Dear Chair and Commissioners:
For several months now, the Planning and Zoning Commission has been presented with a
number of various zoning issues along 20th Avenue, south of Main Street. This corridor
seems to have a propensity to attract good businesses that fit their respective sites, but
don't jive with the zoning district assigned to their parcel. Staff has presented a few
different options for addressing these concerns but has yet to find a clear and
comprehensive path forward that the commission can get behind. With the goal of doing
just that, city staff met with our attorney and planning consultant to conduct a 20th
Avenue zoning summit, if you will.
A recap of some of the issues, along with the proposed changes to address each, is
presented below. The numbers correspond to the attached map:
1. Mini Storage
Issue: A concept plan for a mini-storage facility at 6965 20th Ave. was shown to
the Planning and Zoning Commission. There was mixed opinion on whether or
not a rezoning of the property was appropriate to allow the use, given the context
of the surrounding properties. However, there seemed to be consensus that the
use seemed appropriate for the site. This leads to the question of whether mini-
storage could become an allowed use under the B-1 district. The main hesitation
for this change was that mini-storage was not a desirable use along Main Street
(where there is also B-1 zoning). Given the mixed opinion on a rezone and the
hesitance to allow mini-storage in B-1, the developer did not submit a formal
application.
Proposed Change: Add mini-storage as a Conditional Use in the B-1 District.
Add a B-2 District, along Main Street, which does not allow mini-storage.
2. Midwest Best Water
Issue: A potential buyer for the city's remaining lot in the Commerce Drive
business park has proposed the construction of a 25,000 sf building at 2021
Commerce Drive. Their proposed use would best fit the listed industrial uses
"assembly" and "Warehouse/Distribution". However, the site is zoned B-1,
where these uses are not listed. MidWest Best Water intends to fill 15,000 sf of
the building, while renting out two 5,000 sf bays. They feel that their best
opportunity to find tenants will be in the Industrial sector. Therefore, being in the
B-1 district would put them at a disadvantage from that perspective.
Proposed Change: Rezone the potential MidWest Best Water property to I-1.
3. Ruffridge-Johnson
Issue: Ruffridge-Johnson, who is much more industrial than MidWest Best
Water, was just allowed in the B-1 under"motorized equipment sales and
service". However, their use, employs outdoor storage, heavy equipment, and the
like, which are characteristics of an industrial use.
Proposed Change: Rezone the Ruffridge-Johnson site to I-1. Add Motorized
Equipment Sales and Service as a Conditional Use in the I-1 District.
4. Ready Landscaping
Issue: Ready Landscaping's building has a few suites which are built-out and
ready for rental to various industrial uses. One of their tenants is a company that
installs swimming pools and uses the space as a small office and for storage of
small items to support their installation crews. The business also sells other
recreational equipment, including pool tables and recently put up some signage,
indicating that these items could be purchased at their location in Ready
Landscpaing's building. However, retail sales is not an allowed use in the I-1
district. Therefore, the city asked to have any signage indicating a retail location
taken down. Ready Landscaping, and their tenant complied.
Proposed Change: Allow limited retail sales in the I-1 district with restrictions to
avoid high traffic retail such as convenience stores, restaurants, and other similar
uses.
5. Alex's Landscaping
Issue: Without getting into the various issues surrounding Alex's Conditional
Use Permit, the situation here has made it apparent that outside sales and storage
yards in the B-1 district can be problematic, given the lower buffer standards as
compared to those in the I-1 district.
Proposed Change: Restrict building supply and storage yards in the Business
districts to indoor-only, such as those seen at some of the big-box retailers. Allow
outdoor sales and storage yards in the Industrial district.
6. Cultural Center
Issue: City staff fielded an inquiry for a cultural center along Main Street. The
term Cultural Center is not on our table of uses, but does appear in our code.
However the language in the code only allows them in the P-1 district(Public). It
seems that this use would be appropriate in a Business district.
Proposed Change: Allow Cultural Centers in the Business districts.
7. Assisted Living
Issue: City staff fielded an inquiry regarding an Assisted Living facility on Main
Street, in the B-1 district. The term Assisted Living does not appear in our code.
Similar uses, allowed in the B-1 district as a Conditional Use are "Nursing
Homes" and "Specialized Care Facilities".
Proposed Change: Add"Assisted Living Facility"to the list of uses allowed in
the Business Districts.
The following is a summary of the proposed changes. If the Planning and Zoning
Commission agreed with these changes, or a clearly modified version of these changes,it
would be appropriate for staff to properly notice a public hearing to take input, from the
public, on any comprehensive plan amendments, code amendments and rezonings
necessary to implement these changes.
Summary
• Rezone the Commerce Drive Business Park to I-l.
• Add a B-2 (Main Street Commercial)
o As compared to B-1, B-2 would NOT allow
0 Mini-Storage
■ Car or other outdoor sales lots
■ Automotive or equipment service
■ Building Supply sales or storage yards (except indoors)
■ Unmanned, stand-alone car washes
• Add Mini-Storage as a Conditional Use to B-1
• Add Cultural Centers and Assisted Living Facilities to the list of uses in B-1 and
B-2.
• Other changes as shown on the attached draft of a revised Allowed Uses table.
City staff will be on hand to discuss these proposed changes at the upcoming Planning
and Zoning Commission meeting.

Pursuant to due call and notice thereof, the Planning and Zoning Commission held its regular
meeting on Tuesday, February 5, 2019 at 6:30 p.m.

L CALL TO ORDER. The meeting was called to order at 6:30 p.m. by Chairperson
Mosher.

Motion by Commissioner Broussard Vickers, seconded by Commissioner Haiden to
Approve the Agenda as presented. All in favor. Motion carried.

V. PUBLIC HEARINGS
1. Interim Use Permit—Rehbein's Black Dirt
Motion by Commissioner Broussard Vickers, seconded by Commissioner Haiden to
Open the Public Hearing at 6:32 p.m. All in favor. Motion carried.
City Clerk Bender stated that upon the expiration (December 31, 2018) of the existing IUP
issued to Rehbein's Black Dirt on February 1, 2014 Administrator Statz met with Mr. Matt
Rehbein to discuss the completion of the operation or an extension/new request for an NP.
Mr. Rehbein's desire was to continue operations on the site, he submitted an application

for an Interim Use Permit, paid associated fees and presented a letter of support from
United Properties who holds a standing purchase agreement on the property.
Ms. Bender stated that in the packet, Administrator Statz recapped the meeting with Mr.
Rehbein which lists requirements that were discussed. Ms. Bender stated that the same list
is incorporated in the presented Findings of Fact and Draft Interim Use Permit contained in
the packet.
Mr. Rehbein was present and stated that he concurred with the Findings and was agreeable
to the Draft Interim Use Permit.
The Commission questioned whether noise complaints had been received, if there were
difficulties with the current operation or enforcement issues. Ms. Bender stated that no
noise complaints had been received, have had issues with street sweeping and
miscommunication regarding a No Rise Certificate in the past. Ms. Bender stated that Mr.
Matt Rehbein has been responsive to calls and requests. The Commission also questioned
accounting and oversite of hauling records. Mr. Rehbein stated that data has been kept on
their end, reconciled monthly and forwarded to the City for review. Mr. Rehbein
questioned Ms. Bender whether there have been problems/inaccuracies in the past and Ms.
Bender replied no.
Mr. Nick Arnt, Arnt Construction, stated that the Rehbein's and United Properties desired
to improve the site to become "pad ready" for two (2) building sites. He stated that this
would allow for more desirable sites as the construction timeframe would be shortened
along with making marketing easier.
Discussion ensued regarding equipment availability for street sweeping. Mr. Rehbein
stated that he has equipment available along with Mr. Arnt stating that he has two (2) street
sweepers depending upon availability.
Commissioner Broussard Vickers, seconded by Commissioner Haiden to Close the
Public Hearing at 6:40 p.m. All in favor. Motion carried.
VI. OLD BUSINESS
1. Old Mill Estates —Preliminary Plat Revision/Amendment
City Clerk Bender stated that Mr. Todd Christensen has requested that the Planning &
Zoning Commission and City Council consider the removal of Phase III of the originally
submitted Preliminary Plat. Mr. Christensen has stated that Phase III would have required a
very large amount of wetland fill and if contained in the original plat, the project would not
have moved forward in 2019.
Motion by Commissioner Broussard Vickers, seconded by Commissioner Twohy to
Approve the Revised Preliminary Plat with all Conditions Contained in the Original
Preliminary Plat Approval Except for Condition #2 (pertaining to the easterly lots) (P
& Z Minutes 7/31/2018). All in favor. Motion carried.

