That Section 156.006 shall be amended to include the following: RETAIL FUEL SALES. An establishment offering the retail sale of fuel and lubricants for motor vehicles. Motor vehicle service and repairs are not permitted on the premises. In a district where allowed, a car wash may be an accessory use to retail fuel sales when permitted as a conditional use. Section 2. That Section 156.030 shall be amended to include the following: (K) Permitted uses (2) Automobile and motorized equipment sales (Indoors), excluding salvage operations, provided; (a) Automobiles and merchandise are stored, and business transactions are conducted exclusively indoors. (b) No repair assembly, disassembly, or maintenance of vehicles shall occur on site except minor maintenance including tire inflation, adding oil and wiper replacement. Vehicles that are inoperable or are missing body parts shall be stored inside a building. (L) Conditional uses. (1) Automobile and motorized equipment sales (Outdoors), excluding salvage operations, provided; *** (13) Car Wash, as an accessory to Retail Fuel Sales Section 3. (b) the sales lot used to park vehicles to be sold shall be separate and distinct from the area of the premises used to park vehicles necessary to satisfy the minimum parking required by this Code. N E U N E V A T S 1 2 A T E E R T S March 23, 2021 Planning and Zoning Commission 1880 Main Street Centerville, MN 55038 Dear Chair and Commissioners: The following are comments of the City Engineer, regarding the preliminary plat application for the proposed Rehbein Commercial. Plat/Easements 1. A discussion of Abstract/Torrens issues Memorandum. 2. Where public sidewalks or trails are not contained within the right-of-way being dedicated, separate trail easements will be required and recorded. 3. The developer shall verify that the easement over the public drainage system (Doc. #525964.003) does not prohibit the construction of public streets or utilities. 4. Access restrictions along both county roads shall be recorded and shown on the final plat per the Access Letter from Anoka County. Sewer and Water 1. For Lot 3 of Block 1 and Lot 1 of Block 2, sewer service is proposed to be directly from Street A via 6-inch and 8-inch stubs, respectively, out of a proposed manhole. 2. For Lot 2, Block 1, sewer service is proposed via a 6-inch stub from a proposed manhole. The stub appears to be intended only to serve Kwik Trip and is placed on the lot line between Lots 2 and 3 of Block 1. If this 6-inch line is intended to serve only Kwik Trip, it should be placed entirely on their lot, so they could perform maintenance without trespassing on the neighboring property. 3. For Lot 2, Block 2, sewer service is proposed via an 8-inch line traversing the east side of Lot 1, Block 2 and connecting to a proposed manhole on Street A. This sewer should be publicly owned and maintained through Lot 1, Block 2. The public ownership and maintenance could be agreement and could terminate outside MH 5. To better align with city ordinances, MH 5 may be best placed on the property line, 10 feet south of its proposed location. Reasonable access to MH 5 should be provided in the site plan for the apartment complex. st 4. The sewer in Street A leads to an existing sanitary sewer stub from 21 Avenue. st This stub was intended for this use. The sewer main in 21 Avenue is owned by the city of Lino Lakes. However, there is an agreement in place, between the city of Lino Lakes and Centerville, laying out the parameters for Centerville developments to use this sewer. th 5. Sewer service for Lot 1 of Block 1 is proposed via a future stub, bored under 20 Ave. (CSAH 54), connecting to a manhole on the west side. The city has no objection to this location. However, it may be possible to connect to the sanitary sewer to a manhole directly north of the site in the southwest corner of the Willow Glen development, avoiding the need to cross CSAH 54, if elevations work out. 6. For all sewer service lines, city ownership and maintenance responsibility stops at the property line, per city ordinance. 7. Water main through the development is shown along Street A, and continues through the future alignment of Street A, connecting to the water main along the th east edge of 20 Avenue (CSAH 54), via a cut-in tee. Water main stubs for each lot are provided directly from Street A, with the exception of Lot 1, Block 2, which takes service off a looping main that comes from Street A, connecting to a stub from the east side of the Willow Glen development. The looping main will be publicly owned and maintained. If the water main through Lot 1/1A, Block 1 is not constructed with the initial plat, security must be posted to ensure its future construction. 8. Water main, hydrants, valves and other appurtenances on each site will be under private ownership, regardless of whether or not they are in public easements. st 9. The water mains on 21 Avenue on the west side of the road are solely owned and operated by the city of Centerville. 10. Sewer Access Charges (SAC) are due at the time of building permit issuance and shall be collected in two parts, based on the number of Residential Equivalency Units (REUs) as calculated by the Met Council. A SAC charge owed to the Met Council will be collected by the city, as a pass-through cost. Then, a City SAC charge is collected to account for the city determined which city will collect the 11. Water Access Charges (WAC) are due at the time of building permit issuance. Stormwater/Wetlands 1. A permit through the Rice Creek Watershed District will be required. City standards for stormwater are in alignm comments, if necessary, at that time. 2. The RCWD is the Local Governing Unit (LGU) for the Wetland Conservation Act (WCA). Any wetland impacts require permitting through them. 3. Further discussions with the developer will be required if one or more of the component parts of the development does not move forward to determine if any modifications to the stormwater ponds is required since both public and private drainage are utilizing the same pond system. Additionally, if the extension of Street A is required, without a user for Lot 1/1A, Block 1, the pond labeled as 4. A realignment of the storm sewer and water main on Street A should be explored to potentially eliminate a storm sewer crossing. 6. An emergency overflow (EOF) should be identified for the low point on Street A near street station 3+30. 7. A stormwater area charge applies at the time of Final Plat. It is based on the square feet of impervious surface ($0.07/sf impervious) on each site for commercial and multi-family developments. The fee does not apply to the public roadways. Anoka County has issued an Access Letter, detailing the requirements for access th to CSAH 14 (Main Street) and CSAH 54 (20 Avenue). 2. The plans show a proposed cul-de-sac, known as Street A, utilizing the curb st returns that were put in place during the construction of 21 Avenue. A future extension of Street A is also shown, which would eliminate the cul-de-sac and thst make Street A a thru-street, connecting 20 Avenue to 21 Avenue. A discussion of the issues surrounding the extension of Street A are presented in the City 3. commercial/industrial road with regard to width and strength. The cul-de-sac also along Street A, a center, shared turn lane (3-lane) design is not necessary, nor are dedicated left or right turn lanes on Street A. Each site should control access to Street A with a stop sign for those exiting their respective sites. st 4. Striping/restriping work on 21 Avenue will be necessary. 5. The permanent name of Street A should be discussed. 6. The trail along the south side of Street A should be pushed back, to within one foot of the right-of-way, if grades allow, to afford more room for snow storage and better survival of boulevard grass. 7. INTRODUCTION R&R Leasing Inc. (Rehbein’s development business) is requesting to plat two parcels of land into six lots and a new street in the Rehbein Commercialplat. Three of the new lots also have concurrent development approval requestsin separate applications for comprehensive plan amendment, PUD, rezoning, conditional use permit, and site plan review, and three lots would remain vacant for now. The plat involves 24 acres of vacant land on the north side of Main Street between thst 20 and 21Avenues, just west of I-35E. The property is nowguided Commercial and zoned B-2, but two of the lots are proposed for residential uses – a senior living facility (allowed as a conditional use in B-1, assuming a rezoning) and apartments on the furthest north lot, with a request for a comprehensive plan amendment and rezoning to R-3. th Avenue, Willow Glen townhomes to the NW, Surrounding uses include commercial west across 20 st Avenue. MidWestOne Bank in the SEcorner, and the 35E Park and Ride lot east across 21 April 6, 2021 Centerville Planning & Zoning Commission Page 2 of 9 RE: Rehbein Commercial – Preliminary Plat SUMMARYRECOMMENDATION 1)The Rehbein Commercial plat meets basic City criteria for a preliminary platand should be approved. 2)Block 1, Lot 1 and Lot 1A cannot be combined into a single lot because their ownership documents are recorded with the County using conflicting methods for property recording. (Lot 1A is currently recorded as Abstract property, not Torrens, the preferred format.) We recommend that Lot 1A be converted from Abstract property to Torrens property so it may becombined with Lot 1. This lot combination should be a condition of any future development approval for that combined lot. 3)Street A through the plat is shown ending in a cul-de-sac at Kwik Trip, but possibly th extending west to connect with 20Avenue in the future. We recommend that the developer dedicate street ROW, as well as sidewalk and trail easements, and conduct a traffic study on the impacts of extending this street or not. 4)The cul-de-sac is proposed with a temporary easement over part of the Kwik Trip lot. This is an acceptable arrangement. If the corner lot is developed, the street may beextended in the future and the easement would be vacated. 5)Sidewalks and trails are proposed in parts of the plat and we recommend additional bike/pedestrianto build a network serving the area. 6)Park dedication is required for all lots, according to the City’s fee schedule. 7)Approval of the preliminary plat involvesa number of engineering issues which are detailed in a separate memorandum from the City Engineer. 8)Approval of the preliminary plat may be made regardless ofapproval or disapproval of any of the concurrent development proposals on each lot. Approval of a final plat should be conditioned on the approval of the use onthe lots that are final platted. These recommendations are detailed further in this report. It is underthe same ownership but recorded as Abstract vs. Torrens property (abstract is olderand morecumbersome; Torrens is the newer, preferred format). The lots cannot be combined unless they are recorded using the same method. Theprocess to convert the parcel to Torrens would involve more time and expense for the developer, but it would make the process cleaner to have all property Torrens in the final plat. If Lot 1 and Lot 1A were sold for development,they would need to be combined anywayin the future. We suggest that the preliminary plat can be approved but that as a condition of approval, proposed Lot 1A be recorded as Torrens and combined with Lot 1 Block 1 whenever development and final plat is proposed for those lots. Street A st Avenue west to a temporary cul-de-sac New Street A is shownin the platextending from 21 ending atthe Kwik Trip lot. The cul-de-sac is about 700 ft long, less than the 800-ft maximum allowed in City code. The site plan shows this street being extended in the future to connect th through to 20Avenue, but the plat does not formally dedicate right-of-way or an easement. th Anoka County has communicated in writing their approval of a “commercial access”to 20 th Avenue, which we interpret to mean any access to the lot abutting 20Avenue, either a driveway or a street. Such an accesswould include a southbound bypass lane and northbound th right turn lane. TheCounty’sapproval is needed since 20Avenue is a County road. Extending this street, now or in the future, would make for an integrated development with a logical traffic patternserving not just the lot it abuts but all lots in the development and nearby. Extending Street A would involve considerable expense (perhaps $500,000 or more), for the street th itself and for improvements to 20Avenue that the County would require. The cost of these improvements would be the developer’s responsibility, but the City should weigh requiring this street extension against the cost-benefit of doing so. It is possible that Lot 1/1A could develop with no access to 20th Avenue, using only its access to the east to the cul-de-sac. The future user of Lot 1/1A may not find value in the extended street and access to 20th Avenue. If that is the case, the costs to extend the streetmay adversely affect the salability of thiscorner lot. The County is also clear that Lot1/1A would not get its own right-in/right-out off Main Street. We suggest a traffic study is needed to quantify these impacts. The study would analyze the impacts to area roadways and traffic signals, comparing traffic conditions with full development of the Rehbein plat, in each of these three scenarios. If the impacts of not building Street A are significant, the City might require the street to be extended and the County’s required improvements be madewhen development is approved for Lot 1/1A.If theimpactsare negligible, the City could allow Lot 1/1A to develop with access only to the cul-de-sac or with R/R only.Regardless of If and when Street A is extended in the future, we suggest that street, sidewalk and trail ROW be dedicated now with this plat. Prior joint st planning on the part of Centerville and Lino Lakes resulted in the extension of 21 Avenue and sanitary sewer facilities to serve this area. The Joint Powers Agreement establishes Sanitary Sewer 1. Sanitary Sewer service and billing will be provided by the City of Lino Lakes under the terms of the JPA, approved in October of 2013. 2. Each property connection will require a permit from Lino Lakes and each is subject to the n to MCES Sac Fees. We will need to coordinate collection of these fees with both final plat approval and building permit issuance. Transportation 1. The JPA provided for one full access located approximately 562 feet north of Main Street. Street A is located opposite the existing private street to the east and meets this requirement. 2. Consideration should be given to provide access to the existing bank from the internal service road. This was discussed as part of the original road planning. The existing bank intersection, due to its proximity to the Main Street intersection, may be limited to right- in/right-out movements in the future to avoid operational impacts on the Main Street intersection. Sewer and Water 1. Sewer service is proposed from Street A, leading to an existing sanitary sewer st stub from 21 Avenue. This stub was intended for this use. The sewer main in st 21 Avenue is owned by the city of Lino Lakes. However, there is an agreement in place, between the city of Lino Lakes and Centerville, laying out the parameters for Centerville development to use this sewer. 2. Water main, hydrants, valves and other appurtenances on the site will be under private ownership. However, the city may wish to have access to the valve on the 4-inch line so that it can shut off water to the building, without deactivating the hydrant. 3. Metering requirements shall be reviewed 4. may have comments on hydrant placement and other design issues. 5. Sewer Access Charges (SAC) are due at the time of building permit issuance and shall be collected in two parts, based on the number of Residential Equivalency Units (REUs) as calculated by the Met Council. A SAC charge owed to the Met Council will be collected by the city, as a pass-through cost. Then, a City SAC charge is collected to account for the city determined which city will collect the 6. Water Access Charges (WAC) are due at the time of building permit issuance. Stormwater 1. A permit through the Rice Creek Watershed District will be required. City standards for stormwater are in alignm comments, if necessary, at that time. 2. A skimming weir or other device in a manhole immediately upstream of the pond should be added to allow an opportunity to capture volatile organic compounds t of a small gas/diesel spill. 3. The furthest downstream manhole with access from the parking lot should include a sump as a sediment trap. 4. A stormwater area charge applies at the time of Final Plat. It is based on the square feet of impervious surface ($0.07/sf impervious). The estimate, based on the current layout of the site is: $7,668.85. Streets/Walks 1. Anoka County has issued an Access Letter, detailing the requirements for access to CSAH 14 (Main Street). A westbound right turn lane is required on the north side of CSAH 14. The plans show this construction and will be subject to review by Anoka County. 2. The plans show a sidewalk leading from the trail on the south side of Street A to the east side of the parking lot. Pedestrian access from Main Street should also be provided. There is an existing curb ramp in the northeast corner of Main Street th and 20 Avenue. Extending a trail from this point to the Main Street entrance to the site may be the most practical way to allow access to those looking to walk or bike to the store from the south and central parts of town. 3. The north-south drive lane west of the landscaped island on the west side of the site is likely to be used by customers of the future retail development on Lot 1, Block 1. This cut-through traffic will exist whether Street A goes through, or remains a cul-de-sac. We wish to further conversations with Kwik Trip regarding this situation. The city wishes to ensure that this cut-through traffic remains a viable route to Lot 1, Block 1. Further, it should be understood that Kwik Trip reserves no right to block this passage or assess costs to the neighboring lot (except through mutual agreement) for future maintenance needs. Finally, a contingency plan should be shown for how the north end of this corridor would look when and if Street A continues through and the cul-de-sac, therefore, is eliminated. The alignment of the curb in this area would need to change, landscaping would be lost and it should be understood whose cost it would be to make these changes. It must be understood that the city would not accept any burden to affect these modifications. Miscellaneous 1. A Conditional Use Permit (CUP) will be required for the Car Wash. 2. April 6, 2021 Centerville Planning & Zoning Commission Page 3 of 7 RE: Kwik Trip – Conditional Use Permit, Site Plan Review REQUESTS Conditional Use Permit A car wash is Conditional Use in the B-2 district, assuming that amendment is approved (being considered concurrently).The typical issues with a car wash are adequate stacking distance, noise from the dryer and screening from streets and residential areas.In this case, the car wash is located on the north side of the Kwik Trip building, away from Main Street and behind the pond along Street A, so it is not close or visible from either street. The area around the pond is landscaped, adding to the screening.The car wash is over 400 feet from both the existing Willow Glen townhomes and the proposed NorBellaassisted living. Site Plan Review Access on West Side Kwik Trip will have a right-in/right-out from Main Street that connects to a north-south drive aisle on the west side of the siteaccessing the cul-de-sac on Street A. We can expect that traffic will use the Kwik Trip site as a shortcut between Main Street and Street A, regardless of whether they patronize Kwik Trip. The west side drive aisle will function more or less like a public street. Kwik Trip says they are fine with this, since it may bring more customers. The site is designed to handle this adequately and it should not pose a traffic or safety problem. The City would expectthis drive to stay open and free of obstructions. This is illustrated on the site plan graphic on the next page. Parking City parking standards require 7 parking spaces per 1,000 sq ft for convenience stores and 5 stacking spaces for a car wash. The Kwik Trip store is 9,000 sq ft, but at least 15% of that space is storage and restrooms, resulting in about 7,700 sq ft for parking purposes, requiring 54 parking spaces. Trash Enclosure The trash enclosure is on the west side of the building near the entrance to the car wash. It will be enclosed on the north side with the same red brick as the building and on the west side with tan gates, also matching the color of the building. Landscaping The landscape plan is generous and well designed, including a mix of overstory and ornamental trees, conifers and deciduous, and foundation plantings of shrubs, perennials,and grasses. Signage Signage consists of a pylon sign in the southeast corner of the site along Main Street, signage on outside edges of the gas pump canopies, and wall signage in the gables on three of the four sides of the building. Signage will be reviewed according to the City Code standards at the time of building permit review. RECOMMENDATIONS Conditional Use Permit I recommend approval of the Conditional Use Permit for the Kwik Trip car wash as proposed. Suggested Findings of Fact for Approval of the Conditional Use Permit for the Car Wash: 1)A car wash produces noise and spray. It is reasonable and appropriate to ensure it is a reasonable distance from sensitive residential uses. The location of the proposed car wash is over 400 feet from existing and proposed residential uses in the vicinity. 