Downtown Zoning
Attached, you will find a planning memorandum with detailed information on the proposed amendments to the
downtown zoning map, zoning code and Master Plan. A public hearing was held on these proposed
amendments and a first reading of the changes to the code was on the last Council agenda. Modifications have
been made to the code incorporating Council's concerns from the first reading (height of accessory structures
and the addition of public buildings as an allowed use in the M-2. Slight modifications were made to
accommodate situations where underground parking is not feasible.

RE: Downtown Zoning Changes
BACKGROUND
In light of the possible redevelopment of Block 7, the City has decided to revisit the relevant
Master Plan and zoning requirements to ensure that any potential development meets City
expectations. The City held a joint meeting of the EDA, Planning and Zoning Commission, and City
Council on October 24, 2018 to discuss changes to the zoning map, zoning code and Master Plan.
The understanding at that meeting was that more formal action would be taken down the road to
formalize these changes. At their meeting on September 3, the Planning and Zoning Commission
recommended approval of the changes to the city zoning code, zoning map and Master Plan.
The City Council is asked to consider formal changes to the zoning code, zoning map and Master
Plan as detailed in this memo to address these issues. A public hearing is required prior to
amending the zoning code and official zoning map. The notice of public hearing was published in
the official newspaper at least 10 days prior, and the hearing was held at the Planning
Commission meeting on September 3, 2019.

PLANNING ISSUES
Master Plan Updates
There are several changes that have been discussed to the Master Plan and Development
Guidelines for Downtown Centerville. This document is referenced directly in the zoning code and
provides development guidelines for downtown. Given past discussions with the Planning and
Zoning Commission, the following changes are proposed to the Master Plan document:
(1)arify Mixed Use Corridors as M-1 and Downtown
Neighborhood as M-2 to better correlate with the zoning code.

per acre, and the maximum density will be 30 units per acre. These changes are consistent
with the Comprehensive Plan.

facilities, where feasible. Given the limitations with the water table experienced at Block 7,
there should be some flexibility for this requirement.

Proposed Zoning Map Changes
The purpose of the proposed changes is to decrease the size of the M-1 Mixed Use Corridor, and
to rezone the majority of the CBD to M-2 Downtown Neighborhood District. Part of the rationale for
this change is that the M-1 District requires retail on the first floor of every building, at a minimum.
The M-2 District on the other hand allows both retail and higher density residential on the first floor,
allowing for greater flexibility of uses in the CBD. These proposed changes are shown on the next
page.

Zoning Code Text Changes
Changes are needed to the zoning code in order to maintain consistency with the Master Plan
and zoning map, as well as to remove unnecessary language and fix typographical errors. These
include the following changes which are summarized in part in the attached revised Table 156-A.1
in the Zoning Code, as well as in the attached draft ordinance:
(1)A typographical error will be fixed in Section 156.051 to reflect the correct term, Mixed Use
District (M-1).
(2)The Purpose statement of Sections 156.051(A) will be updated to clarify that the M-1 district
in the Master Plan, and that the district
implements the Master Plan, and all subsequent revisions. This is important given the
proposed revisions to the Master Plan document.

Accessory Structures and Storage in the CBD
At the August 13 Planning and Zoning Commission meeting, there was a discussion of accessory
structures in the downtown. The consensus was that accessory structures should be allowed, with
reasonable conditions and restrictions. A related issue is whether storage or warehousing as a
separate use should be allowed within the principal structure, and how to better regulate this in
the zoning code. Please note the distinction between an accessory structure, which is a separate
structure on the site, and an accessory use, which is some use of space, but it could be in the
principal structure or in a separate accessory structure. The following are options to consider.
The Zoning Code currently does not allow accessory structures to be constructed in the M-1 and
M-2 districts. This is indicated in the zoning code table of uses for these districts by the absence of
a P or C in either the M-1 or M-2 columns across from Accessory Structures. In order to allow for

