The commission will consider changes to City Code Chapter #93 later on this agenda. Changes to City Code
related to land use requires a public hearing.
The commission should open a public hearing on the proposed code revisions, take public input and close the
public hearing.

The city is in receipt of a concept plan for a 276-Unit Mini Storage Facility at 6965 20th Ave. S. An
application for a Conditional Use Permit has been received and a Public Hearing has been scheduled for June
18 (Special P&Z Meeting). A full application for a Site Plan Review has not yet been submitted. However, we
anticipate that submittal in time for review at the special meeting on the 18th.
The concept plan is being presented to the commission simply for information and discussion purposes.

Small Cell Wireless (5G) Ordinance
BACKGROUND AND SUPPLEMENTAL INFORMATION:
As cellular technology continues to evolve, the next generation (5G) is set to demand substantially different
infrastructure than the previous technology. Cit across the state have been preparing for this new
infrastructure by passing ordinances regulating its placement and appearance.
Attached are recommended changes to our ordinance, addressing 5G technology.
Also attached is an email from a resident concerned with the propagation of 5G technology.

CHAPTER 93 Î SMALL WIRELESS FACILITY ORDINANCE

§ 93.16 DEFINITIONS.
MICRO WIRELESS FACILITY means a small wireless facility that is no larger than
24 inches long, 15 inches wide, and 12 inches high, and whose exterior antenna, if any, is not
longer than 11 inches.
SMALL WIRELESS FACILITY means a wireless facility that meets both of the
following qualifications:
¤ Each antenna is located inside an enclosure of no more than six cubic feet in volume or,
in the case of an antenna that has exposed elements, the antenna and all its exposed
elements could fit within such an enclosure; and
¤ All other wireless equipment associated with the small wireless facility provided such
equipment is, in aggregate, no more than 28 cubic feet in volume, not including electric
meters, concealment elements, telecommunications demarcation boxes, battery backup
power systems, grounding equipment, power transfer switches, cutoff switches, cable,
conduit, vertical cable runs for the connection of power and other services, and any
equipment concealed from public view within or behind an existing structure or
concealment; or
¤ A micro wireless facility.
§ 93.17 PERMIT REQUIREMENT.
(A) Generally. Except as otherwise provided in this code, no person may obstruct or
excavate any right-of-way without first having obtained the appropriate permit from the
city.
(1) Excavation permit.
(a) An excavation permit is required to excavate that part of the right-of-way
described in the permit and to hinder free and open passage over the
specified portion of the right-of-way, to the extent and for the duration
specified therein.
(b) An obstruction permit is not required if a person already possesses a valid
excavation permit for the same project.
(2) Obstruction permit.

(a) An obstruction permit is required to hinder free and open passage over the
specified portion of rights-of-way by placing equipment and/or garbage
containers described therein on the rights-of-way, to the extent and for the
duration specified therein.
(b) An obstruction permit is not required if a person already possesses a valid
excavation permit for the same project.
(3) Small wireless facility permit. A small wireless facility permit is required by a
registrant to erect or install a wireless support structure, to collocate a small
wireless facility, or to otherwise install a small wireless facility in the specified
portion or the right-of-way, to the extent specified therein, provided that such
permit shall remain in effect for the length of time the facility is in use, unless
lawfully revoked.
(B) Permit extensions. No person may excavate or obstruct the right-of-way beyond the date
or dates specified in the permit unless the person makes both a supplementary application
for another right-of-way permit before the expiration of the initial permit, and a new
permit or permit extension is granted.
(C) Delay penalty. The city shall establish and impose a delay penalty for unreasonable
delays in right-of-way excavation, obstruction, patching or restoration. The delay penalty
shall be established from time to time by City Council resolution.
(D) Permit display. Permits issued under this subchapter shall be conspicuously displayed or
otherwise available at all times at the indicated work site and shall be available for
inspection by city.
(E) No permit required . A small wireless facility permit is not required, nor any permit fee or
collocation agreement in order to conduct any of the following activities:
(1) Routine maintenance of a small wireless facility;
(2) Replacement of a small wireless facility with a new facility that is substantially
similar or smaller in size, weight, height, and wind or structural loading than the small
wireless facility being replaced; or
(3) Installation, placement, maintenance, operation, or replacement of micro wireless
facilities that are suspended on cables strung between existing utility poles in compliance
with national safety codes.
Advance notification to the city of these activities is required if the work will obstruct a
public right-of-way.

