Statz, City Administrator/City Engineer From: Bruce DeJong, Finance Director Item: Storm Water Fund Capital Improvement Plan CIP Discussion City staff would like to discuss the Storm Water Fund cash flow with the City Council on a similar basis as our discussion of the Water Fund and Sewer Fund. Staff has included two large sheets listing all revenues and expenditures for cash flow purposes. There are significant assumptions included in the documents, so we will lay them out for discussion purposes. • Storm Water charges are held steady in Scenario 1. Storm Water Charges increase by 4% per year in Scenario 2. Storm Water Charges increase by 4% per year in Scenario 2. Storm Water Charges increase by 5% per year in Scenario 3. • Interest is projected at 1% of the previous year ending balance. • All other items are estimated for 2019 and inflated by 3% for each year after. • CIP Cash Outlay is included in the cash flow since it is actual cash outlay. It doesn't show on the annual financial statements. In accrual accounting, the purchase of a new capital item is the exchange of one asset (cash) for another asset (infrastructure). The expense is recognized on the financial statements through the depreciation calculated over the projected life of the asset.. • Pension Expense and Depreciation are moved to the bottom of the sheet since they are not cash expenditures. • Depreciation is currently just under $105,000 annually and is adjusted in the future calculations to reflect new capital outlays depreciated over 20-40 years. This fund has a lot of assets that are difficult to determine a maintenance schedule. We have little information on which to determine an average level of pond sedimentation. The speed at which city ditches fill up is not clear and can be easily disrupted by neighborhood actions such as leaf or yard waste dumping. Rain gardens have not worked very well in town and replacement of their filtering media may have no effect on percolation. Some of the storm water ponds have been measured during winter to determine the amount of sedimentation. The ponds that have been measured have not shown any significant change in depth or storage capacity. Municipal Separate Storm Sewer System (MS4) rules indicate a pond is non-functioning if it is below 50% of design capacity. None of our measured ponds are below that level. Even when they are below 50%, the regulations don't require any specific maintenance. Mr. Palzer doesn't believe we should perform much if any maintenance on ponds that are above 70% remaining capacity. It is difficult to determine when city ditches, which don't really have a good definition, need to be dredged or deepened. We did a small dredging job this year with Olson's Sewer Service. The length of the project was 140 feet and the bid was $4,912. That works out to about $35 per foot. That bid was about half of the other bid received, so the cost may not be representative for other projects. Staff has used a price of $40 per foot for estimating ditch maintenance costs. Rain gardens will likely fill up their media with sediment sometime, but we don't have a great handle on how long that happens on average. Since the percolation has been very poor in the rain gardens that have been installed, it may not make sense to reconstruct them. It is staff s understanding that rain gardens will not be required in the future, so we have not budgeted to replace the existing ones. The legal standard regarding when we need to test sediment removed from these water features is when 3,000 cubic yards of material are removed. The testing is to determine if Polycyclic Aromatic Hydrocarbons (PAHs) primarily from coal tar based driveway sealers are present. It is staff s intention to remove less that that amount annually to avoid the necessity of testing. Staff estimates a cost of $2,000 as an average to remove sediment from the inlet and outlet of each pond. We plan to do maintenance to each of the 84 public ponds during a 10 year period. That leads us to a total of $168,000 for all ponds or $16,800 per year. Staff would plan to start a regular pond maintenance program in 2021. Staff estimates a cost of $40 per foot as an average to remove sediment from ditches. We plan to do maintenance to each of the 14 ditches during a 10 year period. That leads us to a total of $277,400 for all ditches or $27,740 per year. Staff would plan to start a regular pond maintenance program in 2021. These assumptions are predicated on not having to completely reconstruct any storm water feature. The standard rule of thumb for a minimum cash balance in an enterprise fund is something between three to six months of operating expenses in reserve. The estimated annual operating expenditures of the fund starting in 2021 are around $90,000. Holding three months of expenses in reserves means $22,500 should be kept for cash flow purposes. The actual cash on hand at year end 2018 was $266,237. This means that there is an available balance of $240,000 available for capital projects. In 2020, the downtown storm water project associated with the street reconstruction and water main is estimated to cost $341,000. We also have a matching amount of $33,000 for our $100,000 Storm Water grant from the Metropolitan Council for the expansion of the LaMotte Park sprinkler system. After 2020, there are no major projects planned in the next 10 years. Scenario 1: With the above expenses included, we are projected to go below our target cash amount of $25,000in 2020, and actually go negative in cash for 2025 and beyond. In Scenario 1, we never get back to our minimum cash balance amount. Scenario 2: Staff projects a 4% increase in storm water fees on all users starting in 2020. With that assumption, we drop below our cash target in 2020, but get back over our 25% minimum cash balance in 2021. The cash balance keeps rising until it 2024 when we can start to address backyard ponding issues. Scenario 3: Staff projects a 5% increase in storm water fees on all users starting in 2020. With that assumption, we drop below our cash target in 2020, but get back over our 25% minimum cash balance in 2021. We can also start to address backyard ponding issues in 2021. In all scenarios, we are now formally budgeting for our sediment removal from ponds and ditches. Staff presents this information in anticipation of discussions for setting enterprise fund rates for future years. We need to annually evaluate our rates based on any increases passed on to us from MS4 requirements. The interim use will afford them time to 1) obtain licensure for the facility and 2) address the public safety concerns set forth below. This interim use is intended as a path toward granting a Conditional Use Permit once the applicant has satisfied those concerns. The Interim Use Permit and the future Conditional Use Permit would be granted on the terms recommended by the City Planners in their companion memorandum. BACKGROUND Gonion Group LLC has applied for a Conditional Use Permit to build a 16-unit senior living/memory care facility on a vacant site located at 1825 Main Street. The site is zoned B-2 Main Street Commercial district. "Specialized care facilities" are allowed as a conditional use in the B-2 zoning district. City code defines a "Specialized Care Facility" as A state -licensed care facility which is not otherwise specifically defined or regulated elsewhere in this chapter. The City Planners, Lauren Walburg, Stantec, Urban Planner, and Phil Carlson, AICP, Stantec, Senior Planner, have submitted a memorandum addressing zoning and site plan considerations for this application. A version of this memorandum now submitted by the City Attorney addressed the public safety considerations related to this application to the Planning and Zoning Commission. The Planning and Zoning Commission adopted the information provided by Stantec and the City Attorney; and recommends adopting their Findings of Fact and recommend approving an Interim Use Permit allowing Gonion Group, LLC, allowing them to build and operate their senior living/memory care facility. DISCUSSION Facility Licensure The requires licensure from the State of Minnesota and Anoka County to operate their proposed senior living and memory care facilities. During that application process the State will review the applicant's policies, procedures, and intended operating guidelines. The facility's staffing levels will be part of this review by the State. The applicant employs personnel with professional experience of having worked in the field of providing care at assisted living or memory care facilities. The applicant does not currently own or operate assisted living or memory care facilities. The applicant has not yet obtained licensure to operate its proposed facility. They intend to apply for licensure within one year. Issuing an Interim Use Permit will afford them the opportunity to move forward with constructing the facility knowing they have interim approval for use of property as a senior living/memory care facility. Should they fail to obtain their necessary licensure, an Interim Use Permit will allow the land to revert to a state where future owners will be required to apply for land use permissions based on the individual circumstances of their proposed use. Public Safety Services Memory care and assisted living facilities can be associated with an increased number of calls for emergency public safety services. This type of patient population has greater needs for medical services and are at a greater risk for injury. The applicant will operate a 16-unit senior living/memory care facility. The relatively small size of this facility means the business model will employ less staff than would a larger facility. With less staff at the facility to address patient matters, the facility's staff may need to call 911 for support. Any assisted living facility will proportionally increase calls for emergency services simply due to the type of patient population served by these facilities. However, the City should be concerned with the potential for increased costs for emergency services if 911 calls were used to supplement the applicant's facility staffing. The Mayo Clinic studied emergency medical utilization of assisted living facilities in Olmsted County, Minnesota.' In one finding the report concludes, Data findings show that one-third of visits from [Assisted Living Facilities] to the [Hospital Emergency Department] occurred during weekends and after traditional clinic hours. Traditional primary care medical models featuring ambulatory clinic hours (8 am to 5 pm) may not meet the current and future needs of medically complex older adults. To operate this facility the applicant proposes, "Our staff will consist of two people on - site during the day and one overnight." The applicant submitted three proposed staff policies and procedures to the City regarding their response to emergency situations. The proposed policies and procedures will be subject to State review at the time they apply for their operating licensure. It is reasonable for the City to place operating conditions on the facility to ensure that an increase in emergency service is the responsibility of the applicant, and not the City. ' A Comparison of Emergency Medical Service Utilization in Assisted Living and Long -Term Care Facilities, Ericka E Tung, MD, MPH, Mayo Clinic, Annals Of Long -Term Care, Sept/Oct 2017. 2 For example, the City might place a condition stating that the facility shall have an adequate number of staff with training to handle non -emergency situations such as lift - assistance and illnesses. The City could also choose to set up a fee in -lieu of service, in which the facility would be allowed to call emergency services a certain reasonable number of times per year but would be required to pay for services should calls become excessive. These conditions could be included in a conditional use permit. The State will review and approve the applicant's operating policies and procedures during its licensure approval process. That process will likely occur at some point during the next year. After that process is complete, the City will know the applicant's State - mandated operating policies and procedures. Moreover, the City may gain valuable insight into the applicant's operations as a result of the State's process. The City should use information gained from the State's licensure process to augment its decision - making related to the applicant's request for a Conditional Use Permit. If the Commission wants to consider information from the State's process as part of its decision -making related to a Conditional Use Permit, the Commission has two choices: 1) deny the Conditional Use Permit and wait for the licensing process to occur, or; 2) grant an Interim Use Permit allowing the applicant to go forward with property development while completing the licensing process. RECOMMENDATION The City Attorney recommends granting an Interim Use Permit for a limited scope and duration affording the applicant the opportunity to obtain licensure to operate the facility and satisfy the stated public safety concerns. The additional reasons for granting this permit are set forth in the memorandum from the City Planners. Please note that to grant the Interim Use Permit, technically speaking, the Commission is denying the current request for a Conditional Use Permit, and instead, granting an Interim Use Permit. The Interim Use Permit should be renewed annually until the State licenses the applicant to operate its facility. Thereafter, the City can observe and study their operations to determine whether to institute conditions to insure that the City will not incur unreasonable cost increases for emergency services due to their staffing decisions. Thereafter, they must obtain a Conditional Use Permit to continue operating. The Planning and Zoning Commission felt that a one-year period of observation would be appropriate. The Zoning Code, in 156.330(C), states the way in which an Interim Use Permit may be used. The phrases in bold are intended to emphasize relevant information. (1) An Interim Use Permit may be granted for the following uses only: (a) Any use specifically listed as a Conditional Use or Interim Use in the 3 regulations applicable to the district in which it is to be located or otherwise stated in this Chapter as a conditional use or interim use; (b) Any use which is the same or similar, and consistent with, a conditional use specified in the use district, the Planning Commission may consider and allow such use as an interim use; and (c) A use which is limited in scope or duration. The Zoning Code, in 156.330(C), states the criteria for granting an Interim Use Permit. The phrases in bold are intended to emphasize relevant information. It is worth noting how the first three criteria for granting an Interim Use Permit are the same three criteria used for granting a Conditional Use Permit. (2) An Interim Use Permit shall be granted only if evidence is presented to establish: (a) That the proposed building or use at the particular location requested is necessary or desirable to provide a service or a facility which is in the interest of the public convenience and will contribute to the general welfare of the neighborhood or city; (b) That the proposed building or use will not have a substantial or undue adverse effect upon adjacent property, the character of the neighborhood, traffic conditions, utility facilities and other matters affecting the public health, safety and general welfare; (c) That the proposed building or use will be designed, arranged and operated so as to permit the development and use of neighboring property in accordance with the applicable district regulations; and (d) That the scope or duration of the proposed use is of a limited nature which would not otherwise run with the land; (e) That the scope or duration of the proposed use is subject to clearly defined and stated limitations. Conclusion The Findings of Fact and conditions proposed by the Planning and Zoning Commission meet these legal standards and are wise and appropriate grounds in support of their recommendation to approve an Interim Use Permit. The site is zoned B-2 Main Street Commercial district. "Specialized care facilities" are allowed as a conditional use in the B-2 zoning district. City code defines a "Specialized Care Facility" as A state - licensed care facility which is not otherwise specifically defined or regulated elsewhere in this chapter. The project is being processed as an Interim Use Permit (temporary) which would allow the applicants to apply in the future for a Conditional Use Permit (permanent) once they are in operation and the City can review their performance, plus Site Plan approval. PLANNING & ZONING COMMISSION RECOMMENDATION The Planning & Zoning Commission heard the requests at their January 9, 2020 meeting and unanimously recommended approval of the Interim Use Permit and Site Plan for the project, with conditions. There are attachments in the City Council packet detailing various policies and procedures involved. 3) Screening and landscaping of the facility to neighboring properties, lighting, parking, and exterior building materials. 