(Side Yard) Licensed and operable cars, RVÓs, trailers and toppers permitted if side yard setback is met (3Ó or 5Ó depending on zoning district). (Rear Yard on grass) Limited to recreational vehicles that are currently licensed and operable (RVÓs, trailers and toppers) and one passenger sized collector vehicle, as defined by state statute. The collector vehicle must be licensed, appear operable, and screened from all sides by six (6) foot high 100% opaque fence (fence permit is required). The collector vehicle may not be stored in rear yard for more than two (2) years. All vehicles parked in rear yard must meet required driveway setbacks. (Rear Yard on driveway) Passenger vehicle parking is permitted in a rear yard if a paved driveway extends to a detached garage that serves as the sole garage for the residence. Vehicles may not be stored off the paved surface. (Provided Diagram). No vehicles in excess of 12,000 lbs. (GVW) are permitted in residential areas. City of Circle Pines Î Parking and Storage of Vehicles and Equipment in Residential Zones. Vehicles must be parked on an approved impervious surface but not within two feet of a side or front property line. Parking vehicles on landscaped areas is prohibited. Hugo Î Vehicles and trailers may be parked in the front yard, provided it is kept on an established driveway. Large Recreational Vehicles may be stored in the driveway and rear yard no closer than five feet from rear lot line, five feet from side lot line and not located within a drainage or utility easement. In case of a corner lot, large recreational equipment may be stored on the side of an attached or detached garage adjacent to a public street, but shall be located at least 20Ó from the public right-of-way. Large recreational equipment may be parked in the side yard abutting an attached or detached garage, provided the area is surfaced with asphalt, concrete, or crushed decorative rock. If area is all defined, not closer than five feet from side lot line. If the surface is decorative crushed rock, the surface shall be no closer than one foot from the side lot line. Parking or storage of large recreational equipment on the side yard abutting the principal building is prohibited. No vehicles in excess of 9,200 lbs. are permitted in residential areas. City of Lexington Î Outside storage of boats, unoccupied boat trailers, unoccupied trailers with a maximum gross weight of 3,000 pounds and recreational camping vehicles as defined in Section 9.03 of this code, are permissible in the following areas: Rear yard Î at least 10 feet from the rear property line, Side yard Î at least 5 feet from side property line, Front yard Î at least ten feet from the back curb line on a driveway surface. All trailers stored pursuant to this section may not be used to store materials and equipment on or about the trailer, with the exception that boat trailers may store a boat intended for use with the trailer. City of Lino Lakes Î Passenger motor vehicles, including cars, pickup trucks, vans and motorcycles may be parked on a residential or rural property provided that they are parked on an appropriate surface in compliance with Section 1007.044(3)(h)16. They are operable and appropriately licensed at all times that they are parked outside, setback a minimum of five feet from side and rear property lines, except if shared driveway previously approved. When parked in the front yard or corner side yard of a property, they are parked on a designated driveway or parking area. Recreation Vehicles and Trailers may be parked or stored on residential site if registered to or rented by resident of dwelling. Must have current registration and license plates. Vehicles are stored no closer than five (5) feet from side and rear lot lines. Vehicles located within front yard areas are confined to driveway/parking surfaces. All front yard storage comply with the following setbacks from street curb and pavement lines: Major Arterial Î 30 feet, Minor Arterial Î 30 feet, Collector Î 20 feet and Local Î 15 feet. THE CITY OF CENTERVILLE ANOKA COUNTY, MINNESOTA ORDINANCE NO. XX, SECOND SERIES RELATIVE TO LOCATION AND SURFACING OF DRIVEWAYS AND PERMITTED VEHICLESAND EQUIPMENT IN RESIDENTIAL DISTRICTS The City Council of the City of Centerville hereby ordains: Section 1. That Section 156.006 DEFINITIONSshall be amended by revising the definition of Impervious Surface as follows: IMPERVIOUS SURFACE. Any artificial or natural ground cover that prevents the penetration or infiltration of surface water .Any material that substantially reduces or prevents the infiltration of stormwater into previously undeveloped land. IMPERVIOUS SURFACE shall include graveled driveways and parking areas. Section 2. That item (c) under Section 156.144(M)(1)shall be revised as follows, and the other lettered items reordered to read as follows: (M) Outside storage. All products, materials, and equipment, except as specifically provided in this chapter, shall be stored within permitted structures, except for the