He also recognized Ms. Mary Capra for being the only female Mayor in Centervi who work at City Hall, the Police Department, and the Fire Department. He stated that they have ything they have done for the City. Mayor Love provided an opportunity for others to add or delete any items. Administrator Statz added Checks #33614-33615 to Consent Agenda Item #1. Motion by Council Member Koski, seconded by Council Member Lakso to Approve the Agenda as Amended. A roll-call vote was taken. November 12, 2020 City Council Meeting Minutes Mayor Love noted on page 5, it stated that there were no public comments but there was one public comment from Mr. Steve King prior to him being on Council. Mayor Love provided an opportunity for members to make corrections or additions. Motion by Council Member Lakso, seconded by Council Member Koski to Approve November 12, 2020 City Council Meeting Minutes with the noted change on page 5. A roll- call vote was taken. Mayor Love and Council Members Lakso, King & Koski voted in favor. VII. CONSENT AGENDA 1. Mayor Love provided an opportunity for Council to add or remove any item(s) to/from the Consent Agenda. Council Member King asked to pull Items 3, 4, 5 & 6 for discussion. Administrator Statz asked to run through the revisions to these documents before Council Member King asked his questions or made his comments. He explained that that an individual is interested in purchasing the former Vincenzo Catering Service property, as well as the property to the south which is under joint ownership. The City ordinance states that upon the sale of the property, the property must be connect to municipal water. He stated that the prospective buyer has approached him regarding the policy and stated that his intent is to redevelop the property in the near future. He stated that the City would like to foster the development spirit by being helpful if possible. He stated that staff shared information regarding the program to offer half price fees and offered the option of assessing those fees to the property or entering into an agreement to escrow funds to complete the work if for some reason the development did not happen within a certain period of time similar to other businesses and locations. The prospective buyer asked if the City could do a 5-year sunset to either redevelop the property or to connect to municipal water. He reminded the Council that the cost to connect is generally around $18,000, which can be a hindrance to redevelopment when the City is attempting to encourage redevelopment. He stated that the idea behind escrowing these funds with a sunset date would be as an incentive to redevelop and put the funds away to ensure that there is the ability to force the connection if redevelopment fails. He explained that there are four agreements because there are two different properties and two different things happening: assessing the connection fees; escrowing the funds for the physical hook-up. He noted that the reason there are four (4) agreements as there are two (2) separate properties with connection fees that will be assessed to the property taxes and the necessity to ensure that the physical connection is completed and paid for. Administrator Statz explained the fees in the agreements and explained that the original escrow agreement had 150% of the cost and that has been revised to 100% and an added a clause that the quotes will be updated on a regular basis ensuring that the funds escrowed meet the required fees. He reiterated that the City has done this with other properties in the past. He stated he is recommending that change be made to both escrow agreements. He noted that only one of the assessment agreements are changing and should payment in full for a lateral benefit fee and four (4) has four (4) residential equivalent hook-ups: the catering business has two (2) and the apartments up above have two (2). He explained that the discount is 50% of the fees that are on the assessment agreement, so the subject parcel would pay $7,700 which without the discount program would have been $15,400. Council Member King asked if the $18,000 connection cost was for each property. Administrator Statz stated the escrow totals $18,000 and explained that the existing owner obtained a quote from Olson Sewer, to complete both connections which totaled $18,000. Council Member King asked about page 23, paragraph he cost listed below that satisfies payment in full for a lateral benefit fee and a water access fee. The amount listed Page 3 of 8 6 City of Centerville Council Meeting Minutes March 10, 2021 this paperwork tells the public the reason for the reduction. has been paid for and satisfied ed that this was approved at a recent Council meeting where they voted to offer half-price hook-up fees during COVID. Council Member King stated that he would like the document to be specific and asked if that was called the Covid Business Relief Grant. Administrator Statz noted that the City did not come up with a fancy name for it, but agrees that the document could be changed so it is more specific