2)The doors to the car wash open to show machinery and cars being washed. It is reasonable and appropriate to screen the view to the car wash from adjacent roadways. The landscape plan does an adequate job of screening the car wash. 3)Adequate stacking space for cars waiting to enter the car wash is important for the safe and convenient functioning of the Kwik Trip site. The site has space for at least eight cars to stack while waiting for the car wash, in excess the of the five stacking spaces required by City Code. Sewer and Water 1. Sewer service is proposed from Street A, leading to an existing sanitary sewer st stub from 21 Avenue. This stub was intended for this use. The sewer main in st 21 Avenue is owned by the city of Lino Lakes. However, there is an agreement in place, between the city of Lino Lakes and Centerville, laying out the parameters for Centerville development to use this sewer. 2. The sewer running along the east side of the building, serving the property to the north shall be publicly owned and maintained. 3. Water main, hydrants, valves and other appurtenances on the site will be under private ownership with the exception of the looped water main along the south side of the building. Metering requiremen building department. 4. may have comments on hydrant placement and other design issues. 5. Sewer Access Charges (SAC) are due at the time of building permit issuance and shall be collected in two parts, based on the number of Residential Equivalency Units (REUs) as calculated by the Met Council. Part of this lot is across from the proposed Kwik Trip as well, but it is only the storm pond on this lot across from the storm pond on the Kwik Trip lot, not the buildings. The Land Use Plan designation of Commercial would not change – both districts correspond to the C designation on the Land Use Plan. When the B-2 district was created recently it was intended to regulate uses on Main Street, with B-1 for other commercial properties off Main Street. Since the original larger Rehbein parcel fronts Main Street it was all zoned B-2, even though the NorBella lot and other parcels are some distance from Main Street. The NorBella site is 550-600 ft north of Main Street. Conditional Use Permit A Specialized Care Facility is a Conditional Use in the B-1 district, defined in the Zoning Code as “A state-licensed care facility which is not otherwise specifically defined or regulated elsewhere in this chapter.” The facility will require state licenses for assisted living and memory care. If the rezoning is approved, the proposed NorBella facility would be allowed with a CUP. The issues associated with this type of facility involve having the appropriate license(s) from the State and County; having adequate staff to handle emergencies involving residents, such as falls; and having a plan in place to followed in case of emergencies, with the City being able to assess the owners for excessive use of emergency services. These conditions and findings are detailed later in this report and in the City Attorney’s draft CUP. A CUP must meet the criteria in Section 156.320 of the Zoning Code – basically that the use is necessary and desirable; that it will not adversely impact the neighborhood; and that it is designed to allow development of neighboring property. The proposal meets these criteria. April 6, 2021 Centerville Planning & Zoning Commission Page 4of 9 RE: NorBella Senior Living – Rezoning, Conditional Use Permit, Site Plan Review Site Plan Review Northeast Patio The site layout of the facility is straightforward, with access to parking and entry off new Street A, st not directly off 21 Avenue. The L-shaped building has common areas in the middle with memory care units in the west wing of the building and other assisted living units in the middle and east wings, all off a common hallway. There is an open patio at the NE corner of the building for assisted living residents and a gated patio in the SW corner for memory care residents (security is an important issue for the memory care residents) See site plan illustration below. One issue with the site plan is the location of the northeast patio. Being on the NE side of the building it would not get sun, especially afternoon sun. An improvement would be if the building or site could be reconfigured to give some southern exposure to this patio. I believe it would be important to have a sidewalk loop around the site that residents could take for walks. As currently designed, there is a sidewalk around the east and south sides of the building, but not all the way around. We suggest this be remedied with a loop around the building, with other possible connections of this loop to st Avenue and the park & ride to the east, and to the the Willow Glen townhomes to the west, to 21 proposed apartment site to the north. Also, a proposed sidewalk extends to Street A south of the main entry which would cross mid-block. We suggest this be removed in favor of sidewalk st extensions that would get pedestrians to 21Avenue. These options areillustratedabove. Parking There are 35 parking spaces in the parking lot, including two handicapped spaces. This is almost one space per unit in the 40-unit building. Experience with other assisted living facilities is that often only one half space per unit is needed. Few residents would have cars and most of the parking would be used by staff and visitors, especially on holidays. Parking should be adequate. Building Materials The proposed exterior building materials are manufactured stone and textured steel siding in three different patterns in a residential style. The B-1 required district building materials standards include the following: (M) Commercial exterior building materials. (1) Except as otherwise regulated herein, the exterior wall surfaces of all new or expanded commercial buildings shall consist of face brick, finished block or other textured masonry product approved by the Planning and Zoning Commission. (2) Exceptions to all masonry exteriors may be considered and approved by the Planning and Zoning Commission provided the following findings are met: (a) The combination of exterior materials is used as an architectural complement to the structure; (b) The combination of exterior materials used is not inconsistent with the quality and appearance used on similar buildings in the same zoning district or neighborhood; (c) Site conditions limit public exposure to certain exterior surfaces where masonry products are not proposed; and (d) An exterior wall may be temporary and a future expansion area of a structure and be subject to removal or redesign as an interior wall. (3) Buildings are required to have contrasting architectural features and must be designed to be aesthetically pleasing. Lighting Lighting on site is provided by two 25-ft light poles in the parking lot and wall-mounted and under- soffit fixtures at nine locations around the building. All lighting fixtures are downcast cutoff type. Total light levels shown on the photometric plan are less than 1/10 foot-candle at the edge of the site. Trash Enclosure/Storage There is a small enclosed outdoor storage structure and trash enclosure south of the main entry accessed from the main entry drive. It will be screened with a row of trees and shrubs. It is to be constructed of cultured stone to match the building, steel panels on the trash enclosure gate and storage doors to match the building, and a band of EIFS (synthetic stucco) in a color to match the building. Doors to both the storage and trash areas face west in the parking lot, not to the street, which is acceptable. Landscaping The landscape plan is generous and well designed, including a mix overstory and ornamental trees, conifers and deciduous, and foundation plantings of shrubs, flowers and grasses. RECOMMENDATIONS Rezoning I recommend approval of the rezoning from B-2 to B-1 for Lot 1 Block 2 of the Rehbein Commercial plat. Suggested Findings of Fact for Approval of the Rezoning: 1) The requested B-1 zoning is consistent with the Land Use Plan designation of Commercial. 2) The proposed site is over 500 feet north of Main Street which is the focus of the B-2 district, with B-1 zoning intended for other commercial sites not on Main Street. 3) The proposed site is adjacent on the west and north to existing and proposed multi-family uses, which are compatible with the proposed residential care facility in the requested B-1 district. This type of patient population has greater needs for medical services and are at a greater risk for injury. 6) The applicant proposes to operate a 40-unit senior living facility. Any assisted living facility will proportionally increase calls for emergency services simply due to the type of patient population served by these facilities. However, the City should be concerned with the potential for increased costs for emergency services if 911 calls were used to supplement the applicant’s facility staffing. 7) It is reasonable for the City to place operating conditions on the facility to ensure that an increase in emergency service is the responsibility of the applicant, and not the City. 8) The State will review and approve the applicant’s operating policies and procedures during its licensure approval process. The applicant stated that process will likely occur at some point during the next year. After that process is complete, the City will know the applicant’s State-mandated operating policies and procedures. Moreover, the City may gain valuable insight into the applicant’s operations as a result of the State’s process. The City should use information gained from the State’s licensure process to augment its decision-making related to the applicant’s request for a Conditional Use Permit. 9) The project as proposed meets the criteria for granting a Conditional Use Permit in Section 156.330(C)(2) of the Zoning Code. Sewer and Water 1. Sewer service is proposed through a new main running north-south along the west st side of 21 Avenue, then into a new manhole on Street A. The main in Street A st leads to a stub from 21 Avenue. This stub was intended for this use. The sewer st main in 21 Avenue is owned by the city of Lino Lakes. However, there is an agreement in place, between the city of Lino Lakes and Centerville, laying out the parameters for Centerville development to use this sewer. st Alternatively, the sewer could directly access the 21 Avenue sewer at the st existing manhole in 21 Avenue, roughly in the middle of the site. This would require concurrence with the city of Lino Lakes, construction of an inside drop st Avenue. In either case, the sewer capacity will need to be and patching of 21 the proposed change in land use. We do not anticipate this being a problem since commercial uses can vary widely, so conservative assumptions are often used in the design of sewers that serve these areas. 2. Water and Storm Sewer in the southwest portion of the site should be further evaluated to see if fewer crossings of the two utilities can be accomplished. Additionally, the new valve on the 8-inch line leading to the building should be positioned in a more accessible location (perhaps in the parking lot, but not in a drive aisle. 3. Water main, hydrants, valves and other appurtenances on the site will be under private ownership with the exception of the looped water main in the southwest portion of the site. Metering requirements building department. 4. may have comments on hydrant placement and other design issues. 5. Sewer Access Charges (SAC) are due at the time of building permit issuance and shall be collected in two parts, based on the number of Residential Equivalency Units (REUs) as calculated by the Met Council. A SAC charge owed to the Met Council will be collected by the city, as a pass-through cost. Then, a City SAC charge is collected to account for the city determined which city will collect the 6. Water Access Charges (WAC) are due at the time of building permit issuance. Stormwater 1. A permit through the Rice Creek Watershed District will be required. City standards for stormwater are in alignm comments, if necessary, at that time. 2. A stormwater area charge applies at the time of Final Plat. It is based on the square feet of impervious surface ($0.07/sf impervious). The estimate, based on the current layout of the site is: $6,798.54 3. The flared end section leading to the storm pond in the southwest corner of the site should be pulled back to be completely within the property lines of the apartments. This entire storm sewer system will be under private ownership, so it is important that the apartment building maintenance force has access to it without permission from the neighboring property. The public easement does not afford the private party access, as it does the city. 4. The furthest downstream manhole with access from the parking lot should include a sump as a sediment trap. Streets/Walks st 1. Vehicle access to the site is via a single driveway connection to 21 Avenue. 2. The plans show a sidewalk along the outer perimeter of the parking lot, except the south side of the lot. All walks on the site and the sidewalk adjacent to the site, in st the 21 Avenue right-of-way will be privately maintained. 