following: (1) Residential districts and single family properties in other zoning districts: (a) Agricultural products, equipment and appurtenances owned by the owner of the property andused on the property on which they are kept; All licensed and operational motor vehicles shall be parked on the permitted driveway area. Any unlicensed, nonoperational vehicles must be stored in an enclosed structure; (b) Motor vehicles in a lawful and operable condition, displaying valid registration, when parked on the permitted driveway area. All other vehicles must be stored in an enclosed structure; A maximum of two of the following units may be stored outside of a structure for more than 48 hours on any residential parcel, provided they are stored on the permitted driveway area outside of the road right-of-way or are in a side or rear yard. A licensed motor home or fifth-wheel trailer is allowed in a side or rear yard. Motorhome; Temporary storage of materials and equipment during construction and landscaping for a period of no greater than 15 days; and (d) Permitted Areas of Outside Storage. Outside storage is permitted on all areas of a parcel and the permitted driveway excepts those areas noted as prohibited in this section. (e) Prohibited Areas of Outside Storage. (i) Outside storage is prohibited between the street and the street-facing plane of a structure except on the permitted driveway surface. (ii) Outside storage is prohibited within five (5) feet of a side lot line. (iii) Outside storage is prohibited within ten (10) feet of the street, from blocking a sidewalk or trail, or from creating a public nuisance. (h) Firewood. The outside storage of firewood shall be no closer than five (5) feet to any property line. Such wood shall be stacked in a neat, orderly, safe manner. The maximum height allowed is four (4) feet. (i) Construction Storage. Outside storage may include temporary storage of materials and equipment during construction and landscaping when performed pursuant to a permit issued by the City. Temporary storage shall not to exceed four (4) months from the date a permit is issued by the City unless written permission is granted by City Staff to extend this period. (j) Fish house. fish spearing, commonly known as an ice shelter, dark house, fish house, or wheelhouse, otherwise requiring a license from the State. These shelters include any shelter ever licensed for taking fish from public waters. Once any structure or shelter is licensed by the State for this section. (k) Storage Effective After 24-hours. For purposes of this section, items, materials, or equipment existing outside of a structure for a period Section 3. The owner of any parking or loading area shall maintain the area in good condition without holes and free of all dust, rubbish and other debris. Parking and access drives shall be located a minimum of five (5) feet from any property line. Parking spaces shall be a minimum of nine feet wide and 18 feet deep. Section 4. That a new Section 156.166(L) shall be added and currentitems (L) and (M) shall be reordered to item (M) and (N), as follows: (L) Improvement and maintenance residential properties. Parking spaces and driveways shall be improved with a durable and dust-free surface such as asphalt, concrete, pavers, cobblestone or similar material as approved by the City Administrator or their designee. Gravel or loose rock, such as landscape rock, is not permitted in the front of the property, within the front yard setback, or within the public street right-of-way, but is allowed elsewhere on a residential property. This surfacing requirement does not apply in the R-1 District, where gravel driveways shall be allowed. All parking and driveways shall provide for proper drainage of surface water to prevent the drainage of the water onto adjacent properties or walkways. The owner of any parking area or driveway shall maintain the area in good condition without holes and free of all dust, trash and other debris. Parking and driveways shall be located a minimum of five feet from any property line. (M)(N) Permitted driveways for residential uses. \[as in current ordinance\] Section 5. That new Sections 156.166(O) and (P) shallbe added and current item (N) in that section be reordered to item (Q), to read as follows: (O) Permitted vehicles and equipment stored on residential lots. The permitted vehicles and equipment allowed to be stored outside of a structure on residential lots consist of three categories and two sizes: a. Passenger vehicles, such as a car, truck, or van, provided they registered and operable and which are defined herein; b. Other vehicles, such as a snowmobile, camper, recreational vehicle, travel trailer, camper, motor home, boat,personal watercraft and similar, which may be or as defined herein; c. Equipment, such as a trailer, construction equipment, skid steer, ice house, fish house, and similar, and which are as defined herein; d. Small units. Small units referred to in this section shall have an overall length from front