and say that the fees have been paid by the 2021 Covid Relief Grant Program and perhaps also cite the resolution/motion and add in those specifics. Council Member King confirmed that he had read somewhere that the prospective buyer is liable for all the expenses associated with the drafting of the documents. City Attorney Glaser explained that there is language in the escrow agreement that requires him to be responsible for a variety of fees. Council Member King noted that on page 24 at top under 2, it states exceeds the benefit to the subject City Attorney Glaser explained that with this agreement, it is waiving all the rights they would have if they wanted to push the City for a formal assessment hearing. At a formal assessment hearing, the City has to prove that the benefit to the property will either exceed or is equal to the amount assessed. Administrator Statz stated that this is a voluntary option for the prospective buyer rather than paying it up front and clarified that this has not been forced on them. Council Member King noted that he had spoken with Administrator Statz earlier and asked if this could be split up, what the total amounts would be without the grant for each of the properties. Administrator Statz noted that the two (2) escrow agreements have no grant associated with them and that the special assessment waivers would be $7,700 and $4,925 of which a discount of $12,625 has been given. He noted that would be multiplied by 2 for a total of $25,250 for all fees associated with both properties. Council Member Mosher asked if that would be spread over 15 years at 2.5% . Page 4 of 8 7 City of Centerville Council Meeting Minutes March 10, 2021 Administrator Statz concurred and stated that it should be quite affordable. He explained that this is similar to what the City did for people in the downtown area that elected to connect to municipal services. Council Member Koski asked about an item on page 19 of the packet and noted that he did not understand the reference to $12,650.85. Administrator Statz explained that had been changed and noted that in some escrow agreements they will be conservative and ask for 150% of the cost, but in this case, there is a direct quote, so 100% of the cost is actually $8,443. Mayor Love stated that he wanted to make it clear that he is very supportive of businesses and he voted in favor of the program that will be utilized in this situation. He stated that if there is an opportunity to spur development and long-term thinking, he would support that, but thought that the program had a timeframe of the end of 2021. He asked how allowing a five-year term to connect to municipal water could be justified when any other business would need to get the hook- up done this year. Administrator Statz explained that he viewed it as the prospective buyer committing to paying the fee this year, but with different payment terms. Mayor Love asked whether the City would approve if one (1) of the other businesses that spurred the Council to think about this program were to come and ask for this same type of deal and noted that he feels this would set a precedent. Administrator Statz stated that even without precedent, he would have interpreted this the same. He stated that the City has always offered, with other hook-ups, to assess the hook-up fees over a period of time so people can more easily afford it. Mayor Love stated that there was a huge bill passed by the House today to allow the City to receive funds in order to take care of COVID expenses. He stated that with the last program, the City had to get to year end and make sure they could justify spending those dollars. Administrator Statz clarified that the hook-up would be paid for with the escrow funds. He stated that he has been following the legislation and one of the features that that legislation is that it seems to be tracking towards allowing the City to recover lost revenues. This discount program would be viewed that way along with discounted liquor license fees and those types of things. He stated that he has a feeling that the City will be able to recover the discounted water rates through that fund. Motioned by Council Member Koski, seconded by Council Member King, to Approve Consent Agenda Items #3, #4, #5, and #6 as Presented with Language Contained in the Agreements that the COVID Relief Grant Program was Covering A Portion of the Fees. OLD BUSINESS Page 5 of 8 8 City of Centerville Council Meeting Minutes March 10, 2021 1. None. IX. NEW BUSINESS 1. None. X. COUNCIL/ADMINISTRATOR ANNOUNCEMENTS 1. Administrator Statz stated that things are finally into the vaccination stage of COVID. He explained that the City has found some volunteers to assist with Fete de Lacs and the Main Street Market but are still looking for vegetables and ot homegrown produce, eggs from backyard chicken are lots of exciting things happening with the EDA and noted that there is a meeting coming up next week. The school is reworking some of their numbers associated with their remodel and noted that City staff has been working with them to revise the plan and find ways to make it more affordable. He stated that 14 people have already joined the Adopt-A-Storm drain program and encouraged others to contact the City if they are interested. He stated that there is a lot of outreach programming available through the MS4 program and explained that the City partners with County/Regional conglomerates. Council Reports a. Lakso - Council Member Lakso stated that she did not have any reports to give but thanked Mayor Love for his statement oned that she has definitely been inspired by women who have served before her. Meeting will be held April 29, 2021 No report given. b. i. Fire Steering Committee ii. Planning & Zoning Commission Planning and Zoning Commission meeting where they discussed the Peltier Estates project. He stated that the project is basically what the Council had already approved three years ago. Administrator Statz noted that they are planning to begin this project in the spring and explained that the preliminary agreements will come before the Council at their next meeting. Council Member Koski stated that with the warmer weather there are more children outside playing and encouraged residents to watch their speed and be aware of those neighborhoods that have children and be extra careful. He also encouraged people to help out with the trash that has Page 6 of 8 9 City of Centerville Council Meeting Minutes March 10, 2021 been exposed by the snow melt. He expressed his appreciation to Mayor Love for his acknowledgements of women in the community. c. Meeting will be held March 17, 2021 d. Other Mayoral Reports Noted that he had received a question on whether there should be a Council float at the Fete des Lacs parade and asked the Council to start thinking about it for future discussion. He stated that there is a need for a parade announcer because he and his wife are going to pass along those duties and allow someone else to step up and be the voice of the City. Explained that he was wearing a suit and ti have been Day at the Hill day which means he normally would have been in Washington D.C. visiting with the senators and State representatives to talk about things that are important to the cities. He stated that instead of going to their offices, those meetings took place over Zoom. He stated that he had the opportunity to attend an Anoka County meeting regarding partner violence. He stated that it was very educational and gave kudos to Alexandra House for being a great partner with the City with offering resources and education. He stated that North Metro T.V. has proposed to provide a camera operator for all live meetings once City Hall is open to the public. He also stated that they are still working on the contract with Comcast that ended on December 31, 2020 and trying to get a new contract with a 10-year term. There are currently oral arguments going on to appeal the use of music publicly. Mayor Love reiterated his appreciation for the women in the community, including elected officials, volunteers, Moms, wives, daughters and stated that he supports Wo Month. XI. He explained that this program is an EDA program to subsidize participation by restaurants and gas stations in the blue logo signs on the freeway. This was done as part of the response to COVID to help the businesses out a bit. Last year there was a decision made that the Council would actually pay this expense because it would be reimbursed through CARES Act funds which was a tricky accounting move to get it to the EDA. He stated that he would like to continue doing this because we know there is money again from more recent Federal funds. If the Council chose not to fund this type of thing at a future date, the EDA can write the City a check, which is easier than the reverse. He stated that this is an EDA commitment and they do have the budget to cover it, if the American Rescue Plan funds will not cover it. Mayor Love provided an opportunity for Council to add or remove any item(s) to/from the consent agenda. Council Member Koski asked to pull item #1 in order to have additional discussion regarding Check #33642. Motion by Council Member King, seconded by Council Member Lakso to Approve Consent Agenda Items #2, #3, and #4 as Presented. A roll-call vote was taken. Council Member Koski asked for an explanation of whether this check amount will cover all annual expenses, and asked if it was an expense that would be incurred every year. Page 2 of 9 13 City of Centerville Council Meeting Minutes March 24, 2021 Administrator Statz Mark stated that the program is set to reimburse anyone who qualifies up to 75% of costs, such as restaurants and gas stations. The check will cover 75% of their costs for the in May. The EDA will be considering the question of whether this will continue in the upcoming year. Council Member Koski asked if the EDA could check with the participating businesses to track how much business was actually generated from the signage. Administrator Statz stated that question can be asked and noted that he believes the businesses will also be interested in this information because they are covering 25% of the costs. Council Member Koski stated he is in favor of the program and appreciates the EDA for looking into it and for the businesses that are participating. He noted that personally, he thinks those signs are effective because he uses them frequently when he is traveling. Administrator Statz agreed and states that he feels it kind of puts the City on the map and have pointing to Centerville. Mayor Love asked if this expenditure would come from the 2020 budget or from the 2021 budget. Administrator Statz explained that the reimbursement is coming in 2021 so it would be the 2021 budget. Mayor Love stated that the City gave the EDA a specific budgeted amount and asked if this amount was in addition to that amount. Administrator Statz explained that what was done last year and will continue this year was to put blinders on and pretend as if there is no bail-out package and continue to earmark these dollars as part of the budget. He explained that even though the City Council will pay this, in his presentation to the EDA, he will mark off the dollars as if they have been spent and when the reimbursement comes from the American Rescue Plan, then they before they are hatched. He noted that he had asked the EDA to be conservative with their spending as if those dollars will not be coming through. VIII.OLD BUSINESS 1.Centra Homes - Block 7 Memorandum of Understanding (MOU) Administrator Statz stated that Mr. Pattberg & Ms. Dunham were present but asked City Attorney Glaser to first give the Council a brief overview of an MOU and noted that he thinks of an MOU as a bit more formal than a hand shake and a bit less formal than a purchase agreement. Page 3 of 9 14 City of Centerville Council Meeting Minutes March 24, 2021 City Attorney Glaser explained that for this MOU, they took the proposal from Centra and put it a format that says, in good faith, the City is accepting this proposal and the expectations are that they will move towards that with the idea that once a few more things are done they will be entering into a purchase agreement. Administrator Statz noted that the proposal spoke of a specific number of townhomes and in the MOU they kept it a bit more vague because they are exploring several options that may have a different amount. He noted that would be brought back before the Planning Commission and the Council for a final blessing at a later date, but noted that the general concept is for a high-density townhome project. Mr. Pattberg stated that they have pulled together some really rough brainstorm ideas and started having conversations with staff and they think this is the next step to moving forward. Ms. Dunham stated that she feels this has been a really great collaborative process thus far and looks forward to continuing that. Council Member Koski asked if everything was going as expected at this stage in the game. Mr. Pattberg stated that they have not spent much money yet but if this agreement is in place, they can begin more substantially starting tomorrow. Council Member King stated that he realizes this is still in the preliminary stage but asked Administrator Statz about the offsite costs not exceeding $100,000. He asked if there was any idea of what those costs would actually be. Administrator Statz stated that the offsite costs are the streetscaping along Centerville Road and the estimate was around $180,000 so some decisions will need to be made, but the City has the ability to scale the work up or down in order to control costs. He stated that he thinks all the parties feel it is important to have an urban style boulevard. Mayor Love asked how soon the City can expect to see dirt moving. Mr. Pattberg explained that they would love to have dirt moving at the end of the fall season in 2021. Motion by Council Member Koski, seconded by Council Member Lakso, to Approve Block 7 Memorandum of Understanding between the City of Centerville and Centra Homes, for the construction of a townhome style development on the City-owned Block 7 property, as Presented. IX.NEW BUSINESS 1.Peltier Estates a.Preliminary Plat Page 4 of 9 15 City of Centerville Council Meeting Minutes March 24, 2021 b.Preliminary Conditional Use Permit for a Planned Unit Development Administrator Statz stated that this project is back in front of the Council after three years. Previously, the Council had approved the plat and rezoning and that plan is what is once again being proposed. He noted that they did not record the plat or approve/record Agreement, PUD, or CUP. He explained that those items have essentially started over because they become invalidated after one year. There was a public hearing held at the Planning and Zoning Commission earlier this month where this was unanimously approved. The plans are for 24 detached townhomes that are slab on grade, with public road and public right of way as well as a PUD that allows variances to setbacks and lot dimensions in exchange for a development that adds value and is properly positioned to take advantage of the usable land while protecting the natural resources. He noted that the idea of using a PUD in this case is to realize a better use of land that would otherwise be difficult to develop. He stated that there is a proposed trail connection to Brian Drive as well with portions paved and portions as a boardwalk that go over th the wetland area. They are also proposing a southbound right turn lane on 20Avenue. Council Member Lakso stated that she thinks this sounds like it will be the best use of the land. She stated that without basements she would expect there will be no water issues and feels this may provide a good mix of things for the City. Council Member Koski asked how they figured out where the trail access would go. Administrator Statz gave an overview of the proposed trail connection and noted that the boardwalk will be maintained by the HOA and be a public trail, not private. Council Member Mosher stated that he thought from a previous Planning and Zoning discussion that there was a different number of homes. Administrator Statz noted that there was a concept that showed 18 homes early on in the process. Council Member King stated that he had tried to watch most of the Planning and Zoning meeting. He asked about the drainage and utility easements and asked how vehicles will be able to get access to these easements because everything looks so close. Administrator Statz stated that he had neglected to include the grading plan in the Council packet. He stated that this was discussed the last time around and there were some revisions made to the original application and layout for this purpose. He explained that it can be accessed between Lots 16 and 17. He stated that this area was widened enough that they can get a truck or backhoe in there Council Member King confirmed that it is just wetland to west. Administrator Statz stated that is standing water and has a DNR number, but noted that there is also additional wetland around it. The Council discussed drainage, the holding pond, the drainage and utility easement locations. Page 5 of 9 16 City of Centerville Council Meeting Minutes March 24, 2021 Administrator Statz noted that the whole idea of a PUD is that the City can do things a bit differently than they normally would in order to make it a viable development. He reiterated that there has been no change to the plans and there is enough room for everything. Mayor Love stated that he is very happy that this project is back before the Council and thinks development is a positive. He asked if the cul-de-sac is large enough for plow trucks to turn around. Administrator Statz explained that it is the standard sized street and cul-de-sac. Mayor Love asked if there had been any thought given to putting a pond underneath the bridge/walkway and take some credits to a certain property that would be a bit south and east of there. Administrator Statz explained that opening up water in a wetland does not necessarily get credit and is sometimes viewed as degradation rather than enhancement. Motion by Council Member Koski, seconded by Council Member King, to Approve the Preliminary Plat, Preliminary Planned Unit Development, and the Associated Findings of Fact, as Presented. A roll-call vote was taken. Mayor Love and Council Members King, Koski, Lakso & Mosher voted in favor. Motion carried. X.COUNCIL/ADMINISTRATOR ANNOUNCEMENTS 1. Administrator Statz stated that his report was contained in the packet and that he would be happy to answer any questions that Council may have. He noted that there have been some loosening of restrictions from Governor Walz and additional resources for vaccines and noted that there is more information available on the City website. The Main Street Mark is still looking for farm vendors and noted that today they secured one or two more. He encouraged people that may be selling honey, maple syrup, or cottage food items such as jams or jellies to contact the City. He reminded everyone that there is no fee involved in being part ask for a deposit and if they are present for all 6 weeks of the market, they will get the deposit back. Mayor Love stated that he loved reading the Administrator Report and noted that he feels it is well done and does a great job of keeping members of the public informed. Administrator Statz pointed out that there is a very important Planning and Zoning meeting coming up on April 6, 2021, where they will be considering three potential projects within one development. He noted that there are links on the City website to be able to join the Zoom meeting. Administrator Statz stated that he has not heard any negative feedback and stated that they have just continued to encourage people to sign up for the e-mail as well as follow them on social media. Council Member King stated that they had discussed Christmas/holiday lights. He noted that he thought one of the logos they were considering with a canoe would be perfect for the City and suggested that the mountains be changed to pine trees. He stated that they discussed promoting Running Aces in the City. Mayor Love stated that recently there was a logo committee and noted that he would definitely like a logo like with Council Member King is suggesting to be vetted and discussed more broadly. He stated that there are already some diversity and inclusion issues with having a trapper included especially considering that there is a Native American burial ground located in the City. He stated that there may be some opposition but he thinks the logo looks great. Council Member King stated that history has shown that many of the trappers were very friendly with Native Americans. Administrator Statz noted that this topic came up during their logo discussions around whether or not they could honor both heritages with a logo, which can be difficult without becoming too complex. He suggested that the decision be made on whether the City is going to rebrand before a decision is made about a logo. He suggested that it be brought back for a workshop discussion. The banners being discussed are bran neutral. Council Member King stated that he feels this logo is kind of a story of Centerville and same premise of French architecture that is desired for downtown. Council Member Mosher explained that they had gone over the events calendar which is broken down in different topics and events. He stated that the group is going to attempt to split them up and each attend one or two of the events. He stated that they also talked about banners and noted that some of the designs are pretty cool even though he was somewhat skeptical. Love topic on the next work session to discuss whether or not they will have a float in parade. He encouraged anyone in the City who wants to get involved to volunteer to assist in planning Fete des Lacs to contact Administrator Status or City Clerk Bender. He stated that if there is anyone interested in announcing the parade, they are looking for that as well and noted that it would be a great opportunity for a teenager or a college student who has an interest in broadcasting. i. Other Mayoral Reports Mayor Love stated that he attended the North Metro Cable meeting last week and noted that they are offering services to residents to transfer their video tapes to DVD or digital files for free and also transfers tapes, in most film formats, photos, slides, for a fee. They also noted that coverage of high school sports is moving into tournament play and are able to cover more than one game at a time. All games are streamed live over Roku, Apple TV, Facebook and YouTube, but only one game can be played on the cable channel at a time. They are working on a plan to introduce closed captioning. The FCC filed a motion for abeyance requesting that the Sixth Circuit Court put the FCC 621 Cable franchising order on hold so that the FCC can have time to reconsider its position. He noted that the 621 order has the potential to reduce franchises fees to cities if the appeal is not successful. XI. They are building a new home and want to build a new detached garage which would be within the required front setback to Mound Trail, which is 35 ft in the R-2 district. The survey submitted does not indicate the dimension of the proposed garage to the lot line, but it measures about 31 ft. The Zoning Code in Sect. 156.107(A)(4) provides that the area between the house and the street would be setback, not the space around a house. The variance for the proposed garage, therefore, is to the required 35 ft front yard setback and not to its location in front of the house. SURVEY It should be noted that there is a difference between the lot survey submitted and the lot lines as they appear on the Anoka County property website. We assume the survey is accurate; the County website does not claim to be accurate for survey purposes. The graphic on the next page shows the survey overlaid on the Anoka County website aerial, noting the difference in the angle of the front (north) lot lines. Therefore, placing the new garage in the front toward Mound Trail is appropriate. Two other factors on this lot should be considered: There are two rows of existing evergreen trees, one north of the existing garage and south of the proposed garage, and the other at the north edge of the lot along Mound Trail, illustrated to the right. The location of other homes and garages along Mound Trail. The two rows of evergreen trees are significant positive site features to be maintained. Placing the new garage between the rows of trees is reasonable, but it places the structure toward Mound Trail into the required setback. Placing the garage further south to move out of the setback would encroach on the southern row of trees. The northern row of trees, along with a similar row on the neighboring lot to the east, provides screening to Mound Trail, as the trees do for the is also forward on the lot toward Mound Trail. An option for locating a new garage that would not require a variance is in the location of the existing garage, shown in red on the graphic. Three homes appear to be at the 35-ft front setback and another two at about 40 ft, but none as close as the 