Planning April 2, 2019 TITLE OF ISSUE: Kim Ganzel Resignation BACKGROUND AND SUPPLEMENTAL INFORMATION: Ms. Ganzel has resigned her position on the Planning and Zoning Commission. City Code does not require action from the commission to accept the resignation, but it would be customary to take action to accept the resignation and declare the seat open. The commission could accept applications and conduct interviews, if more than one candidate comes forward. Then, the commission should make a recommendation to the City Council for appointment. The City Council would then need to take formal action to fill the seat. Several actions needed to accomplish the goals discussed require Public Hearings. The site is currently zoned B-1 but the proposed use is not consistent with the commercial nature of B-1 uses. It would be more appropriate for the I-1 District. With this III potential purchase, the City has also looked at the area around this site and proposes rezoning several properties to have them conform more closely to the intent of the Business and Industrial zoning districts. PLANNING ISSUES 11 a Existing Land Use � The proposed site for Midwest Best Water is currently vacant and owned by the City. The adjacent site to the east on Commerce Drive is Ruffridge-Johnson, a company that leases 11 paving and construction equipment. Further east of that is Sheehy Construction. Extending the 1-1 zoning north onto the Proposed Zoniing, Rehbein parcel would have the added benefit of keeping that parcel in one zoning district. Comprehensive Plan Amendment The properties that are proposed for 1-1 zoning are currently guided in the City's 2040 Future Land Use Plan as Commercial.To be consistent with the proposed zoning the Comp Plan should be amended to guide them Industrial, as illustrated below. These include the following changes to uses for the 1-1 Industrial District Table 156-A.1 in the Zoning Code: • "Automobile and motorized equipment sales and service, excluding salvage operations" o Add as "C" (Conditional use) in 1-1 o This use is currently a Conditional use in the B-1 district, but it is not permitted in 1-1, although it is a use that makes sense in the industrial district. • "Building supply sales and storage yards" o Add as "C" in 1-1 o This use is currently a Conditional use in the B-1 district, but it is not permitted in 1-1, although it is a use that makes sense in the industrial district. • "Car washes" o Add as "P" (permitted) in 1-1 o This use is currently a Permitted use in the B-1 district, but it is not permitted in 1-1, although it is a use that makes sense in the industrial district. • "Non-Retail (bulk) Fuel Sales" (a new use) o Add as "C" in 1-1 o This use is currently not listed in the Zoning Code, but it is a use that is allowed in other cities' codes and makes sense in the industrial district. • "Retail sales and service, but excluding adult-oriented businesses, limited to no more than 10%of the building floor area but no more than 5,000 square feet" (a new use) o Add as "C" in 1-1 o The retail sales and service use is currently a Permitted use in the B-1 district, but it is not permitted in 1-1, although it is a use that makes sense in a limited way in the industrial district. We do not want large retail uses in the industrial district creating customer traffic and conflicts with truck traffic, but a limited amount would be acceptable. We suggest inserting a new use in the table, with the restriction in size. Each of the three items needs a public hearing, and each has been duly published in the City's official newspaper and surrounding property owners within 350 feet have been notified at least ten days in advance. 1) We recommend that the Planning & Zoning Commission recommend amending the Comp Plan (Future Land Use Plan), changing the following properties from Commercial to Industrial: a. PID 24-31-22-23-0018 (7030 20t" Avenue) b. PID 24-31-22-23-0017 (Ruffridge-Johnson, 2065 Commerce Drive) c. PID 24-31-22-23-0016 (Sheehy Construction, 7047 21 st Avenue) d. PID 24-31-22-23-0020 (Sheehy Construction, remnant of above parcel south of Commerce Drive) e. PID 24-31-22-23-0019 (City-owned pond parcel south of Commerce Drive) f. PID 24-31-22-32-0003 (Rehbein, south of City pond parcel) 2) We recommend that the Planning & Zoning Commission recommend rezoning the same parcels above from B-1 to I-1. 3) We recommend that the Planning & Zoning Commission recommend amending the Zoning Code to include the text amendments adding or modifying the uses in the I-1 District as in the attached proposed ordinance. 4) We recommend that the Planning & Zoning Commission recommend adopting the Findings of Fact on the next page. OPTIONS For each of the actions and recommendations above the Planning & Zoning Commission can: 1) Move to recommend approval and adopt Findings in support of the motion; 2) Move to recommend denial and adopt Findings in support of the motion; or 3) Move to continue the items) for further discussion or to gather additional information. PROCESS There needs to be time in the process to accommodate the Metropolitan Council review in addition to the City's review. If the change to the Land Use Plan is approved by the City Council that change will be conditioned on review of the change by the Met Council. The City in the middle of updating its 2040 Comp Plan, including the future Land Use Plan. The Met Council is no longer accepting requests for changes to the previous 2030 Comp Plans and will only consider changes to the 2040 Plan once that plan has been reviewed and approved by the Met Council. That process is officially a 60-day process but in practice it can be shorter than that. Met Council staff is willing to process a request quickly. At this point, the City can have its full 2040 Comp Plan wfflh r„ �?rnrnun iy in rrfirrl I April 2, 2019 Centerville Planning &Zoning Commission Page 6 of 7 B-1 &1-1 Zoning,Commerce Drive reviewed by the Met Council and then apply for review of this specific amendment to that Plan, or this land use change could be included with the full 2040 Plan within its review. Either way the review process needs to be taken in to account. FINDINGS OF FACT Findings of Facts-Approval of Comprehensive Plan Amendment 1) The properties in question to be guided Industrial are currently guided Commercial in the City's Comprehensive Plan. 2) The proposed use of the property at 7030 20t" Avenue, assembly of water dispensing equipment, is more appropriate for an industrial area than a commercial retail area. 3) The current use of the Ruffridge-Johnson and Sheehy Construction properties is industrial in nature, not commercial or retail. 