Driveway and Parking Ordinances
BACKGROUND AND SUPPLEMENTAL INFORMATION:
Over the course of the past several months, the Planning and Zoning Commission has reviewed various aspects
of the city code related to residential driveways and parking on residential lots.
A public hearing on these matters was held on October 1, 2019.
Staff would like to finalize the suggested changes to the ordinances and present them to the City Council for
adoption. Attached you will find the proposed language changes as well as graphic figures depicting the
proposed new rules.

THE CITY OF CENTERVILLE

ORDINANCE NO. XX
RELATIVE TO LOCATION AND SURFACING OF DRIVEWAYS AND
PERMITTED VEHICLES AND EQUIPMENT IN RESIDENTIAL DISTRICTS
The City Council of the City of Centerville hereby ordains:
Section 1. That Section 156.06 DEFINITIONS shall be amended by adding two new definitions
to be placed in alphabetical order with the current definitions, as follows:
DRIVEWAY. A private access road, the use of which is limited to persons residing,
employed, or otherwise using or visiting the parcel of land on which it is located.
DRIVEWAY, PERMITTED. A driveway that is of the appropriate size, location, and
surface as regulated by this Chapter.
Section 2. That Section 156.06 DEFINITIONS shall be amended by revising the definition of
Impervious Surface as follows:
IMPERVIOUS SURFACE. Any artificial or natural ground cover that prevents the
penetration or infiltration of surface water. Any material that substantially reduces or
prevents the infiltration of stormwater into previously undeveloped land. IMPERVIOUS
SURFACE shall include graveled driveways and parking areas.
Section 3. That item (c) under Section 156.144(M)(1) shall be deleted, and the other lettered
items reordered to read as follows:
(M) Outside storage. All products, materials and equipment, except as specifically
provided in this chapter, shall be stored within permitted structures, except for the
following:
(1) Residential districts.
(a) Agricultural products, equipment and appurtenances owned by the
owner of the property and used on the property on which they are kept;
(b) All licensed and operational motor vehicles shall be parked on the
permitted driveway area. Any unlicensed, nonoperational vehicles
must be stored in an enclosed structure;
(c) A maximum of two of the following units may be stored outside of a
structure for more than 48 hours on any residential parcel, provided

they are stored on the permitted driveway area outside of the road
right-of-way or are in a side or rear yard. A licensed motor home or
fifth-wheel trailer is allowed in a side or rear yard. None of the
following items may have an overall length from front to back in
excess of 35feet:
1. Boat;
2.Camper;
3. Motorhome;
4.Snowmobiles;
5. Personal watercraft;
6.Personal utility trailer;
7. Icehouse; and
8.Small construction equipment.
(c) (d) Clotheslines, antennae, air conditioners, outdoor grills, play
equipment, ornaments and monuments;
(d) (e) Temporary storage of materials and equipment during construction
and landscaping; and
(e) (f) Lakeshore properties can store the following items of personal
property within 50 feet of the shoreline during the months from
September to May: docks, boatlifts, swim rafts, slides and other
swimming equipment.
Section 4. That the heading for Section 156.166 shall be amended to read as follows:
156.166 PARKING AND DRIVEWAY REQUIREMENTS.
Section 5. That Section 156.166(K) shall be amended to read as follows:
K) Improvement and maintenance. Required parking and loading spaces, together with
driveways, aisles and other circulation areas, shall be improved with in a way as to
provide a durable and dust-free surface such as asphalt, concrete, pavers, cobblestone
or similar material as approved by the City Engineer. Gravel or loose rock, such as
landscape rock, is not permitted. according to minimum city specifications, excluding
R-1 Districts. This surfacing requirement does not apply in the R-1 District, where
gravel driveways are allowed. All parking and loading areas shall provide for proper
drainage of surface water to prevent the drainage of the water onto adjacent
properties or walkways. The owner of any parking or loading area shall maintain the
area in good condition without holes and free of all dust, trash and other debris.
Parking and access drives shall be located a minimum of five feet from any property
line. Parking spaces shall be a minimum of nine feet wide and 18 feet deep.