31 ft proposed, at least based on measurements from the County website. This segment of Mound Trail and the approximate setbacks to Mound Trail are illustrated on the next page. 77 July 13, 2021 Centerville Planning & Zoning Commission Page 4 of 6 Setbacks (approx.) along Mound Trail VARIANCE CRITERIA The criteria in the Zoning Code for considering variances follow closely the requirements in State statute and are listed below. The key considerations in this case, I believe, are reasonable use, unique circumstances and the character of the locality. Reasonable Use g vehicles and equipment on a single family lot. Locating it away from the lake is also reasonable. Unique Circumstances There are unique circumstances on the property that pose challenges to meeting the required setback. The rows of existing trees should be preserved and placing a typical sized garage between them is reasonable, rather than removing some of the trees in order to meet the setbacks. The optional location suggested above may not require removal of any trees. Character of the Locality homes and garages built close to the front. The proposed garage would be a few feet closer but screened by the existing row of trees. The optional location would have less impact. 78 July 13, 2021 Centerville Planning & Zoning Commission Page 5 of 6 Variance criteria in Sect. 156.310(A): 1) The variance is in harmony with the purposes and intent of the zoning chapter of this code; 2) The variance is consistent with the comprehensive plan; and 3) The proposal puts the property to use in a reasonable manner; and 4) There are unique circumstances to the property not created by the landowner; and 5) The variance, if granted, will not alter the essential character of the locality; OPTIONS The Planning & Zoning Commission could: 1) Recommend approval of the variance as submitted, with conditions and findings of fact. Motion: I move that the Planning & Zoning Commission recommend approval of the variance \[as submitted or modified\], \[with conditions\], \[with findings of fact for approval\]. 2) Recommend denial of the variance, with findings of fact. Motion: I move that the Planning & Zoning Commission recommend denial of the variance, \[with findings of fact for denial\]. 3) Continue the item for more information or further discussion. Motion: I move that the Planning & Zoning Commission continue the item to \[date\] in order to gather more information. RECOMMENDATION I recommend approval of the variance to the front yard setback at 1313 Mound Trail as submitted, with the condition that the existing trees along Mound Trail and to the west toward the neighboring property be maintained or replaced with similar landscaping to be reviewed and approved by the City Engineer. Findings of Fact for Approval 1) The proposed use of the property for a garage on a single family lot is reasonable. 2) Placing the garage on the lake side of the lot would not be reasonable or in keeping with the character or wishes of the residents of the lakeshore environment. 79 July 13, 2021 Centerville Planning & Zoning Commission Page 6 of 6 3) There is a row of trees on the north side of the lot that are valuable features to be preserved. Placing the garage at the required setback would remove some of those trees. 4) The proposed garage is to be placed approximately 31 feet from the front lot line compared to the required 35-foot setback, a variance of approximately 4 feet. 5) There is a row of existing trees on the north lot line that will screen the proposed garage, softening the impact of the encroachment into the setback. 6) Several existing homes and garages along Mound Trail are at 35- to 40-foot setbacks. The character of Mound Trail is one with many structures close to the street. 7) The request meets the criteria for granting a variance in the Centerville Code. If the Planning & Zoning Commission decides to recommend denial of the variance, possible findings of fact for denial could include the following: Findings of Fact for Denial 1) The proposed garage could meet the required 35-ft setback by moving it south a few feet, potentially removing some of the existing trees in that area. This tradeoff is preferable to encroaching in the setback. 2) There are other options to building a new garage that would not require a variance, including in the area where the existing garage is, without removing any trees. 3) There is an existing garage on the property, which is already a reasonable use of the property. A new garage is not a necessity. 4) Building the garage within the required setback would alter the essential character of the locality by being closer to Mound Trail than an of the other homes or garages along this street. 5) There are not unique circumstances on the property that pose challenges to meeting the required setback. 6) The request does not meet the criteria for granting a variance in the Centerville Code. DEADLINE FOR FINAL ACTION The variance application was received on June 10, 2021. The deadline for final action by the City Council is August 10, 2021. 80 81