2. Bay View Villas —Planned Unit Development/Conditional Use Permit(PUD/CUP)
Revision/Amendment
Ms. Bender stated that City Attorney Glaser has submitted a recommendation for action
regarding the previously approved PUD for CUP associated with Bay View Villas. She
stated that a recent meeting between staff, Mr. Tom Budzynski (TJB Homes), Mr. Jim Boo
and Mr. Rich DeFoe had taken place and the Attorney's recommendation stems from those
discussions to allow lap pools and hot tubs to be installed on a patio or underneath decks of
the homes within the development. City Attorney Glaser along with the Developer agreed
that safety fencing would be allowed around the pool or hot tub rather than the perimeter of
the lot reducing clutter or adverse sightlines on the smaller lots. He further stated that the
Homeowner's Association would restrict the height of safety fencing around these "lap
pools" or"hot tubs" to be 4 feet and regulate the type and styles of these fences.
Mr. Rich DeFoe, 7265 Main Street, stated that he intended on purchasing a lot within the
Bay View Villas development and desired to have a full sized pool. He stated that at the
time of the above meeting he misunderstood the definition of water-oriented accessory
structures and accessory structures. He did not realize that he would not be allowed to
install a full sized pool with required fencing.
Ms. Bender contacted City Attorney Glaser via telephone for clarification of language
contained in his recommendation. City Attorney Glaser stated that Mr. DeFoe's current
property and swimming pool are and will be allowed with the develop. However, if Mr.
DeFoe is intending on purchasing a lot within the Bay View Villas development full sized
pools and required fencing would not be allowed by the HOA.
Lengthy discussion was had regarding the timeframe for making a decision on the item.
Mr. DeFoe requested that a decision sooner would be better for all concerned as marketing
of the homes is essential.
Lengthy discussion ensued regarding the possibility of the Commission making
recommendation to Council to approve the recommendations of City Attorney Glaser at
this time and Mr. DeFoe coming back to the Commission at a later date requesting full
sized pools or whether the items should be tabled to formalize the inclusion of full sized
pools.
Motion by Commissioner Broussard Vickers, seconded by Commissioner Haiden to
Table this item Allowing Council to Take Action if Deemed Suitable with the
Inclusion of Swimming Pools. All in favor. Motion carried.
The Commission did desire to acknowledge their support for Mr. DeFoe and the
installation of a full size swimming pool.

VII. NEW BUSINESS
1. Interim Use Permit—Rehbein's Black Dirt
Action was taken on this item following the closed of the public hearing.
Motion by Commissioner Broussard Vickers, seconded by Commissioner Ganzel
Recommend to Council Approval of the presented Interim Use Permit based on the
Findings of Fact and Recommendation of Staff. All in favor. Motion carried.
2. 20' Avenue/Commerce Drive Zoning Discussion
Mr. Phil Carlson stated that Midwest Best Water, Inc. is interested in purchasing 7030 —
20'h Avenue/2061 Commerce Drive to operate their assemble and warehouse operation.
Ms. Bender reported that they have submitted a purchase agreement, it has been discussed
at Council and Council has authorized staff to negotiate a purchase price. She stated that
staff is unaware if an agreeable purchase price has been secured. Mr. Carlson stated that
the property is currently zoned B-1 (Commercial) and does not believe that this business
fits into any Use Category and Use Types for the district. He stated that a more proper
zoning would be I-1 (Industrial). He referred the Commission to his submitted
memorandum and possible recommendations for assisting this company and the City in
long-term zoning strategies.
He explained that the City could rezone the property to I-1 (Industrial) which fits the
assembly and warehousing portion of the business, but it would need to encompass
additional parcels otherwise it could appear to be spot zoning. He stated that rezoning
2065 Commerce Drive would seem appropriate along with the City's parcel south of the
site, the Sheehy parcel and that portion of the Rehbein parcel that is bisected with zoning
of B-1 & Z-1. He also discussed that the Commission has discussed a"Service District" or
may incorporate a new zoning district which would allow for optimum usage along with
marketing trends.
Mr. Carlson's discussion also contained previous discussions regarding mini-storage and
an allowable zoning district other than I-1 (Industrial).
Mr. Carlson stated that it is important to determine the zoning desired by the negotiating
party as the sale of the property could be dependent upon same. However, he also
cautioned the Commission as to a purchasers desire to "have their cake and eat it too". He
stated that the Commission should always consider the reasonableness of the zoning.
Lengthy discussion was had regarding the timing of needed modifications, the required
public hearings if modifications were made for zoning or code modification and the
addition of a new district, whether the use fit existing zoning with a conditional use permit
as being determined as same or similar uses as the existing code.
Council Liaison Koski stated that a Light Industrial zone may be fitting for both this
business and mini-storage and the Commission may desire to look in that direction.

Mr. Carlson stated that a listing of permitted uses, conditional uses and under what
conditions those could be granted would be the perfect world and should be taken under
advisement.
Commissioner Broussard Vickers requested that Staff provide suggested Zoning Districts
and neighboring communities of similar size districts so that the Commission had an
opportunity for review.
Motion by Commissioner Broussard Vickers, seconded by Commissioner Ganzel to
Schedule a Work Session to Discuss Zoning Districts, Use Cate2ory and Use Types
for districts and Reviewing Nei2hborin2 Communities of Similar Size Districts in the
near Future. All in favor. Motion carried.
VIII. APPROVAL OF MINUTES
1. Planning & Zoning Commission January 8, 2019 Meeting Minutes
Chairperson Mosher provided an opportunity for members to make modifications.
Motion by Commissioner Ganzel, seconded by Commissioner Twohy to Approve the
January 8, 2019 meeting minutes as presented. Commissioners Broussard Vickers
and Haiden Abstained. Motion carried.
2. EDA & Planning & Zoning Commission January 16, 2019 Meeting Minutes
The Commission questioned whether there was a need to approve the meeting minutes as
there was a lack of quorum at the meeting.

1. Council Member Liaison
Council Member Koski gave a brief update of recent Council activity. He stated that
several members were sworn into office of Council and new EDA members. He updated
the Commission of Council Liaisons appointed to Committees/Commissions. Council
Member Koski provided information regarding the Fire Steering Committee's concerns
regarding the hiring of Duty Crew individuals for day-time firefighter responders and
ramifications to the Fire District budget/tax levy. He stated that Chief Lundstrom will be
forwarding to Council several recommendations regarding the need for staffing the fire
stations during the day.