3. Snow storage should be considered along the south side of the parking lot, there is limited room for pushing snow without encroaching on the neighboring property. Miscellaneous 1. A Conditional Use Permit (CUP) will be required for the Planned Unit Development (PUD). 2. The city reserves the right to review future iterations of the development plans. 3. The site may be the best place in Centerville for apartments, but is not an ideal commercial site, being quite a distance from Main Street. 2)The rezoning to R-3 is reasonable and appropriate if the land use is changed to HDR. 3)The PUD allows flexibility with zoning standards along with benefits to the City or residents. The increased building height is offset by increased setbacks. 4)Extending the internal sidewalk network should be considered to connect west to Willow Glen and south to the assisted living facility. 5)Parking, lighting, landscaping, and building materialsare all acceptable. The land uses in Lino Lakes, east across 21Avenue (Commercial) and to the north (Mixed Residential) are also shown for context.The request is to guide the Belleville lot as High Density Residential (HDR), the same as the Willow Glen townhomes to the west. The Centerville Future Land Use Plan is illustrated on the next page, with the Belleville site shown HDR,as requested.The siteis adjacent to other higher density residential uses and a transit stop. It st is close to commercial uses and to I-35E, with easy access on 21Avenue. It is not adjacent to other Centerville single family neighborhoods and separatedfrom the Lino Lakes single family homes to the north by a large pond. The Belleville site may be the best location in the City for apartments. Comprehensive plan goals call for a mix of housing types. The plan summarizes existing housing types in the City in Table 10 to the right. Only 8% of the City’s housing is multi-family of 5 units or more. The proposed Belleville apartments would fill this needwith a high quality project. The Land Use Plan designates HDR as 12-25 units/acre. The proposed Belleville Landing project is 103 units on 5.3 acres, or 19.4 units/acre, meeting this density range. A letter narrative from the applicants discusses other issues in favor of the use, citing its location, the kind of residents expected (professionals, empty nesters, others wanting high quality apartment living) the building design, and amenities to be included. April 6, 2021 Centerville Planning & Zoning Commission Page 5 of 10 RE: Belleville Landing Apartments – Land Use Plan Amendment, Rezoning, PUD/CUP, Site Plan Review Planned Unit Development/Conditional Use Permit A Planned Unit Development (PUD) is processed as a CUP in the Centerville Zoning Code. The criteria for considering a PUD are included on the following page. Flexibility on zoning standards can be given in exchange for other benefits. The Belleville Landing plan is laid out simply – one building of 103 units in three floors above a st Avenue. If the Land Use Plan is parking below,a surface parking lot, with site access off 21 amended as requested above, the development would be consistent with the comprehensive plan, it would be compatible with surrounding land uses, it does not pose a risk to natural amenities, and it would not be a burden on parks, schools, streets or other public facilities. A CUP must meet the criteria in Section 156.320 of the Zoning Code – basically that the use is necessary and desirable; that it will not adversely impact the neighborhood; and that it is designed to allow development of neighboring property. The one area of flexibility that is requested in the PUD is the height of the building – it is 48.5 ft in height vs. the 35 ft height limit in the Code, or 13.5 ft more. Section 156.121 Height addresses this: (B)Excess height on a building. Upon the securing of a conditional use permit any building may be erected to a height exceeding that specified for the respective district, provided the front, rear and side yards shall be increased one foot for each one foot by which the building exceeds the height limit established for that district. The building will be three stories of apartments above one level of parking. This is typical of apartment development and not unreasonable. April 6, 2021 Centerville Planning & Zoning Commission Page 6 of 10 RE: Belleville Landing Apartments – Land Use Plan Amendment, Rezoning, PUD/CUP, Site Plan Review PUD standards in 156.210 of the Zoning Code: (A)The development shall be planned so that it is consistent with the city comprehensive plan; (B)The PUD is an effective and unified treatment of the development possibilities on the project site and the development plan provides for the preservation of unique natural amenities such as streams, stream banks, wooded cover, rough terrain and similar areas; (C)The planned unit development proposal appears to harmonize with both existing and proposed development in the area surrounding the project site; (D)The tract of land shall be under unified control at the time of application and scheduled to be developed as one unit. In addition, the development plan must include provisions for the preservation of natural amenities; (E)Each phase of the proposed development, as it is proposed to be completed, is of sufficient size, composition and arrangement that its construction, marketing and operation are feasible as a complete unit, and that provision and construction of dwelling units and common open space are balanced and coordinated; (F)The PUD will not create an excessive burden on parks, schools, streets and other public facilities and utilities which serve or are proposed to serve the district; (G)The proposed total development is designed in a manner as to form a desirable and unified environment within its own boundaries; (H)The plans required under this section must be submitted in a form which will satisfy the requirements of Chapter 153 for the preliminary and final plats; Site Plan Review Parking There are 108 parking spaces in the parking lot, including 4handicapped spaces. There are 101 spaces under the building, for a total of 209 spaces for 103 units, over 2 spaces per unit. Parking is more than adequate. Building Materials The proposed exterior building materials are EIFS (synthetic stucco), EIFS stone, and “engineered siding” which a wood chip product made durable with additives and coatings. It is common in the buildings industry currently, is longer lasting that plain wood siding, and is considered more environmentally friendly. There are no specific building materials requirements in the R-3 district. Lighting Lighting on site is provided by four25-ftlight poles in the parking lot and wall-mounted and under- soffit fixtures at manylocations aroundthe building. All lighting fixtures are downcast cutoff type. Total light levels shown on the photometric plan are less than 1/10 foot-candle at the edge of the site. We have made suggestions