TITLE OF ISSUE:
Witzel Electric - Nuisance Violation Appeal
BACKGROUND AND SUPPLEMENTAL INFORMATION:
In August 2019, the P&Z Commission heard an appeal of the Zoning Administrator's (ZA) decision on a
nuisance violation related to lighting at Witzel Electic. A letter from the ZA to Witzel Electric and the response
letter are attached. Also attached are the minutes from the August meeting where the appeal was heard. The
appeal was "...tabled pending action by Mr. Witzel to abate the nuisance." Mr. Witzel installed a small
extension to the hood on one of the lights. However, the complainant did not see a difference in the glare. Mr.
Witzel was made aware that this hood extension had not solved the problem. No further action has been taken
by Mr. Witzel since then. A few months ago, Mr. Witzel left a voicemail message for the ZA stating that there
had been an auto theft from the parking lot. He is also asserting that the responding officer was in support of
his lighting to deter crime. Attached is the written opinion of another officer who examined the area at night.

Staff was directed to bring back possible language allowing accessory structures as conditional
uses in the M-1/M-2 districts and to add that change in code to the public hearing notice for the

I tried to call you. Sgt. Giese went to the business at night. He thought that the light was NOT too
bright. He could not tell how it would be shining directly into anyone's residence. He compared the
lighting to that of a normal street light. The way he described it was "ambient lighting." That was just his
opinion, and obviously this is not necessarily a police issue, but let me know if you would like any further
assistance from us.

glare for the neighbors. We understand that security is an issue in this area, but
think there is a way to light the area, without lighting the neighbors.

On/Off Street Parking
BACKGROUND AND SUPPLEMENTAL INFORMATION:
At the last Planning and Zoning Commission meeting, the issue of on/off street parking was reviewed,
especially as it relates to certain situations in the downtown area, as we prepare for the reconstruction of the
streets in that area. Attached are some sketch layouts of various parking arrangements for a business in
downtown.
Our attorney has given an opinion related to the status of a business or homeowner's parking arrangement as a
legal non-conformity. In summary, he asserts that parking facilities on private property may be somewhat
protected by the legal non-conformity status, but parking facilities that extend into the city's right-of-way would
not be afforded those same protections, nor would the location or size of an access to the road. The city has the
right and duty to control its right-of-way and access to it for the health, safety, and wellfare of the public.

Direct staff on whether or not certain changes or clarifications to the existing city code should be explored
related to on/off street parking.

Old Mill Estates 2nd Addition
BACKGROUND AND SUPPLEMENTAL INFORMATION:
The developer of Old Mill Estates has requested approval for a final plat of Old Mill Estates 2nd Addition. The
proposed final plat is largely in conformance with the approved Preliminary Plat so it does not require a public
hearing. The Commission should review and give comments on the proposed 2nd Addition.