§ 93.19 ISSUANCE OF PERMIT; CONDITIONS.
(A) Permit issuance. If the applicant has satisfied the requirements of this subchapter, the
city shall issue a permit.
(B) Conditions. The city may impose reasonable conditions upon the issuance of the permit
and the performance of the applicant thereunder to protect the health, safety and welfare
of the public or when necessary to protect the right-of-way and its current use.
(C) Small wireless facility conditions. Subject to a required city issued permit and pursuant to
Minn. Stat. § 237.163, subd. 2(f), the placement of small wireless facilities and wireless
support structures to accommodate small wireless facilities is a permitted use in a public
right-of-way, provided however that a special or conditional land use permit is required
to install a new wireless support structure for the siting of a small wireless facility in a
right-of-way in a district or area zoned for single-family residential use or within a
historic district established by federal or state law or city ordinance as of the date of
application for a small wireless facility permit. This paragraph does not apply to areas
outside a public right-of-way that are zoned and used exclusively for single-family
residential use.
In addition to the above paragraph of this clause (c), as applicable, and to clause (b)
above, the erection or installation of a wireless support structure, the collocation of a
small wireless facility, or other installation of a small wireless facility in the right-of-way,
shall be subject to the following conditions:
(1) A small wireless facility shall only be collocated on the particular wireless support
structure, under those attachment specifications, and at the height indicated in the
applicable permit application.
(2) No new wireless support structure installed within the right-of-way shall exceed 50
feet in height without the city's written authorization, provided that the city may
impose a lower height limit in the applicable permit to protect the public health,
safety and welfare or to protect the right-of-way and its current use, and further
provided that a registrant may replace an existing wireless support structure
exceeding 50 feet in height with a structure of the same height subject to such
conditions or requirements as may be imposed in the applicable permit.
(3) No wireless facility constructed in the right-of-way after \[MONTH DAY OF
IMPLIMENTAION, 2019\] may extend more than ten feet above its wireless support
structure in place as of \[MONTH DAY OF IMPLIMENTAION, 2019\].
(4) Where an applicant proposes to install a new wireless support structure in the right-of-
way after \[MONTH DAY OF IMPLIMENTAION, 2019\], the city may impose
separation requirements between such structure and any existing wireless support
structure or other facilities in and around the right-of-way for purposes of the public

health, safety and welfare, reasonable city right-of-way management, or protection of
the right-of-way and its uses.
(5) Where an applicant proposes collocation on a decorative wireless support structure,
sign or other structure not intended to support small wireless facilities, the city may
impose reasonable requirements to accommodate the particular design, appearance or
intended purpose of such structure.
(6) Where an applicant proposes to install a new or replacement wireless support
structure for a small wireless facility or to collocate a small wireless facility on a
wireless support structure in a public right-of-way, the city may impose reasonable
restocking, replacement, or relocation requirements on the replacement of such
structure.
(7) The city may condition its approval on compliance with generally applicable and
reasonable health, safety, and welfare regulations consistent with the city's public
right-of-way management.
Pursuant to Minn. Stat. § 237.163, subd. 3a, an approval of a small wireless facility
permit under this section authorizes the installation, placement, maintenance, or operation
of a small wireless facility to provide wireless service and shall not be construed to
confer authorization to (i) provide any service other than a wireless service, or (ii) install,
place, maintain, or operate a wireline backhaul facility in the right-of-way.
(D) Small wireless facility agreement. A small wireless facility shall only be collocated on a
small wireless support structure owned or controlled by the city, or any other city asset in
the right-of-way, after the applicant has executed a standard small wireless facility
collocation agreement with the city. The standard collocation agreement may require
payment of the following:
(1) Up to $150.00 per year for rent to collocate on the city structure.
(2) Twenty-five dollars per year for maintenance associated with the collocation;
(3) A monthly fee for electrical service as follows:
a. Seventy-three dollars per radio node less than or equal to 100 maximum watts;
b. One hundred eighty-two dollars per radio node over 100 maximum watts; or
c. The actual costs of electricity, if the actual cost exceed the foregoing.
The standard collocation agreement shall be in addition to, and not in lieu of, the required
small wireless facility permit, provided, however, that the applicant shall not be
additionally required to obtain a license or franchise in order to collocate. Issuance of a
small wireless facility permit does not supersede, alter or affect any then-existing
agreement between the city and applicant.