the M-1 and M-2 columns for the row listing accessory buildings. This would allow the Commission
and the Council to place reasonable conditions on the construction of accessory structures.
Accessory structures for residential uses are regulated by a list of conditions in the zoning code
structures in non-residential areas. However, the conditions and regulations placed on these
structures are much less stringent. One option could be to include a list of conditions in the zoning
code text for accessory structures in non-residential areas as well. Zoning Code section 156.107 is
already referenced in the Zoning Code table of uses, so any regulations added to the zoning
code text would be applied to accessory use structures in the M-1 and M-2, if they were to be
allowed. A list of proposed conditions is shown in the summary on the next page.
A related issue is whether storage should be allowed as a use within the principal structure.
Currently storage is allowed as a principal use in the I-1 industrial area. Mini storage is allowed as a
conditional use, and warehouse/distributing is allowed as a permitted use in I-1. Storage is not
allowed now as a principal use within the M-1 and M-2 downtown areas. Certainly, most typical
commercial uses within the M-1 and M-2 would have storage as an accessory use within the
principal structure. For example, restaurants typically have some amount of space that is used for
storing goods and equipment, but the principal use would not be considered storage. One could
say that the storage is accessory, and incidental to the principal use as a restaurant. Every office
use has some kind of storage space or closets, but it is also accessory or incidental.
This raises the question of how much space would be allowed as storage or warehousing within a
principal structure. The zoning code currently does not provide limitations on the amount of
warehouse or storage space within a principal use, although the storage could not be the
principal use under current code. We suggest that storage be indicated in the zoning code as a
permitted accessory use as long as it is directly related to and incidental to the principal use.

In summary, the proposed changes to the zoning code to address accessory structures and
storage in the downtown include:
(1)
indicating that accessory buildings are allowed as a conditional use.
(2)
that accessory storage is allowed within all
districts as a permitted use.
(3)Section 156.107 relating to accessory uses and structures will be updated with the following
conditions for non-residential accessory structures
a.No more than two detached accessory buildings are permitted on any parcel.
Combined aggregate square footage for detached accessory structures shall not
exceed 1000 square feet or 10% of the lot area, whichever is less
b.Detached parking garages for residential uses may be allowed to exceed the area
limitations above, but only with a finding that underground or attached parking is
impractical or infeasible.
c.In no event may any accessory building exceed the square footage of the main
level of the principal structure.
d.No accessory structure may be constructed on a parcel without a principal
structure.
e.No accessory structure shall be erected or located within the front yard.
f.The side walls of an accessory structure shall not exceed 10 feet in height and the
overall height of a structure shall not exceed 15 feet, except to match the roof
slope of the principal structure.
(4)in a
principal structure shall be directly related to and incidental to the principal use.
The attached ordinance shows the changes as they would appear within the City Zoning Code.
RECOMMENDATIONS
There are numerous individual changes being proposed, but there are four basic actions to be
taken:
1)We recommend the City Council approve of the draft ordinance amending the text and

FINDINGS OF FACT
If the City Council moves to approve the actions above, the following Findings of Fact could be
cited in support of those decisions.
(1)The City wants to maintain a mixed-use Central Business District with a balance of retail
and moderately dense residential housing. Given these priorities, updating the standards
for the mixed use and downtown neighborhood districts is reasonable and appropriate.
(2)With the updated standards to the M-1 and M-2 districts, it is necessary to rezone properties
to be consistent with guided land use. Updating the zoning map is therefore both
reasonable and appropriate.
(3)The Master Plan & Development Guidelines for Downtown Centerville is a document that
was adopted by the City Council in 2006. Over time, some of the language and standards
in the document have changed, and therefore it is reasonable and appropriate to update
the document.
(4)The Zoning Code directly references the Master Plan & Development Guidelines for
Downtown Centerville document, and therefore text changes to the zoning code are also
reasonable and appropriate.
(5)Attractive, high quality development in Downtown Centerville is an important goal of the
City and large or unsightly storage uses are inappropriate. Limiting accessory structures
and storage uses in the M-1 and M-2 districts with reasonable regulations is therefore
reasonable and appropriate.

PLANNING & ZONING COMMISSION REVIEW AND RECOMMENDATION
The Planning & Zoning Commission review on September 3 focused on the following issues:
1)Green Space and Landscaping
A landscape plan has been submitted showing new plantings at the edges of the site. The zoning
code standards for landscaping are discussed in the Planning & Zoning Commission memo. Part of
technically parking lots, but drive aisles serving the storage units, so the standard for providing
grass and shrubbery on 3% of the parking area does not apply.
The key issue in terms of screening and landscaping for this site is to the rear, or west side, to the
single family neighborhood. The proposed site plan would remove almost all existing trees and
vegetation along this rear lot line, except for a small area in the NW corner. The existing wetland
would remain, and additional storm ponding would be added up to the west lot line. Discussion at
the Planning & Zoning Commission focused on narro
added in the SW corner by shortening the southern building. These ideas are illustrated below:

2)Security
Safety and security are issues for all storage facilities. The applicants stated that they would install
security cameras with a view of the door to every storage unit, operating and recording
continuously, with speakers to talk to people on site. The police can be called immediately if there
is any concern.
3)Lighting
The applicants indicated that all lighting would be downcast, cutoff type fixtures, to keep light
glare away from adjacent residential properties and the street.
Other issues were discussed previously, but not specifically at the September 3 meeting:
4)Sales and Auctions
Sale of items from the storage units by individuals, such as a yard sale, action, or other event will
not be allowed. The owners would be able to hold a sale of abandoned items a few times a year.
5)Outside Storage
Outside storage is not specifically noted on the site plan or other application materials and we
assume there will be no outside storage of any materials or vehicles.
6)Exterior Building Materials
The building is proposed to be constructed with split-face concrete block and vinyl lap siding. The
siding is not consistent with this standard and the building exterior must be revised.
RECOMMENDATION
Conditional Use Permit
The Zoning Code has specific criteria in 156.320(B)(2) for granting a Conditional Use Permit:
a)That the proposed building or use at the particular location requested is necessary or desirable to
provide a service or a facility which is in the interest of the public convenience and will contribute to
the general welfare of the neighborhood or city;
b)That the proposed building or use will not have a substantial or undue adverse effect upon adjacent
property, the character of the neighborhood, traffic conditions, utility facilities and other matters
affecting the public health, safety and general welfare; and
c)That the proposed building or use will be designed, arranged and operated so as to permit the
development and use of neighboring property in accordance with the applicable district
regulations.

We recommend that the City Council approve a Conditional Use Permit for the Centerville
Storage project with the following conditions:
1)Exterior storage of goods or vehicles is not permitted.
2)Sales or auctions on the premises are not permitted except for auctions conducted by the
facility owner no more than four times a year for items that have been stored in the facility,
not outside property or items brought onto the site for the auction.
3)The facility will consist of individual storage units for retail customers, with individual rental
spaces of no more than 500 square feet, not large industrial type warehousing.
4)The hours of operation will be limited to 7:00 am to 10:00 pm.
5)Site lighting will be downcast cutoff type fixtures directed away from adjacent residential
uses with no more than one half (0.5) foot-candle of light at all exterior lot lines. The lighting
plan will be submitted to the City Planner and City Engineer for review and approval
before a building permit is issued.
6)The site plan and storm ponding plan will be modified by reducing the length of the
southern building to set it back from the west edge of the site and removing proposed
storm ponding in an area 40 to 60 feet wide along the western edge of the site. The intent
is to preserve and enhance existing landscape screening along the western edge.
7)Landscaping and screening shall be provided as indicated on the landscape plan dated
8/29/2019 with the following features and modifications:
a.Landscaping will be provided around the edges of the site and around the
wetland as shown on the 8/29/2019 plan.
b.The facility will provide a fence or wall in the rear yard that is at least 90% opaque,
or a double row of evergreen trees or shrubs, at least 6 feet high, to screen activity
areas on site from adjacent residential uses.
c.Existing trees and vegetation on the west side of the site will be preserved in an
area 40 to 60 wide to be determined in discussion with the applicant and City staff.
The intent is to screen the residential uses to the west. Additional overstory or
understory trees and shrubs will be added as need to provide an effective screen,
to be reviewed and approved by the City Planner and City Engineer.
8)The exterior building materials will be revised to be face brick, finished block or other
textured masonry product.
9)Signage for the project will be reviewed and approved by the City Planner.

10)All engineering, infrastructure and stormwater issues will be resolved to the satisfaction of
the City Engineer prior to issuance of a building permit.
11)The users of the site will produce no noise, vibrations, air pollution, light pollution, fire
hazards or noxious emissions which will disturb or endanger neighboring properties.
12)Applicant will follow the applicable standards and requirements of the City of Centerville
City Code, Rice Creek Watershed District, Anoka County, Army Corp of Engineers, FEMA,
Minnesota DNR and any other agency having jurisdiction over the property and shall
secure those same files with the City.
Findings of Fact for Conditional Use Permit
The Planning and Zoning Commission might consider the following Findings of Fact in support of
their recommendation on the Conditional Use Permit:
