TITLE OF ISSUE:
Interim Use Permit - Rehbein Black Dirt
BACKGROUND AND SUPPLEMENTAL INFORMATION:
Attached is a draft Interim Use Permit (IUP) and associated, draft Findings of Fact for an Interim Use Permit.
Rehbein's Black Dirt has an existing IUP which is set to expire at the end of the year and is seeking an
extension of that agreement. Staff is suggesting issuing a new IUP. The new IUP would have only minor
language changes from the last, but would also add a requirement for a Letter of Credit to cover the costs of
removal of existing piles of material, should that not be accomplished during the duration of the proposed IUP.
Also attached are photos from a recent compliance inspection. While there are compliance issues, the applicant
has generally been responsive to requests for correction. We, would of course, make correction of these issues
a condition of issuing the new IUP.

After a staff report, the chair should open the public hearing to allow for public comment. He may invite
comment from the applicant as well. A motion should be made/seconded/approved to close the public hearing.

conditional use. Such report shall be accompanied by findings of fact specifying the reasons for
the recommendation. In considering conditional use applications in the Flood Plain Districts, the
Planning Commission shall consider all requirements of this Chapter together with Chapter 155,
Flood Damage Prevention.
(4) The Council shall, within 30 days of the receipt of the report of the Planning Commission, grant
or deny the conditional use or refer the matter back to the Planning Commission for further
consideration. The Council shall not grant a conditional use unless it finds that the standards of
this Section have been satisfied. Any proposed conditional use which fails to receive the
approval of the majority of the members of the Planning Commission voting upon it shall not be
approved except by a favorable vote of four-fifths of all of the elected members of the Council.
(5) A Conditional Use Permit shall be valid for a period of one year from the date of its approval by
the Council, after which the same shall be revoked in the event that any proposed construction,
alteration or operation has not been started in accordance with the terms of such permit.
(6) A Conditional Use Permit shall remain in effect only so long as all of the conditions granted by
the Council are observed. The Permit is immediately void when a condition is no longer
observed and may only be renewed after a new application for a Conditional Use Permit has
been granted as set forth in this section. The Permit shall run with the land so long as the
conditions are observed. Failure of the City to discover the violation of a condition, or failure by
the City to act upon a violation of a condition does not constitute a renewal of the Conditional

and performance standards that protect the public health, safety and welfare.

(D) Procedure.
(1) An application for an Interim Use Permit shall be submitted in triplicate to the Zoning
Administrator. The Planning Commission or the Council may require any additional information

(E) Termination. All Interim Use Permits shall terminate on the happening of any of the following events,
whichever first occurs:
(1) The date stated on the permit;
(2) Upon violation of the condition under which the permit was issued; or
(3)
(F) Right of Enforcement. All Interim Use Permits are immediately void when a condition is no longer
observed or a condition has expired. The Permit may only be renewed after a new application for an
Interim Use Permit has been granted as set forth in this section. The Permit shall not run with the land.

INTERIM USE PERMIT
1. Permittee. Subject to the terms and conditions set forth herein, the City of Centerville hereby
grants approval of an INTERIM USE PERMIT, to Rehbein Properties, a partnership consisting
of Gerald L. Rehbein and Gordon W. Rehbein, the current owner of the Property described
below, and for R & R Leasing, Inc., (a. k. a. Rehbein' s Black Dirt) to operate on the Property.
This Permit is not transferable to another party or property owner. This Permit does not run
with the land.
2. Permit. Subject to the terms and conditions set forth herein, the City of Centerville hereby
grants approval of an INTERIM USE PERMIT for R & R Leasing, Inc., (a. k. a. Rehbein' s Black
Dirt) to operate a topsoil processing business at the properties described below, subject the
conditions of this Permit. All previous Interim Use Permits issued by the City which govern
this Property are void, and this Interim Use Permit shall supersede and replace all previous
Interim Use Permits issued for this Property.
3. Property. The Permit is limited to the following described property:

SUBJECT TO EASEMENT OF RECORD.
4. Conditions. This Permit is issued subject to the following conditions:

a)!The permissions granted by this Permit are strictly limited to the Property described in
paragraph three, above, with the following exception: the operations permitted in
paragraph two, above, may not be conducted north of Clearwater Creek.
b)!Definition: Topsoil Earthen material meeting the requirement of the Minnesota
c)!All activity on the Property must comport with the Minnesota Creek Buffer law,
Minnesota Statute Section 103F.48, by keeping a fifty (50) foot wide buffer from
Clearwater Creek except at such time as temporary nonvegetated
maintenance and mining of topsoil, and backfill within that buffer.
d)!All topsoil processing activities, including stockpiling of topsoil shall be conducted entirely
within the easterly 680 feet of the property south of Clearwater Creek (approx. 13 acres
Area A on Exhibit A), and shall not encroach within fifty (50) feet of the top of the
ordinary high water mark of Clearwater Creek within the area described above.
e)!Mining/stripping of topsoil and backfill of the mined/stripped area with existing, on-site
material shall be allowed on the entire property described and included in this Permit
(Areas A & B on Exhibit A). Generally, these operations may not encroach within fifty (50)
feet of the top of the ordinary high water mark of Clearwater Creek, however, operations
may encroach within ten (10) feet of the top of the ordinary high water mark of
Clearwater Creek for a period no longer than necessary to mine material near the Creek.
Thereafter, the fifty (50) foot buffer shall be resorted.

1.!Maintain double row of silt fence around perimeter of site while there is exposed
soil. Fences shall be maintained through the duration of this permit in accordance
with MPCA best practices.

stockpiling and black dirt processing operation, except temporarily by maintaining
a ordinary high water mark of Clearwater Creek for
mining/stripping operation. minimum buffer shall be maintained no
longer than necessary to conduct mining/stripping operations, and shall be
immediately restored on the conclusion of mining/stripping operations.

4.!Maintain a rock construction entrance per approved city detail plates at the
entrance to the site and keep the drive and adjoining street free of mud and dirt.
Upon notice by the city of excessive accumulation of dirt or mud in the street,
Permittee shall clean and\\or sweep within four hours. A pick-up style sweeper
shall be used for all street cleaning activities. Sidewinder style brooms shall not
be allowed.

k)!No fuels or chemicals shall be stored on the site south of Clearwater Creek.
l)!Maximum noise emitted at the property line shall conform to the noise regulations
contained in City Code Section 91.09 and applicant shall not violate other nuisance
regulations contained in Chapter 91.
m)!The maximum height of all piles shall be limited to 50 feet above the natural grade of the
site. Materials allowed to be brought to the site shall only be topsoil materials (as defined
above). Upon request, the permittee shall present the city with soil test results
demonstrating that imported soil meets this criteria. Up to 5,000 cubic yards (Loose
Volume) of non-topsoil material for the exclusive use of amending the topsoil material for
sale shall be allowed on the site at any given time during the term of this Permit. No
broken concrete or asphalt material is permitted.

n)!Ingress and egress shall be limited to 21 Avenue. Hauling on Commerce Drive and
Fairview Street in conjunction with this Permit is not allowed.
o)!Permittee shall supply a monthly accounting of all material hauled in to the site and
hauled off the site. This accounting of material hauled from the site shall be in the form
of a log of loads hauled out each day and documenting the quantity of material in each
load together with copies of truck load tickets and/or bills of sale.
1.!Recognizing the impact on adjoining streets and in recognition of administrative
and other costs of monitoring this Permit the following fees shall be paid by the
operator: For loads of topsoil material hauled from the site, $0.25 per cubic yard,
to be paid monthly.
2.!For loads of existing non-topsoil material hauled from the site, $0.10 per cubic
yard, to be paid monthly.
p)!Landowner and the business operator shall jointly and individually be responsible for the
continuing conformance with the Permit and that if the proposed use is not initiated
within six months of this date, the Permit shall be void.
q)!Grantee will follow the applicable standards and requirements of the City of Centerville,
Rice Creek Watershed District, Anoka County, Army Corp of Engineers, FEMA, Minnesota
Department of Natural Resources, Minnesota Pollution Control Agency (MPCA) and any
other agency having jurisdiction over the property and shall secure and file with the City,
copies of any permits required by outside agencies. Grantee will secure necessary permits
and follow the applicable rules and regulations of Minnesota Pollution Control Agency
and EPA for collection, storage and disposal of solids, liquids and gases. Grantee will file
with the City within ten days of receipt, copies of any permits and/or notice of
enforcement actions by these agencies.
r)!Grantee will permit a City Inspector to view the premises, including the inside of buildings,
during normal business hours.
s)!No fill may be placed in the FEMA designated floodway or flood fringe. The City reserves
the right to review this Permit annually for compliance with the conditions and may
impose additional conditions to mitigate unforeseen problems.
t)!Portable toilets shall be provided and serviced regularly at all times during site operations
and shall be screened from visibility by neighboring properties.

u)!An administrative fine of $500 per day shall be levied for uncorrected violations of the
above conditions. The fine shall be levied per day, per condition violated.
5. This Permit shall be effective April 1, 2019 January 2, 2021, and shall expire aton December
31, 20202022. Not later than December 31, 20192021, all excess non-topsoil material
remaining on the site shall be hauled away and/or leveled and the site graded and seeded
to prevent erosion, in conformance with law. All in-place topsoil intended for mining, shall
be stockpiled, or removed from the site. Not later than December 31, 20202022, all topsoil
and other material shall be removed from the site orshall be graded (leveled) in a manner
consistent with a pad-ready building site. Not later than December 31, 20202022, all
equipment shall be removed from the site. After such date, the City may take all measures
necessary to enforce the provisions of this Permit, including but not limited to creating a
pad-ready building site on the Property, and assess costs for same, against the Property.
Extensions to the deadlines in this Permit may be granted upon application and approval by
City.
6. This Permit shall become effective once the applicant submits an Irrevocable Letter of Credit
(LOC), in a form acceptable to the city attorney, in the amount of $200,000, which shall
ability to enforce
and remediate issues related to this Interim Use Permit which may arise during or after the
termination of this Permit.
7. Criminal Penalty. In addition to civil penalties, violation of the terms of this Permit is a
criminal misdemeanor.

BACKGROUND AND SUPPLEMENTAL INFORMATION:
Attached is a draft Interim Use Permit (IUP) and associated, draft Findings of Fact for an Interim Use Permit.
Rehbein's Black Dirt has an existing IUP which is set to expire at the end of the year and is seeking an
extension of that agreement. Staff is suggesting issuing a new IUP. The new IUP would have only minor
language changes from the last, but would also add a requirement for a Letter of Credit to cover the costs of
removal of existing piles of material, should that not be accomplished during the duration of the proposed IUP.
Also attached are photos from a recent compliance inspection. While there are compliance issues, the applicant
has generally been responsive to requests for correction. We, would of course, make correction of these issues
a condition of issuing the new IUP.

After five (5) years of serving on the Parks & Rec. Committe and serving seven (7) years on the Planning &
Zoning Commission Mr. Mark Haiden and his family has desired to retire and move from the City of
Centerville. As you are aware, Mr. Darrin Mosher ran for the Council Seat that would fill the remainder of
Mayor Love's Council Seat. Mr. Mosher was successful and was declared the winner for that seat at the
General Election. Mr. Mosher has served on the Commission for 13 years.
The Commission does wish both Misters Haiden and Mosher good luck in their future ventures and thank them
very much for their dedication to the community.

(A) This section establishes a City Planning and Zoning Commission, and a Parks and Recreation
Committee. The purpose of these Committees is advisory and they may make recommendations to the
City Council for consideration regarding matters relating to this Committee.
(B) For the purpose of this chapter, the terms Commission and Committee are used interchangeably. Policy
refers to Commissioners and Committee Members alike.

§ 31.02 BYLAWS FOR COMMITTEES.
(A) Authority. The Committee has the authority to conduct investigations and to make recommendations;
however, it may not make decisions on behalf of the Council. Committees are subject to the same rules
as the City Council under the open meeting laws.

(B) Eligibility. Any resident of the city is eligible to apply as a Committee Member. This individual is
welcome to serve on one committee at a time.
(C) Appointments.
(1) Each member of the Committee will be appointed by the City Council via a letter of interest
submitted to the City Administrator. This letter will be received by the City Administrator no
later than November 1 of each year. This same action will take place if a vacancy should
happen. On an annual basis, the City Administrator would ascertain those who desire to remain
on the Committee.
(2) Seven members shall be appointed to each City Committee.
(D) Appointment of officers. At the first meeting of the year, the Committee will appoint by majority vote a
Chair and a Vice-Chair.

SECTION 31.03. ESTABLISHMENT OF PERSONNEL BOARD
(A) The purpose of this section is to establish a Personnel Board. The Board is a subset of the City Council

investigate high-level and policy level personnel matters for the limited purpose of making
recommendations to the Council. The Board is also granted a limited role in specified areas calling for
the immediate involvement of members of the Council; subject to ultimate ratification by the Council.
The Board is not intended to involve itself in the day-to-day operations of the City or infringe on the
authority of the City Administrator.

(A) This section establishes a City Planning and Zoning Commission, and a Parks and Recreation
Committee. The purpose of these Committees is advisory and they may make recommendations to the
City Council for consideration regarding matters relating to this Committee.
(B) For the purpose of this chapter, the terms Commission and Committee are used interchangeably. Policy
refers to Commissioners and Committee Members alike.

§ 31.02 BYLAWS FOR COMMITTEES.
(A) Authority. The Committee has the authority to conduct investigations and to make recommendations;
however, it may not make decisions on behalf of the Council. Committees are subject to the same rules
as the City Council under the open meeting laws.

(B) Eligibility. Any resident of the city is eligible to apply as a Committee Member. This individual is
welcome to serve on one committee at a time.
(C) Appointments.
(1) Each member of the Committee will be appointed by the City Council via a letter of interest

later than November 1 of each year. This same action will take place if a vacancy should
happen. On an annual basis, the City Administrator would ascertain those who desire to remain
on the Committee.
(2) Seven members shall be appointed to each City Committee.

schedule of regular meetings. This schedule shall be available for public inspection during

(2) Special meetings. Any three members of the Committee may call a special meeting of the

ADMINISTRATION
COVID-19 Response
City Hall
City Hall is currently closed to the public. All permits and other city services may be
accessed online or by calling 651-429-3232.
The City is working towards a re-opening of City Hall to the public by February 1, 2021.
Meetings
All Committee and Commission meetings (P&Z, P&R, EDA, and CC) will continue to be
held via Zoom videoconferencing at least until the renovation work inside City Hall is
complete. The meetings are also broadcast live on North Metro TV and streamed on their
website. Additionally, meeting connection information is being posted on the website and
will be widely distributed so that the public can join. The City is working towards the
transition back to in-person meetings by February 1, 2021.

A 2021 Meeting Calendar has been produced and will be on the December 9 City Council
Meeting Agenda for approval.

Minnesota Technology Corridor
The Excipio Data Center Feasibility Study is now complete. The report presents numbers
which show our site as being very competitive on
number of positive attributes including its proximity to two or more fiber providers,
coming from different corridors, redundant power supplies, and low disaster risk factors
such as our distance from airports, highways, and rail lines.
Minnesota Technology Corridor stakeholders will now begin using this document to
market the property to prospective developers.

A final round of grant funding was recently offered to businesses who had qualified for
either of the first two rounds
Order: bars, restraurants, gyms, dance studios, etc. The application period begain on
November 5 and was open until funds were exhausted. Grants up to an additional $10,000
were be distributed on a first come first serve basis. This means that some businesses were
able to receive up to $30,000 in total from this program. The federal deadline to expend
these funds has now come to a close. No further grant dollars are available through this
fund.
FINANCE
COVID-19 Relief Programs
The city was able to spend or allocate all of its $304,902 worth of CARES Act relief from the
Federal Government, through the State and County and did not have to refund any of it. The
funds were used for:
General direct expenses (hand sanitizer, plexiglass dividers, etc.)
Diverted staff time (time spent on COVID mitigation)
Police and Fire payroll expenses (for time spent on COVID mitigation)
North Metro TV COVID mitigation efforts
City Hall office area renovations for social distancing and other COVID resilience
items.
2021 Budget/Truth in Taxation
The Preliminary 2021 Budget was adopted by the City Council at its September 23 meeting.
If adopted as a Final Budget, it would raise the levy by less than 1%. The City Council may
reduce the budget and levies, but not increase them, prior to adoption of the final versions in
December.
At the December 9 City Council meeting, the Truth in Taxation hearing will be held at
6:30 PM nance director will present information on
the proposed levies and the affect on local taxes. The public will be afforded an opportunity
to speak on these issues.
After hearing from the public, the City Council will need to adopt a final budget and levy for
2021.
COMMUNITY DEVELOPMENT
Centerville Elementary School
Centennial School District is in the early stages of planning an addition to Centerville
Elementary. The addition would add classroom space to add one section to each grade.
Architects working with the district are looking to fill in some of the courtyard space on the
west side of the building and extend the building footprint to the north a bit, necessitating a
move of the current playground equipment. With this configuration, the design will look to
incorporate natural light into the classrooms that would otherwise have views to the courtyard.
The expansion would not require any new work on the parking lot.
The expansion will require a re-route of some city owned sanitary sewer lines. The re-route is being
being reviewed by city staff. Any costs
associated with this will be borne by the school district.
Apartment Complex Concept Plan
The Planning and Zoning Commission was presented with a concept plan for a 3-story, 96-
thst
unit apartment complex sited on commercially zoned land between 20 and 21 Avenues,
north of Main Street. The project would require a Comprehensive Plan Amendment and
Rezoning. If the developer chooses to pursue these land use requests, a public hearing
would be scheduled to receive community input on the proposal.