to back of no more than 25 feet, an overall height of no more than 8 feet, and a gross vehicle weight rating of no more than 14,000 pounds, corresponding to Class 1, 2 and 3 vehicles. Small units may be for personal DRAFT Page 3of 4 or commercial use; e. Large units. Large units referred to in this section shall have an overall length of no more than 40 feet, an overall height of no more than 13 feet, and a gross vehicle weight rating of no more than 19,500 pounds, corresponding to Class 4 and 5 vehicles. Anything longer, taller, or heavier than these maximums is not allowed to be stored outside on residential property. Large units must be for personal use only; no large commercial units are allowed to be stored outside on residential property. f. Vehicles or equipment loaded on a trailer shall not count as separate units under this provision, butrather the trailer shall count as one unit. The trailer when loaded must herein; (P) Any number of registered and operable passenger vehicles shall be allowed on a permitted driveway. A maximum of three units of other vehicles and equipment may be stored outside of a structure on the permitted driveway area on any residential defined herein. All vehicles, and equipment must be parked at least ten (10) feet from the curb or edge of pavement of a public street. (Q) Requirements For Mixed-Uses. If a building or structure contains a mixture of uses as defined by paragraphs (A) and (I), the minimum number of parking spaces required for the entire building or structure shall be calculated for the most restrictive parking use as permitted by the applicable zoning district and building codes. (R) The definitions of terms used in this Sectionshall conform to State and Federal law and regulation including but not limited to vehicle definitions contained in Minnesota Statutes Sections 168.002 and 169.011; and gross vehicle weight ratings and classification as defined the Code of Federal Regulations 49 CFR Part 523. Section 6. Effective Date. This ordinance takes effect upon its adoptionand publication. ADOPTED by the City Council of the City of Centerville, Minnesota, this X day of XX, 2021. I. CALL TO ORDER The meeting was called to order at 6:30 by Chairperson Darrin Mosher. II. PLEDGE OF ALLEGIANCE The Pledge of Allegiance was recited. II. APPROVAL OF AGENDA Chairperson Mosher called for changes to the agenda. No changes were requested. Motion by Commissioner Broussard-Vickers, seconded by Commissioner Krueger to approve the agenda. A roll call vote was taken. All in favor. Motion carried. IV. PUBLIC HEARINGS (6:30 PM or shortly thereafter) 1. Easement Vacation Î 1825 Main Street Administrator Statz reviewed the ground rules for public hearings held via Zoom. Administrator Statz explained the request for vacation of the drainage and utility easement across the property at 1825 Main Street; the site of the proposed Atlas Villas Memory Care facility. The proposed development will dedicate new drainage and utility easements around the stormwater Page 1 of 4 City of Centerville Planning and Zoning Commission August 4, 2020 facilities and perimeter of the site. The easement is no longer needed since the ditch that it covers is no longer in use. Mr. Statz reviewed the public hearing mailed notices and publications. Commissioners asked questions of Mr. Statz regarding the status of the ditch, easement. Chairman Mosher declared the Public Hearing to be open at 6:44 PM. The public was given an opportunity to comment, via the ÐRaise your HandÑ function or simply by unmuting their microphone and speaking. No members of the public chose to speak or asked to be recognized. The Chairman and Commission chose to keep the public hearing open in case anyone was having difficulty with the technology. The intent was to close the public hearing, later in the agenda when the easement vacation was considered as an agenda item. V. AWARDS, PRESENTATIONS & APPEARANCES 1. EDA Strategic Plan Presentation Î Mike Giovinazzo, EDA Commissioner Mr. Giovinazzo gave a presentation on the purpose and objectives of the cityÓs EDA, outlining their future goals. Chairman Mosher asked if anyone had any questions for Mr. Giovinazzo. No members appeared to have questions. Chairman Mosher asked Mr. Giovinazzo about the EDAÓs observance of neighboring cities and developments happening within them. Mr. Giovinazzo expressed that he and the EDA was aware of surrounding development and looked at it as an opportunity to build off the regional success. Mr. Statz played a short promotional video, produced by the EDA. Commissioners and Council Liaison Koski expressed their thanks to Mr. Giovinazzo for his presentation and service to the city. 2. Variance Concept Review Î Mr. Joe Bibeau, 1840 Center Street (Driveway) Administrator Statz explained the process of a Concept Plan Review for a variance and the fact that the Commission would not make a binding decision tonight. Mr. Statz then gave a staff report, outlining the details of the proposed variance for the paving of a driveway expansion. The proposed driveway would be within 2 feet of the property line, when the setback for driveways is 5 feet. Commissioners discussed the lack of a unique situation which was beyond the control of the homeowner. Mr. Bibeau spoke and after hearing the discussion and better understanding the rules, thought there was a viable solution within the city code, remaining 24Ó wide through the right-of- way, then widening out to within 5Ó of the property line. Since this was a concept review, no official action was taken. 3. Concept Plan Review Î 2052 Gateway Circle Page 2 of 4 City of Centerville Planning and Zoning Commission August 4, 2020 Administrator Statz gave a staff review of the proposed addition to the building. He discussed the interpretation of the setbacks and noted that the proposal seems to fit within the city code as long as parking or proof of parking is addressed. Representatives from the contractor doing the proposed renovation answered commissionersÓ questions regarding the addition. They noted that the expansion was to facilitate a new piece of equipment. Also, they stated that the addition would match the architecture of the existing building. Consensus was that the proposal was a welcomed addition to the city and the commission did not see any complications with the zoning code. Since this was a concept review, no official action was taken. st 4. Concept Plan Review Î 71XX 21 Avenue Apartment Building Administrator Statz gave an overview of the proposal, noting that the site is currently zoned B-2 Main Street Commercial and the Comprehensive Plan does not currently guide this property for anything other than a commercial use. However, there may be some practicality to the development, given its proximity to the park and ride, and the neighboring uses to the north and west being residential. Chris Harchanko, a representative of the development presented his view of why this site is being looked at. Mr. Harchanko is proposing a 96-unit, market rate, 3-story apartment building, taking approximately 6 acres of property in the north end of the 22 acre parcel. He noted that underground parking was being looked at, but depending on soil conditions, it may need to be a ½ story above ground parking scenario. Commissioner Haiden had questions about the footprint of the development Mr. Steve King, from 1724 Sorel Street was recognized by Chairman Mosher. Mr. King asked if there would be ÐaffordableÑ units as a part of the development. Commissioner Fehrenbacher noted that the developer had presented the proposal as Ðmarket rateÑ, meaning non-subsidized. Since this was a concept review, no official action was taken. VI. OLD BUSINESS 1. Driveway and Residential Parking Ordinance Revisions Administrator Statz outlined the commissionÓs progress on this ordinance to date. XXXXXXX No formal action was taken. Specific code language revisions will be brought back to the commission at an upcoming meeting. 2. Outdoor Storage in Residential Districts Administrator Statz introduced and provided background on this item. There was discussion on this item regarding if the graphic in the Commissions packet can be entered as part of the City Code. City Attorney Glaser stated legally, only certain images and graphics such as blueprints, including legal points of some sort can be included in City Code. Administrator Statz stated they could hand out the graphic whenever this item is discussed or mail it out with the public hearing notice. It was the consensus of the Commission to have staff and City Attorney Glaser add the language agreed upon in August, as well as definitions for clarity, to the draft and set this item for a public hearing. Motion by Commissioner Kubat, seconded by Commissioner Kuiper to call for a public hearing on this item. All in favor. Motion carried VII. NEW BUSINESS 1. Motion by Commissioner Kubat, seconded by Commissioner Olson to recommend that the City Council adopt amendments to City Code, Chapter 50, related to Flexible or Compact Dumpsters as detailed in the attached suggested ordinance language, removing the license requirement for pick up and editing road right of way requirement to allow for placement of the dumpsters in the right of way, but excluding placement in the actual road. All in favor. Motion carried. IX. Announcements and Updates 1. Council Member Liaison Council Member Koski stated they have approved a maximum of a 3% increase in the tax levy for the City. He noted they have been working with the Fire Steering Committee to create the changes to the fire department. 2. AdministratorÓs Report Page 3 of 4 City of Centerville Planning and Zoning Commission September 7, 2021 Administrator Statz stated they have been working to keep the development projects moving forward. He stated that he has reached out to contractorÓs to receive bids on items that developers have not finished on a timely basis. He noted that if needed, Letters of Credit will be drawn against for this action and payment to contractors. X.