4) The City property on the south side of Commerce Drive is used for ponding and will likely remain so for many years. It is an appropriate use for almost any land use designation, including Industrial. 5) The Rehbein property on 20t" Avenue is adjacent to other properties currently guided and zoned Industrial and is vacant. Guiding it for Industrial use is reasonable and appropriate. 6) The pattern of land use resulting from the proposed Comp Plan amendment will place Industrial land adjacent to Commercial land, a reasonable and appropriate pattern. Findings of Facts-Approval of Rezoning 1) The properties in question to be rezoned to I-1 Industrial are currently zoned B-1 Commercial. 2) The proposed use of the property at 7030 20t" Avenue, assembly of water dispensing equipment, is more appropriate for industrial zoning than commercial retail zoning. 3) The current use of the Ruffridge-Johnson and Sheehy Construction properties is industrial in nature, not commercial or retail. 4) The City property on the south side of Commerce Drive is used for ponding and will likely remain so for many years. From there, if the City Council agrees, staff would work with that developer to draft a memorandum of understanding or some other form of agreement allowing both sides to do further due diligence on the project and negotiate terms. Staff understands that making this determination will be difficult without more firm commitments on what might be expected in the way of city assistance (fees, TIF, land price, etc.). However, gaining those commitments will take several months, and having both developers go through this simultaneously, simply isn't feasible. We will need to chose one. If an agreement can not be reached with the chosen developer, the other would certainly be invited back to the table. OLD BUSINESS 1. 20th Avenue Zoning Issues Page 1 of 2 City of Centerville Planning and Zoning Commission March 5,2019 City Administrator Statz stated that Staff met, discussed neighboring/similar sized communities and provided the proposed changes to zoning districts and associated permitted and conditional uses. Lengthy discussion ensued by the Commission. Numerous recommendations were made regarding language, allowable uses, definitions, and the like. The commission supported the general concept of adding the B-2 (Main Street) district, rezoning the Commerce Drive properties to 1-1, Industrial, and amending the land use table. Several changes to staffs proposed land use table were included in the discussion and noted by staff. Motion by Commissioner Haiden, seconded by Commissioner Olson to Schedule a Public Hearing for the Inclusion of the B-2 District and Modifications to the B-1 & I- 1 Districts, as discussed, Associated Comprehensive Plan Amendment and Rezoning for May 7, 2019, unless an earlier date was needed to accommodate development schedules. Page 2 of 2 Administrator/Engineer's Report P&Z Committee — April 2, 2019 ECONOMIC DEVELOPMENT Anoka County Regional Economic Development(ACRED) Committee I attended a Marketing Committee meeting recently and got up to speed on the committee's initiatives. We will be working on creating some promotional videos, expanding on our Broker Event and developing a Business Retention and Expansion strategy. Minnesota Technology Corridor The MN Tech Corridor group met again, this time to talk transportation needs. County Engineers from both Anoka and Washington Counties got together along with the cities in the corridor. The meeting was very productive, and should lead to some synergy between transportation plans from the two counties and all the cities. Good conversation was had, as well, about the future of interstate access points along both 35E and 35W. Economic Development Authority The EDA reviewed an outline of our proposed Business Loan and Grant program, reviewing interest rates,loan maximums and other terms. We are planning an open house to introduce the program to businesses in a few months once we have finalized our program and secured the necessary funds. The decisions on funding will come before the City Council for final consideration. The EDA also reviewed the concept of a downtown Tax Increment Financing (TIF) District and affirmed the City Council's approval for the home inspections. The City Council and EDA will need to work with our finance director and financial consultants to determine if a TIF district should be operated by the City Council or EDA. Rebranding The Rebranding Committee held a kick-off meeting on Tuesday, March 26 and has a follow-up meeting scheduled for April 2. The committee consists of Mayor Paar(CC), Jim Weatherhead(EDA) and Nick Twohy (P&Z). Mr. Twohy has a background in marketing and has been a part of over a dozen rebranding exercises. He was able to lead the group through the initial stages of that process, which will culminate with a worksheet that conveys all of the elements of our brand. The committee will seek final input on this document from other stakeholders. Then, we will work with a graphic designer to take those attributes and values and put them into a logo and tag line.