§ 93.20 PERMIT FEES.
(A) Excavation permit fee. The city shall establish an excavation permit fee in the amount
sufficient to recover the following costs:
(1) The city management costs; and
(2) Degradation costs, if applicable.
(B) Obstruction permit fee. The city shall establish the obstruction permit fee, which shall be
in an amount sufficient to recover the city management costs.
(C) Payment of permit fees. No excavation permit or obstruction permit shall be issued
without payment of excavation or obstruction permit fees.
(D) Nonrefundable. Permit fees that were paid for a permit that the city has revoked for a
breach as stated in § 93.27 are not refundable.
(E) Application to franchises. Unless otherwise agreed to in the franchise, management costs
may be charged separately from and in addition to the franchise fees imposed on a right-
of-way user in the franchise.
(F) Establishment. All permit fees shall be established by resolution of the City Council.
(G) Small wireless facility permit fee. The city shall impose a small wireless facility permit
fee in an amount sufficient to recover management costs.
§ 93.23 DENIAL OF PERMIT.
(A) The city may deny a permit for failure to meet the requirements and conditions of this
subchapter if the city determines that the denial is necessary to protect the health,
safety of the public and welfare, or when necessary to protect the right-of-way and its
current use. The city may additionally deny a permit for the following reasons:
(1) The applicant failed to fully comply with the application requirements herein.
(2) Except for small wireless facilities permits, the city has initiated revocation of a
prior permit issued under this article against the applicant.
(3) Except for small wireless facilities permits, the applicant has violated within the
past two years any requirements of this article.
(4) The time schedule for the project will conflict or interfere with a community
exhibition, celebration, festival or any other similar community event in the area
of the project.

(5) The time schedule for the project conflicts with scheduled public improvement of
the public right-of-way.
(6) The time schedule for the project conflicts with another applicant's previously
approved project.
(7) The proposed project violates a provision of this chapter or city Code.
(8) The proposed project is adverse to the public health, safety and welfare, by
interfering with the safety and convenience of ordinary travel over the public
right-of-way, or endangers the public right-of-way and its users based on one or
more of the following factors:
a. The extent of public right-of-way area available;
b. The competing demands for the particular proposed area space in the public
right-of-way;
c. The availability of other locations in the public right-of-way or in other public
rights-of-way for the facility(ies) or equipment of the permit applicant;
d. The applicability of an ordinance or other regulation that affect the location of
a facility or equipment in the public right-of-way;
e. Except for small wireless facilities permits, the applicant's prior
noncompliance with the terms and conditions of its franchise, this article and
other applicable ordinances and regulations;
f. The condition and age of the public right-of-way and the city's scheduled
reconstruction thereof; and
g. The costs of disruption to the public and damage to the public right-of-way
balanced against any benefits to the public served by an expansion into
additional parts of the public right-of-way for facilities or equipment.
(B) Right to cureÏSmall wireless facilities. Pursuant to Minn. Stat. § 237.163, subd. 4(f),
for small wireless facilities permits, if a permit application is denied, the
telecommunications right-of-way user may cure the deficiencies identified by the city
and resubmit its application.
(C) Procedural requirements. The denial of a permit must be made in writing and must
document the basis for the denial. The city must notify the applicant or right-of-way
user in writing within three business days of the decision to deny a permit. If an
application is denied, the right-of-way user may address the reasons for denial
identified by the city and resubmit its application. If the application is resubmitted
within 60 days of receipt of the notice of denial, no additional application fee shall be

