HomeMy WebLinkAbout2019-05-07 P & Z Minutes - Approved CITY OF CENTERVILLE PLANNING AND ZONING COMMISSION Pursuant to due call and notice thereof, the Planning and Zoning Commission held its regular meeting on Tuesday, May 7, 2019 at 6:30 p.m. PRESENT: Chairperson Darrin Mosher Commissioner Linda Broussard Vickers Commissioner Ben Fehrenbacher. Commissioner Mark Haiden (Arrived at 6:33 p.m.) Commissioner Darrell (DJ) Olson, Jr. Commissioner Nick Twohy (Arrived at 6:37 p.m.) Vacant Seat ABSENT: None. STAFF: City Administrator/Engineer Mark Statz City Planner Phil Carlson OTHERS PRESENT: City Council Liaison Alternate Mayor Jeff Paar I. CALL TO ORDER The meeting was called to order at 6:30 p.m. by Chairperson Mosher. II. PLEDGE OF ALLEGIANCE III. APPROVAL OF AGENDA Chairperson Mosher questioned whether there were additions or removal of any items. No Commissioners desired changes. Motion by Commissioner Broussard Vickers, seconded by Commissioner Fehrenbacher to Approve the Agenda as presented. All in favor. Motion carried. IV. PUBLIC HEARINGS (6:30 PM or shortly thereafter) 1. Rezoning of 1801, 1825, 1845, PIN #23-31-22-12-0092, 1873, 1969, 1970, 1973, 1976, 1979, 1980, 1981, 1988, 1990, 2030, 2050 & PIN #24-31-22-23-0010 Main Street, 7090, thst 7205, 7140 – 20 Avenue and PIN #24-31-22-23-0010 & 7095, 7111 – 21 Avenue from B-1 (Commercial) to B-2 (Main Street Commercial); Text Amendments & Amendment to Table 156-A.1, District Allowed Uses Chairperson Mosher opened the public hearing at 6:32 p.m. Administrator Statz stated that the Commission has been discussing ways to better address commercial land use issues for quite some time and have previously reviewed the concept of rezoning Main Street properties to differentiate them from other commercial properties. Page 1 of 3 City of Centerville Planning and Zoning Commission May 7, 2019 City Planner Carlson reviewed his submitted memorandum with the Commission. Chairperson Mosher asked for public commentary. The following public comments were taken:  Mr. Karl Stocker, 7122 Brian Drive, addressed the Commission and stated that he felt that a 4-story apartment building would not be a benefit to taxpayers and he did not like the increased density within the community. The commissioners explained to Mr. Stocker that the items being reviewed with this public hearing did not affect the downtown area. There were no further comments from the public. Motion by Commission Member Broussard Vickers, seconded by Council Member Haiden to close the public hearing at 6:35 p.m. All in favor. Motion carried. V. AWARDS, PRESENTATIONS & APPEARANCES 1. Mr. Jon Krueger, Application for Appointment to Commission Mr. Jon Krueger, 7368 Old Mill Road, appeared before the Commission stating that he desired to serve on the Commission, he provided background about his education, longevity in Centerville and assets that he would bring to the Commission. Motion by Chairperson Mosher, seconded by Commissioner Broussard Vickers to Recommend to Council the Appointment of Mr. Jon Krueger to the Planning & Zoning Commission. All in favor. Motion carried. VI. OLD BUSINESS 1. None. VII. NEW BUSINESS 1. Ordinance #XX – Creating a new B-2 Main Street Commercial District, Amending the Text of the B-1 District and Amending the Table of Allowed Uses The Commission discussed this item previously and again reviewed the submitted memorandum from City Planner Carlson. Commissioners asked about existing uses in the commercial districts that may be affected by these changes. Administrator Statz and Planner Carlson explained that existing uses that become non-conforming due to these changes would retain the right to continue operation until such time as their use changed or ceased for a period of more than one year. It was also explained that the business could be sold to another proprietor and that the new owner could continue the operation as long as the use did not change. Motion by Commission Member Fehrenbacher, seconded by Commissioner Broussard Vickers to Recommend to City Council Adoption of Ord. #XX and associated Findings of Fact – Creating a New B-2 Main Street Commercial District, Amending the Text of the B-1 Page 2 of 3 City of Centerville Planning and Zoning Commission May 7, 2019 District and Amending the Table of Allowed Uses per City Planner Carlson’s Memorandum Dated May 7, 2019. All in favor. Motion carried. 2. Ordinance #XX – Rezoning Certain Properties from B-1 to B-2 Administrator Statz reviewed the map of the properties to be rezoned, noting that they all abut Main Street. Motion by Chairperson Mosher, seconded by Commissioner Haiden to Recommend to City Council Adoption of Ord. #XX and Associated Findings of Fact – Rezoning Certain Properties from B-1 to B-2 per City Planner Carlson’s Memorandum Dated May 7, 2019. All in favor. Motion carried. 3. Schedule a Public Hearing for May 21, 2019 – Conditional Use Permit, Midwest Best Water, 2021 Commerce Drive Administrator Statz stated that due to Midwest Best’s construction timeline, need for a Conditional Use Permit due to Light Manufacturing/Assembly and their request for a Conditional Use Permit and 60 day rule. Motion by Commissioner Broussard Vickers, seconded by Commissioner Fehrenbacher to Schedule a Special Meeting for a Public Hearing on May 21, 2019 to Consider a Conditional Use Permit for Midwest Best Water at 2021 Commerce Drive.