4) The process involved - an Interim Use Permit first, so that the City can review the facility's operations and experience over a period of time, followed by the opportunity for the applicants to apply for a Conditional Use Permit. RECOMMENDATIONS The recommendations below for the Interim Use Permit Conditions and Findings of Fact are also in the draft Interim Use Permit prepared by the City Attorney, in the City Council packet. Interim Use Permit I recommend that the City Council approve the Interim Use Permit (IUP) for the Atlas Villas Memory Care project at 825 Main Street with the following conditions, which follow closely the Planning & Zoning Commission recommendation: 1) Landowner will obey all laws and regulation necessary to operate this type of facility, and will obtain and maintain, in good standing, all licenses necessary to operate this type of facility. 2) The facility will have a sufficient number of trained personnel at the facility at all times who are capable to perform lift assists and will follow protocol discussed in Policy 2.05 Fall Protocol submitted with the CUP application. If the nature of those calls become excessive, at such time as the Landowner may apply for a Conditional Use Permit the City may impose conditions to compensate the City for excessive calls for emergency services. 6) The IUP would renew annually but the applicants may apply for a CUP at least one year from the date they open their doors. 7) Site lighting on the Subject Property will be downcast cutoff type fixtures directed away from adjacent residential uses with no more than one half (0.5) foot-candle of light at all exterior lot lines. The lighting plan will be submitted to the City Planner and City Engineer for approval before a building permit is issued. 8) Landscaping and screening shall be provided as follows: a. The site plan will be revised to include a wall or fence to the adjacent property at least 6 feet in height to screen the east side of the site and to allow views to the pond north of the site, to be reviewed and approved by the City Planner. b. If the facility includes an outdoor patio or recreation area, the entirety of this area shall be screened to the satisfaction of the City Planner. c. The Landowner must make this application within one-year of the date the licensure has been fully granted. Failure to make timely application voids the Interim Use Permit. 17) This Interim Use Permit is not transferrable to another party without the written approval and consent of the City Council. Findings of Fact for Interim Use Permit I recommend the City Council adopt the following Findings of Fact in support of the IUP: 1) The proposed Atlas Villas Memory Care facility is an appropriate use for the City's Main Street Commercial District as a specialized care facility use. 2) The addition of a memory care facility in this location benefits the general welfare of the neighborhood and City. 3) The City's expectation for high quality, durable building materials is reasonable to protect the investment and character of its business districts. 4) The proposed Atlas Villas Memory Care facility is required to operate pursuant to licensure granted by the State of Minnesota and Anoka County. The facility has not yet obtained that licensure. The City's expectation is that the facility will comply with applicable law, regulation, and licensure necessary to operating the facility, as well as additional operating conditions set by the City which are reasonable to ensure that the facility is not an undue burden on public emergency services. 5) Memory care and assisted living facilities similar to the proposed facility can be associated with an increased number of calls for emergency public safety services. This type of patient population has greater needs for medical services and are at a greater risk for injury. 6) The applicant proposes to operate a 16-unit senior living/memory care facility. The relatively small size of this facility means the business model will employ less staff than would a larger facility. With less staff at the facility to address patient matters, the facility's staff may need to call 911 for support. Any assisted living facility will proportionally increase calls for emergency services simply due to the type of patient population served by these facilities. However, the City should be concerned with the potential for increased costs for emergency services if 911 calls were used to supplement the applicant's facility staffing. 7) It is reasonable for the City to place operating conditions on the facility to ensure that an increase in emergency service is the responsibility of the applicant, and not the City. „Ig wffl"l it rnlrr�Wi; January 22, 2020 Centerville City Council Page 5 of 6 Atlas Villas Memory Care - Interim Use Permit & Site Plan Approval 8) The State will review and approve the applicant's operating policies and procedures during its licensure approval process. After that process is complete, the City will know the applicant's State -mandated operating policies and procedures. Moreover, the City may gain valuable insight into the applicant's operations as a result of the State's process. The City should use information gained from the State's licensure process to augment its decision -making related to the applicant's future request for a Conditional Use Permit. However, it would be premature for the City to grant a Conditional Use Permit until the facility's licensure process is complete. 9) Granting an Interim Use Permit until the facility's licensure process is complete will allow the applicant to move forward with development of the property. 