Regional Economic
Minnesota Technology Corridor
As an offshoot of ACRED, a group of cities along 35E have been exploring the idea of
creating a"Technology Corridor"in an attempt to leverage our high-speed fiber optic
network(the Zayo network installed about 10 years ago). The idea is to attract data
centers and other Big Data users, in a coordinated marketing effort, touting pad-ready
sites. The group has quarterly meetings set up and is being led by Jaquel Hajder and
folks from both Conexus Energy and Xcel Energy. The Rehbein sites off of Fairview are
being highlighted as part of this initiative.

Economic Development Authority
The EDA meeting for February 20, was cancelled as we await proposals from developers
for the Block 7 project.
Farmers Market
I was able to meet with the event organizer that runs the White Bear Lake"Marketfest".
She was very helpful in explaining the logistics of such an event and what might work for
a scaled down version in Centerville. She will be putting together a proposal for helping
to plan and manage something here. We are initially thinking of a 3-week run of
Thursday evenings in August, between the end of Marketfest and the State Fair. We are
exploring lots of ideas, but may try to start small with a few food trucks and vendors in
Cornerstone Park, to build off the crowd at the Bald Eagle Waterski show.

Block 7 Property
City staff and our realtor are continuing to work with two interested parties as they
prepare more detailed concept plans for the Block 7 property.
General Downtown Redevelopment Interest
City staff made contact with both the owner and realtor for the Old Creamery Apartment
building to let them know about some of the tools the city may be able to offer, should a
buyer be interested in a redevelopment of the property.
City staff met with the ownership of Kelly's and the Sothern Rail to discuss their future
plans and gain input on downtown redevelopment. Also discussed, were their
involvement in Fete des Lacs, and possible participation in a farmers market or similar
events.
Commerce Drive Property
Negotiations on the possible purchase of the Commerce Drive site by Midwest Best
Water continue. The architect for Midwest Best Water is drafting some potential
building facade treatments and hopes to present these to the City Council along with their
counter offer.
20' Avenue Corridor Zoning
City staff met with the City Attorney and City Planner to discuss a variety of issues
related to zoning conflicts that have come up along 20'h Avenue over the past several
years. The city's real estate agent for the Commerce Drive properties has suggested a
"Service District" and there have been several proposals which have struggled to fit in the
zoning code, despite seeming like appropriate uses for the land.
Out of this meeting will come a staff recommendation for addressing these issues, which
will be brought to the Planning and Zoning Commission for further consideration.
CODE ENFORCEMENT—RESIDENTIAL
General
• A small area of sidewalk snow removal which had been neglected was cleaned up
by city staff to address a citizen complaint. No charges were levied against the
homeowner.
• Several reminder letters were sent out for folks who have zoning violations which
will need to be addressed in the spring.
• A follow-up letter was sent to a homeowner who removed one of the vehicles
from the rear yard as requested in the initial enforcement letter, but has not
removed a large construction trailer or other vehicles to come into compliance.

Ready Landscaping
Ready Landscaping's tenant has taken down all of their signage.
Rehbein Black Dirt
The Rehbein Black Dirt operation off of 21st Ave. was granted an Interim Use Permit by
the City Council at the last meeting, based on a recommendation from the P&Z
commission.
7129 20'Ave.
New outdoor lighting fixtures attached to the building at 7129 20th Ave. have become a
nuisance to area residents. The lights were put up due to safety concerns. City staff
mediated a meeting between the building owner and the residents. The building owner is
going to install hoods on the fixtures and/or lower voltage fixtures and communicate with
the homeowners to make sure they are satisfied with the results. A follow-up date was
set to ensure progress is being made towards a solution.
Kelly's
City staff met with Kelly's ownership on February 21. They have agreed to work out a
plan to reduce their signage to comply with city code. Jeff and Vicki also discussed their
plan to remove the dilapidated garage near the Southern Rail, this summer.
Wholesome Health
A follow-up letter was sent, requesting a response to earlier notices regarding the need
for a sign permit.
Tobacco Shop
The city has received a sign permit application from Ameer's Tobacco Shop. They wish
to replace their existing sign with a new illuminated sign.