Section 6.That Section 156.166(L) shall be amended to read as follows:
(L) Driveway Aaccess. All off-street parking areas in non-residential zoning districts
shall have access from driveways rather than from public streets, and except by
conditional use permit, the driveway access shall be limited to a maximum of 32 feet
in width at the curb line.
Section 7. That a new Section 156.166(M) shall be added to read as follows:
(M) Permitted driveways for residential uses. A permitted driveway for any residential
use:
(1) Shall be a minimum of 8 feet in width; maximum shall be 24 feet wide at the
right-of-way line, or for garages 24 feet in width or wider, the width of the
garage, to a maximum of 32 feet;
(2)Shall be a minimum of 18 feet deep;
(3) Shall be located a minimum of five feet from any property line, including
roadway right-of-way or roadway easement;
(4) Shall not be located within any required side or rear yard setback nor within
a drainage and utility easement;
(5) May include a paved parking or turnaround area not more than 8 feet by 18
feet adjacent to a driveway connecting a roadway to a garage or front yard.
(6) May not include more than one driveway connection from a public roadway
into a single family residential lot, except for corner lots which are permitted
one driveway per street frontage.
(7) Shall connect to a garage or other permitted structure in the yard, not to open
yard.
(8) Driveway connections for multi-family uses will be reviewed in the site plan
review process.
Section 8. That a new Section 156.166(N) shall be added and current item (M) in that section
be reordered to item (O), to read as follows:
(N) Permitted vehicles and equipment stored on residential lots. Any number of
automobiles shall be allowed on a permitted driveway. A maximum of three of the
following units may be stored outside of a structure on the permitted driveway area
on any residential parcel or in a side or rear yard, provided they have an overall
length from front to back of 35 feet or less:
(1) Automobiles not parked on the permitted driveway;
(2) Boat;
(3) Camper;
(4) Motor home;
(5) Snowmobiles;
(6) Personal watercraft;
(7) Icehouse;

(8)Small construction equipment; or
(9) Personal utility trailers, provided that vehicles loaded on a trailer shall not
count as separate units under this provision, but rather the trailer shall count
as one unit;
(O)
Requirements For Mixed-Uses. If a building or structure contains a mixture of uses
as defined by paragraphs (A) and (I), the minimum number of parking spaces
required for the entire building or structure shall be calculated for the most restrictive
parking use as permitted by the applicable zoning district and building codes.
Section 9. Effective Date. This ordinance takes effect upon its adoption and publication.

meeting on Tuesday, February 4, 2020 at 6:30 p.m.

The following people addressed the Committee during the public hearing:

o Why have slips been sold if the total number of slips was not finalized?
o Asked about drainage through culvert between lakes. Concerned that docks may impede
flow.

o Explained that the market has driven the change in the amount of slips. The initial builder
that the developer had worked with felt that not all the upland homes would want dock
access, but the current buyers have all expressed interest and several leads have walked
away after they were told that dock access may not be available to them.

Hearing at 6:52 PM. All in favor. Motion carried.
Administrator Statz explained that no studies have been done, but that with half or more of the
lakeshore occupied by a reginal park, the overall density of docks (boats) on the lake, is certainly
not more than most suburban lakes. He also assured the commission that the docks would not
impede the flow of water between the lakes.

1. Conditional use Permit Re
Commissioners debated the various issues, with consensus being that there was not a large
concern regarding the overall issue of dock or boat density and that the main concerns were the
aesthetics of such a large complex of docks. The commission felt strongly that the City Council
should be given at least two options to review for the layout of the docks, prior to approval of the
Conditional Use Permit revisions.
Motion by Commissioner Twohy, seconded by Commissioner Olson to recommend approval
of the Conditional Use Permit Revision, by the City Council with the stipulation that the
Council should be presented with at least two layout options for the docks. All in favor.
Motion carried.

Administrator Statz presented a preliminary plat for a Lino Lakes development that would abut
portions of Centerville. There are no road connections proposed between the two communities.
All traffic would be directed out to one of two county roads adjacent to the development. There
was some discussion over drainage from the development coming onto adjacent property in

Centerville and the fact that the plans seemed to show grading and an outlet pipe on said property.
The commission did not feel that those encroachments should be allowed.
Administrator Statz would convey the commissions concerns to the City of Lino Lakes.
No formal action taken
3. Review of Off-Street Parking in Downtown
The commission was presented with three locations in the downtown where the current parking
configuration is not in line with city code. With the pending street reconstruction project in the
area, city staff was asking to look at ways to bring these areas into compliance, being sensitive to
the needs of those businesses, institutions and residents. The commission had some discussion of
options, including diagonal or parallel parking spots.
Mr. Tom Wilharber was in attendance to address the parking issues related to the church. He
stated that a church has been at this location (on Sorel Street) since 1854. He was appreciative of
the issues relating to the code, but hoped something could be worked out to preserve the parking
spots.
Staff was asked to bring back on-street parking sketches

1. Appeal of Zoning Administrator Decision-Witzel Companies, 7129 20 Avenue
Lighting Nuisance
Administrator Statz explained that several months ago, he, acting as the Zoning Administrator
issued a letter to Witzel Companies regarding their exterior lighting, stating that it was causing a
public nuisance and requiring the nuisance to be mitigated. Mr. Witzel, owner, of Witzel
Companies subsequently appealed that decision and was heard by the appeal board (the P&Z
Commission). During the hearing, Mr. Witzel agreed to mitigate the situation by installing a

shield or different fixture, screening the light from the neighbors. With this promise, the P&Z
Commission tabled the appeal. To date Mr. Witzel has not completed this task.
After a brief discussion, the P&Z Commission took action as detailed below.
Motion by Commissioner Fehrenbacher, seconded by Commissioner Haiden to affirm the
decision of the Zoning Administrator. All in favor. Motion carried.
2. Off Street Parking in Downtown
Staff presented various arrangements of on and off-street parking for the 3 locations in downtown
that will be affected by the street reconstruction project. The Commission discussed these parking
spaces, the business impacts of eliminating them and the connection to the downtown master plan.
The consensus was to trade these parking spaces for parallel spaces, in accordance with the
Downtown Master Plan, where practical. The downtown street project, is programmed to build
some parallel parking on the south side of Sorel St. to accommodate a future business on the first
floor of an apartment building and adding parallel parking spaces along the north side of Sorel St.
from Centerville Rd to Progress St and in front of the church's property would compliment that
arrangement.
Motion by Commissioner Fehrenbacher, seconded by Commissioner Haiden to recommend
utilizing parallel on-street parking to replace non-conforming spaces lost to the street
reconstruction, where feasible. All in favor. Motion carried.
3. Centerville Storage-Revised Site Plan
Staff presented a revised site layout for the proposed Centerville Storage project. It removes the
northernmost building and extends the two middle buildings to the north about 40 feet each. This
is done because they could not reach an agreement with the neighboring property owner to the
north to vacate the ingress/egress easement. The new layout does not increase impervious area,
the number of units or expand the footprint of the development. In some areas, there is a reduction
in the impacts.
Motion by Commissioner Haiden, seconded by Commissioner Fehrenbacher to recommend
approval the revised site plan as presented. All in favor. Motion carried.

Staff presented the proposed final plat for Old Mill Estates 2 Addition. The Final Plat is similar
in nature to the Preliminary Plat, approved by City Council.
Motion by Commissioner Olson, seconded by Commissioner Krueger to recommend

approval of the Final Plat for Old Mill Estates 2 Addition. All in favor. Motion carried.
2. Interim Ordinance-Group Living Uses

Administrator Statz explained to the commission that there was a likelihood that the city could see
another application for a Memory Care Facility similar in nature to Atlas Villas, but potentially
much larger. Given the fact that Atlas Villas was approved via an Interim Use Permit, for the
purposes of monitoring their fist year of operation, to get a sense of their impact on community
ng additional facilities to the city under the same
circumstances, magnified the risk of unintended difficulties dealing with these establishments.
Therefore, staff is recommending an interim ordinance to allow time for the city to evaluate the
performance of their first such facility, so they may better regulate future ones.
The commission understood the position of staff and after some discussion came to a consensus to
support the interim ordinance.
Motion by Commissioner Fehrenbacher, seconded by Commissioner Krueger to recommend
approval of the interim ordinance as presented. All in favor. Motion carried.