10) An Interim Use Permit could be renewed annually on the condition that the applicant demonstrates their intention toward seeking an operating license for a 16-unit senior living/memory care facility. Once licensure to operate the facility is granted, the applicant must apply for a Conditional Use Permit from the City within 180-days of that date. 1 1) The project as proposed meets the criteria for granting an Interim Use Permit in Section 156.330(C) (2) of the Zoning Code. Site Plan Review I recommend that the City Council approve the Site Plan for Atlas Memory Care with the following conditions: 1) Landscaping and screening shall be provided as follows: a. The site plan will include a wall or fence to the adjacent property at least 6 feet in height to screen the east side of the site and to allow views to the pond north of the site, to be reviewed and approved by the City Planner. b. If the facility includes an outdoor patio or recreation area, the entirety of this area shall be screened to the satisfaction of the City Planner. c. At least 3% of the paved driving areas shall be landscaped with grass, shrubbery or approved ground cover as required by City Code. 2) The exterior building materials be face brick, finished block or other textured masonry product. 3) Revise plans to address the comments of the City's Engineering, Public Works and Public Safety departments as listed below: a. The drainage and utility easement through the middle of the site must be vacated. This will require a public hearing. The plans show a proposed 20-foot wide drainage and utility easement along the north line of the property. This is acceptable to the city. Additionally, 5-foot wide easements along the west and east edges of the property should be recorded. The applicant shall create necessary easement documents and pay for costs associated with recording. c. An easement covering the entirety of the stormwater infiltration basin shall be recorded. While the property owner will be responsible for this private stormwater BMP, as an MS4 City, we would be required to maintain this facility, should the property owner fail to do so. The applicant shall create necessary easement documents and pay for costs associated with recording. d. Water services (fire and domestic) shall have adequate cover through the stormwater treatment area and under the retaining wall. e. The sanitary sewer connection to the manhole, must be completed with a water- tight gasketed fitting, such as a Kor-n-seal. f. The outlet from the Rain Garden Turret should be piped. Rip rap outlets are discouraged. g. The Outlet Control Structure must be wholly contained within private property (in city drainage and utility easement), since the city does not control the county right- of-way. h. The full sized set of plans did not print at a proper scale. Please review this issue. i. A 6" water main stub exists near the center of the property, along the county road. The water main connection should be to this stub. Most buildings in our city have only one water service line enter the building. Then, the fire suppression system splits off prior to the meter. j. A tap in the sewer exists 10 feet west of the manhole where you are showing connection to the sewer. Utilizing this tap is preferable to entry into the MH. The tap may need to be enlarged to accommodate your 6" service and a saddle which prevents service intrusion will be required. k. The fire inspector will classify the building as such: Supervised living facility Class B-2, 7-16 residents all of whom may not be capable of self-preservation. IBC Class R-4. I. Fire department access roads shall extend to within 150 feet of any portion of the building. Actual is 170 feet but an increase is allowed due to building being sprinklered. m. Fire Hydrant within 400 feet of farthest point of building (sprinklered). n. Ironwood (Ostrava Virginiana) grows to 40 feet high and 25 feet wide. Once licensure to operate the facility is granted, the City can observe the facility in operation in order to examine its concerns related to consumption of emergency services. Those that struggle with memory issues typically require a higher level of care than a standard assisted living facility. Residents would not have the capability to drive and would only leave the facility for supervised day trips or doctor's visits. Atlas Villas will provide a safe and secure home for the residents and will be equipped with a secured entry and alarms at all doors and windows to silently alert staff when opened. Residents will have access to a concrete encased room in the event of a storm that will also double as a movie theater, and meeting room. The majority of the time the room will be used as a virtual room. The room will contain large screen tv's and scenery that will offer residents visual, audio, smell, and touch sensory exposure for a variety of different locations. The scenes will change on a weekly basis. For example, we will have video of a beach scene with beach sounds, sand, coconuts, and other props along with the scent of a Caribbean island. Often people suffering from dementia and Alzheimer's will experience alterations in their sleep cycles. It is our goal to alleviate these symptoms. We have designed an environment that consists of a faux sky on the ceiling that will mimic sunrise and sunset through the use of lighting and sounds. On -site staff will provide assistance in the preparation and serving of meals and will assist with bedtime routines as part of encouraging a proper sleep cycle. We also wish to create a sense of community throughout the facility. One of the ways in which this will be achieved is by giving each room an individual exterior look by using vinyl siding, exterior doors, and porches. Our staff will consist of two people on -site during the day and one overnight. We do not anticipate much traffic at the site. There will be weekly food deliveries as well as visits from family members. Trash service will be picked up biweekly.
