Towhomitmayconcern: MynameisMarkStatzandIamtheCityAdministratorfortheCityofCenterville.WehavebeenmadeawarethatM HealthFairviewintendsuseinternalresourcestoassumetheresponsibilityforAmbulanceServiceforourCity,asthey canceltheircontractwithNorthMemorial.ThisissettotakeplaceonJune1.Thischangeseemedlikeagood opportunityforustoreviewourservice,sinceweareintherarepositiontobeabletochoosebetweentwoproviders (MHealthandAllina).WewanttomakesurewehaveproperlyresearchedandpreparedforthischoiceandIwas hopingtoverifyafewthings.Ifyoucouldreplyorcallwithverificationofthefollowing: Centervillehastherighttochooseourambulanceproviderfromoneofthetwoentitieswithrightstoourarea, throughtheiroverlappingPSAs.Thosetwoorganizationsare:MHealthandAllina Centervilleissituatedwithinanareawithoverlappingprimaryserviceareasassociatedwiththedeliveryof advancelifesupportambulanceservice.OnelicenseeisAllinaHealthEMS,andtheotherlicenseeisFairview HealthServices.FairviewHealthServicesoperatessomeofitsbusinessunitsasMHealthFairview,anditisour understandingthatFairviewHealthServiceswillbeoperatingitsambulanceserviceasMHealthFairview.The EMSRBdoesnothavejurisdictionorauthoritytomandatewhichlicenseeservesthePSAintheeventofsuchan overlap.TheEMSRBhasworkedwithservicescollaborativelyandvoluntarilytoresolvemattersofPSAoverlap, andambulanceserviceshaveworkedamongthemselvescollaborativelyandvoluntarilytoresolvemattersof PSAoverlap.ThereisnothinginMinnesotaStatuteschapter144EorMinnesotaRuleschapter4690which grantstheEMSRBtheauthoritytostatethattheCityofCentervillehasthetochooseitsambulance providerwhenthereissuchoverlap.Saidanotherway,thereisnothinginstatuteorrulewhichspecifiesa processformunicipalitiestoengageinsuchachoice.Likewise,thereisnothinginstatuteorrulewhich empowerstheEMSRBtoenjointheCityofCentervillefromdoingpreciselywhatyouseektodo. Centervillemay,atanytime,passaresolutionoftheCityCouncilelectingtouseoneofthetwoproviders.In otherwords,wemaychoose,sayMHealthbeginningJune1,andthensay,theyperformpoorlyoverthe 2 firstfewmonths,wecouldpassanotherresolutionassigningservicetoAllina,instead.TheCityofCenterville hasthelegalauthoritytopassresolutions.Sucharesolution,asweunderstandit,couldnotjurisdictionally compelanambulanceservicetodosomethingunlesstheservicewishestodoso. OurchoicedoesnotredrawPSAlines,orotherwisecancelanyrightswemayhavetochooseourservice providerfromthetwoPSAowners. AnyresolutioncraftedbytheCityofCentervilledoesnotdisturbthenatureorboundariesofanyexistingPSAs. Wedonotneedpermissionfororconcurrencewithourchoicefromanyotherentity,suchastheEMSRBor othergovernmentalagency. IcanonlyspeakabouttheEMSRB.Wedonothavejurisdictiontoprovidepermissionorconcurrence. Wemaynegotiateacontractwiththechosenproviderfortheuseofourmunicipalbuildings/fire stations,etc. Municipalitiesgenerallyhavecontractingauthorityaspartofitsdelegatedpowers. Afterverifyingtheabovestatements,wehaveafewquickquestions: DoweneedtocontacttheEMSRBoranyotheragencytocommunicateourchoice? WhiletheEMSRBcannotcompeltheCityofCentervilletonotifyusofanydecision,wekindlyaskthatitwould doso. Isthereanything,ingeneralthatyoufeelweshouldbeawareofasweconsiderouroptions? Aswediscussedyesterday,youmentionedtometheimportanceofhavinganambulancelocatedinyourcity andtothatendoneoftheservicesofferedtorentspacetohouseanambulanceandcrewinoneofyour municipalbuildings.BasedupontherelativelylowrunvolumeintheCityofCenterville,ifhavinganambulance locatedinyourcityisofparamountimportance,youmaywishtoexplorehowoften(hoursperday/daysper week)anambulanceandcrewwillbestationedinyourmunicipalbuilding.Tobeclear,thisisnotlegaladvice. Isthereanything,specificallyinvolvingeitherofthetwoprovidersthatweshouldbeawareof?Anyissueswith licensure,recentdisciplinaryactionsfromtheboard,etc. TheacquisitionofHealthEastCareSystembyFairviewHealthServiceshascreatedaquestionregardingthe proposedtransferofthelicense/ownershipofthelicensedambulanceserviceregardingaHealthEastambulance licenseinDakotaCounty.ThematterwillbediscussedandhopefullyresolvedatameetingoftheEMSRBBoard onThursday,June18,2020.