Centerville Storage (20Ave. Mini Storage)
Framing of the two largest storage buildings is underway. Work continues on the driveway
areas and site grading.
Old Mill Estates
Phase II paving is complete and work on punch list items continues. Homes are being sold.
Bay View Villas (Waterworks Site)
Paving of the wear course and driveway connections is now complete. Punch list items
including landscaping, ped ramps, mailboxes and shoreline plantings will be addressed
in the spring. A letter of credit reduction request is on the December 9 City Council
agenda for consideration.
7241 Main Street
The prospective developer of this property recently contacted the city to reengage in the
process of subdividing the property. We anticipate a sketch plan in the near future.
Block 7 Property (Downtown)
A concept plan for row homes will be reviewed by the planning and zoning commission at
their December 8 meeting. The proposal shows 20 units on the city-owned vacant land in
downtown.
Atlas Villas Memory Care Project (1825 Main Street)
Excavation and building pad preparation work has begun.
Driveway and Parking Ordinance Review
The Planning and Zoning Commission continues to work diligently on issues related to what
and where certain vehicles can be parked on residential properties. Both the existing
ordinance and the one being contemplated by P&Z do not allow parking of any vehicles in
the front yard (not on the driveway).
Planning and Zoning Commission Meeting Postponed
The Planning and Zoning Commission will be meeting on December 8, 2020. Its normally
scheduled meeting was pushed back one week.

PUBLIC WORKS/STREETS
City Hall Renovation
The COVID-19 related office area improvements are now complete. The contractor
will move into construction of the renovation work in the City Council Chambers and
front lobby area (see rendering below). This work should wrap up by mid-January.
The City is working towards a City Hall re-opening on February 1, 2021, including a
transition to in-person meetings of the City Council and various Committees. Of
course, as conditions of the pandemic change, this scheduled will be reevaluated.
Trucks
One of the three new trucks we ordered almost a year ago have now been delivered to
the dealer. Once the other two are delivered to them, they will make a delivery of all 3
to the city.
Misc.
Public works staff have been busy with preparing winter equipment and supplies of salt
& brine. The water systems have been winterized and staff has assisted homeowner
associations with winterizing their irrigation systems. All staff are healthy and on a
regular work schedule.
STORMWATER/WETLAND
LaMotte Park Stormwater Reuse System Expansion
Work on the project is substantially complete, with a few odds and ends that may need to
wait until the spring start-up of the system.
SEWER AND WATER
Wellhead Protection Plan
A Public Hearing on the Plan was held on September 9. No significant comments were
received. A draft of the Part II Plan will be sent to the Minnesota Department of Health for
review and comment.
2020 Downtown Street and Utility Improvements
Paving is now complete! The contractor paved the base course of asphalt just before the

snow plows while we wait to pave the final lift of asphalt next year or perhaps the year
after, depending on how the pavement looks upon inspection next spring.
The project has been hyrdo-seeded. This should allow for good turf growth early next
spring. Mail service has been switched back to normal delivery at permanent mailboxes.
A credit against all assessments has been issued, since sod was initially planned as part of
the project. Watch your mail for a letter outlining the specifics of your credit.

The Parks and Recreation Committee met on December 2 and agreed to keep the Skate

Dates have now been set for our annual Skate Nights: Friday, January 8 and Saturday,
February 6, 2021, from 6 to 9 PM. Mark your calendars.

In an effort to ensure there is an effective response force to respond during the daytime hours,
the Centennial Fire District implemented a Applications for the
position were posted and four candidates have been selected. The four who were selected are
metro departments (Lake Johanna, Andover,
Minnetonka, and SMB Fire) who currently have the same program. The Duty Crew will
rotate from station to station within the district and respond to emergency incidents between
