that he has two (2) street
sweepers depending upon availability.
Commissioner Broussard Vickers, seconded by Commissioner Haiden to Close the
Public Hearing at 6:40 p.m. All in favor. Motion carried.
VI. OLD BUSINESS
1. Old Mill Estates—Preliminary Plat Revision/Amendment
City Clerk Bender stated that Mr. Todd Christensen has requested that the Planning &
Zoning Commission and City Council consider the removal of Phase III of the originally
submitted Preliminary Plat. Mr. Christensen has stated that Phase III would have required a
very large amount of wetland fill and if contained in the original plat, the project would not
have moved forward in 2019.

Rehbein's Black Dirt Interim Use Permit Application
1. On January 8, 2014 the City Council (see attached minutes)issued an Interim Use
Permit for said properties (PIN 424-31-22-32-0002 & 24-31-22-32-0003) (see
attached)which expired on December 31, 2018. However, that permit allowed until
December 31, 2019 for "...all excess material remaining on the site [to] he hauled
away and or leveled and the site graded and seeded to prevent erosion, in
conformance with law."
2. On January 4, 2019, Rehbein's Black Dirt submitted an application for an Interim
Use Permit to operate a Black Dirt Mining and Processing Business at property along
21st Avenue, in Centerville defined as PID4s R24-31-22-32-0003 and R24-31-22-32-
0002. Attached to that application was a letter of support from United Properties
who, under separate agreement with Mr. Gerald Rehbein, holds options on purchasing
the property for future development. Also attached was a list of preliminary
conditions for a draft Interim Use Permit. These draft conditions were generally
acceptable to both the applicant and city staff.
3. On January 9, 2019 the City forwarded correspondence to the applicant, stating that
the application was deemed complete and a public hearing would be scheduled for
February 5, 2019 before the Planning & Zoning Commission.
4. The Planning Commission held a public hearing on February 5, 2019 to take public
comment on the proposed NP.
5. The public hearing was properly noticed, through mailings and publication.
6. The 60-day review period will end on March 3, 2019. The city granted a 60-day
extension of that review period, such that the review period now ends on May 4,
2019.
7. The properties are zoned I-1 (Industrial).
8. The proposed use may be operated in the I-1 Zoning District subject to an Interim
Use Permit with reasonable conditions.
9. The proposed use is not inconsistent with the Comprehensive Plan if allowed on a
temporary basis until the planned use of the property is executed by United Properties
or December 31, 2020 whichever is earlier.

ANOKA COUNTY, MINNESOTA
INTERIM USE PERMIT
1. Permit. Subject to the terms and conditions set forth herein, the City of Centerville hereby
grants approval of an interim use permit for:
Rehbein Properties, DBA Rehbein's Black Dirt, to operate a topsoil processing business
at the properties described below, subject the conditions of this permit.
2. Property. The permit is for the following described property:
PID-'s: 24-31-22-32-0002&24-31-22-32-0003
This permit only applies to those areas south of Clearwater Creek on the above parcels.
3. Conditions. This permit is issued subject to the following conditions:
a) Definitions:
1. Topsoil — Earthen material meeting the requirement of the Minnesota
Department of Transportation's 2016 Standard Specification, Section 3877.
b) All topsoil processing activities, including stockpiling of topsoil shall be conducted
entirely within the easterly 680 feet of the property south of Clearwater Creek (approx.
13 acres—Area A on Exhibit A), and shall not encroach within fifty(50) feet of the top of
the bank of Clearwater Creek within the area described above.
c) Mining/stripping of topsoil and backfill of the mined/stripped area with existing, on-site
material shall be allowed on the entire property described and included in this permit
(Areas A & B on Exhibit A). These operations may not encroach within ten (10) feet of
the top of the bank of Clearwater Creek.
d) No more than ten (10) acres of land outside of the area described in condition "b" from
above, may be disturbed and without vegetative cover at any given time.
e) Existing green strip along Clearwater Creek shall not be disturbed.
f) Operating hours shall be limited to 7:00 a.m. to 6:00 p.m. Monday through Friday and
7:00 a.m. to 6:00 p.m. Saturday.
g) Permittee shall endeavor to limit speed of trucks entering or leaving the site to 25 miles
per hour.
h) The following erosion and sediment control measures shall be followed:

1. Maintain double row of silt fence around perimeter of site while there is exposed
soil. Fences shall be maintained through the duration of this permit in
accordance with MPCA best practices.
2. Maintain 50' buffer to top bank of Clearwater Creek for stockpiling and black dirt
processing operation.
3. Maintain 10' buffer to top bank of Clearwater Creek for mining/stripping
operation.
4. Limit the slopes on stockpiles to a 3:1 ratio
5. Maintain a rock construction entrance per approved city detail plates at the
entrance to the site and keep the drive and adjoining street free of mud and dirt.
Upon notice by the city of excessive accumulation of dirt or mud in the street,
Permittee shall clean and\or sweep within four hours. A pick-up style sweeper
shall be used for all street cleaning activities. Sidewinder style brooms shall not
be allowed.
6. An administrative fine of$500 per day shall be levied for uncorrected violations
of the above conditions. The fine shall be levied per day, per condition violated.
i) No fuels or chemicals shall be stored on the site, unless contained in a building.
j) Maximum noise emitted at the property line shall conform to the noise regulations
contained in City Code Section 91.09 and applicant shall not violate other nuisance
regulations contained in Chapter 91.
k) The maximum height of all piles shall be limited to 50 feet above the natural grade of
the site. Materials allowed to be brought to the site shall only be topsoil materials (as
defined above). Upon request, the permittee shall present the city with soil test results
demonstrating that imported soil meets this criteria. Up to 5,000 cubic yards (Loose
Volume) of non-topsoil material for the exclusive use of amending the topsoil material
for sale shall be allowed on the site at any given time during the term of this permit. No
broken concrete or asphalt material is permitted.
1) Ingress and egress shall be limited to 21s'Avenue. Hauling on Commerce Drive and
Fairview Street in conjunction with this permit, is not allowed.
m) Permittee shall supply a monthly accounting of all material hauled in to the site and
hauled off the site. This accounting of material hauled from the site shall be in the form
of a log of loads hauled out each day and documenting the quantity of material in each
load together with copies of truck load tickets and/or bills of sale.
1. Recognizing the impact on adjoining streets and in recognition of administrative
and other costs of monitoring this permit the following fees shall be paid by the
operator: For loads of topsoil material hauled from the site, $0.25 per cubic
yard, to be paid monthly.
2. For loads of existing non-topsoil material hauled from the site, $0.10 per cubic
yard, to be paid monthly.
n) Landowner and the business operator shall jointly and individually be responsible for
the continuing conformance with the permit and that if the proposed use is not initiated
within six months of this date, the permit shall be void.
o) Grantee will follow the applicable standards and requirements of the City of Centerville,
Rice Creek Watershed District, Anoka County, Army Corp of Engineers, FEMA,

Minnesota Department of Natural Resources, Minnesota Pollution Control Agency
(MPCA) and any other agency having jurisdiction over the property and shall secure and
file with the City, copies of any permits required by outside agencies. Grantee will
secure necessary permits and follow the applicable rules and regulations of Minnesota
Pollution Control Agency and EPA for collection, storage and disposal of solids, liquids
and gases. Grantee will file with the City within ten days of receipt, copies of any
permits and/or notice of enforcement actions by these agencies.
p) Grantee will permit a City Inspector to view the premises, including the inside of
buildings, during normal business hours.
q) No fill may be placed in the FEMA designated floodway or floodfringe. The City reserves
the right to annually review this permit for compliance with the conditions and may
impose additional conditions to mitigate unforeseen problems.
r) Portable toilets shall be provided and serviced regularly at all times during site
operations and shall be screened from visibility by neighboring properties.
4. This permit shall be effective April 1, 2019, and shall expire at December 31, 2020. Not
later than December 31, 2019, all excess non-topsoil material remaining on the site shall
be hauled away and/or leveled and the site graded and seeded to prevent erosion, in
conformance with law. Not later than December 31, 2020, all topsoil and other material
shall be removed from the site or graded (leveled) in a manner consistent with a pad-ready
building site. Not later than December 31, 2020, all equipment shall be removed from the
site.
5. Criminal Penalty. Violation of the terms of this permit is a criminal misdemeanor.

Block 7 Property
One of the previously interested parties for the Block 7 property has re-engaged in
conversations with city staff and our realtor. They are developing a concept plan for the
site and intend to submit it for review at an upcoming meeting.
General Downtown Redevelopment Interest
City staff met with a prospective business owner who was looking at opening a bakery in
the downtown. They were interested in the Vincenzio's Catering site for a remodel
opportunity. We also discussed the smaller parcels along Main Street, near the school as
possibilities for new construction if the remodeling opportunity does not work out. Staff
also directed them to assistance through Open to Business and the Chamber of
Commerce.
Commerce Drive Property
Negotiations on the possible purchase of the Commerce Drive site by Midwest Best
Water continue. City staff is working to address questions from the Planning and Zoning
Commission on various zoning scenarios for this site and others on the 20th Ave.
Corridor.

City staff has corresponded with Kelly's, asking them to work towards compliance with
our sign ordinances, particularly related to the temporary signage on the north face of
their building.
STORMWATER/WETLAND
Centerviile/Peltier Lake TMDL
The TMDLs for these lakes were completed 15+years ago and have never had the final
step of an Implementation Plan completed and approved by the MPGA. This final step is
now in progress and should unlock important funding for projects that actually work to
reduce the pollutants identified in the TMDL study. Staff is working with Rice Creek
Watershed District Staff on the logistics of this process.
SEWER AND WATER
Wellhead Protection Plan
Part I of our Wellhead Protection Plan has now been approved! We are working with
our engineering consultant to move into Part 2 of the plan.

As a potential participant in the Hazard Mitigation Assistance Program, the City of Centerville,
Minnesota hereby states its interest in participating in the multi jurisdictional Anoka County All-
Hazard Mitigation Plan.
After FEMA funding approval and during the planning implementation, the City of Centerville,
Minnesota agrees to participate in the hazard mitigation planning process.
As signed, we understand this is a voluntary program and our participation may benefit our