for additional internal sidewalkson the NorBellaSenior Living site to the south, which couldinvolve the Belleville site to connect east and west, plus north and south between the two sites, as illustrated below. Trash Enclosure Trash is handled completely inside the building on the parking level. Landscaping The landscape plan is generous and well designed, including a mix overstory and ornamental trees, conifers and deciduous, and foundation plantings of shrubs, flowers and grasses. April 6, 2021 Centerville Planning & Zoning Commission Page 8 of 10 RE: Belleville Landing Apartments – Land Use Plan Amendment, Rezoning, PUD/CUP, Site Plan Review RECOMMENDATIONS Land Use Plan Amendment I recommend approval of the Land Use Plan amendment from Commercial to High Density Residential for Lot 2 Block 2 of the Rehbein Commercial plat for the Belleville LandingApartments. Suggested Findings of Fact for Approval of the Land Use Plan amendment: 1)The proposed apartment site is a significant distance form Main Street, the City’s main commercial artery and not an attractive commercial site, for which is it now guided. 2)The site is adjacent on the north and west by existing residential uses and on the south by a proposed residential assisted living facility. To the east is a transit stop park and ride facility, which is convenient for multi-family residential uses. The proposed land use designation is compatible with these surrounding uses. 3)Only 8% of Centerville’s housing is in multi-family uses with five or more units. The City’s comprehensive plan calls for a mixture of housing types, which this project would meet. 4)Considering the site’s surrounding uses and the need for more diverse housing types, the proposed project may be the best location in the City for multi-family housing. Rezoning I recommend approval of the rezoning from B-2 to R-3 for Lot2Block 2 of the Rehbein Commercial plat, with the condition that the Land Use Plan amendment to HDR is approved. Suggested Findings of Fact for Approvalof the Rezoning: 1)The requested R-3 zoning is consistent with the Land Use Plan designation of High Density Residential (if approved). Planned Unit Development/Conditional Use Permit I recommend approval of the Conditional Use Permit for the Planned Unit Development for Belleville Landingas proposedon submitted drawings from Carlson McCain dated 3-11-21 and from THA Architects dated 3-11-21, with the following conditions: 1)Landowner will obey all laws and regulations necessary to operate this type of facility. 2)Signage for the project will be reviewed and approved by the City Planner. April 6, 2021 Centerville Planning & Zoning Commission Page 9 of 10 RE: Belleville Landing Apartments – Land Use Plan Amendment, Rezoning, PUD/CUP, Site Plan Review 3)Users of the site will produce no noise, vibrations, air pollution, light pollution, fire hazards or noxious emissions which will disturb or endanger neighboring properties. 4)Landowner will follow the applicable standards and requirements of the City of Centerville City Code, Rice Creek Watershed District, Anoka County, Army Corp of Engineers, FEMA, Minnesota Department of Natural Resources, and any other agency having jurisdiction over the Subject Property and shall secure those same files with the City. 5)Landowner will construct and maintain the Subject Property and improvements contained thereon, in accordance with the Site Plan and Building Plans as approved by the City. Suggested Findings of Fact for Approvalof the Conditional Use Permitfor the Planned Unit Development: 5)The proposed Belleville project is an appropriate use for the R-3 district. At 19.4 units/acre it meets the City’s density range of 12-15 units/acre. 6)The proposed use fills a need in the City for additional multi-family housing in a location that is served by major roadways, commercial goods and services, and transit. 7)The proposed use will not negatively impact surrounding uses or inhibit development of surrounding properties. 8)The project is well designed and attractive. 9)The project meets the criteria for increased setbacks to mitigate increased height of the building from the 35-foot height limit in the Code to the proposed 48.5-foot height. 10)The project as proposed meets the criteria for granting a Conditional Use Permit in Section 156.330(C)(2) of the Zoning Code. Site Plan Review I recommend approval of the site plan for Belleville Landing apartmentsas illustrated on submitted drawings from Carlson McCain dated 3-11-21, and from THAArchitects dated 3-11-21, with the following conditions: 1)The developerwill consider additional sidewalk connections to the west and south as illustrated in this report. 2)Parking will be provided as illustrated on the site plan, with two handicapped, accessible spaces near the front entry. 3)Building materials and colors will be as illustrated on the submitted materials. Suggested Findings of Fact for Approval of the Site Plan: 1)The City expects and requires well-designed, high quality development that follows City Zoning Code standards. 2)It is reasonable and appropriate to provide easy access to sidewalks around the sitefor the use and enjoyment of residents. 3)Provision of adequate parking is necessary forsafe and efficient functioning of the site as well as provision of accessible handicapped spaces. 4)The City expects high quality, durable building materials for all development in the City. 5)Adequate site lighting is necessary for a safe environment, but glare and light spillage off site is a nuisance. Candidate Interviews The Commission presented the following set of six questions to each candidate, with each commissioner taking turns asking a question. Question 1: Please tell us what are your qualifications are and why you want to become a member of the Planning and Zoning Commission? City of Centerville Planning and Zoning Commission January 26, 2021 Question 2: The Planning and Zoning requires a commitment on the first Tuesday of each month plus potential other workshops. Do you foresee any problems attending these meetings on a regular basis? Have you ever attended a Planning and Zoning meeting, and if so, when? Question 3: The Planning Commission is often required to make recommendations on controversial applications. Describe the steps you will go through as a commissioner to make decisions. Who will you listen to and where will you go for advice? Question 4: How do you feel about your ability to provide objective recommendations on land use applications and other ordinance issues? Question 5: Not everyone always agrees with one another. Can you describe a time when you worked as part of a team to reach a consensus? Question 6: Do you have any questions for us? a. Pat Branch 1. Mr. Branch answered that he has been interested in the Planning and Zoning Commission since joining the Parks and Rec Committee. His qualifications are that he is a resident of Centerville and enjoys living in the city. Mr. Branch also spoke about his career in the military and as the vice president of a company. He said he has a good record of leadership and making sound judgements and takes a lot of input before making those judgements. 