imposed. The city must approve or deny the resubmitted application within 60 days
after submission.
§ 93.29 LOCATION OF FACILITIES.
(A) Locations. Placement, locations and relocation of facilities must comply with the act,
with other applicable local or state law, and with Minn. Rules.
(B) Corridors. The city may assign specific corridors within the right-of-way or any
particular segment thereof as may be necessary, for each type of facilities that is located
or, pursuant to current technology, the city expects will someday be located within the
right-of-way. All excavation, obstruction or other permits issued by the city involving
the installation or replacement of facilities shall designate the proper corridor for the
facilities at issue.
(C) Limitation of space. To protect health, safety and welfare or when necessary to protect
the right-of-way and its current use, the city shall have the power to prohibit or city shall
strive to the extent possible to accommodate all existing and potential users of the right-
of-way, but shall be guided primarily by considerations of the public interest, the publicÓs
needs for the particular utility service, the condition of the right-of-way, the time of year
with respect to essential utilities, the protection of existing facilities in the right-of-way,
and future city plans for public improvements and development projects which have been
determined to be in the public interest.
(D) Collocation of small cell wireless facilities. Collocation of small wireless facilities and
installation of wireless support structures, approved by the city and in compliance with
Minn. Stat. §§ 237.162, 237.163, are exempted from this section.
§ 93.35 ACTION ON SMALL WIRELESS FACILITY PERMIT APPLICATIONS.
(A) Deadline for action. The city shall approve or deny a small wireless facility permit
application within 90 days after filing of such application. The small wireless facility
permit, and any associated building permit application, shall be deemed approved if the
city fails to approve or deny the application within the review periods established in this
section.
(B) Consolidated applications. An applicant may file a consolidated small wireless facility
permit application addressing the proposed collocation of up to 15 small wireless
facilities, or a greater number if agreed to by the city, provided that all small wireless
facilities in the application:
(1) Are located within a two-mile radius;
(2) Consist of substantially similar equipment; and

(3) Are to be placed on similar types of wireless support structures.
In rendering a decision on a consolidated permit application, the city may approve some
small wireless facilities and deny others, but may not use denial of one or more permits
as a basis to deny all small wireless facilities in the application.
(C)Tolling of deadline. The 90-day deadline for action on a small wireless facility permit
application may be tolled if:
(1) The city receives applications from one or more applicants seeking approval of
permits for more than 30 small wireless facilities within a seven-day period. In such
case, the city may extend the deadline for all such applications by 30 days by
informing the affected applicants in writing of such extension.
(2) The applicant fails to submit all required documents or information and the city
provides written notice of incompleteness to the applicant within 30 days of receipt
the application. Upon submission of additional documents or information, the city
shall have ten days to notify the applicant in writing of any still-missing information.
(3) The city and a small wireless facility applicant agree in writing to toll the review
period.

TITLE OF ISSUE:
Schedule Special Meeting of the Planning and Zoning Commission
BACKGROUND AND SUPPLEMENTAL INFORMATION:
An application for a Conditional Use Permit has been received for the construction of a Mini Storage Facility at
6965 20th Ave. S. The developer's time constraints do not allow him to wait until the commission's regular
meeting on June 4 for the required public hearing. Therefore, he has requested that a special meeting be called.
Costs associated with this special meeting are being paid by the applicant.

REQUESTED ACTION:
Motion to schedule a Special Meeting of the Planning and Zoning Commission for June 18, 2019 at 6:30 p.m. to
accommodate a Public Hearing for a Conditional Use Permit, with costs for said meeting to be paid by the
applicant.

Commission/EDA held its regular meeting on Tuesday, April 2, 2019 at 6:30 p.m.

The meeting was called to order at 6:30 p.m. by Chairperson Mosher.