2. Mr. Branch said that he has not attended a Planning and Zoning meeting. He said that he lives in two different places (Minnesota and Maryland), but as long as meetings are held via Zoom, he can attend all meetings. 3. Mr. Branch stated that he makes independent decisions, and would make them based on what he feels is best for the citizens and the city. He would look to City Council and their objectives and planning doctrine, city ordinances, City Administrator Statz, and City Attorney Curt Glaser. He also stated that if there were controversial questions from residents about their property, he would look to the opinions of neighbors and how they might be affected. 4. Mr. Branch said he feels he has good judgement. During his career in the military he had experience balancing inputs and making decisions. 5. Mr. Branch said that he joined the Parks and Rec Committee in 2008 when there was not a lot of funding for the parks. The committee started the Fete des Lacs 5K/8K Runs to raise money to improve the parks. 6. Mr. Branch asked about the number of members and openings on the Planning and Zoning Commission, and meeting frequency. He also asked about the responsiveness of the commission, due to only meeting once per month. City of Centerville Planning and Zoning Commission January 26, 2021 b. David Kubat 1. Mr. Kubat answered that he moved to Centerville recently. He has a BA in History from the University of Minnesota, a law degree from Hamline School of Law, and is a practicing attorney in immigration law and criminal justice. He was in the National Guard from 2008-2020 and completed two tours in Iraq. He also served as Rapids while living there. He was looking for a new opportunity to serve, but wanted something that did not require as much time as the National Guard 2. Mr. Kubat stated that he had not attended a Planning and Zoning Commission meeting, but he has attended an EDA meeting. He has no problem with the time commitment and has read through past meeting minutes in order to learn more about the Commission. 3. Mr. Kubat answered that he would look at past history on other similar decisions and talk to people with experience. He stated that as an attorney, he is skilled at seeing things objectively. 4. Mr. Kubat stated that he is used to being objective and giving opinions based on what is best. 5. Mr. Kubat stated that at the law firm he works for, the owner takes a round-table approach to build consensus amongst the team. The different backgrounds within the firm help to contribute to discussion of different points of view. He is not invested in getting things his own way; he is interested in making sure that the decisions made are the right decisions. 6. Mr. Kubat asked when the Commission might go back to in-person meetings, versus Zoom meetings. City Administrator Statz explained that he recommends meetings still be held via Zoom until everyone has the opportunity to be vaccinated from Covid-19. He feels that June 1, 2021 is a good target date. c. Les Kuiper 1. Mr. Kuiper responded that he has earned a reputation as a fair and capable leader. He was elected as president of his throughout North America. He comes with no agenda, and is a good listener. He has lived in Centerville since 2012 and is eager to serve on a local level. 2. Mr. Kuiper stated that his schedule is flexible and he would be able to attend meetings without any problems. He has not attended any Planning and Zoning meetings, and has recently retired and is now living full-time in Centerville. 3. Mr. Kuiper responded that he would read the documents that were submitted, visit the site being considered, talk with people who are impacted by the decision and talk with other members of the commission. City of Centerville Planning and Zoning Commission January 26, 2021 4. Mr. Kuiper stated that he has not worked with people on those kinds of issues, but he has worked with people on issues that are divisive and he looks for ways to be fair. He would approach the issues with a desire to be fair to all parties. 5. Mr. Kuiper explained that he had served on the board of a local Christian high school, and was asked by the Board to Chair a committee to address combining the high school and two elementary schools into one legal entity. He said that one elementary school was in a community of approximately 50,000 people and the other was in a community of approximately 3,000 people and the smaller community was afraid it would be swallowed up by the larger. He said that some came to the meeting determined to make it happen, and others were very resistant. He arrived at one particular meeting with a feeling that they would come to an impasse they would not be able to move beyond. They got through it and decided to become a federation instead of a corporation, with the possibility of becoming a single entity in the future. He felt that the communities were committed to working together, and put things in place that would draw the schools together. The consensus to become a federation was recommended to the boards and approved by all. As chairman, he was able to see the communities through the impasse and arrive at the recommendation. Another example happened in 2012 when he worked with four congregations for approximately 12-18 months. Each congregation had difficult separations with their pastors and there were a lot of hurt and angry feelings. In the end, all four churches have been able to move forward in a positive way and he felt good about the work he had done and has stayed in touch with them. 6. Mr. Kuiper asked what are one or two of the more challenging decisions the board has had to make over the last five years. Chairperson Broussard-Vickers responded that variance requests are challenging because they do not always meet the requirements of the law and you have to say no, making the applicant unhappy. Commissioner Twohy stated that there have been times when they are trying to change ordinances to make the city better or tighten up the city code, and it is challenging to do without being disruptive to the residents that are utilizing their land the way that is allowed, such as on-street parking, outdoor storage and conditional use permits. Questions were finished and each commissioner talked about their impressions of each candidate. The commissioners felt that all candidates would work well on the commission, but had concerns Mr. Kubat stood out to all due to his background, and Chairperson Broussard-Vickers stated that a newer resident could bring a different perspective. After more discussion, it was decided to recommend that Council to appoint Mr. Kubat and Mr. Kuiper to the Commission. Motion by Commissioner Fehrenbacher, seconded by Commissioner Krueger to recommend to the Council to appoint Mr. David Kubat and Mr. Les Kuiper to the Planning and Zoning Commission.