Resignation of Ms. Kim Ganzel
City Administrator Statz stated that he had received the submitted letter from Ms. Ganzel.
Motion by Commission Broussard Vickers, seconded by Commission Haiden to accept the
resignation of Commissioner Ganzel. All in favor. Motion carried. .

Motion by Commissioner Broussard Vickers, seconded by Commissioner Olson to Approve
the Agenda as presented. All in favor. Motion carried.
IV. PUBLIC HEARINGS (6:30 PM or shortly thereafter)
1. Commerce Drive Area Zoning
City Planner, Phil Carlson, Stantec, reviewed and presented his April 2, 2019 memorandum with
the Commission/EDA.
Chairperson Mosher opened the public hearing at 6:40 p.m. No members of the audience desired
to speak regarding the item.
Motion by Commissioner Broussard Vickers, seconded by Commissioner Twohy to Close
the Public Hearing at 6:45 p.m. All in favor. Motion carried.
a. Comprehensive Plan Amendment
Motion by Chairperson Mosher, seconded by Commissioner Haiden to Recommend
Approval of the 2040 Comprehensive Plan Amendment and Related Findings of Fact, re-
guiding certain property from Commercial to Industrial as Presented in the Stantec
Planning Memorandum Dated April 2, 2019, Contingent on Met. CouncilÓs Approval of the
CityÓs Draft 2040 Comprehensive Plan. All in favor. Motion carried.
b. Re-Zone
Motion by Chairperson Mosher, seconded by Commissioner Broussard Vickers to
Recommend Approval of Re-Zoning of certain property from Commercial to Industrial and
Related Findings of Fact as Presented in the Stantec Planning Memorandum Dated April 2,
2019, Contingent on Comprehensive Plan Amendment Approval by Met. Council. All in
favor. Motion carried.
c. Code Amendment
Motion by Chairperson Mosher, seconded by Broussard Vickers to Recommend Approval of
Code Amendments and Related Findings of Fact as Presented in the Stantec Planning
Memorandum Dated April 2, 2019, Contingent on Comprehensive Plan Amendment
Approval by Met. Council.. All in favor. Motion carried.
V. AWARDS, PRESENTATIONS, APPEARANCES
1. Block 7 Redevelopment Concepts
a. (7:00 Î 7:45 PM) Apollo Properties, LLC
Mr. Chris Harchanko, Owner, Apollo Properties, LLC, introduced himself to the
Commission/EDA and reviewed his proposed development for Block 7. He reviewed their
proposal for a 4-story, 90 unit apartment building with underground parking.

Mr. Harchanko offered a question and answer opportunity for the Commission/EDA or audience
members.
b. (8:00 Î 8:45 PM) Trident Development
Misters Roger Fink, Sr. Vice President, and Patrick Brama, Vice President Trident Development,
introduced themselves to the Commission/EDA and reviewed their proposed development for
Block 7. They reviewed their proposal for a 3-story, 53 unit apartment building with surface
parking.
Misters Fink and Brama offered a questions and answer opportunity for the Commission/EDA or
audience members.

VII. NEW BUSINESS
1. Commerce Drive Area Î Comprehensive Plan Amendment/Rezoning/Code
Amendment
This item was handled previously.
2. Block 7 Redevelopment Recommendation
Input was received from the Commission and EDA, as well as Mr. Phil Carlson, Mr. Mike Brass
and Administrator Statz. The discussion centered around each developerÓs resume of past
projects, the thoroughness of their presentation and relevance of their market study information.
Motion by Commissioner Fehrenbacher, seconded by Commissioner Haiden to Recommend
to Council to Begin Negotiations with Trident Development, LLC for the Redevelopment of
Block 7. All in favor. Motion carried.
VIII. APPROVAL OF MINUTES
1. Planning & Zoning Commission March 5, 2019 Meeting Minutes
Chairperson Mosher provided an opportunity for members to make modifications.
Motion by Commissioner Broussard Vickers, seconded by Commissioner Olson to Approve
the March 5, 2019 meeting minutes as amended. All in favor. Motion carried.
